Dear Friend of Legal Aid,We passionately protect the rights of those in our community who most need, but can leastafford, legal help. Amidst the prosperity of San Mateo County, the median household incomeof our clients is $18,846, which is only one-fifth of the San Mateo County median householdincome of $93,623.Since the last impact report, our low-income neighbors from nearly every city in the countyhave sought our legal assistance to ensure that they have the basic necessities of life.In addition to continuing our 6 key areas of service—housing, healthcare, public benefits,immigration, domestic violence and education—we are expanding the scope of our servicesto respond to uncertainty from the federal government. We’ve been asked to make scoresof presentations about the status of the law particularly in immigration, healthcare and housing,and we regularly get calls for technical assistance about the law.We are grateful to local funders who have responded quickly to the shifting political landscapeby providing grants to help us address immigrants’ urgent requests for legal assistance.This funding gives our LIBRE (Linking Immigrants to Benefits, Resources, and Education)program the resources to increase the range of services offered to immigrants, includingrepresenting immigrants seeking legal status and helping parents develop family preparednessplans in case a family member is detained or deported.We are also proud of the first-of-its-kind 2016 San Mateo County Eviction Report publishedby Legal Aid and co-author Community Legal Services in East Palo Alto. For the first time,statistical information about the housing crisis in our neighborhood was compiled, analyzedand made public. This family was able to keep their housing with help from Legal Aid. \"Laila\" and her children have made their home in an apartment in Redwood City for seven years. The two younger children walk to elementary school every day, and the eldest daughter is on the swim team and the cheer team at the local high school. In the fall of 2016 the building was sold to new owners. On the day escrow closed, all the tenants received notice of a $200 rent increase, except Laila. She received a 60-day eviction notice that didn’t state a reason for the eviction. Laila told the landlord that she couldn’t move in 60 days and didn’t want her children to have to leave school in the middle of the school year. The new landlord said she could have an extra thirty days on condition that she pay the $200 rent increase the other tenants were absorbing, and an additional $500, for a total of $700. Laila was desperate and paid the new landlord $700.Laila came to one of Legal Aid’s three weekly housing clinics where she was interviewedin Spanish by a housing coordinator. Legal Aid contacted the landlord to find out why thefamily was being evicted and was told that the family was “messy.” When staff met withLaila in her apartment, they found it was in good condition and became suspicious that thelandlord was discriminating against Laila because she had three children and was a singlemother.The landlord filed an eviction case against Laila. Legal Aid fired back by vigorouslycontesting the eviction case, and threatening to file a discrimination case against thelandlord. The landlord backed down, dismissed the case, and dropped his efforts to evictLaila and her children. They remain tenants in their home and the children continue toattend their schools. This boy found a path to reading with help from Legal Aid. Reading wasn’t easy for 5th grader \"Zeke.\" While his classmates were choosing chapter books for quiet reading time, he was choosing picture books, hoping none of his friends would notice. Zeke’s teacher knew he was struggling and put him into a small reading group, but that wasn't working. Zeke’s mother was concerned. Zeke’s older sister hadn’t had the same kind of problems when she learned to read. When Zeke’s mother told the pediatrician at Gardner Packard Children’s Health Center (Gardner) about Zeke’s reading struggles, the doctor referred her to the Peninsula Family Advocacy Program (FAP), a medical- legal partnership between Legal Aid, Gardner, Lucile Packard Children’s Hospital Stanford, and other clinics in the county. FAP provides free legal services to children, pregnant women and their families to help address the social determinants of health, including education issues.The FAP attorney immediately began to advocate with the school district on behalf of Zeke’smother. In the past, Zeke's mother had asked Zeke's school for a special education assessment,to see if he had a learning disability, but the school had declined. As a result of the attorney'sadvocacy, the school finally agreed to the assessment.After a thorough assessment, it was determined that Zeke had a learning disability and wasonly reading at a 2nd grade level. The FAP team recommended an outside reading interventionprogram that specializes in working with children who have reading disabilities. FAP was optimisticthat Zeke, who was a hard worker and eager to improve his reading, would thrive with this type ofreading intervention. After negotiations were complete, Zeke began his program as soon as schoolconcluded for the year. Now, Zeke’s mother reports that her son has made tremendous strides inhis summer intensive program and is excited to be closer to be reading just like his peers at middleschool this fall.Client names and other details have been changed for reasons of privacy

This young mother kept her family safe with help from Legal Aid. Many months prior to the Trump Administration's end of the DACA program, \"Aleeza,\" an 18 year old mom, contacted Legal Aid's Teen Parent Project because she had filed for DACA but had never heard back from US Citizenship and Immigration Services (USCIS). She was unable to re-file because she could not afford to pay the $495 filing fee again. She met with Legal Aid's Teen Parent Project attorney, who helped her file a request with the money order company to reimburse her filing fee and then re- filed her DACA application. When USCIS wrongly denied her DACA because of juvenile police contacts, Legal Aid helped her file a complaint and her DACA application was approved.Shortly thereafter, Aleeza and her husband were brutally attacked by gang members, who hit herhusband over the head with a brick and grabbed her by the hair and threw her to the ground.Aleeza turned to Legal Aid’s Teen Parent Project attorney again, who gave her immediate legalassistance and representation in court. The attorney helped Aleeza file for restraining ordersagainst the gang members and encouraged her to cooperate with the prosecution, despite herfear of retaliation.Aleeza did testify against the gang members and three of her attackers, and a fourth whohelped them intimidate her after the attack, were convicted or pled no contest to felony chargesand were sentenced to state prison. Legal Aid advised Aleeza that because she had helpedlaw enforcement and testified against perpetrators of a crime, she was eligible to apply for UNonimmigrant Status. Legal Aid helped Aleeza obtain a U Visa certification and apply for UNonimmigrant Status for herself and her parents, long term San Mateo County residents with twoUS citizen children. This girl got the medical care she needed with help from Legal Aid. \"Brianna\" is a medically fragile child who was discharged from the hospital with a diagnosis of a serious medical condition. Although she qualified for at-home nursing care under her health care coverage, even after several months had gone by, her family's insurer was still looking for a qualified nurse to assign to her case. Brianna's mother \"Mary,\" though not a medical professional, had assumed the sole responsibility for the complexities of her daughter's care and was feeling exhausted and overwhelmed. She was also frustrated by the long delays in obtaining a service which her daughter was entitled to receive. Following a referral from our partner agency Community Gatepath, Brianna's case came to Legal Aid's Peninsula Family Advocacy Program (FAP).FAP is a medical-legal partnership between Legal Aid, Gardner Packard Children’s HealthCenter, Lucile Packard Children’s Hospital Stanford, and other clinics in the county. FAPprovides free legal services to children, pregnant women and their families to help addresslegal problems which are adversely impacting their health, including access to health care.The FAP attorney discussed the case with Mary, and informed her of Brianna's legal rightto appropriate at-home nursing care. The attorney then immediately filed a grievancewith the insurer. Shortly after the grievance was filed, Brianna was hospitalized again. Inthe meantime, Brianna's nursing care was approved and a nurse was assigned to care forBrianna as soon as she was discharged from the hospital.Mary is relieved that her daughter is now receiving the appropriate care at home, andgrateful that Brianna's health and wellbeing are being supported by a skilled nurse.Client names and other details have been changed for reasons of privacy

Impacting the Housing Crisis: San Mateo County Eviction Report 2016 In 2016, the Legal Aid Society of San Mateo County and co- author Community Legal Services in East Palo Alto released the San Mateo County Eviction Report, funded by The San Francisco Foundation and designed by the Anti-Eviction Mapping Project. This report, the first of its kind in San Mateo County, compiles three years of the agencies' eviction case data, covering the period July 2012 to June 2015, and will aid agencies and governments in bringing clarity to a contentious local issue. San Mateo County eviction data is not available in any centralized, publicly accessible database, making this report the first integrated source of information to reveal the full scale of the eviction problem in the heart of Silicon Valley, and to bring to light a number of startling trends:• A 59% increase in the number of evictions for people unable to pay rent on time• A 300% increase in the number of \"no-cause\" evictions, where the landlord gave no reason for the eviction• Seventy percent of the households that sought legal services to help with eviction issues had children• Evictions disproportionately impact Hispanic and African American householdsOne of the report's authors was Legal Aid Directing Attorney Shirley Gibson, who brought to theproject nearly a decade of experience working on housing issues in the county.Says Shirley, \"My hope is that the San Mateo County Eviction Report will be used by officials, decisionmakers and the general public, all of whom are well aware of the housing crisis, but lack data to informdebate and make decisions.\"The full report may be read at the Legal Aid website:http://www.legalaidsmc.org/eviction_report_2016.html

The Impact of Advocacy: California AB 291 strengthens protection for tenants This year, California Assembly Bill 291, The Immigrant Tenant Protection Act, passed the state legislature, and was signed into law by Governor Brown in October. The Act strengthens state law to protect immigrant tenants from intimidation and retaliation in their homes. Immigrant tenants live in a climate of increasing fear of government enforcement action that may be taken against them at any time. This fear can be held over their heads by unscrupulous landlords who assume that their immigrant tenants will be afraid to report abusive actions—extreme rent increases, threats of illegal eviction, or refusal to maintain the property in livable conditions—if they are threatened with being reported to Immigrations and Customs Enforcement.\"Tenants should not have to live in fear simply because they are immigrants or refugees,\" saysbill sponsor Assemblymember David Chiu. \"Trump's escalating war on immigrants is rippingapart families, and mass deportations could be our new reality. This bill will deter the smallminority of landlords who unscrupulously take advantage of the real or perceived immigrationstatus of their tenants to engage in abusive acts.\"\"We have seen an alarming increase in national origin/immigration status discrimination feltby tenants since the election,\" says Legal Aid Housing Project Coordinator Andreina Leon, \"afear that can be exploited by landlords wishing to pressure tenants to accept rent increases, oreviction, without formal legal process.\"Legal Aid Directing Attorney Shirley Gibson contributed data and testimony in support ofthe bill, and she is pleased that these tenant protections have become law: \"AB 291 is acommonsense bill that responds directly to the abuses most commonly reported by Legal Aidclients. Its safeguards are especially necessary given that most undocumented Californiansare renters.\"

Their excellent training materials and mentor attorney relationships allow our attorneys tobecome proϔicient in the law quickly, which maximizes the value we can provide to our pro bono clients andenhances client outcomes.\" — Nick Woloszczuk, Latham & Watkins LLPAttorney Nick Woloszczuk Legal Aid and Pro Bono Attorneys Making an Impact When \"Maria\" ended her brief dating relationship with \"Eric,\" he responded with threats of physical harm and violently shoved her. After she moved out to escape him, he began stalking her: he would leave notes and personal effects on the windshield of her car, and send texts to show that he knew her movements and whereabouts. Eventually, Maria discovered that a GPS device had been hidden in a secret compartment of her car, and she turned it over to the police. She then iled for a restraining order against Eric, and her case was referred to the irm of Latham & Watkins LLP by the Domestic Violence Collaborative, a partnership of the Legal Aid Society of San Mateo County, Bay Area Legal Aid, and CORA (Community Overcoming Relationship Abuse).Eric denied all of Maria's claims and asserted his right to an evidentiary hearing, which wouldbe delayed for 8 months due to court backlogs. Although Maria had the bene it of a temporaryrestraining order in the interim, Eric used this time to harass and intimidate her by bringingbogus claims against her in small claims court. While the rules of small claims courts did notallow a Latham attorney to appear with Maria in small claims court, we helped prepare herdefenses, and project assistant Na Ho attended the hearing to provide support. As a result ofthese efforts, the small claims court denied relief for Eric's claims.Led by Emily Chen and Nick Woloszczuk, the Latham team took advantage of the time beforethe evidentiary hearing and successfully subpoenaed records from the GPS device maker. Theserecords proved that Eric had purchased the GPS device and that he was receiving alerts tomonitor our client's movements. Facing this evidence of stalking (which is a form of domesticviolence under state law) and the prospect of paying Maria's fees and costs, Eric gave up hisdefense, and the evidentiary hearing, and instead agreed to the stipulation of a three-yearrestraining order. For the year ending 6/30/17, law ϔirms and individuals donated 13,339 hours of pro bono service to Legal Aid clients.
