The following circumstances shall be appreciated: 9.2.1 Physical illness 9.2.2 Good faith 9.2.3 Taking undue advantage of official position 9.2.4 Taking undue advantage of subordinate 9.2.5 Undue disclosure of confidential information 9.2.6 Use of government property in the commission of the offense 9.2.7 Habituality 9.2.8 Offense is committed during office hours and within the 9.2.9 premises of the office or building 9.2.10 Enrolment of fraudulent means to commit or conceal the offense 9.2.11 Length of service in the government 9.2.12 Education, or Other analogous circumstances Nevertheless, in the appreciation thereof, the same must be invoked or pleaded by the proper party, otherwise, said circumstances shall not be considered in the imposition of the proper penalty. The Commission, however, in the interest of substantial justice may take and consider these circumstances. 9.3 Manner of Imposition When applicable, the imposition of the penalty may be made in accordance with the manner provided herein below: 9.3.1 The minimum of the penalty shall be imposed where only mitigating and no aggravating circumstances are present. 9.3.2 The medium of the penalty shall be imposed where no mitigating and aggravating circumstances are present. 9.3.3 The maximum of the penalty shall be imposed where only aggravating and no mitigating circumstances are present. 9.3.4 Where aggravating and mitigating circumstances are present, paragraph [a] shall be applied where there are more mitigating circumstances present; paragraph [b] shall be applied when the circumstances equally offset each other; and paragraph [c] shall be applied where there are more aggravating circumstances. 9.4 Penalty for Most Serious Offense If the respondent is found guilty of two or more charges or counts, the penalty to be imposed should be that corresponding to the most serious charge or count and the rest shall be considered as aggravating circumstances. 91
9.5 Duration and Effect of Administrative Penalties The following rules shall govern in the imposition of administrative penalties: 9.5.1 The penalty of dismissal shall result in the permanent separation of the respondent from the service, with our without prejudice to criminal or civil liability. 9.5.2 The penalty of transfer shall carry with it the sanction that failure on the part of the respondent to seek transfer to another office within a period of not less than ninety (90) days, he shall be considered resigned. The penalty of transfer may be imposed with a condition that the respondent shall be barred from holding a position involving property or money responsibility. 9.5.3 The penalty of demotion shall include reduction in rank, or salary or both. 9.5.4 The penalty of suspension shall result in the temporary cessation of work for a period not exceeding one (1) year. Suspension of one day or more shall be considered a gap in the continuity of service. During the period of suspension, respondent shall not be entitled to all money benefits including leave credits. 9.5.5 The penalty of fine shall be in an amount not exceeding six (6) months salary of respondent. The computation thereof shall be based on the salary rate of the respondent when the decision becomes final and executory. 9.5.6 The penalty to reprimand or censure shall not carry with it any accessory penalty nor result in the temporary cessation of work. 10. REVISED FACULTY TRAINING AND DEVELOPMENT MANUAL ( 5th Edition ) INTRODUCTION Faculty development as an approach of developing manpower potentials has been encouraged by the government among educational institutions in its efforts of equalizing educational opportunities and of enabling talented citizens to contribute maximally to the country’s development ventures. 92
As a state college, the Palompon Institute of Technology is imbued with the obsession to develop the human resources with greater effectiveness particularly in terms of quality and equality. It is meant to channel its resources into highly profitable investment in terms of a well-developed and trained manpower. To pursue this goal, the College has to engage as extensively as possible in faculty training and development programs, among other strategies. And in so doing, there is a need to establish a system or specific and objective set of guidelines particularly those which concern qualifications, requirements and procedures. This will certainly reduce if not completely avoid confusions and arbitrariness in granting the said program. This set of guidelines will hopefully serve as a permanent and reliable frame of reference for the more detailed development plan concerning the faculty. 1. Objectives of the Program The main purpose of this program is to promote organizational vitality by providing continuing and progressive training and development opportunities that support lifelong learning and assist members of the faculty in working effectively together within their departments and the whole Institute. Specifically, the program aims to: 1. Provide for a continuing advanced formal education and/or in-service training to all qualified members of the faculty to upgrade their skills and competencies in their fields of specialization; 2. Enhance the attainment of the educational objectives and aspirations of the Institute; 3. Uplift the morale of the faculty members through massive retooling; 4. Develop a strong faculty to maintain a high standard of instruction in all courses offered; and 5. Provide research, extension, production and other forms of development programs and activities relevant to the field of specialization of the faculty members. 2. Policies 2.1 The Institute shall develop and implement a continuing program of training and development for its faculty members. All academic 93
personnel of the Institute, as well as those of its external campus shall be granted free tuition if they intend to enroll in the graduate and postgraduate programs of the Institute. 2.2 It shall encourage its faculty members to pursue relevant local and foreign-assisted training programs, scholarship grants, attend seminars, conferences, workshops or related human resource development courses. 2.3 It shall provide budgetary allocation specifically for this purpose. 2.4 Selection of participants in training programs shall be prioritized based on actual needs for specialization and enhancement of competence, taking into consideration organizational policies. 2.5 Grantees shall execute a contract and abide by the conditions stipulated therein. 2.6 Preference shall be given to candidates with permanent appointment but does not preclude faculty with temporary status who have satisfied the necessary qualification requirements. 2.7 The Institute shall choose/determine the school where the grantee should study. 2.8 Scholarship contracts shall be presented to and approved by the Board of Trustees. 3. Faculty Training and Development Committee (FTDC) The Faculty Training and Development Committee (FTDC) shall be composed of: 3.1 Vice-President for Academic Affairs – Chairman 3.2 All College Deans – Member 3.3 President of Faculty Association duly recognized by CHED and PIT – Member 3.4 HRMO – Secretary 4. Duties and Functions of the FTDC The Committee shall: 4.1 Establish a yearly rank list of faculty members classified by field of study and priority area for development to serve as ready reference; 94
4.2 Fix the field of specialization of the scholarship grant; 4.3 Fix the duration of scholarship for a grantee; 4.4 Recommend candidate for scholarship to the College President for approval, subject to the confirmation of the Board of Trustees; 4.5 Prepare a yearly faculty training and development schedule; 4.6 Monitor the performance of the scholars and submit status report to the President for appropriate action. 4.7 Serve as linkage of the Institute with the selected institutions tapped for the PIT Faculty Training and Development Program; 4.8. Require the grantee, if necessary, to share what he has learned with his/her colleagues through an echo seminar; and 4.9 Recommend revisions or modifications to improve the Faculty Training and Development Program. 5. Types of Training and Development Programs A. Scholarship Faculty members who are sent for advanced studies are classified as follows: 5.1 Plan A - includes faculty members who are considered scholars of the Institute. They shall enroll/study in a prestigious school other than PIT to avoid in-breeding. They will receive the following privileges: 5.1.1 Full salary from the Institute; 5.1.2 Stipend of P5,000.00 per month which is equivalent to P60,000.00 for one (1) year, provided, grantee will take summer classes; 5.1.3 Tuition fees and other fees at actual cost; 5.1.4 Book allowance of P3,000.00 per semester/term; 5.1.5 Traveling expenses (roundtrip boat fare per semester/term, local only; and 5.1.6 Thesis/Dissertation allowance of P15,000.00 for master’s degree and P20,000.00 for doctoral degree. 5.2 Plan B - Like Plan A, this includes scholars of the Institute but these are faculty members who are qualified but are beyond the quota for Plan A. 95
The privileges are as follows: 5.2.1 Full salary from the Institute; 5.2.2 Tuition fees at actual cost; and 5.2.3 Thesis/Dissertation allowance of P15, 000.00 for master’s degree and P20, 000.00 for doctoral degree. 5.3 Plan C - includes faculty members who are granted to study on official time if it does not require the hiring of a substitute teacher. This plan is renewable every semester or term. Grantee under this plan is entitled to his full salary from the Institute and the thesis/dissertation allowance. The privileges are as follows: 5.3.1 Full salary from the Institute 5.3.1 Thesis/Dissertation allowance of P15,000 for master’s degree and P20,000 for doctoral degree 5.4 Plan D - includes faculty members who are not recipients in any of the above-mentioned plans but who are officially enrolled in graduate/post graduate courses at their own personal expense on Saturdays in colleges/universities outside Palompon, Leyte, and who are granted official time on Fridays due to transportation constraints, upon recommendation of the Department Chair concerned, College Dean, Chair of the Faculty Training and Development Committee, Vice-President for Academic Affairs and the approval of the College President. Under this plan, grantee shall be entitled automatically to receive the thesis/dissertation allowance. 5.5 Plan E - includes faculty members who are recipients of other scholarship grants, subject to the terms and conditions of the memorandum of agreement between PIT and the funding agency. Grantee is also entitled to thesis/dissertation allowance if the funding agency does not so provide. (11.1.1 and 11.1.2) 5.6 Plan F - includes faculty members who are not recipients of the aforementioned scholarship plans but have passed the final defense and are ready for printing the clean copies of his/her thesis/dissertation in the book form. These faculty members shall be granted thesis/dissertation allowance upon presentation of a certification from the Dean. 96
5.7 Plan G – includes faculty members who are granted free tuition for graduate and post graduate studies in the Institute. The grantees are also entitled to a thesis and dissertation allowance if the course is finished within the contract time-frame which is 4 years for the master’s program and 5 years for the doctoral program. TERMS AND CONDITIONS ON SCHOLARSHIP 1. A master’s degree must be completed in at most 4 semesters and 2 summers, while a doctoral degree must be completed in at most 6 semesters and 2 summers, including thesis and dissertation writing. However, this condition does not apply to Plan G scholars. 2. Extension of scholarship grants (Plan A and B) shall be granted for 1 semester on official time with pay only upon recommendation by the Dean of Graduate Studies to allow the grantee enough time to finish his/her thesis / dissertation. 3. Scholars who do not continue their studies or fail to graduate within the scholarship contract duration or constrained to comply with the stipulated service requirement due to irrevocable resignation or transfer to other Institutions shall be required to refund all financial assistance that they have received from the Institute within 2 years after the expiration of the contract duration. 4. The number of scholarship grants each year will depend on the availability of funds. 5. The grantee, both in the master’s or in doctoral degree, shall be required to comply with the stipulated service requirement as follows: Plan A – 3 years in the Institute for every year or a fraction thereof of the study. Plan B – 2 years in the Institute for every year or a fraction thereof of the study. Plan C to G – 1 year in the Institute for every year or a fraction thereof of the study. 6. All grantees shall be made to sign a contract. The contract contains other important conditions specific of the type of scholarship (Appendix A, B, C.) 97
B. Trainings 1. Intra-Agency This refers to seminars, workshops, training sessions and other special programs or activities which are sponsored and conducted by the Institute to support the continued professional and personal growth of the faculty. 2. Out-of-Agency This refers to education or training authorized by the Institute for selected faculty. These may be in the form of seminars, workshops and other activities offered by other agencies within or outside the country. Where funds are not available, the faculty may be allowed to attend on official time where travel and other incidental expenses shall be shouldered personally by the grantee. C. Sabbatical Leave A sabbatical leave is a privilege granted to a faculty member who has demonstrated above average ability in instruction, research or other creative accomplishment as seen in one’s publication, teaching, exhibition or performance. This program aims to maintain and improve the quality of the educational programs of the Institute by creating opportunities for the faculty to enhance professional competence through study, research, and other professional development activities. Eligibility A faculty member with the rank of at least Associate Professor who has rendered a minimum of seven (7) years of continuous service is entitled to a sabbatical leave of one full year (2 terms and 1 summer) with full pay. Services outside the College are considered part of the seven- consecutive-year requirement provided that they are rendered by the applicant on secondment to a government institution, either locally or internationally and that the year immediately before the filing is spent in the College. The required continuous service for the subsequent leave shall be counted from the date of return. In cases where the sabbatical leave applied for in writing is deferred due to scheduling difficulties, years of continuous service for the next leave shall include the period of deferment. 98
A sabbatical leave for not more than one year with full payment of salary may be granted to a faculty member if in the judgment of the President and the Board of Trustees, the applicant’s record as a teacher or researcher shows reasonable assurance of fulfillment of the aforementioned purpose of the sabbatical leave. No person shall receive a sabbatical leave more often than once in seven years. Priority Categories An applicant for a sabbatical leave may do one of the following options: - To finish post-graduate studies on a particular discipline. For those requesting a leave for a study leading to advanced terminal degrees, recent and consistent effort toward the attainment of the degree should be shown; - To conduct research. The completed research study shall be published in reputable journals within or outside the College; - To write/translate a book in relation to one’s field of specialization; - To write and produce a play or engage in any artistic production; In case of publication of outputs of the sabbatical leave, rules and regulations on publication as stipulated in the College code must be observed. Procedures Application for sabbatical leave should be submitted to the Office of the President, through channels, at least one semester prior to the intended leave. Those who apply for sabbatical leave should submit their plan at least one (1) term before the intended leave to the Vice-President for Academics for approval. The merit of the sabbatical plan will be evaluated by the Sabbatical Leave Award Committee composed of the following: - The Vice-President for Academic Affairs as Chairperson. - The Vice-President for Research, Planning and Extension, as Member - The Vice-President for Administrative Affairs, as Member - The Dean of the College where the applicant belongs, as Member The chair and committee members may also choose; 99
- One representative from the Full Professor rank and - One representative from the Associate Professor rank If any of the members listed above is himself/herself an applicant, he/she shall be replaced by a member chosen by the remaining members of the Committee. The Committee’s recommendation shall be forwarded to the Office of the President for appropriate action. Unless the research to be undertaken requires teaching, a faculty on sabbatical leave should not be engaged in teaching at any institution. Obligations A faculty member granted a sabbatical leave assumed a professional obligation to return and render service to the College for a period of at least two (2) full academic years subsequent to his/her leave. Within three (3) months of the completion of a sabbatical leave, the faculty member must file a written report to the Office of the President, through channels. This report should detail the accomplishments of the sabbatical leave specifically in terms of benefits accruing to the College and the specific activities listed in the original sabbatical proposal. He/She may be required to present a report in an appropriate forum. D. Fellowships Fellowships for faculty development shall be created on the basis of the greatest need of, and usefulness of the Institute. Fellowships shall be awarded by the President of the Institute, upon the recommendation by the Head of the Unit concerned, to the most able, promising and deserving in the line of study selected. Save in exceptional cases, no member of the faculty above the rank of assistant professor shall be appointed to University fellowships. Partial Fellowships Members of the faculty who have obtained fellowships or scholarships from other entities may be granted partial fellowships under such terms and conditions as may be determined by the Board of Trustees. A member of the faculty receiving any offer of financial aid from any person or organization in the form of fellowships, graduate or research 100
assistantships, or other kinds of remunerative employment to be able to pursue advanced or special studies abroad, must obtain the approval of the President of the Institute. Local Fellowships The heads of units shall recommend to the President of the Institute promising young instructors who may be appointed as local fellows by the President to enroll in the Institute for advanced degrees free of tuition, with full pay, back allowance, and other benefits under such terms and conditions as the Board of Trustees of the Institute may stipulate. All candidates for fellowships shall undergo a thorough physical and medical examination by the Institute’s health service or equivalent government health agency. Recipients of the Institute fellowships shall sign a contract under such terms and conditions to be determined by the board. E. Exchange Professorships Exchange arrangements and consortia may be made with Institute of recognized standing, both local and foreign. The President of the Institute upon approval by the Board of Trustees, shall allow exchange professorships with accredited institutes of higher education for a period of one year, renewable for another year. In addition to his regular salary, an exchange professor assigned abroad or elsewhere shall be given such assistance as will enable him to maintain the dignity of his position in his place of assignment. F. Visiting Professorships The President of the Institute upon the approval by the Board of Trustees shall appoint visiting professors who shall serve in the Institute for some special purpose for a period of one year renewable for another year. He/She may also appoint visiting professors from the Institute to another institute of recognized standing by special arrangements and conditions mutually acceptable to both institutions. The Institute shall make adequate provision in its yearly budget to ensure the implementation of the foregoing articles. 101
6. Selection of Candidates for Scholarship The basic qualifications of a faculty member to qualify as a candidate for scholarship are set in Table 1. Strategies of Implementation 7.1 Selection of Faculty Members for Scholarship Faculty members shall be selected on the basis of the Institute’s development plan. Whenever funds shall warrant and in accordance with the Faculty Training and Development Program, the Institute shall send scholars to undergo advanced studies in accredited state or 102
private institutions upon the recommendation of the FTDC and approval of the College President. 7.2 Priority for the Finishing Faculty In case a finishing faculty becomes a candidate for scholarship, the scholarship priority should be awarded to him/her if he/she meets the requirement. 8. General Provisions 8.1 The grantee has no pending administrative and/or criminal case. 8.2 The grantee is not a recipient of any other scholarship. 8.3 The grantee must be willing to sign the Service Contract with the Institute. 8.4 Those granted a scholarship shall be required to serve fully the service requirement before availing a subsequent scholarship. 8.5 Previous scholars who have not finished their studies prior to the approval of the FTDP (third revision) shall be disqualified from availing another scholarship grant. 8.6 The recommendation of the FTDC must be presented in writing to the College President for approval, subject to the confirmation of the Board of Trustees. 9. Repealing Clause This revised Faculty Training and Development Program will take effect upon its approval by the PIT Board of Trustees and will be subjected to further revisions as the need arises. All previous issuances relative to faculty training and development, particularly on scholarship are deemed rescinded and considered null and void immediately upon approval of this manual. 103

g. for other justifiable grounds which prove the inability of the grantee to complete his/her degree (i.e. poor health as verified by a government physician; and the grantee will need to go on maternity leave); h. non-availability or exhaustion of funds; i. any act of discourtesy to an official or employee of the CHED; j. commission of any act of immorality, drunkenness, dishonesty, discourtesy, and any form of misconduct; k. conviction of any crime by a court or a competent administrative body; and l. such other acts as may be considered by CHED as inimical to the interest of the government of the Republic of the Philippines and those that adversely affect the integrity of the FDP. 4. provide the grantee the following upon successful completion and return to the home or SHEI: a. promotion or upgrading of position whenever legally possible; and b. salary upgrading upon availability of funds. 5. provide the Full Salary of the grantee during his/her scholarship; 6. require the grantee to render return service equivalent to the length of time that he/she enjoyed the scholarship, i.e. one year of service for every year of scholarship or a fraction thereof; or according to the specifications provided in the faculty handbook of the SHEI with respect to return of service, or such other policies, rules or regulations that CHED may impose pertinent to return of service by the grantee under this scholarship grant; 7. enforce strictly the terms of the scholarship grant, specifically the return of service requirement stated above and ensure faithful compliance by the grantee of the terms of the scholarship grant; 8. faithfully abide with all existing and future policies of the CHED with respect to the FDP; and 9. reimburse CHED the total financial assistance released to the grantee in case it recalls the latter without valid reasons and prior notice to the CHED. 113
C. Grantee’s Responsibilities The Grantee shall – 1. enroll in the program of study and in the field of specialization approved by CHED; 2. devote the full amount of time required by the CHED approved program of study; 3. take the required academic load per semester/term for part time program; 4. maintain an academic record to the standards of the DHEI; 5. follow the regular schedule of academic course offerings prescribed by the DHEI until he/she finishes his/her program within the allotted time; Provided that, deferment of enrollment shall not be allowed except for the following reasons: a. Poor health of grantee (if the grant is already on going) as certified by a government physician; b. The grantee is on maternity leave of absence; and c. Meritorious reason acceptable to the concerned institute/CHED. Provided further that, deferment in these cases shall be limited to a maximum of one (1) year. 6. render return service to the SHEI which has endorsed him/her for the grant and for which the grant has been accommodated equivalent to the length of time that the scholar enjoyed the scholarship one year of service for every year of scholarship or a fraction thereof. COMBISTA, President, hereinafter referred to as the INSTITUTE. WITNESSETH The Institute grants the Faculty Scholar a faculty development assistance or scholarship under Plan E subject to the following conditions and stipulations, to wit: 1.0 The term for this grant shall be four (4)/(5) years to start at the beginning of ____ semester / school year ___________ and to terminate at the close of SY _________ subject to the extension at the discretion of the Institute and the further conditions set forth in item 6 hereof. 2.0 The Academic Development Assistance or Scholarship granted to the Faculty Scholar by the Institute shall consist of the following: 2.1 Free tuition fees for the semester/school year covered by the above grant (For faculty holding temporary and permanent status of appointment only). 2.2 The amount representing the thesis/dissertation allowance which in no case shall exceed 15,000 / 20,000 PESOS to be fixed later by the Institute upon recommendation of the Faculty Development Committee (For faculty with permanent status of appointment only). 3.0 In the event that the Faculty Scholar is separated from the service for cause at the time of or during the period of this scholarship grant or within the period of four (4)/ five (5) years following this scholarship grant, the said Faculty Scholar binds him/herself to pay to the Institute the full amount of the expenses incurred by the latter relative to his/her scholarship grant. 123
4.0 The Faculty Scholar shall, immediately following this scholarship grant, serve the Institute for a period equivalent to a ratio of one year for every year of study grant or any fraction thereof. 5.0 The Faculty Scholar hereby obligates himself/herself to submit to the Institute his/her reports of rating at the end of every semester of study grant including such other reports as the Institute may require from time to time. He/She will not be allowed to enroll in the succeeding semester if he/she does not comply with this requirement. 6.0 The Faculty Scholar shall keep and maintain a good academic performance during this study grant and shall be recommended by his/her Dean of Graduate Studies to qualify for extension as provided for in item 1 hereof. Should the Faculty Scholar fails to maintain a good academic performance and as a result thereof, is disqualified to continue with his/her course of study, or if he/she fails to graduate due to poor academic performance, plain neglect to comply the dissertation requirement of the degree pursued, under loading or other similar causes, he/she binds him/herself to reimburse the Institute all expenses incurred relative to his/her scholarship grant within four (4) / five (5) years after the expiration of the contract duration.
