This enables faster case submission with simplified administration and reporting for cases with qualifying criteria. It also grants access to the most competitive rates we can offer. One-off cases For all areas of litigation we can individually assess one-off cases and provide an insurance quote for ATE cover. Unlike some of our competitors we won’t charge you an assessment fee or enforce any membership requirements. You will have access to professional case handlers to liaise with throughout the life of the case, should questions arise or further cover be required. What is After the Event insurance?After the Event insurance or ‘ATE’ is a policy of insurance taken outonce an accident or legal dispute has occurred. The policy will protecta claimant in litigation against the financial risks associated withbringing a claim for compensation.It is important to note solicitors have a duty under the SRA Code ofConduct 2011 to advise their clients on the availability of ATE insurance.What type of cases can be insured?Insurance cover is available for a full range of personal injury, clinicalnegligence and civil litigation claims.Who is the insurer?DAS LawAssist is part of the DAS UK Group of companies ownedultimately by Munich Re, the largest reinsurance company in theworld with capital assets of €21.2 billion. DAS holds an “A” ratingwith Standard & Poor’s.What does ATE insurance cover?DAS LawAssist’s ATE insurance products provide cover forpossible adverse costs, own disbursements, failure to beat a Part 36and interim costs orders.Are Counsel’s fees covered?Yes, DAS LawAssist is one of the few ATE providers to provideprotection for the costs associated with Counsel fees as long as theyare not acting under a conditional fee agreement (CFA).Is the premium self-insured?Yes, this means that no premium is payable in the event the case islost or discontinued. 14

What levels of cover are available?For standard personal injury and clinical negligence claims, cover isavailable up to £500k. For civil litigation and insolvency claims, coveris available up to £3m.When does the insurance cover commence?Where cases are run under a CFA the insurance cover is appliedretrospectively to the date the CFA was entered into. For otherretainers the cover commences from the date the policy was incepted.Do you insure multiple defendants?Yes, unlike many of our competitors, if you win against one defendantand lose against another, your client will keep any damages awardedand a claim can be made on the policy for any adverse costs order etc.Do you provide ATE/BTE top-up cover?Yes, DAS LawAssist is one of the few providers on the market able totop-up any ATE or BTE insurance policy.Can I recover the ATE insurance premium from the losing party?Since the introduction of qualified one-way costs shifting (QOCS) inApril 2013 it has not been possible to recover additional liabilitiessuch as Success Fees and ATE insurance premiums from the losingparty, however there are some exceptions which are currently:¡ Mesothelioma¡ Defamation¡ The ATE insurance premium in clinical negligence matters relating to liability and causation reports onlyThese recoverable premiums are protected by our unique PremiumIndemnity Guarantee. This guarantee ensures that neither your firmnor your client is responsible for any shortfall in recovered premium. 15
