According to its lawsuit, Prime Inc. claims it notified Amazon of the alleged trademark infringement more than two years ago, through written correspondence from Prime Inc. and then through proceedings Prime initiated at the Trademark Trial and Appeal Board. “Nevertheless, Amazon has persisted in displaying one or more of the Accused Marks on trailer trucks and other shipping and transportation vehicles in commerce, and thereby has continued to infringe Prime Inc.’s exclusive rights…and has continued to engage in unfair competition in violation of the Lanham Act,” the lawsuit states. “Amazon’s infringement and unfair competition are therefore intentional, willful and malicious.” Attorneys for Prime Inc. and Amazon were not available to comment. The lawsuit asserts that in 2015, Amazon began moving goods to Amazon Prime loyalty program members and retail customers in its own trucks. Then, in 2016 or 2017, nearly 40 years after Prime first used “Prime Inc.” on its trucks, Amazon began displaying its “prime” logo on its own trucks. While some might argue that the two “prime” markings do not look similar – Prime Inc. uses all upper-case letters, Amazon uses small case and in a different font – Prime Inc. nonetheless contends that Amazon’s marking is “identical in appearance, sound, meaning, and commercial impression” when compared to Prime’s Inc.’s marking. “The dominant component of each of these marks -- the word ‘prime’ -- is the same,” according to Prime Inc. An attorney for the U.S. Patent and Trademark Office found that because of this same dominant component of the markings, it is “given greater weight than any minor stylistic differences between the marks,” according to the lawsuit. Also, because Prime Inc. and Amazon operate in the same transportation channels, Prime Inc. claims that consumers “have associated and are likely to continue to associate with Prime Inc. any defect, objection or fault found with Amazon’s services, both at and after the point of sale.” At the same time, Prime Inc. contends, consumers familiar with Prime Inc. and its transportation, trucking and shipping services sold and marketed under its “Prime Inc.” logo “are likely to purchase and-or associate goodwill to Amazon based on the erroneous assumption that Amazon’s services are provided, authorized, sponsored, or endorsed by, or in some manner associated with, Prime Inc., both at and after the point of sale.” The lawsuit also alleges that Amazon misrepresented to the trademark office how it planned to use its “prime” marking on trailers in connection with an expedited shipping service available to the public at large, versus shipping its own goods to its retail customers and Amazon Prime loyalty program members. Prime Inc. has asked for a jury trial on its four-count lawsuit. Based on what the Trucking Alliance asserted is a “statistically valid sample” of 3.5 million commercial drivers, the survey projects with a 99 percent confidence level and less than 1 percent margin of error that 301,000 truck drivers currently on the road would fail or refuse a hair analysis. “We have a huge drug abuse problem in the trucking industry, and should actually purge an estimated 300,000 commercial drivers to clean it up,” said Lane Kidd, managing director of the Trucking Alliance. “No wonder truck accidents are on the rise.” The results of the survey were recently submitted to the U.S. Department of Transportation (DOT) as well as to the U.S. House Transportation and Infrastructure Highway Subcommittee before its hearing today (June 12) on the state of the trucking industry. “The T&I Subcommittee can intervene to mitigate this problem,” the Alliance stated in comments to the subcommittee. The group wants lawmakers to urge the U.S. Department of Health and Human Services (HHS) to complete hair test guidelines, which were mandated under the FAST Act surface transportation legislation in 2015 but have yet to be rolled out. “Until DOT recognizes a hair analysis, no employer will be allowed to submit hair test failures into the pending USDOT Drug and Alcohol Clearinghouse. This will make it virtually impossible for another employer to know if a person applying for a truck driver job has previously failed a drug test,” according to the Alliance. Testifying at the June subcommittee hearing, American Trucking Associations (ATA) President Chris Spear echoed the group’s concern: “The hair-test guidelines have been sitting at HHS for three years. (Huge drug problem continued from page 1) LTL carrier suddenly closes LME Inc. of Roseville, Minn., a regional less-than-truckload (LTL) carrier has shut down abruptly, apparently unable to face obligations from a legal settlement regarding charges of being a chameleon carrier. LME closed all of its 30 facilities in mid July without warning or providing notice to employees. The family-owned company offered LTL coverage in 10 states, according to its website. It operated more than 1,200 tractors and trailers. In July the company announced “LME Inc. will no longer be making pickups or deliveries of freight due to unforeseen circumstances. We have ceased operations.” The website announcement told customers it planned to use an alternate carrier to help get its freight in transit delivered. “There will be some delays in the transits of these moves and they may be significantly delayed in some remote locations,’’ the company said. In an earlier website announcement the company said: “Unfortunately our lender is in control of all finances. The lender must be paid all monies owed to the lender first before payment can be made to the employees. This process will take at least 90 days if not longer. Ninety union workers were locked out of work and laid off in November 2016 from Lakeville Motor Express, which filed for bankruptcy in January 2017. Former workers sued, saying the company just moved and changed its name, continuing operations as a non-union company. However, “a growing number of trucking company employers, including Trucking Alliance carriers, require a second drug test, a hair analysis, as part of their pre-employment truck driver hiring policies.” Using urinalysis alone missed nine out of 10 illegal drug users, according to the Alliance survey. Cocaine was the most prevalent drug that tested positive, followed by opioids and marijuana. “Applicants who failed or refused the hair test were disqualified for employment at these companies, but likely obtained the same job elsewhere, at companies that administer only a urinalysis,” the Alliance said. Some trucking experts contend that, while needed, more rigid federal guidelines and enforcement of drug testing will make it more difficult to seat drivers. DEF is a solution of almost pure urea and deionized water in a 1:2 ratio. It is sprayed into the exhaust fumes of diesel vehicles and helps cut down the amount of harmful nitrous emissions. It is a colorless, nontoxic, non-flammable fluid and plays a key role in selective catalytic reduction. DEF is not a fuel additive, but is rather stored in a separate compartment and sprayed directly into the exhaust fumes. Berry Technologies Unveils the Midas Elbow The problem: Cross-contamination costs fuel carriers thousands of dollars every year in compensation to retailers and consumers. The solution: Berrys Technologies US LLC recently introduced the Midas Elbow, a game-changing anti-cross drop device that replaces regular fuel delivery fittings, creating an anti-cross-contamination system that is portable, easy-to-use and, best of all, affordable. A RFID tag in the spill bucket communicates the fuel grade to the elbow, then the elbow reads the fuel type being delivered into a gas station’s bulk storage tank, thus avoiding contamination from gas, diesel, kerosene and water. If the correct fuel is dropped, the Midas Elbow valve allows the fuel drop to continue. If the wrong fuel is delivered, the Midas Elbow remains closed, disallowing the wrong fuel from being dropped. The device also sounds an audible alarm and sends a readable message to the driver alerting him or her that there was a problem with the fuel choice, allowing the driver to rectify the error. No incorrect fuel ever reaches the UST tank. The cross- contamination accident is avoided. The original Midas system has been installed for nearly a decade in Europe and the UK and has been successful under extreme temperature conditions in Russia (minus 30 degrees), as well as in the deserts of the Middle East where the temperatures regularly top 100 degrees. This second-generation Midas Elbow has been modified to suit the North American market, incorporating the latest technology in a compact and totally portable product. Tanker drivers carry the portable elbows in their truck, which once hooked to the fill position in the spill bucket and hose leading to the fuel tank, sense which fuel is the correct one for dropping into which UST. The RFID tag permanently installed in the spill bucket continues communicating with the Midas Elbow, passing on any information the tag has had written onto it, such as the tank number and retailer or the site address. The Midas Elbow already has the time, date and year information stored in its non-volatile memory. The customer can determine what other information, however basic or dense, they choose to record and store. All data will be down-loadable via a smart-phone app coming soon. MARK BURNS HEATH COLVIN Harley Wilson dies Harley Wilson, a long-time employee at Seneca Tank, died July 2 in Johnston, Iowa, after a hard-fought battle with colon cancer. He was born and raised in Des Moines, Iowa, and grew up in Norwoodville. He graduated from Saydel High School in 1976. While in high school, Wilson became the first employee of Champion Auto in Des Moines. He began as a salesman and during his 17 years at the store he worked his way up to assistant manager. After leaving Champion Auto, Wilson joined joined the sales team and then executive team at Seneca Tank. During his 30 years at Seneca Tank, which began in 1988, he was instrumental in growing the PTO and Hydraulic division. “He took pride in all the accomplishments, accolades and milestones that his team accomplished along with the great relationships with the many suppliers and customers that he had the pleasure of working with throughout the years,’’ said S.J. Risewick, president of Seneca Tank. Wilson is survived by his wife of 31 years, Melody; his son Tyler Wilson and wife Alison; daughter Amanda Holloway and husband Jake; brother Jeff Wilson and wife Sarah;, sister Joyce Tracey; and his first grandchild, Charlie Wilson. He was preceded in death by his mother Mary Townsend. Funeral services for Wilson were held July 12 in Pleasant Hill. Randy Sheeler dies at age 53 Randy Keith Sheeler, vice president of operations at Linden Bulk Transportation in Linden, N.J., died July 8, company officials said. He was 53. “Randy was not only a valued member of our management team, but his warm, outgoing personality endeared him to colleagues and customers alike,’’ said Micheal Salz of Odyssey Logistics and Technology, Linden’s parent company. “Randy fought a long, difficult health battle with an outlook of hope and positivity. May his example of a life well-lived be an inspiration to us all.’’ Before joining Linden Bulk Transportation, Sheeler held a variety of senior positions with several carriers. Sheeler is survived by his wife, Maureen Freeze Sheeler; his mother, Judy Dickinson (Ron); three daughters, Kayla, Bailey and Mackenzie Sheeler; two step-daughters, Ashley Christacopulos and Taylor Freeze; a nephew, Ryan Sheeler; and two nieces, Abigail Sheeler and Annalise Sheeler. A memorial service was held July 13 in Coatesville, Pa., followed by a private burial. we could start actual construction, so we got our air permit in September of 2016 and then finished raising our equity in July of 2017.” The substantial completion document for the 80 MMgy plant was signed in May and the plant passed its performance test in early June of this year, Wendland said. “We still have a couple of minor calculations that are being redone on the system to help us optimize things a little better,” he said. “But we’re running as fast as we can right now.” Ringneck’s opening took place despite a challenging time for the industry. Ethanol producers are dealing with low margins industry-wide, and concerns about this year’s corn crop stemming from spring flooding in the Midwest places Ringneck in a unique situation. “Thank goodness we’ve faired a little better than most maybe when it comes to corn planting,” Wendland said. While planting has been behind in the Onida area, recent weather has allowed area farmers to make up lost ground. “They did get in just in the nick of time when the weather has really cooperated since the first of June. That has helped,” he said. Ringneck is designed to run more efficiently, Wendland said. He said while the plant doesn’t include much new equipment, it does incorporate “new designs to be more efficient.” Ringneck includes less piping and ductwork than other ICM-designed plants, Wendland said. “When they built the original plants, they really didn’t re-engineer it, they just kind of used the same blueprint for all of them,” Wendland said. “So, this was ICM’s first chance to build a U.S. plant that they could redesign to be more efficient.” The cost for the sprinkler system was kept low as well, Wendland added. “ICM plants always had ethanol within the process building and some places required full or partial sprinkling,” he said. “By relocating that part of the facility outside with the rest of the distillation, it helped keep our sprinkling cost down.” (from Ethanol Producer magazine) (Ethanol plant continued from page 1) www.TankTransport.com AUGUST 2019 I TANK TRANSPORT TRADER 19

Good Food ... Let’s Eat by Carroll McCormick When I met Berni Oickle from Nova Scotia, he’d seen the continent and chewed his way through mountains of truck-stop delights. But a death in the family brought home the fact that his grease-pit diet was Russian Roulette: place your order and hope not to die. It was time to change. Bernie had the road routine down cold, like all-you-can-eat sausage and eggs breakfasts, all day without a meal, then roach coach food. “Bacon sandwiches with lots of butter on the toast. Don’t you like those?” he asked. Instead of supper in the city, the rush to beat the traffic: “A lot of guys boot ‘er out of town and eat a monstrous supper. They eat all that grease. Then they drive 10 miles farther and go to sleep.” It was the same in the states, his wife Joyce told me. “Everything down there is saturated with fat. Always bacon, eggs, grits. Some of the guys would make three or four trips to the buffet -- not a word of a lie. And they put icing sugar on everything down south.” Joyce championed Bernie’s new meal plan. For his five-day runs she’d fix him up with menus like this: Cereal, pre-cut oranges, grapefruit and grapes, maybe with a bit of orange juice added, and bananas for breakfast. Pre- washed salad, mushrooms and baby carrots, maybe doctored up with sliced boiled eggs or cheese and fat-free dressing or rice vinegar for lunch. Suppers might be beans and ham, fish, roast beef, roast pork, turkey, pork chops or even lasagne, packed in tin trays. He’d plug in his lunchbox an hour before supper, and presto: a hot meal. He lost 27 pounds, regained control over his salt, fat and cholesterol intake and was saving around $5,400 a year in meal bills. He had some hot tips for sticking with the program: “You want something easy to prepare. You don’t want to be in your truck slicing and dicing.” And probably the biggest challenge to sticking to a home meal plan is to always have food you can look forward to eating, he told me. “If you’ve got to eat something you don’t want to eat, it is going to be a drag,” he said. Joyce added, “And when you do get tired of it, take a break. Don’t deprive yourself.
