For the petrochemicals industry, the landscape is shifting at an alarming pace. Only one thing seems certain: The coming decade will be shaped by this crisis. Consumer behavior, investment decisions, the corporate landscape and even the path of globalization will be influenced by its effects. Two immediate major shock waves are linked to economic activity and feedstock pricing. 1. Shock wave 1: A sudden freeze in economic activity The global economy is in a recession or heading for one, according to Patrick Kirby, principal analyst at EMEARC Olefins, and Matthew Chadwick, vice president and global head of petrochemics. “Our thinking has moved from an economic slowdown to a deep global recession, with the potential for a slow recovery. This has dramatic implications for the industry,’’ the men said in a recent report. The lockdown measures in place around the world are unprecedented in Trucking activity now normal, study says In a race to stop the spread of COVID-19, millions of Americans across the country were ordered to stay home, except for essential activities. While all states have reopened in some capacity, the date they went into lockdown and the time they spent under that lockdown varies dramatically. To see how these varying restrictions impacted commercial transportation in the United States, telematics service provider Samsara collated data from the nearly 130 million trips its 15,000 customers – operating across industries such as transportation and logistics, food production, local government, among others — have taken since the start of 2020. Confusion surrounds Class 9 hazmat rules There seems to be much confusion regarding transporting class 9 hazardous materials (hazmat). There are two leading issues, one concerning the need for a hazmat endorsement and the other concerning registration. In the classification system of the U.S. Department of Transportation’s (DOT) hazmat, class 9 hazmat includes those that don’t come under any of the other hazmat classes (e.g., explosives, flammables). But, they are still hazardous materials, and there is a placard for them. But, does the placard have to be used? 1. What Is a Class 9 Hazmat? Class 9 hazardous materials are miscellaneous hazardous materials. Oil spill regulation remains muddled In 1971, the EPA and Department of Transportation (DOT) issued a joint memorandum to clarify jurisdictional issues related to the regulation of facilities with the potential to discharge oil into the environment. Nearly 50 years later, there is still significant uncertainty about where one agency’s authority ends and the other’s begins. In the simplest terms, the memo states that the DOT has authority over transportation-related facilities with the potential to discharge oil, while the EPA possesses authority through its Spill Prevention, Control and Countermeasure (SPCC) program over non-transportation facilities. DOT also delegated regulation of certain offshore

modern history. The one playbook the industry has to go by is the 2008/2009 global economic crisis, when chemical demand growth recovered rapidly following a sharp dip in global economic activity. That recovery was supported by global stimulus packages, particularly from China. To date, similar measures in this crisis have provided less momentum or reassurance. “Before the coronavirus outbreak, we had two underpinning base case views for petrochemical demand,’’ Kirby and Chadwick said. Those views were: Long-term demand growth for petrochemicals is robust. Feedstocks are one of the fastest-growing parts of the oil barrel, so oil-related companies continue investing. Plastics circularity will grow in scope and scale to become an increasingly integral part of the industry. Chemical companies are increasingly active in the space. “Longer term, we expect these trends to remain,’’ the men said recently. “However, the crisis will slow investment and shift focus towards cash reservation and discipline. Meanwhile, a low oil price makes recycling economics tougher.’’ The impact will differ across chemical value chains and end- use segments, according to the analysts. Packaging, sanitary and medical polymer applications are seeing a short-term lift. This is due to stockpiling, a boom in delivery services, and the high health-care sector activity. Other major polymer- consuming sectors, including automotive and construction, have taken a hard hit. Shockwave 2: Volatile feedstock pricing following the oil price crash Crude oil prices have crashed, past the lows of the 2008 recession down to around $20 to $25 per barrel. Weak global economic prospects, coupled with high oil supply, are expected to keep prices low in the near term, the men said. “Refined product prices have followed crude, amplified by the sharp drop in mobility and transportation fuel consumption. As a key connection to base olefins and aromatics manufacturers, refining industry trends can dramatically disrupt petrochemicals unit operations down multiple value chains,’’ the analysts said. Short-term NGL supplies (the second key energy-linked feedstock) are more robust than refinery supplies. But North American upstream investment cuts will directly affect petrochemical buyers in the medium term. Assets with the most feedstock flexibility will be best positioned. The tumbling oil price has reshaped the combined cost base of the global petrochemical industry. This is demonstrated clearly by the largest petrochemical: ethylene. Global competitiveness and profitability for the world’s major producing locations changed virtually overnight. “In the medium term, new petrochemical capacity additions are likely to be lower, which is good news for an industry entering crisis,’’ according to the analysts. “Existing projects under construction will be postponed by labor restrictions and decision-making on pre-FID projects will slip, perhaps indefinitely. Frustratingly, in the short term, labor restrictions are also delaying planned maintenance, meaning more supply will stay online. But this could be countered in the coming weeks by difficulties in recovering from unplanned interruptions,’’ the men said. How will the chemicals industry respond to the crisis? Polymer consumption patterns are in disarray. Plunging oil prices are hitting feedstock pricing and profitability. The industry – like so many others – faces significant uncertainty. So, what’s the likely response? “Right now, the focus is mainly on the human aspects of the crisis, in addition to managing immediate operational disruption,’’ the two analysts said. “But crisis management only extends so far. The data,collated in a report, outlines changes to commercial activity, industry-specific trends, and shifts in driver behavior. – Commercial driving activity has returned to normal, or higher than normal, levels: On average, U.S. states have returned to within 95 percent of pre-COVID-19 commercial driving activity, defined as miles driven and the number of operating vehicles on the road. But this is not without some variation. States that experienced limited to no lockdown restrictions are seeing a faster return to average commercial driving activity pre- pandemic. This is in sharp contrast to other industries like passenger transit and education. Passenger transit activity has stabilized at around 35 percent of pre-COVID-19 levels and educational services activity remains below 10 percent. Other industries, like oil and gas, have not yet recovered from COVID- 19’s implications, operating at 60 percent of pre-COVID-19 commercial activity. The construction industry, on the other hand, is starting to clock in more miles, operating at 5 percent above pre-COVID-19 levels in recent weeks, according to the data. – With emptier roads, harsh braking and acceleration decreased by 40 percent: There has been a decline in harsh braking and acceleration across all states, culminating at 40 percent below the pre-COVID-19 baseline. The trend has become even more pronounced as commercial fleets are beginning to resume pre-COVID-19 levels of activity with significantly fewer passenger vehicles on the That is, they are materials that present a hazard during transportation, but they do not meet the definition of any other hazard class. Class 9 hazmat includes: • Materials transported by air that could cause extreme annoyance to a flight crew member to the extent that it prevents the crew from performing its duties; • Hazardous wastes; • Hazardous substances; • Marine pollutants; and • Materials that meet the definition in the hazardous materials regulations (HMRs) for an elevated temperature material. Is a Placard Ever Required for Class 9 Hazmat? Not in the United States. A class 9 placard is not required for domestic transportation. This includes the portion of international transportation, which occurs within the United States. However, a bulk packaging containing a class 9 hazmat must be marked with the appropriate identification (ID) number displayed on either a class 9 placard, an orange panel, or a white square on point (i.e., diamond), which is not considered a placard. Non-bulk packagings of class 9 materials must be marked with the proper shipping name and the identification number of the material and be labeled. 2. Do You Need an HME to Transport Class 9 Hazmat? According to Pipeline and Hazardous Materials Safety Administration (PHMSA) officials, the requirement to have a hazardous materials endorsement (HME) on your license is triggered by placarding. PHMSA requires yearly registration for anyone who offers or transports in commerce a hazardous material that requires placarding. In addition, Federal Motor Carrier Safety Administration (FMSCA) regulations require that anyone transporting a hazardous material that requires placarding have an HME on his or her commercial driver’s license (CDL). So, a driver of a commercial motor vehicle transporting a class 9 hazmat that is excepted from placarding for domestic transportation is not required to obtain an HME for his or her CDL. For hazmat haulers, proper insurance critical Several homes were evacuated earlier this year after a semi-truck tanker overturned near Williamsburg, Ky.,and leaked 5,000 gallons of highly flammable butyl acrylate onto the railroad tracks below. Several agencies responded to the incident, including a hazardous materials (hazmat) crew to clean up the strong-smelling irritant. While officials reported the risks of the chemical spill spreading beyond the site were low, they expressed concerns that the spilled substance could cause an explosion or respiratory issues for nearby residents. The roadway was closed to traffic for several hours as the tanker and chemical spill were cleared. The truck driver reportedly told investigators his GPS misrouted him to the bridge and the tanker overturned as he attempted to turn it around. Fortunately, he escaped injury and no other injuries were reported. Evacuees were allowed to return to their homes that afternoon and the road was reopened to traffic that evening. John McGlynn, director of transportation at Burns and Wilcox in Toronto, Canada, said clean-up costs alone in the Kentucky bridge incident could be considerable if replacement of the railroad tracks or remediation for the soil were necessary, which could disrupt business operations for companies shipping their goods along that route and impact supply chains. Burns and Wilcox is one of North America’s leading insurance brokers. John Woods, a vice president at the company, recommends a three-pronged strategy to protect against risk: utilize advanced technology, identify and implement best practices, and consult experienced and knowledgeable insurance brokers and agents. Woods advises trucking operators to avail themselves of technology such as monitoring software, collision avoidance systems and in-cab camera systems to support accident prevention efforts, inform accident investigations and mitigate liability risks. “I think for the long-term benefit of an organization and the long-term safety of the public, investing in that kind of technology is vital,” he said. 1. Rising risks and legal costs exacerbated without adequate coverage A troubling current trend is trucking operators reducing their liability coverage to cut costs, McGlynn said. Pervasive litigation across the transportation industry has driven up risks and legal costs and, consequently, some insurance premiums, he said. “Five to seven years ago, a small fraction of bodily injury cases would have gone to trial,” McGlynn said. “Now, more cases are going to trial with more advanced negotiations.” The sharp increase in the number of claims going to trial has led to skyrocketing numbers of so-called “nuclear verdicts,” which Woods defined as jury awards of more than $10 million to a plaintiff in a bodily injury case. A customized trucking insurance bundle could include several policy types, some with coverage for mitigating costs of the damaged truck or hauler, such as a physical damage policy, and others with coverage for mitigating costs incurred when events involve bodily injury and prompt legal action. Coverage under an automotive liability insurance policy helps with payments for claims involving injuries to other motorists or their vehicles, structural damage to a nearby building caused by debris, and more. According to Woods, automotive liability is the biggest risk facing trucking operations. Companies hauling goods are often required to carry cargo insurance, which generally assists with payments for damages or destruction of any items in tow. A Truckers General Liability policy is often needed to cover costs such as accidents that occur in parking lots, mishaps while loading or unloading and theft and vandalism. An Environmental and Pollution Liability Insurance policy is often added to help shoulder cleanup costs when accidents involve spilling any substance determined to be a pollutant. Being underinsured could have serious financial consequences on a trucking operation, McGlynn said. “If an operation were is under-insured, it conceivably can be forced into bankruptcy because it lacks sufficient limits in insurance to satisfy a legal judgment or other demand for payment following an accident,” he said. 2. Accident frequency reflects trucking’s outsize role in economy Large truck accidents regularly create safety concerns on U.S. and Canadian highways. These concerns are magnified when hazardous materials are involved. Last October a large section of Highway 32 in western Alberta was shut down after a collision between a truck and another vehicle resulted in the spill of petroleum distillates, a flammable liquid that can cause headaches, dizziness and nausea. No injuries were reported, but because of the hazardous nature of the spill the highway remained closed for hours. The environmental and health risks posed by hazardous material spills are well known; however, spills involving cargo not considered hazardous regularly pollute the natural environment and can even pose a threat to animals and humans living near affected sites. On Feb. 7, a semi tractor-trailer carrying 42,000 pounds of pig parts flipped over on Highway 59 in Rosenburg, Texas, creating a massive health and environmental hazard and snarling traffic. That same day, two separate transport truck accidents – one spilling up to 1,000 gallons of molasses and the other spilling a dump truck load of gravel and dust – occurred hours apart on the same stretch of Highway 101 in Santa Rosa, Calif. In 2017, more than 15.7 millions tons of freight were shipped inter- and intrastate in the U.S., according to the U.S. Federal Motor Carrier Safety Administration (FMCSA); nearly 70 percent of that was shipped by truck. The FMCSA also reported that in 2017, large trucks were involved in 450,000 of the over 6.4 million vehicle accidents that occurred in the U.S. Of those accidents, 102,000 resulted in injuries and 4,237 involved fatalities. The data shows a marked increase each year since 2014, when 411,000 large trucks were involved in accidents, 82,000 of which involved injuries and 3,429 of which resulted in fatalities. Groendyke awards scholarships For the first time, Groendyke Transport of Enid, Okla., has named three recipients of the Jonathan Luevano Memorial Scholarship. This year’s recipients are Kailey Davis of Angleton, Texas; Anna Smith of Gastonia, N.C.; and Lorraine Lowrey of El Dorado, Kan. The scholarship honors the memory of Jonathan Luevano, a driver at Groendyke’s Fort Worth, Texas, terminal who was shot and killed May 7, 2015, while delivering fuel to a local convenience store. To keep Luevano’s memory alive, the trucking company started the scholarship for children and grandchildren of its employees. “We are very proud of each of this year’s recipients,” said Greg Hodgen, Groendyke Transport’s president and chief executive. “It’s important to us as a company to keep Jonathan’s spirit alive. He represented Groendyke with complete professionalism, and his helpful spirit inspired coworkers, customers, family and friends alike.’’ Kailey Davis received the top scholarship award in the amount of $1,500. She is the granddaughter of Angleton drivers Julie and Kary Golden. Davis is a graduate of Boling High School in Boling, Texas. She has been accepted to attend the University of Texas at Austin in the fall and plans to major in youth and community services. Anna Smith Kailey Davis Lorraine Lowrey Celadon auctioning Mexican business Celadon Group has asked a court to allow it to pursue a public auction for its Mexican businesses, with a deadline set for early summer. The most recent court filings are part of the U.S. Bankruptcy Court for the District of Delaware hearings for trucking company Celadon Group, which filed for Chapter 11 bankruptcy in December. Celadon had been in talks with White Willow Holdings to sell its Mexico business for $2.4 million, after the proposed $7 million sale to P.A.M. Transportation Services fell through in April, according to court filings. A group of unsecured creditors had asked the court to halt the sale to White Willow, proposing the sale be completed through a public auction, according to court documents filed May 14. The sale to White Willow Holdings was set for a hearing in late May. However, representatives for bankrupt Celadon filed a motion stating they “have received numerous unsolicited expressions of interest for the Mexican assets.” Representatives for Celadon filed a motion to establish a public bid deadline of June 8 for the Mexican assets, with an auction possibly proceeding on June 11. Celadon’s Mexico assets include wholly owned subsidiaries Celadon Mexicana, Jaguar Logistics and Leasing Servicios, according to filings. In a separate court filing, Cincinnati-based Huntington Bank also filed a motion to block the sale of Celadon’s Mexico busines, saying it was owed more than $3 million for trailers it had financed for Celadon. Representatives for the bank said some of the trailers may be located in Mexico. Program hastens cargo inspections A new cargo inspection program aims to cut border crossing wait times at the Pharr-Reynosa International Bridge in Pharr, Texas. U.S. Customs and Border Protection (CBP) officers are now working at the Pharr Land Port of Entry alongside their Mexican counterparts to jointly inspect thousands of trucks loaded with non-agricultural imports. The new Unified Cargo Processing (UCP) program, which began in June, will save time and money for trucks traveling from Mexico, CBP officials said. “Conducting a single inspection with dual components, in this case CBP officers working alongside our Mexican counterparts, will streamline the inspection process, which can ultimately only expedite the flow of international commerce,’’ said Carlos Rodriguez, CBP’s port director for the Hidalgo/Pharr/Anzalduas ports of entry. Previously, trucks crossing at the border had to be inspected by Mexican custom officials in Mexico, and then they would drive about seven miles across the Pharr-Reynosa International Bridge and be inspected all over again with U.S. customs officers. The city of Pharr donated infrastructure modifications to the CBP to establish two dry-dock bays at the Pharr Land Port of Entry. The dry-dock bays will be used by CBP officers and Mexican custom officials as additional secondary inspection bays for non- agricultural imports. “We look forward to benefiting from expedited inspections, reduced wait times, and more efficient international commerce as a result of this program,” Pharr Mayor Ambrosio Hernandez said. The UCP program is also used at ports of entry in El Paso and Laredo, Texas; Nogales, Arizona; and Otay Mesa, California. Pharr is located in Texas’ Rio Grande Valley, which consists of the nearby cities of Brownsville, Harlingen, Weslaco, McAllen and Edinburg. Pharr is also connected to the Mexican city of Reynosa by the Pharr-Reynosa International Bridge. The amendment was introduced by U.S. Rep. Anthony Brown (MD-04) and supported by U.S. Rep. Greg Pence (IN-06) in a bipartisan effort to provide relief to dry bulk stakeholders throughout the supply chain. The amendment was introduced on behalf of a coalition of more than 130 partners representing major industries and employers from across the country, including agriculture, food and manufacturing. “On behalf of the broad dry- bulk coalition, I commend House Transportation and Infrastructure Chairman Peter Defazio, Rep. Brown, and Rep. Pence for their critical support of our top legislative priority,” said Dan Furth, president of National Tank Truck Carriers (NTTC). “Through their leadership, the bipartisan Brown Amendment was passed by the transportation committee last evening resulting in a significant victory for our coalition. NTTC dry bulk carriers extend their gratitude to these leaders, their professional staffs, and the many advocates that worked so hard to achieve this win in this particularly trying time for the nation’s economy.” This amendment does not allow for any increase in the maximum weight or size of truckloads. It incorporates into current limits an axle tolerance to account for dry bulk shifting and settling during transportation. Dry bulk commodities such as grains, powders, and pellets tend to shift during loading, unloading, and transportation, resulting in an uneven distribution within the trailer. This means that a truck that was compliant with all weight limitations at the beginning of its journey may find itself in violation of them at a later inspection, despite hauling the same load. “As an active coalition participant and dry bulk carrier, I am extremely pleased with the inclusion of the dry bulk axle- tolerance amendment in yesterday’s Invest in America Act,” said Harold A. Sumerford Jr., chief executive of J&M Tank Lines in Birmingham, Ala. “This common sense fix to a unique operating issue will ultimately improve highway safety and reduce congestion.” The Invest Act is expected to pass the House and move to the Senate, where its prospects are still fluid. NTTC and the Dry Bulk Coalition will continue their joint efforts to make a 10-percent dry bulk axle tolerance into law, the organizations said. Mitigating environmental exposures underscores the need for a thorough consultation with insurance brokers and agents familiar with those risks. “It is absolutely critical to consult an expert and obtain appropriate coverage for environmental damage,” Woods said, adding that “a standard automobile liability policy would not cover those types of claims.” Cargo insurance policies typically have limits that cover some, but not all clean-up or site remediation costs, he noted. 3. Strategies to maximize safety as well as profits Woods pointed out that while investing in advanced technology is important for trucking carriers, it is not a magic bullet. Emphasizing training and teaching best practices, he said, can help drivers avoid avoidable situations like the one that occurred in Kentucky. He argued that it is essential for both large and small transportation carriers to be proactive in identifying their risks based on their operations. Additionally, he said, they would be well served to implement emerging risk mitigation strategies, which would involve consultation with experienced risk management professionals, experienced insurance brokers and agents and industry associations. and onshore facilities to the U.S. Coast Guard (USCG). But that general statement provides little illumination in the complex world of oil infrastructure. For example, both agencies may have authority in a single facility – called a complex – that possesses a combination of transportation- related and non-transportation- related components. Furthermore, a specific piece of equipment may be either transportation-related or non- transportation-related depending on its use. Sometimes jurisdiction can go to one agency or the other based on the location of a single valve. “Determining agency jurisdiction can be difficult and should be treated on a case-by-case basis,” the EPA states in SPCC Guidance for Regional Inspectors. The 1971 memo endeavors to clarify the most common jurisdictional issues for inspectors and the regulated community. EPA’s guidance document also provides examples that can help clear up confusion about which agency’s regulations govern a facility and its operations. The following examples provide a sense of how the separation of authority works. 1. Tank Trucks The EPA regulates tank trucks as mobile/portable containers under the SPCC rule if they operate exclusively within the confines of a non-transportation-related facility. For example, a tank truck that moves within the confines of a facility and leaves the facility only to obtain more fuel (oil) would be considered to distribute fuel exclusively at one facility. This tank truck would be subject to the SPCC regulations if it or the facility contained above the regulatory threshold amount and there was a reasonable expectation of discharge to navigable waters or adjoining shorelines. A tank truck that distributes fuel only to multiple off-site facilities and does not perform fueling activities at the home base would be transportation-related and regulated by the DOT. Additionally, the EPA regulates containers that were formerly used for transportation, such as a truck or railroad car, and are now used to store oil (i.e., no longer used for a transportation purpose) as a bulk storage container. Tank trucks that are used in interstate or intrastate commerce can also be regulated if they are operating in a fixed, non- transportation mode. For example, if a home heating oil truck makes its deliveries, returns to the facility, and parks overnight with a partly filled fuel tank, it is subject to the SPCC rule if it or the facility has a capacity above the SPCC threshold amount and there is a reasonable expectation of discharge to navigable waters or adjoining shorelines. However, if the home heating oil truck’s fuel tank contains no oil when it is parked at the facility, other than any residual oil present in an emptied vehicle, it would be a highway vehicle regulated only by the DOT. 2. Marine Terminals A marine terminal is an example of a complex subject to both USCG and EPA jurisdiction. The USCG regulates the pier structures, transfer hoses, hose-piping connection, containment, controls, and transfer piping associated with the transfer of oil between a vessel and an onshore facility. The EPA regulates the tanks, internal piping, loading racks, and vehicle or rail operations that are completely within the non-transportation portion of the facility. EPA jurisdiction begins at the first valve inside secondary containment. If there is no secondary containment, EPA jurisdiction begins at the valve or manifold adjacent to the storage tank. 3. Breakout Tanks Although breakout tanks can be used to relieve surges in an oil pipeline system or to receive and store oil transported by a pipeline for re-injection and continued transportation by pipeline, they are sometimes used for bulk storage (i.e., non-transportation-related storage). Thus, breakout tanks may be regulated by EPA, DOT, or both, depending on how the tank is used. Breakout tanks used solely to relieve surges in a pipeline, not used for any non-transportation-related activity (i.e., pipeline-in and pipeline-out configuration, and with no transfer to other equipment or mode of transportation such as a tank truck), are not subject to EPA jurisdiction. Bulk storage containers used to store oil while also serving as a breakout tank for a pipeline or other transportation-related purposes may be subject to both EPA and DOT jurisdiction. (Oil spill regulation continued from page 1) (For hazmat haulers continued from page 14) TSA issues interim hazmat exemption The Transportation Security Administration (TSA) has issued an interim exemption that will allow drivers with a valid Transportation Worker Identification Credential (TWIC) to obtain a hazardous materials (hazmat) endorsement without going through additional security checks. The TSA Modernization Act – passed in October 2018 – allows states to issue a hazmat endorsement on a state-issued CDL to a driver who holds a valid TWIC. This provision allows states to use the existing TWIC to verify the completion of the TSA security threat assessment. The exemption will go into effect until TSA can amend the pertinent regulations to conform with the TSA Modernization Act. TSA said until the process to revise the regulations is complete, it is necessary to issue this exemption so that drivers can comply with the new statutory language and remain in compliance with TSA’s regulations. Under current law, cited in the 2001 anti-terrorism Patriot Act, no state may issue a hazmat endorsement for a commercial driver’s license until TSA notifies the state that the applicant does not pose a security threat. It also requires TSA to conduct a security threat assessment consisting of criminal, immigration, and terrorism checks. Hazmat applications also must provide biographic and biometric information to TSA. But the TSA Modernization Act allows TSA to grant an exemption from those regulations if the administrator determines the exemption is in the public interest. TSA said it has has determined that it is in the public interest to grant an exemption from certain hazmat regulations when an applicant holds a valid TWIC. With this new exemption, individuals with a valid TWIC may now forego the submission of information, biometrics and fees to TSA because the individual is deemed to have already completed the appropriate security threat assessment. The class 9 placard found at 49 CFR 172.560 (white diamond with seven black vertical stripes on the top half and an underlined nine centered in the bottom half) is primarily for use in international transportation. Truckers are allowed to use it in the United States to display the ID number on a bulk packaging. However, if operators use a class 9 placard for this reason (i.e., marking the appropriate ID number), the shipment is not subject to additional requirements applicable to shipments that require placards. 4. Do You Need to Be Registered to Haul Class 9 Hazmat? Shipments that don’t require placarding don’t require that the person who offers for transportation, or transports, hazardous material be registered under PHMSA regulations at 49 CFR 107.601. So, you can accept a load that contains a class 9 hazmat without being registered with PHMSA. 5. But, Don’t Forget Training Even though a driver transporting a class 9 hazmat is not required to obtain an HME for his or her CDL, that driver is still carrying a hazmat under PHMSA regulations and must receive hazmat training.
