This is interesting because commercial drivers are getting better pay, more benefits, improved working conditions, and higher levels of quality training. In fact, these impactful changes are useful recruiting tools that are intended to improve retention, turnover and job satisfaction within the transportation industry. On the other hand, even armed with practical recruiting tools the commercial driver labor disruption paradigm does not seem ameliorated. In fact, labor shortages in the U.S. transportation industry seems to be constant and troubling, so much so that according to the American Transportation Research Institute (2021), driver shortages and driver retention have remained a major issue for more than three consecutive years. Therefore, the topic of commercial driver labor disruptions in transportation is important to research because of its continued possession of particular negative qualities within the industry. Interesting enough, there are many articles that outline causations for driver shortages. To this point, some of the described reasons for driver shortages cover areas of interest such as relatively high average age of the existing workforce, failure to attract all segments of the population, hard to find candidates that are eligible or meet specific hiring guidelines, and industry related driver churn (term used to describe employees moving from one organization to another). The Environmental Protection Agency said it would set the 2022 levels for corn-based ethanol blended into gasoline at 15 billion gallons. Red Trail Energy LLC announced it officially began carbon capture and storage (CCS) at its ethanol facility located near Richardton, N.D., on June 16. Carbon capture and storage is the process of capturing carbon dioxide (CO2) from a large stationary source, compressing the CO2 into a liquid and injecting it via a Class VI injection well deep underground for permanent geologic storage. North Dakota was the first state to be granted primacy from U.S. EPA in 2018. Wyoming followed in 2020. “After six years of research, development and investment Red Trail Energy is celebrating this historic moment in North Dakota and United States history of becoming the first facility permitted under state primacy to capture and store CO2. Our success establishes a trail for other industries in the state to follow,” said Gerald Bachmeier, chief executive officer of Red Trail Energy (RTE). “The significance of implementing this project cannot be understated. From the beginning we wanted to set RTE apart from other ethanol plants and this project puts us ahead of the curve in terms of lowering the carbon intensity of our ethanol.” Already considered a low-carbon fuel, ethanol produced at RTE now has a lower carbon footprint than conventional ethanol sources thanks to carbon capture, according to the company. The RTE ethanol plant emits an average of 180,000 metric tons of CO2 annually from the fermentation process during ethanol production. With CCS, RTE is capturing 100 percent of its CO2 emissions from the fermentation process and is injecting about 500 metric tons of CO2 per day. The CO2 is permanently stored underground more than a mile below the surface in the Broom Creek formation. In October 2021, less than five months after receiving the RTE application, the North Dakota Industrial Commission approved the Class VI injection well and the reservoir pore space RTE needed to operate the facility. They would also require companies to share information about: • How they are monitoring and managing climate-related risks. • How climate-related risks have or may affect their strategy and outlook in the short to long term. • How transition activities and climate-related events such as severe weather could impact their financial statements. “They’re on the track to passing these disclosure rules, and it’s got a broad support in the investment community,” Oliver Browne, vice president of policy at mobile fuel delivery company Booster said. “There is a broad push by investors to have this information in a comparable standardized way from companies.” Similar climate disclosure rules are already in place or soon will be in the EU, U.K., Japan, New Zealand and Singapore, said Karthik Balakrishnan, co-founder and president at environmental, social and governance transformation platform Actual. “If adopted, it would provide investors with consistent, comparable and decision-useful information for making their investment decisions, and it would provide consistent and clear reporting obligations for issuers,” SEC Chairman Gary Gensler said in a March release. The inclusion of scope 3 emissions likely would have the largest impact on smaller freight companies. Scope 3 emissions would be required if they are “material” or if the company has a target to reduce them. The rules would provide a safe harbor for liability from scope 3 emissions disclosure and an exemption for In addition, it seems that current research does not fully examine the impact that organizational culture has on driver retention acting as an outcome variable. From this stance, it is paramount to explore organizational culture because it is deeply rooted in beliefs and values, wherein individuals hold a substantial investment as the result of analyzing and processing data about organizational life (Little 2022). For this reason, the beliefs or notions of culture are often referred to in terms that are associated with people, places, myths, rites, languages, and practices (Smith et al. 2002). Under those circumstances, organizational cultures are considered to be the building blocks of societies and the main dynamic that drives collective actions within the workplace (Scott 2003). As a matter of fact, Schwartz (2014) states that if the majority of individuals within an organization follow current missions and strategies, then the culture of the organization is considered to be “good,” but alternatively, if individuals do not conform to organizational missions and strategies then the culture of the organization is considered to be bad (Schwartz & Davis 1981). Therefore, as a consequence of this contention a research question is developed within the transportation industry. Question 1: Are organizational cultures within the transportation industry a major contributing factor for labor disruptions that cause negative influences towards driver retention? This an important question to consider because organizational cultures are so ubiquitous that they tend to fade into the background and their impact within the workplace can be unnoticed (Little 2022). So, if there are no designed workplace practices within trucking companies that attempt to increase job satisfaction, then possibly relationships between the organization and drivers may become negative. Therefore, from this perspective job satisfaction is an evaluated judgment made about the workplace that create emotional experiences (Weiss & Rupp 2011) and is defined by individualist emotional attachment someone has about his or her job (Locke & Lathum 2002). In closing, it is highly recommended that workplace culture include day-to-day operational practices that promote job satisfaction that may influence long-term affective commitment from drivers. He said the SEC needs to make sure that small companies and owner- operators have their voices “really heard and factored in.” The SEC accepted public comments on the proposed rules from March 21 to June 17, according to a release. Several companies and organizations submitted comments, including suggestions for clarifications or changes. About 90 percent of carriers in the U.S. operate 10 or fewer trucks, and nearly 50 percent of trucking businesses are single-truck carriers, the Owner-Operator Independent Drivers Association (OOIDA) said in its comments on the proposed rules. The freight industry generally operates on a low margin, so having to hire extra employees or spend extra time on the reporting could be a burden for small operators, said Frank Mycroft, chief executive of Booster. “Small-trucking businesses already lack the back office resources that would facilitate collecting and calculating this data, especially when compared with publicly traded carriers that employ dedicated administrative departments,” OOIDA said. “Far too often, small carriers are victims of regulations promoted by these large fleets as a method of squeezing competitors out of the industry by increasing their operating costs.” The freight sector is not suited for scope 3 reporting, and small businesses don’t have the resources to do so, the American Trucking Associations (ATA) said. But ATA supports “the underlying goals of the SEC rule in seeking better transparency and disclosure of registrant financial risks.” Small carriers often work with many companies, including third- party logistics firms, manufacturers and retailers. Having to report data for each entity a carrier works with could create “a world of administrative complexity they haven’t seen before,” Mycroft said. According to a recent CPI report, price pressures remained elevated year-over-year. The CPI accelerated 8.3 percent in April, more than the 8.1 percent estimate and near the highest level in more than 40 years, according to analysts. Fleet Executives Dealing with Inflation One of the challenges fleets are facing today is that there has been little or no inflation for many years. There’s a whole generation of fleet professionals who have never had to deal with the CPI increase. They negotiated with their vendors for a long time and prices mostly remained stagnant. Now suddenly fleet operators are seeing 2, 3, and 4-percent increases and must evaluate their options to keep costs under control as much as possible. Moreover, they need to answer the C-suite and provide alternate options and recommendations. How M&R Is Impacted by CPI Increases M&R is a significant area where cost control options exist. First and foremost, depending on a lease’s structure -- full-service or unbundled – fleets may have an important choice when understanding what is included in their M&R costs. There are variable inputs that make up these costs and it’s not as simple as just looking at M&R as a single bucket, per se. Fleets must be able to dissect all critical M&R parts and components, such as tires, brakes, service and repair, etc. Knowing Your Lease Structure is Important Because of this, more fleet personnel are taking a closer look at unbundling their lease structure so they and their asset management partners can work with vendors and parts suppliers on the most cost- competitive components. However, in a full-service lease (FSL) structure, fleets are confined to a single, bottom-line figure with little power in negotiating. One of the most significant differences between an unbundled and full-service lease is how M&R costs are calculated. M&R is “front loaded” in a FSL lease. Companies can pay a minimum of .07 per mile in year one versus .02 per mile when unbundling. All trucks have a two- year bumper-to-bumper warranty that can be extended to four years. Expenses for year one include wearable items (tires, brakes) and preventive maintenance. A shorter truck life cycle produces long-term savings beyond the first year. In an unbundled lease, the cost per mile average equals 5.675 cents over five years. However, in an FSL, fleets pay up to 9 cents per mile. Rising CPI exacerbates this further since those rates are not flat. If the CPI increases, as it has recently, fleets will undoubtedly see an increase in their monthly payment. Why It’s Important To Itemize M&R Costs However, when we look at each of those pressures fleet professionals have to deal with, they also have the internal pressures of explaining it all to their leadership. The fleet professional speaks for each individual cost center buckets -- truck procurement, fuel, financing costs, M&R, etc. It becomes very difficult to pinpoint precisely where rising CPI is having the most significant impact on the bottom line. However, when fleet personnel have each cost center unbundled and broken out individually, they can go line item by line item and review efficiencies in each bucket to show how rising costs are affecting scheduled maintenance, preventative maintenance, tire and brakes replacement, etc. In many of these lease agreements, fleets have the maintenance included and additional time and materials on top. Therefore, they’re seeing the CPI increase in general and in parts that can be anywhere from 15 percent to 30 percent on the individual items. Parts availability and supply chain shortages further complicate this. So, if a fleet typically runs 500 tractors, and there was an expected downtime of 8 percent to 10 percent, managers have seen their parts costs increase and their labor increase when they’re tied to a full-service agreement and the CPI increase. With an unbundled agreement, these fleets aren’t tied to any one parts supplier in particular, freeing up the fleet organization to shop around for the best price and availability. We are honored to be the stewards of these great traditions, and are committed to upholding these core values as our North Star.” On hand to witness the plant’s opening were state and local government representatives, Fruehauf dealers, customers and industry suppliers -- along with a lot of news media -- who gathered under a tent outside the new 125,000-square-foot manufacturing facility in the Kentucky Transpark industrial area. An initial $12-million investment will create nearly 300 jobs, according to the company. The new business traces its legacy to August Charles Fruehauf, credited with inventing and commercializing the semi-trailer. Founded in 1918, the original Fruehauf Trailer Co. grew to become a global, vertically integrated conglomerate building products company whose clients included those in the defense and marine equipment. Subsequent financial challenges led to the sale of various divisions and to bankruptcy following the 1996 trailer industry downturn. Wabash National bought the remaining trailer business in 1997. Now doing business here as Fruehauf Inc. , the company is owned by Grupo Fultra, a Mexico-based corporation whose transportation brands include Fruehauf de Mexico, which has produced trailers since 1965. “After the last couple of years, we deserve good days -- exciting days, days of hope, days that move us into the future,” Kentucky Gov. Andy Beshear said. “And that’s exactly what we are celebrating today.” In addition to explaining the historical significance of the plant opening, Beshear suggested that Fruehauf’s invention has allowed Kentucky to become “a logistics capital” in the U.S., geographically located “within reach of 60 percent of the country’s population in a one-day drive.” Indeed, Bowling Green’s location on the Interstate-65 corridor and proximity to key customers was critical in placing the new facility here, said Tom Wiseman, Fruehauf Inc. president. “When we first announced that we were bringing the Fruehauf product back into the U.S. market, it was amazing how many ‘Fruehaufers’ contacted us and were very appreciative that the product was going to be built and offered again here,” Wiseman said. “It makes it a much easier job from a marketing standpoint and meeting customer expectations.” But even though building the facility and getting it up and running has taken less than a year since the site was selected, the effort hasn’t been easy, company officials said. Along with COVID, supplier and labor challenges, Bowling Green was struck by a devastating tornado earlier this year. “But you know what, it all came together,” Wiseman said, and he pointed to a trailer, unit number 17, parked nearby. “Luckily, we were able to start production, maybe only a month or two behind what we had originally targeted. And here we are today, in celebration of product that’s been rolling out the door.” Wiseman and Don Brown, vice president of engineering, both began their careers with Fruehauf in the 1970s. They’ve since worked in the trailer industry in various capacities, with various companies, before teaming up to re-launch Fruehauf’s U.S. production -- and that combined experience and expertise has been crucial to the startup effort, Wiseman noted. “This is a full circle for us -- it’s like checking that box,” Wiseman said. “We’re building a team here with both experienced and junior employees who are learning the skill of trailer building. We are very excited about it.” The facility is a good example of why the North American “common market” and NAFTA (now USMCA) is “a great agreement,” noted Fultra Chairman Eugenio Clariond. “Today is a major step of a long- term commitment to Fruehauf in North America -- we are here for the long run,” Clariond said. “We expect to continue investing in the development of people, our products and the communities that surround us where we operate, and as well establish a nurturing, long-lasting relationship with our customers, dealers, aftermarket partners, and suppliers.” (Fruehauf continued from page 1) R I Return on Investment is the name of the game in fuel transport. NEW PRODUCTS – MANUFACTURING – INDUSTRY NEWS NHTSA underride rule draws criticism The National Highway Traffic Safety Administration (NHTSA) is upgrading safety standards on rear underride protection on tractor-trailers to help prevent crashes involving passenger vehicles, but safety advocates say the changes do not go far enough. Rear underride crashes occur when a passenger vehicle strikes the back of a generally larger vehicle and the front end of the passenger vehicle slides under the rear end of the larger vehicle. In extreme underride crashes involving tractor-trailers, the passenger vehicle can underride the trailer to such an extent that the end of the trailer enters the passenger compartment of the colliding vehicle, severely injuring or killing occupants of the car. Underride guards mounted on the rear of trailers can prevent underride and serious injuries and death. In a 107-page final rule made public in July, NHTSA said it will adopt requirements similar to Canada’s standard for rear-impact guards. Rear guards on truck trailers will be required to “provide sufficient strength and energy absorption to protect occupants of compact and subcompact passenger cars impacting the rear of trailers” at 35 mph. The final rule, which makes no substantive changes to the proposed rule that preceded it in December 2015, will improve protection in crashes in which a passenger car hits the center of the rear of the trailer, according to NHTSA, and in which 50 percent of the width of the passenger motor vehicle overlaps the rear of the trailer. “NHTSA’s priority is the safety of everyone on our roads,” said NHTSA Administrator Steven Cliff. “This new rule will improve protection for passengers and drivers of passenger vehicles while also meeting a critical mandate from Congress under the Bipartisan Infrastructure Law.” Passenger protection technologies in vehicles striking trucks will be able to absorb enough of the crash forces from the impact to “reduce significantly” the risk of fatality and serious injury, according to the final rule. Because an estimated 94 percent of applicable trailers already have compliant guards, according to NHTSA, the annual average incremental fleet cost of equipping the remaining applicable trailers with compliant rear impact guards is estimated to be $2.1 million in 2020 dollars. The added average weight of 48.9 pounds per vehicle that the guards add would result in an estimated annual fleet fuel cost of about $4.43 million and $5.59 million, discounted for inflation at 7 percent and 3 percent, respectively. The industry group Advocates for Highway and Auto Safety (AHAS) , which had sought much more stringent underride requirements, was “deeply disappointed” by NHTSA’s final rule, particularly after the agency’s data recently revealed that large truck fatalities are on the rise. “Unfortunately, today’s action allows trucking companies to choose a less safe course of action at the expense of road user safety,” said Cathy Chase, president of AHAS. Joan Claybrook, a safety advocate and a former NHTSA administrator, said it would have been better had the agency not acted at all. “This final rule…amounts to nothing less than regulatory malpractice,” Claybrook said. “Instead of improving protections to reduce underride fatalities and injuries, the agency has gone backward by issuing a rule that 94 percent of trailers already meet. As such, NHTSA has lowered the bar on public safety instead of ensuring it. This is an affront to the families of underride victims who have been working so hard to have the standard updated.” In developing its rule, NHTSA had considered a standard in which rear impact guards withstand a 35 mph crash of a passenger vehicle into the rear of a trailer wherein only 30 percent of the width of the passenger vehicle overlaps the rear of the trailer. The agency asserted however, that available data related to this standard -- which would have required a modified rear guard and therefore more costly for the industry overall -- do not show such a standard “would be reasonable, practicable or appropriate” for vehicles subject to the regulations. “Accordingly, NHTSA cannot conclude that a federal mandate for such a requirement for all trailers is warranted at this time.” The rule is effective 180 days after publication in the Federal Register, with a compliance date of two years after Federal Register publication. Petitions for reconsideration must be received no later than 45 days after publication. reflecting the lower amount of ethanol produced and decreased sales of gasoline during a period when the virus led to a drop in driving. Most gasoline sold in the U.S. contains 10% ethanol, and the fuel has become a key part of the economy in many Midwest states. The fuel consumes more than 40% of the nation's corn supply, and ethanol and other biofuel production plants offer jobs in rural areas that have seen steady population declines over the decades. President Joe Biden is among many politicians from both parties who have frequently promised to support increases in the renewable fuel standard. “Today’s actions will help to reduce our reliance on oil and put the RFS program back on track after years of challenges and mismanagement,\" said EPA Administrator Michael Regan. The Renewable Fuels Association, an ethanol lobbying group, criticized the retroactive reduction of (Increase ethanol blend continued from page 1) biofuels targets but said the future requirements would bring certainty back to the renewable fuel standard, help lower gas prices and set a foundation for future growth. In the last few days, wholesale ethanol prices have been as much as $1.30 per gallon lower than gasoline, the group said. The final order also denies exemptions for certain oil refineries from ethanol requirements, saying they had failed to show exemptions were justified under the Clean Air Act. The American Fuel & Petrochemical Manufacturers group, which represents refineries, called the 2022 figure “bewildering and contrary to the administration’s claims to be doing everything in their power to provide relief to consumers.” The group said unachievable mandates will increase fuel production costs and keep consumer prices high. The Biden administration also announced Friday that the U.S. Department of Agriculture would provide $700 million to support 195 biofuel producers in 25 states that faced unexpected market losses due to the COVID-19 pandemic. The money comes from the Coronavirus Aid, Relief and Economic Security Act. OOIDA said: “While the rule provides flexibility for registrants subject to SEC reporting requirements, it should clarify that small business entities receiving requests from publicly traded companies for information to comply with this regulation should have flexibility as well.” Carriers that measure and share their emissions with retailers may gain a competitive advantage and help those companies view a better picture of their impact, Balakrishnan said. That can lead to collaboration to lower supply chain emissions. Providing investors with comparable, accurate climate data The goal of the climate disclosure rules is to give investors a better idea of how companies are impacting the climate and how climate change poses risks to companies. “We believe that with this proposed rule, the SEC is responding to investors’ needs for clear, consistent and comparable reporting from companies to produce useful investment insights and ensure financial markets can properly price and act on the physical and transitional risks of climate change,” said Climate Action 100 plus, an investor-led nonprofit dedicated to climate change initiatives. Balakrishnan said all of the existing climate-related financial disclosures are based on Task Force on Climate- related Financial Disclosures (TCFD) recommendations. The challenge will be for carriers to apply the same rigor to these analyses and disclosures as they do for other financially material risks.” Balakrishnan said the standardization should “make it easier for companies to report across many countries without creating undue compliance burdens and to allow for greater comparability for investors and reduce knowledge asymmetries.” He said these rules do not mean the SEC is making a judgment about the climate disclosure results. Fleet personnel should be able to address leadership and say, “here’s what we foresee happening; this is why maintenance is rising in relation to the rising CPI; this is why our tire cost is rising; this is why our fuel cost is rising; and here’s what we plan to do about it. We’re going to unbundle our leases and separate these payments to try to drive some efficiency and fuel/M&R sections. We’re going to go back and look at our programs tied to CPI and see if we should renegotiate, and we’ll look at different approaches to maintenance.’’ With this visibility, fleet operators can instill much-needed confidence in the leadership team despite the rising CPI rates and equipment supply challenges. What’s more pressing for fleets locked in a FSL is the notion that few economists see the CPI rate declining significantly in the near future. Continued supply chain issues in the foreseeable future are expected to keep pressure on the cost of goods -- heavy-duty trucks included -- and this means these fleets won’t see any relief any time soon. And that’s a business strategy that won’t please investors and other financial stakeholders. While they are locked in their current lease agreements, fleet managers would be wise to re-evaluate their longer- term truck acquisition strategies and begin planning for the right time to convert to a more flexible, revenue- friendly unbundled lease. Further framework that complies with the federal rules while managing the pore space resource for the benefit of North Dakota property owners, state officials said. “Receiving primacy from the EPA paved the way for projects like this one to become operational in the state and this is a large step toward making North Dakota a leader in carbon neutrality and a showcase for the rest of the world on how to treat carbon,” said Lynn Helms, director of the Department of Mineral Resources. (Rising CPI continued from page 14) Gensler said the SEC aims to allow investors to decide which risks to take as long as public companies provide “full and fair disclosure and are truthful in those disclosures.” “Today, investors representing literally tens of trillions of dollars support climate-related disclosures because they recognize that climate risks can pose significant financial risks to companies, and investors need reliable information about climate risks to make informed investment decisions,” Gensler added. Greenwashing and competitive impacts Most companies that commented agreed with the SEC’s efforts and recognized the potential positive impacts of the climate disclosure rules. Booster is “aligned with the spirit of what the SEC is trying to achieve,” Browne said. Mycroft said if the rules work as designed, they will set a bar for emissions and climate reporting that will allow people to talk about the risks and impacts more transparently. “When I think about what these [regulations] are supposed to do, what they probably will do is reduce greenwashing.” Greenwashing happens when companies market they are environmentally friendly without supporting the claims with climate action. If the rules are implemented, U.S.-based publicly traded companies would be held to standards that private companies would not. Browne said private companies could continue to greenwash and may seem more sustainable to consumers even though they are not adhering to standards. The climate disclosure rules could also impact the competitiveness of U.S.-based companies with those based in other countries where there are not similar climate reporting requirements. Limits of measuring scope 1, 2, 3 emissions Experts agree it is important to assess what is currently measurable because companies have to begin somewhere. “I think we need to start with what is measurable, just be very mindful that there’s a whole lot of stuff we can’t measure at the same time,” Browne said. Emissions data is useful, but “I need to know the details and the exceptions (Proposed climate rules continued from page 21) that drive it as much as I need to know the number,” Mycroft said. The climate disclosure rules the SEC proposes are limited by what they cannot measure. A company’s basic operations may help other companies or the industry as a whole reduce emissions. Those avoided emissions are sometimes referred to as scope 4. But investors wouldn’t have that data when comparing companies’ scope 1, 2 and 3 emissions. Browne said there will be “hidden shifts in the economy,” where a sector’s emissions are structurally lowered. But that wouldn’t be captured in the SEC reporting. Entities split on scope 3 inclusion The National Association of Truck Stop Operators said the SEC’s proposal for including scope 3 emissions is “not ready for prime time and should be abandoned in the final rule.” “Granularized and consistent scope 3 data comparisons between freight hauling companies is just not practical,” ATA said. Because scope 3 emissions are “notoriously difficult to measure,” Walmart said the SEC should “dispense with the requirement to disclose scope 3 emissions unless and until reporting standards mature to a level of proven reliability.” Some think there should be no safe harbor and stricter requirements to include all scope 3 emissions, whether or not a company considers them “material.” Schneider Electric said, “While the disclosure of scope 1 and scope 2 emissions is vital for investors’ understanding of climate-related risks on business operations and revenue, disclosure of scope 3 emissions is also essential, as most emissions lie in this area for nearly all companies.” Environmental nonprofit Pacific Environment said investors would have “no way of knowing the extent of a company’s scope 3 emissions or what steps the company is taking to reduce them” if companies are not required to disclose them. “Scope 3 reporting is critical for effective risk analysis and investment decision making,” said corporate social responsibility nonprofit As You Sow. “The SEC should not allow companies to decide that their scope 3 emissions are non-material and thus avoid having to assess and disclose these important emissions.
