Chinese factories are booming. Chinese goods are flooding into U.S. ports. Ironically, the virus that started in China and caused severe economic damage to the U.S. has spurred an increase in American business purchases from China, to the benefit of Chinese manufacturers. countries continue. Officials in late August held a six-month “checkup” on the Phase 1 trade deal. Both sides cited progress, yet China was more than 50 percent behind June purchase targets, according to the Peterson Institute. There are some positive signs for exports. According to Argus Media, China began ramping up purchases of U.S. crude oil in May and imported over 800,000 barrels per day in July – a plus for tanker demand. China should also buy more U.S. grain in the second half. But the real story is goods flowing in the other direction, from China to America. “The U.S. import-export imbalance with China just got worse,” said Nerijus Poskus, head of Flexport Global’s ocean freight. “In July, U.S. containerized exports were 30 percent below their average in the past three years, while imports are surging.’’ The Caixin China General Manufacturing Purchasing Managers Index jumped sharply in July, to an all-time high. If U.S. Customs data is any indication, that record could be broken -- maritime import filings are trending more than 20 percent higher this month than in July. 1. Customs filings reach new highs Countrywide, daily maritime import filings are now at multiyear highs, with imports from China on the verge of re-attaining the peak hit in late April, when shipments delayed by the initial Wuhan outbreak hit U.S. shores. Filings from the coronavirus low point, March 1, through the latest available data, on Aug. 21, show how China has fueled U.S. import gains. Customs filings for Chinese goods were up 208 percent over this period, with total U.S. filings up 64 percent. The customs data confirms that more Chinese goods are going to California than taking the long route via the Panama Canal to the East Coast. 2. Trans-Pacific rates keep rising It sounds like a broken record, but freight rates keep rising in the Trans- Pacific market. was at $3,336 per FEU -- 2.5 times pricing at the beginning of March. The rate from China to the East Coast was $3,856 per FEU. The spread between the two routes had shrunk to $520 per FEU, underscoring shipper willingness to pay extra for shorter transit time. The Shanghai Containerized Freight Index put rates even higher, at $3,440 per FEU to the West Coast and $3,953 per FEU to the East Coast for the week that ended Friday. Carriers plan yet another General Rate Increase (GRI) for the trans- Pacific starting Sept. 1. If the latest GRI sticks, rates would go even higher still. 3. Demand drivers, supply limitations What’s driving this import demand just as the U.S. is in the midst of a pandemic-induced economic crunch? Alan Murphy, CEO of Copenhagen- based Sea-Intelligence, commented Monday on demand overall, not just U.S. demand. “While this may seem counterintuitive in a pandemic, there are some factors that we believe are at play here,” he explained. “First is a shift in consumption patterns away from services to physical goods, which would give rise to a need for stockpiling a large volume of goods different to what were previously sold. Second, restrictions of traveling and regular outings would potentially fund a higher spending on consumer products. “Lastly, a change in working conditions necessitating a work- from-home approach has also driven consumer behavior towards purchases for furnishing home offices,” he noted. In the U.S. market, these factors are driving importers to buy more from China, where they can source the highest volumes in the least amount of time. U.S. demand for Chinese exports has escalated so much that it could soon come up against a practical ceiling, according to Poskus of Flexport. Smokey Doramus what types of workers can be classified as independent contractors, sweeping into that definition owner-operator truckers -- both those leased to larger motor carriers and independent owner-operators who haul loads for other carriers. The law effectively makes it illegal for carriers to contract loads to owner- operator drivers working as independent contractors. But in January, a U.S. District Court issued an injunction that exempts carriers from A.B. 5 while CTA’s lawsuit against the law is adjudicated. The injunction is effectively an exemption that allows motor carriers to continue working with owner-operators until a final decision is reached in CTA’s underlying lawsuit against A.B. 5. A three-judge panel on the Ninth Circuit heard oral arguments from CTA, represented by attorney Andrew Tauber of the D.C.-based firm Mayer Brown, as to why that preliminary injunction should remain in effect. “We’re pleased with how it went,” said attorney Bob Roginson, one of the lead attorneys representing CTA in the case and manager of the Los Angeles office of the national law firm Ogletree, Deakins, Nash, Smoak and Stewart. “It’s hard to predict with any clarity on where court is headed or what specifically was most important to it.” The court has not given any indication as to when it will issue a ruling, Roginson said, but its decision will likely have years-long ramifications for carriers and independent contractor drivers that work in the state. Ultimately, the lawsuit could take years to make its way through the various courts, potentially all the way to the U.S. Supreme Court -- marking the importance of the decision in front of the Ninth Circuit in the case heard Tuesday. No matter which way the Circuit rules, the decision will likely be appealed to be heard by so-called “en banc,” meaning that the losing side will request a re-hearing by all 12 judges on the Ninth Circuit Appellate Court. From there, the injunction decision could be appealed to the U.S. Supreme Court. Roginson and other CTA attorneys argue that a 1994 federal law (the Federal Aviation Administration Authorization Act) expressly prohibits states from enforcing laws that interfere with “prices, routes and services” of interstate motor carriers. California’s A.B. 5 does just that, CTA argues in its case, and thus should not apply to trucking operations in the state. Though companies like Uber and Lyft have made headlines recently for losing their court cases against A.B. 5’s impact on their operations, those “gig economy” cases “don’t have any real meaningful impact on how the courts are looking at CTA’s case,” Roginson said. The law has already had major ramifications in the state, with fleets large and small late last year announcing a move away from using owner-operators based in California, or even contracting them to haul loads in the state. Notably, Landstar and Prime said in late 2019 they were cutting ties with their California- based owner-operators. DOT widening off-site audits of truckers U.S. DOT this year has increasingly targeted trucking companies with compliance reviews conducted via email and telephone in place of on-site reviews in which inspectors show up in person. What’s more, the Federal Motor Carrier Safety Administration (FMCSA) is operating under broader authority to use those off-site audits to issue safety ratings to carriers (satisfactory, unsatisfactory and conditional) as part of the federal government’s emergency declaration over the Covid-19 pandemic. “It’s a new twist,” said Lesley Sachs, a partner at the national transportation-focused law firm Taylor & Associates, based in Winter Haven, Fla. “Carriers need to pay attention. It’s something to take seriously. The opportunity presented itself with Covid-19, and FMCSA seized it.” FMCSA and its state enforcement partners this year already have conducted nearly three times the number of remote audits conducted in 2019 -- 3,582 through the end of July of this year compared to 1,374 for all of 2019. If that trend holds, FMCSA and state enforcers will have conducted nearly 6,175 remote off-site inspections by year end. That would be more than five times as many as last year‚ and more than half of the on-pace-for 12,000 compliance reviews. With the increased number of off- site audits has come an expansion in the scope of off-site reviews, said Brandon Wiseman, a partner for Scopelitis, Garvin, Light, Hanson & Feary. “Historically, off-site audits were almost always used for what are known as focused audits,” he said, as opposed to comprehensive reviews. These off-site audits generally take two weeks or less, Sachs. said Investigators, either from FMCSA or a state DOT, will send an email to carriers notifying them of the pending investigation and requiring them to upload information such as accident records, driver lists, equipment lists, MC-90 forms and other records. They’re then often required to fill out a questionnaire with basic details such as revenue and mileage data, insurance information, addresses and other operational information. The investigator will complete the process by phone. “They talk with the carrier about their compliance program and practices to get a feel for how robust and developed the compliance program is for that carrier,” Sachs said. “Finally, they issue a report to identify any acute or critical violations to address.” Or, in the case of a safety rating of conditional or unsatisfactory being issued, carriers then have the usual 60 days (or 45, in the case of hazmat haulers) to file a corrective action plan or an appeal with FMCSA. Like most other compliance reviews over the past decade, FMCSA uses carriers’ percentile rankings within the Compliance, Safety, Accountability (CSA) program to target fleets for safety audits. To ward off audits in the first place, Hansen suggested regularly checking CSA scores. “Log in and review your data,” he said. “Look at trends. Review any data that can be reviewed. Take advantage of the crash accountability program, and have crashes that are clearly not preventable removed. Take steps to address what violations you can to keep your scores down.” fuel they sell and promote on their canopies, often leading to consumer misconceptions that they are businesses owned and operated by a major oil company. Big Oil A Small Percentage of Retail Major oil companies have recently begun to reemerge within the retail landscape, reversing a decade-plus trend that reduced their share of the market to less than 0.1 percent by this year. Even as the major oil companies withdrew from retail operations, their brands remained. In fact, roughly half of retail outlets sell fuel under the brand of one of the 15 largest refiner-suppliers. Most of these branded locations are operated by independent entrepreneurs who have signed a supply contract with a refiner/distributor to sell a specific brand of fuel, but these retailers do not share in the profit/loss of their suppliers. The remaining 50 percent sell “unbranded” fuel. These stations often are owned by companies that have established their own fuel brand and purchase fuels either on the open market or via unbranded contracts with a refiner/distributor. Other Retail Channels Sell Fuels In 1971, just 7 percent of all convenience stores sold gasoline. Convenience stores saw enormous gains in market share for fuel over the next 39 years. Over the past decade that growth has slowed, but the number of convenience stores selling fuels still has grown by 6 percent. Today, about 122,000 of the 152,000-plus convenience stores sell fuel and these stores collectively sell 80 percent of the fuels purchased in the United States. The retail channels that saw their gasoline sales climb the most this century were grocery and mass merchandising stores. As of January, there were more than 6,300 such locations (Walmart, Kroger, Sam’s Club, Costco, Safeway) selling fuel. These sites accounted for an estimated 16 percent of the gasoline purchased in the United States, representing sales volumes that are about twice the amount sold by traditional retailers, according to Energy Analysts International. (Gasoline sales continued from page 1) U.S. seeks input on younger truck drivers The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) is seeking public comments on a pilot program to allow drivers aged 18, 19 and 20 to operate commercial vehicles in interstate commerce. Currently, 49 states and the District of Columbia already allow 18 to 20-year-old commercial driver license (CDL) holders to operate commercial motor vehicles (CMV) in intrastate commerce only -- meaning drivers under 21 years of age are restricted to operating within state limits. The agency’s pilot program would allow drivers to participate if they fall within two categories: 1. 18 to 20-year-old CDL holders who operate CMVs in interstate commerce while taking part in a 120-hour probationary period and a subsequent 280- hour probationary period under an apprenticeship program established by an employer. 2. 19 and 20-year-old commercial drivers who have operated CMVs in intrastate commerce for a minimum of one year and have at least 25,000 miles of experience. The study group drivers would not be allowed to operate vehicles hauling passengers or hazardous materials or special configuration vehicles. In July, Virginia Tech Transportation Institute’s National Surface Transportation Safety Center for Excellence published results of a study showing driving experience (or lack of it) is a greater factor in determining risk than age. It showed, among other things, that among drivers with seven months to one year of CMV driving experience, drivers aged 55 years and older had higher crash rates than their younger counterparts. “Generally speaking, the first year of driving a CMV is riskier in terms of crash rates, crash involvement, and moving violations, regardless of age,’’ the study claims. 3. For ports with chemicals, dangers lurk Those who wonder whether a chemical explosion like the one that leveled the port of Beirut and killed more than 100 people could happen in the USA should consider what happened one spring day in 1947 in the port of Texas City, Texas. Cargo in the hold of the freighter Grandcamp started smoking. Flames erupted, and a blast so powerful that it could be heard more than 100 miles away destroyed the ship, docks and an adjoining Monsanto chemical plant. The explosion killed more than 500 people – the exact number was hard to determine because many bodies couldn’t be recovered – making it one of the worst industrial accidents in U.S. history. The chemical product that exploded on the ship was the same one stored in a Beirut warehouse, ammonium nitrate, which is used in fertilizer. The accident underscores the point that U.S. ports aren’t immune to the kind of destruction that was wrought a half a world away in Beirut a week ago. In ports, threats come in all forms. Potentially explosive cargo may be petroleum, liquified natural gas, chemicals or something else. Fire or an explosion can occur in a single container or in a supertanker. On land, disaster could strike in a storage facility, a huge refinery or an industrial complex that’s part of the port complex. Port officials said the public shouldn’t worry. In the USA, transportation of explosive cargoes is covered by myriad federal and state regulations, and those laws are backed by a web of inspection agencies, the Coast Guard chief among them. Warehouses like the one in Beirut were torn down at U.S. ports long ago. The emphasis is on moving containers directly from a ship to ground transport as quickly as possible, cutting out the warehouse wait. Warehouses were razed to make way for railroad tracks and more container space. On the opposite coast, Sam Ruda, director of Port of New York and New Jersey, said his agency approaches hazardous cargo with the same care. “Port of New York and New Jersey takes dangerous goods extremely seriously,” Ruda said. “The port has regulations and fire safety protocols in place limiting the types and amounts of those materials that may be stored, used or transferred through port facilities.” Any cargo considered dangerous is subject to Coast Guard inspection, segregated from other goods and kept in small amounts. The goods must be stored within 500 feet of a fire extinguisher. The port doesn’t take dangerous cargoes in bulk. The hazards that come with ports became national news this summer when fire broke out aboard the USS Bonhomme Richard as the amphibious assault ship underwent maintenance at a San Diego pier. The fire burned for four days, hitting temperatures of 1,000 degrees below deck. Smoke and debris prompted complaints in nearby communities, and samples showed the emissions contained toxic chemicals, the San Diego Union Tribune reported. Ship explosions cause major damage. The tanker Sansinena blew up in Los Angeles harbor in 1976. The blast broke the ship in two and broke windows in the residential area next to the port, San Pedro. It was felt 20 miles away. The most deadly ship explosion occurred 103 years ago in Halifax, Nova Scotia, when a French ammunition ship, the Mont Blanc, blew up after catching fire in a collision with another vessel.
