In addition, the company sells vapor recovery adapters, test boxes, manways, chemical unloading equipment, accessories, O-rings and gaskets, and AAR- approved tank-car pressure relief valves. The FMCSA is proposing that commercial motor vehicles in interstate commerce with gross weights of 26,001 pounds or more be equipped with electronic engine control units (ECUs) to limit them “to a speed to be determined by the rule making and to maintain that ECU setting for the service life of the vehicle,” the notice said. Coercion claims by drivers may set record The latest data compiled by the federal government reveals that complaints of coercion filed by truck drivers could easily break a record in 2022. As of mid April, there had been close to 500 such complaints against employers, shippers and others that truck drivers have filed with the Federal Motor Carrier Safety Administration’s (FMCSA) National Consumer Complaint Database, according to data provided by the agency. Sales rose for natural gas trucks For the first two months of this year, U.S. and Canadian Class 8 natural gas truck retail sales rose 21 percent year-to-date against comparisons of the same time last year, according to a quarterly report released by ACT Research. president and chief executive Tim Girard. In the beginning, John L Girard manufactured rubber hose assemblies for the local tank market in and around Rahway, N.J. In 2003 after 38 years in the Rahway facility, the company moved to a new location in Linden, N.J., in the heart of the petrochemical industry in the Northeast. In 2009, Girard relocated the entire company to Florida. By then the company was developing castings along with other products. In addition to selling parts, Girard offers an extensive valve re-manufacture and refurbishment service. Most of that work takes place at the company’s service center in Laporte, Texas, near Houston. With 3,500-square-feet of repair space, technicians at that facility can rebuild and recondition all Girard-manufactured equipment. The center is located on Highway 146 north of LaPorte. For a long time, Girard focused its products on the petroleum and chemical industries. But because those industries routinely suffer downturns, the company saw a need to diversify into other areas, including the rail tank, IBC, tank container, vacuum tanks, and food- grade transport markets. The railroad industry is proving to be a rich territory for expansion, Girard said. The company is manufacturing pressure relief devices for major railroads, including CSX, GATX, Union Pacific and BNSF. Most notably tank car manufacturers such as Trinity Rail, Union Tank Car and Greenbrier have been working closely with Girard. In addition, Girard Equipment supplies valves to companies serving the railroad equipment leasing and repair industry such as GATX. “Our Teflon-Coated Pressure Relief Valves are one of our most popular products for railroad companies who transport corrosive ladings. The building itself is designed to withstand a Category 5 hurricane and has 3 stages of backup power to ensure we stay functioning in adverse weather conditions and to keep up with the demand for our products right now and well into the future. Girard generates its own electric power at this facility from the casting process. “Investment casting requires a lot of natural gas,’’ Girard said. “The generator we installed will produce most of our power needs from the 5-inch gas line. The production of electricity is not derived from burning or combustion within the generator. The pressure in the gas line moves the pistons in the linear generator to produce ample amounts of electricity for our current and ever-growing demand.’’ An additional draw for the company was an international airport under construction directly across the street from the plant. Vero Beach Regional Airport will become Vero Beach International Airport by next spring when the US Customs facility is finished near the end of this year. Asked about the effects of the pandemic on his business, Girard said, “The pandemic hurt us a little bit. But when the pandemic began, our industry was starting to slow a bit anyway. However, we were not hurt as much as others because we own our own foundry and molds – a process that allows us to manufacture and store our own stainless steel used for our castings. Also, we tend to have long contracts with our customers.’’ Girard has always prioritized a manufacturing process that is both lean and technologically advanced, Girard said. “The introduction of highly sophisticated CNC machinery, capable of machining our valve components to exact tolerances with consistency, was a direct enhancement to our product line,’’ Girard said. “We will continue to invest in the most accurate manufacturing technologies, and this is a testament to our dedication to product superiority. According to FMCSA, coercion occurs when a motor carrier, shipper, receiver or transportation intermediary “threatens to withhold work from, take employment action against, or punish a driver for refusing to operate in violation of certain provisions of the Federal Motor Carrier Safety Regulations (FMCSRs), Hazardous Materials Regulations (HMRs), and the Federal Motor Carrier Commercial Regulations (FMCCRs).” The agency adopted the coercion rule in 2016 to address the problem by prohibiting employers, shippers and others from coercing drivers to violate hours-of-service limits, which FMCSA may categorize as an ELD coercion, a rule that went into effect in late 2017. Other areas subject to coercion are CDL regulations and drug and alcohol testing rules. The rule also authorizes FMCSA to issue penalties against companies that have coerced drivers. From FMCSA’s perspective, coercion exists when the following has occurred: • A motor carrier, shipper, receiver or transportation intermediary requests a driver to perform a task that would result in the driver violating certain provisions of the FMCSRs, HMRs or FMCCRs. • The driver informs the motor carrier, shipper, receiver or transportation intermediary of the violation that would occur if the task is performed, such as driving over the hours of service limits or creating unsafe driving conditions. • The motor carrier shipper, receiver or transportation intermediary makes a threat or takes action against the driver’s employment or work opportunities to get the driver to take the load despite the regulatory violation that would occur. 1. Fatigue factor The issue of truck driver coercion was highlighted by U.S. Rep. Tom Malinowski (D-N.J), at an April hearing on the National Transportation Safety Board’s 2023 budget request. prices, fuel-charging infrastructure development, equipment prices, products and technological developments, and regulatory changes. Natural gas truck sales data and a forecast for new natural gas adoption are included. “Sales of natural gas-powered vehicles as reported by the six major truck manufacturers, who account for about 60 percent of the heavy- duty natural gas market, were mixed in the December to February time period, with December and January experiencing strong year-over- year gains, but February lagging considerably,” said Steve Tam, vice president of ACT Research. “In the near term, December’s sales easily outshone January and February’s activity, which paled in comparison. Combined, sales in the three-month period extended and increased year-to-date gains meaningfully, a relatively new development.” Tam added: “Besides sales, the Alternative Fuels Quarterly analyzes the change in existing and planned alternative fuel/power infrastructure and equipment developments. We’re seeing an overall increase in electric charging stations, both existing and planned, but a continuing decline of total natural gas stations, particularly those planned for the future. That said, we still see articles about natural gas use in transportation, as well as discussions about hydrogen fuel cells and investments, but the overwhelming amount of trade-industry headlines continue to focus on electric commercial vehicle development.” A 30-day period for public comments and data regarding the adjustment or reprogramming of ECUs will begin after the FMCSA notice is published in the Federal Register, which is expected this week. 1. Truck speeds on Biden administration radar The National Roadway Safety Strategy unveiled in January by the U.S. Department of Transportation cited speed as a significant factor in fatal crashes and the use of speed management to help reduce serious injuries and fatalities. The National Transportation Safety Board listed speed limiters on its Most Wanted list in 2021. The number of commercial motor vehicle (CMV) crashes in which speed is listed as a contributing factor is unacceptable,” FMCSA said. “A carrier-based approach could provide the opportunity to compel fleets that are not currently using speed limiters to slow down their CMVs within a relatively short period.” Federal regulators considered both a carrier and truck manufacturer-based approach to speed limiters in 2016, when FMCSA and the National Highway Traffic Safety Administration jointly proposed a speed limiter rule. NHTSA had proposed a new Federal Motor Vehicle Safety Standard (FMVSS) requiring each vehicle with a gross vehicle weight rating of more than 26,000 pounds – as manufactured and sold – to have its device set so as not to go over a specified speed and equipped with a way to read the truck’s current and two previous speed settings. FMCSA had proposed a similar complementary regulation, including the requirement that carriers maintain the devices for the life of the truck. The two agencies had planned an updated joint rule, according to an agenda posted earlier this year. But FMCSA changed course and will instead move on separate carrier- based speed limiter rule-making. “FMCSA believes that placing the requirement on motor carriers will ensure compliance with the rule and potentially avoid confusion on who is responsible,” according to the notice. “FMCSA will continue to consult with NHTSA during the development of this rule. If necessary, NHTSA will evaluate the need for additional regulatory actions concerning CMV manufacturer requirements to address issues raised during implementation that are beyond the scope of FMCSA’s authority.” Comments to the 2016 joint proposal revealed that ECUs have been installed in most heavy trucks since 1999, with some manufacturers continuing to install mechanical (as opposed to electronic) controls through 2003. “Based on this background, it is likely the required means of achieving compliance with a speed limiter requirement would be to use the ECU to govern the speed of the vehicle rather than installing a mechanical means of doing so,” the April notice said. FMCSA plans to use the comments submitted to its notice of intent, including responses to a list of 12 questions, to inform the SNPRM. 2. Industry mixed on FMCSA plan Chris Spear, president ot American Trucking Associations, said he welcomes the FMCSA’s updated plan for a speed limiter rule. “We intend to thoroughly review FMCSA’s proposal, and we look forward to working with the agency to shape a final rule that is consistent with our policy supporting the use of speed limiters in conjunction with numerous other safety technologies,” Spear said. The Owner-Operator Independent Drivers Association opposes mandating speed limiters, however, contending it would lead to increased interactions between trucks and passenger cars, thereby decreasing safety. Biden selects woman to lead FMCSA President Biden wants to make Robin Hutcheson leader of the Federal Motor Carrier Safety Administation (FMCSA), the White House announced April 6. Hutcheson, the current deputy administrator, has served as the acting chief of the trucking industry regulator since January. A former Minneapolis director of public works, Hutcheson was instrumental in Biden’s bipartisan Infrastructure Investment and Jobs Act – which Biden signed into law in November – while serving as a deputy assistant transportation secretary, according to the White House. She is FMCSA’s fourth consecutive acting administrator. Biden’s previous nominee and acting FMCSA administrator, drivers need and deserve fair leasing agreements, and this work will help ensure that leasing is above board.” Working with the U.S. Department of Transportation and the Department of Labor, the task force also is part of the White House’s long- term Trucking Action Plan, which wants the government to discuss best practices for future commercial vehicle lease agreements. The agency wants the group to include up to 10 people representing labor organizations, motor carriers, consumer protection groups, legal professionals, owner-operators, and other relevant businesses. FMCSA said it encourages “diverse, nontraditional representatives, especially women and people of color, to apply to serve on the task force.” More details on qualifications and how to apply can be found at the FMCSA website. On April 25, at its 2022 Annual Conference and Exhibits in San Diego, Calif., NTTC honored eight finalists for the Professional Tank Truck Driver of the Year and announced Frain as Grand Champion, awarding him the William A. Usher, Sr. trophy. Frain has more than 30 years of professional driving experience and has served as tank-truck driver for Highway Transport, a leader in bulk chemical transportation, for seven years. Tips for effective waste pumping Every day pumper operators pull hoses, connect fittings and pump tanks. Handling hoses and fittings quickly become second nature to the operator. These tools they use each day are the factors that make each pumping job a joy or a headache. Here are some considerations to make these daily tasks run more smoothly. The position of the hose hooks on a tank will make a big difference in the ergonomics of the daily routine. Tank manufacturers set up their trucks differently with some tanks having very high hooks. Operators may consider having the hooks lowered to make handling hoses more ergonomically friendly. This will also decrease time at the job site and offer a safer environment for the operator and other employees. Cleanliness of hoses is an important consideration. Cleaning hoses at every job site usually only involves a fresh water tank on the truck or a borrowed garden hose from a customer. Clean hoses are easier to handle and will prevent waste leakage from site to site. Camlock fittings should also be cleaned to allow for proper function and ease of attachment. Camlock fittings will eventually wear out and need to be replaced. The stiff hoses usually make this a challenge and demand a lot of effort. There are various ideas for the best way to put on a new fitting – some of which can be very dangerous. The right hose clamping mechanism can force a new fitting on with ease. Tools like this can take a lot of frustration out of these common duties. Pumpers should make sure to replace their hoses and fittings when they begin to show signs of wear. High- pressure equipment cannot be trusted when it is worn out and will place operators in unnecessary danger. There are a variety of options when shopping for new hoses and fittings. Stainless steel fittings are more expensive up front but will last longer and need to be replaced less frequently. To sum it up, operators should handle their hoses and fittings often enough to consider small ways to make their day run more smoothly. Ergonomics, safety and efficiency will all pay off in the long run. U.S. Steel opening Arkansas plant United States Steel Corp. broke ground in Osceola, Ark., on the company’s next-generation steel mill. The $3 billion steel-making facility will be the most advanced in North America and largest private project in the history of Arkansas, the company said in a release. “Several years ago, we embarked on a transformative vision for U. S. Steel,” said David Burritt, president and chief executive of U. S. Steel. “This facility is engineered to bring together the most advanced technology, to create the steel mill of the future that delivers profitable sustainable solutions for our customers.’’ The plant will be adjacent to U. S. Steel’s Big River Steel. Together, the two facilities will be known as Big River Steel Works. The new plant is expected to bring 900 plant jobs to the area, along with thousands of construction jobs, according to U.S. Steel. “Last month, we announced that U. S. Steel would build a new state- of-the-art mill in Osceola,” Arkansas Governor Asa Hutchinson said. “We are excited to break ground on the project. Once it is finished, it will be the largest single project investment in the state’s history. This is a great opportunity for Arkansas.” The steel production facility is expected to feature two electric arc furnaces (EAFs) with 3 million tons per year of advanced steel- making capability, a “state-of-the-art endless casting and rolling line, and advanced finishing capabilities.’’ “It is with great pride that we break ground on U. S. Steel’s latest endeavor in Arkansas,” Arkansas Secretary of Commerce Mike Preston said. “Once this mill reaches full production, Mississippi County will be the largest steel-producing county in the nation.’’ Project completion and full operation is anticipated by 2024. MAC Trailer acquires Bullet MAC Trailer Enterprises recently expanded its aluminum dump trailer product line with the purchase of Bullet Trailer. This facility now is formally MAC Bullet Manufacturing, currently located at 410 Factory Road in Sunnyside, Wash. The $2 million expansion includes 3.92 acres, an almost 25,000-square-foot leased facility and office space, all necessary equipment, and the registered trademark (No. 1,622,364) for Bullet Trailer. “This expansion is a crucial move toward continued growth in the western region,” said Bill McKenzie, president of sales for MAC Trailer Enterprises. “The Bullet (Bullet Trailer) will complement our already diversified dump trailer applications. Rick Lusby Rand McNally acquires Fleetsu Rand McNally, in a move to elevate its place in the connected vehicle space, has acquired Australia-based Fleetsu and its flexible platform, according to a joint announcement. The transaction combines Rand McNally’s fleet business with Fleetsu’s platform, data and analytics capabilities to create a global enterprise that will bring innovative solutions to vehicle fleets worldwide, the companies said. The new combined Rand McNally helps fleet operators maximize business productivity through access to real-time, on-the-road data –providing insights to solve challenges such as driver location and safety, engine performance, and vehicle efficiency (fossil and electric), they said. Fleetsu was just a seven-year-old company but had secured a number of global truck and automotive manufacturing contracts, including Toyota Motor Corp. of Australia as its platform. (Complaints of coercion continued from page 13) During the hearing, Malinowski raised concerns on how coercion of drivers by management – particularly when drivers are pressured by dispatchers to stay on the road without enough rest – contributes to the difficulty trucking companies are having trying to fill cab seats. “There are many reasons for the driver shortage – high turnover, low pay,” Malinowski told National Transportation Safety Board Chair Jennifer Homendy. “Treatment of drivers by management is one of the reasons that doesn’t get enough attention – specifically demands put on some of them to continue to drive when they’re too tired to drive safely.” To illustrate his point, Malinowski replayed part of a recent episode of comedian John Oliver’s HBO show “Last Week Tonight” on conditions affecting truck drivers showing a dispatcher threatening to dock a driver’s pay if he failed to deliver a load – after the driver told him he was unsafe to drive because he was tired and needed rest. While the video in the segment replayed by Malinowski was made in 2014, the data from the FMCSA is evidence that the problem has only grown since then. “That’s one anecdote, but we know that NTSB has looked back at a sample of its major investigations across various modes of transportation and found that a full 20 percent of them identified fatigue as a major contributing factor to accidents,” Malinowski said. 2. Deadly consequences In response, Homendy acknowledged that fatigue among commercial truck drivers has been an NTSB safety concern that needs to be addressed. “We do have recommendations on hours of service and electronic logbooks,” she said. “We always look at hours of service as part of any investigation and have found significant concerns regarding scheduling and the impact of that scheduling on commercial drivers.” While reducing fatigue-related accidents in the trucking industry and other transportation modes has been featured frequently on NTSB’s “Most Wanted” list of safety concerns since the list was started in 1990, it did not make the most recent list published in April 2021. But coercion and its effect on exacerbating fatigue “is definitely still a problem,” said Thomas Corsi, academic director for supply chain management at the University of Maryland’s Robert H. Smith School of Business. “I serve as an expert witness on accident cases that overwhelmingly occur when drivers are working on not enough sleep and end up plowing into a car because they’re working way too many hours,’’ Corsi said. “They’re on very strict time commitments that a broker or a carrier made to a client, but there are huge safety implications. Lately, the freight transportation industry has become a focal point of Biden administration initiatives, including recent plans to boost truck driver job and strengthen supply chains. Hutcheson first joined the Biden administration as deputy assistant transportation secretary for safety policy. According to the White House, she coordinated its COVID-19 response and recovery. Her work on the infrastructure law focused on the new Safe Streets and Roads For All program. American Trucking Associations leader Chris Spear, issued a statement calling for Hutcheson’s “swift confirmation by the Senate.’’ Todd Spencer, president of the Owner-Operator Independent Drivers Association, noted Hutchesone has already “demonstrated a genuine appreciation for the work of our members and an eagerness to help address some of the issues that are most important to them.” Spencer encouraged the Senate to confirm her as FMCSA’s administrator. Before coming to Washington, Hutcheson was public works director in Minneapolis, Minn., overseeing a staff of 1,100 people across nine divisions that included fleet management, drinking water, surface waters and sewers, solid waste, and recycling. She also was a transportation director in Salt Lake City, Utah.
