The bill, which has been generally lauded by the American Trucking Associations (ATA) and the International Brotherhood of Teamsters, also suspends changes made to drivers’ hours-of-service (HOS) rules and includes additional measures – as well as funding – to address motor carrier safety. House Committee on Transportation and Infrastructure chairman Peter DeFazio (D-OR) released text of the Investing in a New Vision for the Environment and Surface Transportation in America (INVEST in America) Act, a key component of the Moving Forward Framework that House Democrats released earlier this year. “The bulk of our nation’s infrastructure – our roads, bridges, public transit and Amazon rolls out freight brokerage Amazon last month rolled out its freight brokerage operation nationwide, a strategic move that not only brings the company into competition with other large digital brokerages like Uber Freight and Convoy, but also is intended to give the company leverage over its retailer and shipper rivals during peak shipping seasons, company officials said. Amazon confirmed it has expanded its brokerage arm to the entire lower 48 states, coming roughly 18 months after the online retail giant launched a small pilot program of its brokerage in five Northeast states. The company has opened up its freight.amazon.com portal to more shippers and is trying to lock in capacity from small and mid-sized fleets. Unlike Uber Freight and Convoy, however, Amazon isn’t just selling service as a freight-matcher that connects shippers to carriers. Rather, the company’s broader goal is to build a nationwide network of trucking capacity that it can use to its own advantage as a mega-shipper itself. Oil patch bankruptcies spike Oil and gas bankruptcies spiked from April to June, reaching their highest level in a quarter since the 2016 oil crash, according to a new report. The analysis from law firm Haynes and Boone LLP in July said the filings from 18 companies represent a combined total of $29 billion in debt. By comparison, only five companies declared bankruptcy in the first quarter of this year. In the last week of June alone, three companies made filings, including shale giant Chesapeake Energy Corp., said Kraig Grahmann, chair of the energy and finance practice group at Haynes and Boone. “We definitely expect it to keep picking up over the course of the year,” Grahmann said. As with other oil and gas companies, FMCSA relaxing driver drug tests For carriers having trouble keeping up with truck driver drug screenings amid the COVID- 19 pandemic, the Federal Motor Carrier Safety Administration (FMCSA) said recently it will attempt to use discretion in enforcing the 2020 requirement that fleets issue random drug tests for 50 percent of their drivers. The move, the latest from the agency in granting some leniency to carriers regarding driver drug testing due to the COVID-19 outbreak, highlights an ongoing challenge facing fleets on the drug testing front: Because of the global health and economic crises that have stymied many pre-employment drug tests and impeded random testing, drug screening providers are struggling to stay afloat financially. rail systems, the things that hundreds of millions of American families and businesses rely on every single day – is not only badly outdated, in many places it’s downright dangerous and holding our economy back. Yet for decades, Congress has repeatedly ignored the calls for an overhaul and instead simply poured money into short-term patches,” DeFazio said. “The result? We’re still running our economy on an inefficient, 1950s-era system that costs Americans increasingly more time and money while making the transportation sector the nation’s biggest source of carbon pollution. “That all changes with the INVEST in America Act. The INVEST in America Act is our opportunity to replace the outdated systems of the past with smarter, safer, more resilient infrastructure that fits the economy of the future, creates millions of jobs, supports American manufacturing, and restores US competitiveness.” 1. Under-ride provisions Included in the Motor Carrier Safety portion of the INVEST Act, the under-ride protection section – incorporating stand-alone legislation introduced a year ago – calls for new trailer standards to be revised to include rear impact guards that are designed “to prevent passenger compartment intrusion” when a passenger vehicle traveling at 35 miles per hour (mph) makes: • an impact in which the passenger vehicle impacts the center of the rear of the trailer or semi-trailer; • an impact in which 50 percent of the width of the passenger vehicle overlaps the rear of the trailer or semi-trailer; and • an impact in which 30 percent of the width of the passenger vehicle overlaps the rear of the trailer or semi-trailer. The bill would require “full compliance” no later than two years after the date on which a final rule is issued. Additionally, the section calls for additional research on the design and development of rear impact guards that can prevent under-ride crashes and protect motor vehicle passengers against severe injury at crash speeds of up to 65 miles per hour. “The market control narrative is still in place,” said Carson Krieg, co-founder of Convey, a tech firm that helps retailers with logistics and supply chain processes. Amazon has recently pivoted its own logistics and shipping strategy to focus more on longer haul, middle-mile segments rather than focusing on the last-mile, parcel delivery segment, he said. “They want to own that market,” Krieg said. “They want to gather up capacity so they can dictate middle- mile rates.” Building a network large enough to be able to dictate rates as a brokerage operator not only will help Amazon control its own shipping costs, but it could give the company the ability to squeeze its retail competitors on costs and delivery timing, Krieg said. Given the volume of its own shipping needs, Amazon doesn’t need to turn a profit, necessarily, in the brokerage operation to make it valuable to the company as a whole. “With its built-in book of business,” Krieg said, from its own freight and its third-party partners, “Amazon is positioned to do more than just take a cut of matching a shipper and a carrier.” Amazon intends to be more transparent with shippers and carriers in its pricing, said Krieg, who contends that Amazon can offer cheaper rates to shippers while maintaining market- dictated rates (or better) for carriers – a method that would help the company lock in parties on both sides of the freight transaction. That strategy could undercut traditional freight brokers, though Amazon last May said any price undercutting is not part of its strategy. “Analysis suggesting dramatic undercutting of pricing is false,” the company said. “We work with many line-haul service providers in our transportation network and have long utilized them to carry loads for Amazon. This service is intended to better utilize our freight network.” Likewise, market conditions and relationships will still likely dictate much of the brokerage segment, said Geoff Turner, chief executive of Choptank, a 400-person brokerage based in Preston, Md. For instance, when Amazon experiences a surge in shipping demand during holiday seasons and other peak periods, other shippers usually do, too. “If a shipper can’t access Amazon’s capacity, obviously they’re going to go source it somewhere else,” Turner said. Brokers forge relationships with their shippers “over many years and many different cycles in the freight economy,” he said. “If a new player comes in and says, ‘hey, we can do it for cheaper,’ it can raise a red flag. Service is so important, especially for larger shippers.” And like other tech firms, Amazon likely can only operate its brokerage at a loss as a near-term strategy, especially given that supply and demand (truck capacity and freight movement) dictate pricing for trucking services, Turner said. “At some point it has to revert to some sort of profitability or it just doesn’t make sense,” he added. Court halts Keystone XL pipeline In the third major blow to oil pipelines, the U.S. Supreme Court ordered in July that construction of the long-delayed and once-resurrected Keystone XL project cannot begin. The Supreme Court’s ruling came a day after Dominion Energy and Duke Energy canceled the Atlantic Coast natural gas pipeline project and on the day on which a court-ordered Dakota Access pipeline shut. The justices at the Supreme Court upheld a lower court ruling that the Keystone XL pipeline project cannot use the so-called Nationwide Permit 12 that allowed pipelines to cross rivers with minimal review if they meet certain criteria. The Supreme Court, however, allowed other pipeline projects to return to use that permit aimed at fast-tracking construction of vital oil and gas infrastructure. In April, a Montana judge had canceled the vital permit for the controversial Keystone XL oil pipeline, concluding that the U.S. Army Corps of Engineers failed to consider the effects of the pipeline on one fish species present in rivers that the route of the Keystone XL would cross. The Trump Administration in June asked the Supreme Court to vacate the lower court’s ruling on blocking the nationwide permit. The justices on Monday cleared other pipelines to use the permit, but not Keystone XL. While the ruling is generally favorable overall for other pipeline projects, it could doom the Keystone XL project that was designed to carry crude oil from Alberta in Canada to the United States. The Supreme Court’s ruling is likely to delay the start of potential construction into 2021, TC Energy said in court filings. “TC Energy remains committed to the future of this project,” the company developing Keystone XL said in a statement. “Today’s ruling makes clear that the builders of Keystone XL can’t rely on a flawed, rubber- stamped permit to force the project’s construction through our wetlands, streams and rivers,” Cecilia Segal, an attorney at the Natural Resources Defense Council (NRDC), said in a joint statement of environmentalist groups. Brightoil Petroleum ‘back in business’ Brightoil Petroleum (Holdings) Limited said last month it is now “back in business,’’ having reached a settlement with the Vietnam-based trader Petrolimex which initiated a bankruptcy order against Brightoil over a $30 million debt. In a statement sent to Bunkerspot, Brightoil said that the “satisfactory resolution to the debts settlement’’ will lead to a resolution of the bankruptcy status of the company’s founder, Dr Sit Kwong Lam. Brightoil also reported that it has entered into loan restructuring agreements with Bank of China Limited and China Huarong Overseas Investment Holding Co Ltd. According to Brightoil, “China Huarong Overseas Investment Holding Co Ltd, had invested about $362 million in re-financing for a period of five to 12 years in 2019 to acquire some of the Company’s liabilities. A further $30 million in loan financing to support the company’s operation and repayment of outstanding debts was rendered on May 19. This provided “strong’’ support for the company’s debt restructuring and operations during the epidemic,’’ the company said. As previously reported by Bunkerspot, trading in Brightoil shares has been suspended on the Hong Kong Stock Exchange and Brightoil’s 15-strong fleet of vessels was sold at auction to meet debts. Brightoil Petroleum Holdings Ltd, formerly First Sign International Holdings Ltd, is an investment holding company principally engaged in the oil and gas exploration, development, production and distribution. The company operates its business through four segments. The international trading and bunkering operation segment engages in the international supply of petroleum products and provision of marine bunkering and related services to international vessels. The upstream natural gas business segment engages in the natural gas development, production and sales operation. The marine transportation operation segment engages in the provision of marine transportation services of fuel oil or crude oil. The upstream crude oil business segment engages in the crude oil development, production and sales operation. The company also engages in the oil storage and terminal facilities as well as e-commerce business. (from wire reports) NEW PRODUCTS - MANUFACTURING - INDUSTRY NEWS Nikola, Ryder end partnership Nikola and Ryder have mutually agreed to end their exclusive partnership on Nikola’s hydrogen-electric Class 8 trucks, allowing Nikola to work with major truck dealerships to sell and service Nikola trucks. According to a news release, this means both companies will be able to explore emerging opportunities within the rapidly growing commercial transportation industry. “Nikola and Ryder view this decision positively and are both now open to business arrangements with other partners as the industry continues to evolve,” said the announcement. In December 2016, at the same time it unveiled its electric Class 8 tractor, Nikola announced a strategic partnership with Ryder. A little over a year ago, Nikola was touting its different ownership model that was made possible through its partnership, a leasing model that promises to roll truck payments, full-service maintenance, and the fuel cost itself into a single price. “Ryder has been incredible to work with and they have been with us since late 2016,’’ said Trevor Milton, founder and chief executive of Nikola. “As the market evolves, each of us are now free to expand our operations to other partners, something the previous agreement did not allow us to do. We look forward to finding ways to continue to work with Ryder in the future as a customer and have found them to be a great partner. “We will now be working with major truck dealerships to sell and service Nikola trucks. This is incredible news and I believe will create a great cash flow and backlog of Nikola trucks on order.’’ The move coincides with Nikola’s acquisition by VectoIQ Acquisition Corp., a deal that will create a new publicly traded company named Nikola Corp. After the Nikola Motors Merger is complete, the new ticker symbol will be “NKLA.’’ In its March announcement of the acquisition deal, which is widely expected to become a reality, Nikola executives said moves such as its deal in Europe with Iveco and the introduction of the Badger pickup truck, combined with the funding made available with the merger, will help it ramp up production of its battery-electric truck next year and its fuel-cell electric truck in 2023. Nikola has projected 12,000 unit sales in 2024, according to published reports. Polar opens 2 service centers Polar Service Centers (PSC), the nation’s largest network of commercial parts and repair facilities dedicated to the tank trailer and tank truck industry, announced it has opened new facilities in El Paso, Texas, and Bakersfield, Calif. This brings the total number of Polar Service Centers to 30. “We are excited to continue expanding our network with these two new locations so we can serve our customers with parts and repair services,” said Jerry Cignarella, president. Opened June 1, the Bakersfield facility is located at 34915 Gazelle Court. It has six full-service bays and is equipped to provide a range of services and parts, including hydraulics, pumps and compressors, blowers, hoses and fittings. The legislation likewise supports research to better understand the effectiveness of side under-ride guards and to develop performance standards. Finally, the bill would require the Secretary of Transportation to establish an Advisory Committee on under-ride protection “to provide advice and recommendations” to the Secretary on safety regulations to reduce crashes and fatalities involving truck under-rides. Committee membership would include two representatives of each of the following: 1. Truck and trailer manufacturers 2. Motor carriers, including independent owner- operators 3. Law enforcement 4. Motor vehicle engineers 5. Motor vehicle crash investigators 6. Truck safety organizations 7. The insurance industry 8. Emergency medical service providers 9. Families of under-ride crash victims; and 10. Labor organizations. 2. Trailer length standards Regarding trailers, the Americans for Modern Transportation – a coalition of major shippers and logistics companies – sees the House infrastructure framework as an opportunity to consider “modernizing outdated regulations” and to increase the national twin trailer standard from 28 feet to 33 feet. “This sensible solution will provide meaningful environmental benefits that policymakers can act on today to make trucking safer, more efficient and less taxing on the roadways,” said Randy Mullett, AMT’s executive director. “This solution comes at no cost to the American taxpayer and is already a proven success in 20 states. It is more efficient and less taxing on the roadways. “Now is the time to update this nearly 40-year old federal standard as the U.S. Department of Transportation only expects freight volumes to increase. Most companies with high levels of debt are likely to require restructuring through bankruptcy courts in the coming months and years, Grahmann said. In the second quarter, the majority of oil and gas bankruptcies were filed in the U.S. District Court for the Southern District of Texas in Houston, a major hub for U.S. oil headquarters, according to the report. “Most of the companies filing have a venue basis for being in Houston, and they sort of like the predictability of those judges. They have a better feel for how they’re going to roll and what that venue is going to be like,” Grahmann said. Oil demand plunged earlier this year as U.S. states and countries around the world instituted stay-at- home orders and travel restrictions, causing the price of oil to fall to nearly $20 per barrel in April. While the price of oil is now hovering around $40 per barrel, that is still too low for many shale companies to continue producing, Haynes and Boone said. In addition, even though oil demand has picked up slightly, that is unlikely to continue given that the number of new COVID-19 cases in the United States and some other countries has climbed in recent weeks, the Houston-based firm said. “Until full economic activity returns and consumer confidence that the worst of the pandemic is behind us, demand levels will not pull up prices,” the report said. “Lower for longer remains the watchword for producers and their creditors.” A separate report in July from the International Energy Agency (IEA), however, estimates that the pandemic’s most devastating impacts on oil demand have already happened. The agency found that declines in global oil demand in the second quarter were “less severe than expected” and that demand will be higher on average in the second half of the year. With driver hiring stalled in March, April and into May, “that’s a big chunk of business” to have lost, Easler said. Even if a facility is open, it’s tough to know whether it is adhering to best practices to prevent virus transmission, he added, and thus not putting drivers at potential risk. Easler recommended that fleets consider steps to move driver drug testing in-house, instead of outsourcing. “The most important thing for randoms is scheduling ahead of time,” said Luke Kibby, director of marketing at Compliance Navigation Specialists. Some collection sites have stopped accepting walk-ins all together, he said, whether for random testing or pre-employment screenings. CNS’ network of around 5,000 collection sites hasn’t seen any closures, though Kibby said he’s heard it has been an issue industry-wide. In regards to FMCSA’s leniency in enforcement, carriers should ensure they document any issues with their ability to comply with random drug screenings, Kibby said. “FMCSA is providing that flexibility if you can prove you’re unable to meet the random testing requirement,” he said. That leniency will last through the end of the year, and the agency is considering extending it into 2021, Kibby said. In addition to the waiver announced in July, FMCSA said it will allow carriers to skip pre- employment drug tests for drivers returning to work after being furloughed or laid off, so long as they were in a drug testing program within the prior 90 days. States form emissions initiative Fifteen states and the District of Columbia have signed an agreement pledging to develop a plan to eliminate diesel emissions by 2050. The states agreed to work collaboratively to advance and accelerate the market for electric medium and heavy-duty vehicles, including large pickup trucks and vans, delivery trucks, box trucks, school and transit buses, and long- haul heavy-duty trucks. The goal is for 100 percent of all new medium and heavy-duty vehicle sales to be zero-emission vehicles by 2050, with an interim target of 30 percent zero-emission vehicle sales by 2030. The memorandum of understanding (MOU) was signed July 14 by California, Connecticut, Colorado, Hawaii, Maine, Maryland, Massachusetts, New Jersey, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, and Washington, plus the District of Columbia. The signatory jurisdictions will work through the existing multi-state ZEV Task Force facilitated by the Northeast States for Coordinated Air Use Management to develop and implement a ZEV action plan for trucks and buses. Within six months, the MOU calls for the task force to develop a multi- state action plan to identify barriers and propose solutions to support widespread electrification of medium and heavy-duty vehicles. In July 37 businesses and investors – including major fleet operators such as DHL, IKEA North American Services, PepsiCo, and Unilever – sent a statement of support to the 15 state governors and the mayor of D.C.
