The lightweight design of Polar trailers means operators can haul more payload, which translates into greater revenue per load. In addition to collaborating with customers on the design of its trailers, Polar invites them to take part in the quality process from the very beginning of trailer production to the end. Customers can choose to complete a 3D engineering model review before their trailer is built. During this inspection, the Polar Regional Sales Manager and product engineers will review the 3D CAD drawing of the trailer and its list of specifications. Feds again extend HOS rules Federal regulators issued a fourth extension of a rare 50-state exemption of hours-of-service (HOS) rules due to ongoing health risks caused by COVID-19. The Federal Motor Carrier Safety Administration (FMCSA) announced in February it was extending the HOS waiver – which was set to expire Feb. 28 – through May 31. The national exemption to the HOS rules for truckers and carriers hauling COVID-19 relief was first issued on March 12, 2020 in response to the national emergency declared by President Donald Trump. It was set to expire a month later, but the rapidly spreading pandemic has warranted several extensions and expansions. Prior to the February rulling, the most recent extension issued on Dec. 1 was expanded to include carriers transporting COVID-19 vaccines. “This extension of the expanded modified emergency declaration addresses national emergency conditions that create a need for immediate transportation of essential supplies and provides necessary relief from the safety regulations for motor carriers and drivers,” the latest order stated. The order applies to commercial motor vehicle operations that provide direct assistance supporting relief efforts related to the pandemic. It covers parts 390 to 399 of the federal motor carrier regulations for the 50 states and District of Columbia. In addition to HOS, the regulations also apply to inspection and maintenance of commercial vehicles, employee safety and parking rules, among others. The waiver is limited to hauling. refining overcapacity,’’ IEA said in its monthly report. In 2019, global crude refining capacity stood at 102 million bpd, catering for 84 million bpd of refined oil products demand. That shrank to 76 million bpd in 2020 and is expected to be 80 million bpd in 2021, IEA said. Last month, Royal Dutch Shell said it would halve crude processing capacity and cut jobs at its 500,000-bpd Pulau Bukom oil refinery in Singapore. In Europe, Petroineos plans to mothball nearly half of its 200,000 bpd refinery at Grangemouth in Scotland, and Gunvor will shutter its 110,000 bpd Antwerp oil refinery in Belgium. The outlook for refining remains mixed, with traditionally low-value naptha and fuel oil possible bright spots in the new year, Vitol chief executive Russell Hardy told the Reuters Commodity Trading Summit. He said the 1.6 to 1.7 million bpd of capacity closures already announced to take place by the end of this year to early next year could grow by a further 1 million bpd. Plateauing fuel demand, tightening environmental rules and overseas competition have prompted several European and U.S. refiners to opt for converting plants to produce biofuels. Last year saw carrier surge, data show As freight volumes have risen over time, the U.S. also has seen a steady increase in the number of new for- hire trucking companies authorized each year. Over the past 20 years, the upward trend has paused only a couple of times – during the Great Recession, and in 2019 as the hot 2017-2018 market gave way to falling spot rates just as truck insurance premiums were rising sharply. Although the industry has seen some remarkable year-over-year increases in new entry – 2004 and 2018, for example – nothing compares to 2020, data show. The Federal Motor Carrier Safety Administration granted common authority to nearly 58,000 motor carriers of property, a 36 percent increase over 2019. Nor was 2019 a weak year for new authority, as it just barely fell below the previous record year of 2018. The 2020 surge in new authority was concentrated in the second half of the year. Each month from July through December saw more new carriers authorized than any (Polar Stainless continued from page 1) (EnTrans continued from page 1) (Refinery closings continued from page 1) Cold snap roiled gas market The February cold snap that pushed liquefied natural gas (LNG) prices to record highs is also roiling liquid petroleum gas (LPG), leading to shortages of the gas that’s used for heating and cooking as well as being a feedstock for petrochemical plants. Frigid weather is spurring a rush for liquefied petroleum gas, which is used to heat homes and can also be blended with LNG to generate electricity. That’s on top of a longer- term increase in demand due to several new petrochemical plants in Asia. Saudi Arabia’s move to cut crude output, meanwhile, is set to reduce supplies of LPG, a byproduct of oil production and refining. South Korean and Japanese buyers are scrambling for the gas. Spot prices for propane, a type of LPG, were as high as $37 a ton over the Asian benchmark for late- February delivery, compared with a $10 premium for late-December, according to two traders. The dearth of LPG is causing headaches for owners of propane dehydrogenation (or PDH) plants that process it into propylene, which is in turn used to make plastics for everything from surgical masks to car interiors. It’s also exacerbating a supply squeeze for naphtha, another feedstock for plastics. The spiking LPG prices may weigh on government finances in India, where it’s commonly used as a cooking fuel and is heavily subsidized. “The market is looking pretty short,” said Thomas Olney, global head of natural gas liquids at FGE. There will be at least 150,000 tons per month less supply from the Saudis in February and March, he said, adding that things should calm down once winter requirements in the U.S. and Asia ease from March and April. The rising feedstock costs are driving down margins at PDH facilities and causing them to cut operating rates. Profits from converting propane to propylene at Asian plants have dropped 37 percent since early December to a nine-month low. Utilization at these plants fell in December and was expected to drop further through February, Olney said. Asia’s net shortage of LPG was set to rise by 100,000 barrels per day this year to about 2 million barrels a day, according to Energy Aspects Ltd. A similar phenomenon is playing out in Europe, where propane is at a rare premium to alternative feedstock naphtha. European LPG supplies are being curbed by lower refinery runs, said Ciaran Tyler, an analyst at Energy Aspects. The U.S. is responding to the global shortage, exporting a record 2.68 million barrels a day of LPG in the first full week of January, according to BloombergNEF. Congestion at the Panama Canal, however, is forcing vessels to take longer journeys to Asia, exacerbating the supply squeeze in the region. Demand in the U.S. is soaring too, draining inventories there that are also being eroded by the flood of exports. The amount of propane and propylene supplied, a proxy for domestic consumption, surged to 2.1 million barrels a day in the week ended Jan. 8, by far the highest for the time of year since at least 2005, according to Energy Information Administration (EIA) data. The recent polar vortex, which caused extreme cold in the U.S., similar to the one in 2014, put a lot of strain on American LPG prices, FGE’s Olney said. Despite the shipping bottlenecks, Asia Pacific LPG imports are still likely to be around 2.75 million tons higher in the first quarter than a year earlier, according to FGE. “Asian propane prices should begin to ease as the weather warms in northeast Asia and as the congestion at the Panama Canal lets up,” said Tyler at Energy Aspects. Less supply from the Middle East will act as a support, however, preventing any dramatic crash in spot prices, he said. Traditionally the fuel tax supports the Highway Trust Fund. “There has been talk about increasing that in the past. However, that talk has somewhat waned because of the increase in conversation about electric vehicles – thus leading to a vehicle-miles traveled tax (VMT) discussion.” Tolling and public- private partnerships, which usually also involve tolling, are other options. Heller noted that the fuel tax is the least expensive option as far as administrative costs, allowing 99 percent of that tax to go to the trust fund. However, electric vehicles don’t pay fuel tax – even though they are highway users. NEW PRODUCTS – MANUFACTURING – INDUSTRY NEWS Nikola planning fuel cell cab-over Nikola plans to start building the first prototypes of its fuel cell electric cab-over truck in the second quarter with the goal of starting on-road trials in early 2022, the company said. In an update on its North American hydrogen fuel cell electric vehicle commercial truck program, the company said the fuel cell variant of the Nikola Tre cab-over will follow the launch of North American production of the Tre battery-electric truck. The Tre is based on a Euro-style high cab-over, the Iveco S-Way European cab-over tractor, unveiled in 2019 as the successor to the long-running Stralis model. Nikola partnered with Italian truck maker Iveco to gain the advantage of its manufacturing experience. The relationship will see Nikola’s battery-electric and hydrogen fuel cell technology sold in Europe in Iveco chassis under the Nikola badge. Following the FCEV version of the Tre, Nikola plans to launch the long-range Nikola Two FCEV Sleeper for ranges of 300 to 900 miles in the North American market, possibly as early as late 2024. The Nikola Tre FCEV Cabover is targeted for distances up to 500 miles. The company said it is expected to address the majority of the North American regional market, especially where additional freight hauling capacity and quick fueling are required by fleet operators that would make the battery-electric version less desirable. The Tre FCEV leverages the Tre BEV platform with hydrogen fuel- cell power, while being designed to improve aerodynamics and reduce total vehicle weight, according to the company. The first Tre FCEV prototype builds are scheduled to begin at Nikola’s facility in Coolidge, Ariz., and Iveco’s facility in Ulm, Germany in the second quarter. Testing and validation of the vehicles will continue into 2022, with production planned for the second half of 2023. The Nikola Two FCEV Sleeper is a long-haul freight solution with hydrogen capacity allowing a non-stop range of up to 900 miles, according to the company. The Nikola Two will leverage the weight advantage of hydrogen in long-range, long-haul zero-emission commercial transportation. It will be based on a new chassis custom designed for North American long-haul routes and is anticipated to launch in late 2024. Goodyear acquiring Cooper Tire Goodyear Tire and Rubber Co. has entered into a definitive transaction agreement to acquire Cooper Tire and Rubber Co. in a deal valued at about $2.8 billion. The transaction, subject to customary closing conditions, is expected to close in the second half of the year. The acquisition will expand Goodyear’s product offering by combining two portfolios of complementary brands. It will also create a stronger U.S.-based manufacturer with increased presence in distribution and retail channels while combining both companies’ strengths in the light truck and SUV product segments, Goodyear officials said in a press release. Copper’s company portfolio of brands includes Cooper, Mastercraft, Roadmaster and Mickey Thompson. “The addition of Cooper’s complementary tire product portfolio and highly capable manufacturing assets, coupled with Goodyear’s technology and industry leading distribution, provides the combined company with opportunities for improved cost efficiency. Also, a broader offering for both companies’ retailer networks,” said Richard Kramer, Goodyear chairman, chief executive officer and president After closing, the combined company will be headquartered in Akron, Ohio, but Goodyear expects to maintain a presence in Findlay, Ohio. The companies are preparing for integration focused on continuity of manufacturing, operations and customer service, company officials said. The combined company will have about $17.5 billion in pro forma 2019 sales. Under the terms of the transaction, Cooper shareholders will receive $41.75 per share in cash and a fixed exchange ratio of 0.907 shares of Goodyear common stock per Cooper share for a total equity value of about $2.8 billion. Based on Goodyear’s closing stock price on February 19, the last trading day prior to the announcement, the implied cash and stock consideration to be received by Cooper shareholders is $54.36 per share. Upon closing of the transaction, Goodyear shareholders will own about 84 percent of the combined company, and Cooper shareholders will own about 16 percent. Cummins announces executive changes Cummins announced three roles for senior executives in its engine business division. Effective this month, Amy Boerger will lead the North America region for On-Highway as vice president and general manager, North America. José Samperio is replacing Boerger in her previous leadership role of the field sales and support organization as executive director for sales in the U.S. and Canada. Also joining the North American region is Lyndon Jones, who replaces John Malina as the leader of the Leasing team. “In order to ensure we hit our goals in North America, we have made some executive changes, as the core of Cummins’ strength is our great regional leaders across the globe,” said Brett Merritt, vice president of the on-highway engine segment, in a news release. Boerger will lead a single organization for North America, encompassing the dealer, fleet and original equipment manufacturing (OEM) teams, Cummins said. She has spent 34 of her 37 years at Cummins in the North America on-highway space, in a variety of roles and organizations in sales and service, OEM and general management. “Amy is clearly recognized as the industry expert for Cummins, has long-standing relationships across all parts of the truck and bus businesses, and serves in a variety of leadership roles in the American trucking industry,’’ Merritt said. Samperio will report to Boerger and lead the “end-user sales and support team’’ for national accounts and help represent Cummins in the industry. Most of Samperio’s 20-year professional experience has been with Cummins, growing his career with increasing levels of responsibility in functions such as engineering and sales, and most recently serving as the strategy leader for the engine segment. He has held leadership roles in Beijing, China, and Sao Paulo, Brazil. Jones has been named general manager of leasing for North America, also reporting to Boerger. He will work with some of Cummins’ largest customers and will be responsible for the execution of the strategy of the leasing business. Jones has been with Cummins since 2005, serving mainly in leadership positions within the engine and distribution segments. New chief at FedEx John A. Smith, president and chief executive officer of FedEx Freight, will be named president and chief executive of FedEx Ground on June 1. Smith succeeds Henry Maier, who will remain at FedEx as an executive advisor until his retirement on July 31. Smith has more than 35 years of experience in the transportation industry and joined FedEx in 2000. He has served in several leadership positions, including senior vice president of operations at FedEx Freight. He became FedEx Freight president and chief executive in 2018. Under Smith’s leadership, FedEx Freight has implemented initiatives to help lead the less-than-truckload industry in technology, automation and differentiated solutions, FedEx officials said in a press release. Lance Moll, FedEx Freight’s current senior vice president of operations, was scheduled to take over Smith’s current post on March 1. Moll began his career at FedEx Freight in 1992. Last year’s INVEST in America Act, which was part of the larger Moving Forward Act), a partisan infrastructure bill passed by the House, contained the following measures that are likely to make their way into bills in the new Congress: • Truck parking • Automatic emergency braking • Raising minimum liability insurance • Strengthening rear underride guards • Researching side underride guards • Sleep apnea • Drug-alcohol impairment • Reviewing the new hours of service rules • Changes to FMCSA’s compliance, safety, accountability program 2. Hours of Service Many in trucking hailed the new more flexible hours of service rules that went into effect September 2020. While that rule does not fall under the purview of the Congressional Review Act, which allows a new Congress to nix rules that were made final in the last 60 days of the previous administration, that doesn’t mean it may not face scrutiny. Heller noted that safety advocacy groups have filed suit against those new rules, saying they were developed “arbitrarily and capriciously.” Heller said: “We’ve been down this road before in terms of litigating hours of service. What’s different now is that we’re operating under electronic logging devices. The rules you’re operating under were based on data collected from ELDs.” Two proposed pilot programs aimed at studying further flexibility provisions, however, could be derailed – one studying a three-hour pause of the 14-hour clock that was proposed last August, and one that would study splitting a driver’s rest time into 6-4 or 5-5-hour splits that was proposed only a week before Trump left office. 3. Labor and Independent Contractor Issues “Biden is very close to organized labor,” Heller said. The Teamsters union supports him. The Teamsters also have been waging a war against what it calls the misclassification of employees as independent contractors, especially at the nation’s intermodal ports. A Department of Labor rule that clarified the definition of independent contractor may end up a casualty of regulatory review process under the new administration. In fact, it was specifically cited by Biden transition team as an example of the “midnight regulations it would put on hold as soon as the new president took office. There’s also already an effort to get a law passed to apply an ABC test nationwide in determining who’s an independent contractor, similar to California’s controversial AB5 law, which made it next to impossible for a trucking company to use independent contractor drivers. The California law is currently not being enforced, pending a legal challenge that it interferes with interstate commerce, among other things. It’s possible that case could eventually go all the way to the U.S. Supreme Court. Heller noted that this comes at a time when the industry is facing a severe driver shortage. The number of over-the-road truckload drivers is at its lowest since 2012, he said. The COVID-19 pandemic has led some to take early retirement and slowed the output of new drivers from truck driver training schools, with CDL school enrollees down 40 percent to 60 percent. In addition, the federal drug and alcohol clearinghouse that went into effect last year has resulted in thousands of drivers leaving the industry after testing positive rather than going through the return-to- duty process. (Tractor weights continued on page 19) Feds order carrier to halt operations A small carrier based in has been declared an imminent hazard and ordered to stop operating by federal safety officials after they discovered widespread violations of safety regulations. The infractions ranged from drivers without commercial licenses to failure to maintain a systematic vehicle maintenance program to operating without federal motor carrier operating authority. The Federal Motor Carrier Safety Administration (FMCSA) ordered any motor carriers operated by Matthew Tabner, including two Belgrade, Mont.-based companies – Vallise Automotive Group (aka Nixx LLC) and Central Logistics Inc. – to immediately cease all interstate and intrastate transportation operations. According to the DOT’s Safety Measurement System, Nixx LLC, doing business as Vallise Automotive Group, has three trucks and four drivers, and Central Logistics Inc. has just one vehicle and one driver. An investigation by FMCSA and Montana Department of Transportation found numerous serious violations for Vallise Automotive Group, including: Failure to have a systematic vehicle inspection, repair and maintenance program to prevent unsafe commercial vehicles from operating on public roadways. In November 2020, a truck and trailer operated by one of Tabner’s companies were ordered out-of- service by New York State Police after a roadside inspection revealed deficient brakes on the truck and inoperative brakes on the trailer. Despite the out-of-service order, the unsafe truck and trailer were moved, resulting in two additional citations. Failure to ensure that only qualified drivers with proper commercial driver’s licenses operate on public roadways. Investigators found that on numerous occasions, a 16-year-old Tabner employee, who did not possess a CDL, commercial learner’s permit, or medical examiner’s certificate, was allowed to operate a vehicle exceeding 26,000 pounds – even after receiving multiple citations by law enforcement officers as far away as Minnesota and New York. Matthew Tabner, owner of Nixx LLC d/b/a Vallise Automotive Group and Central Logistics Inc., was also cited during a roadside inspection last year for operating without a CDL. Failure to implement an alcohol and controlled substances testing program required by federal law for drivers who must hold a CDL. Failure to ensure compliance with hours-of-service regulations. Vallise Automotive Group was found to have no programs in place to review its drivers’ records-of-duty-status for falsification, completeness, accuracy, or driver violations of HOS regulations. During the past 12 months, three out of five of the companies’ roadside inspections resulted in the driver being placed out-of-service for having no driver hours of service logs. Giving false company names to inspection officers in late 2020 after Tabner was told he needed to have a DOT number to operate. Tabner/Vallise Automotive Group/ Central Logistics may be assessed civil penalties of up to $27,813 for each violation of the out-of-service order. The carriers may also be assessed civil penalties of not less than $11,125 for providing transportation requiring federal operating authority registration and up to $15,691 for operating a commercial vehicle in interstate commerce without necessary U.S. DOT registration. If violations are determined to be willful, criminal penalties may be imposed, including a fine of up to $25,000 and imprisonment for a term not to exceed one year. FMCSA is also considering civil penalties for the safety violations discovered during the investigation. Livestock and livestock feed. Tractor weights climbing, report says The North American Council for Freight Efficiency (NACFE) has issued an updated report on the changing trends of light-weighting technologies since the council last published a study on the topic in 2015, including strategies to deal with increased tractor weights. The study team interviewed more than 50 companies, including fleets, tractor and trailer manufacturers, suppliers and technology companies, and confirmed that the weight of tractors (and to some degree trailers) has increased, while freight is becoming denser, and shippers are loading more pallets per trailer. Truckers oppose bridge tolls Truckers are pushing back at a Pennsylvania Department of Transportation’s proposal to add tolls to nine vehicle bridges across the state, including on Interstate 79, to close a funding gap to widen the roadway and replace the bridges. Under the proposal — which PennDOT is preparing for federal approval — passenger vehicles would pay a couple dollars and tractor- trailers could pay as much as $10 on a single pass by late 2023. Some in the trucking industry are pushing back, saying the proposal disproportionately relies on trucks. “Truckers currently pay about 40 percent of the transportation costs, in taxes, in Pennsylvania, despite the fact that they only drive about 9 percent of the miles,” said Rebecca Oyler of the Pennsylvania Motor Truck Association. Members of the House Appropriations Committee also questioned the tolling program during a budget hearing, the Pittsburgh Post-Gazette reported. “PennDOT Secretary Yassmin Gramian defended the tolling option, telling legislators her department has annual road and bridge needs of about $15 billion and only $6.9 billion available to address them,” according news reports. PennDOT officials said that gas revenues in the state have dropped off significantly during the COVID- 19 pandemic, leaving the authority with little other choice to fund the necessary road improvements. Thompson Gas expands holdings ThompsonGas, based in Frederick, Md., has acquired All Service Propane, a propane provider based in Anderson, California, in the northern region of the state. “We are pleased to announce that we have added All Service Propane, located in Northern California, to our ever-growing ThompsonGas team,” said Jeff Kerns, chief executive of ThompsonGas. “Brian Gillam has built a business that strives for excellence in service, which will continue with ThompsonGas.” The acquisition strengthens ThompsonGas’ national footprint and is the company’s first this year. Last year, the company acquired Associated Propane and Redwood Coast Fuels in Northern California. ThompsonGas completed a total of eight acquisitions in 2020 in the West, Midwest and South. “All Service Propane is a great addition to our presence in Northern California,” said Derek Ashmore, regional vice president of ThompsonGas. “It gives us another very strong footprint to continue our active growth strategy and continued industry-leading service.” Founded in 1946, ThompsonGas provides propane services to more than 200,000 residential and commercial customers across 20 states in the East, Southeast, West and Midwest. The company ranks No. 6 among U.S. propane marketers for sales of retail propane gallons, according to industry reports. J.B. Hunt says intermodal lagging Expectations around long-term intermodal margins were the main topic at J.B. Hunt Transport Services’ appearance at the Citi 2021 Global Industrials Virtual Conference in February. John Roberts, the company’s president and chief executive, said management plans to evaluate this season’s bid cycle before making a final determination. On the company’s fourth-quarter call in January, management acknowledged the intermodal segment had been lagging the long-term goal of 11 percent to 13 percent in recent years and that future expectations were under review. Roberts believes the key determinants will be the rate increases gained this cycle as well as bid compliance for those rates. The company’s intermodal division operated at a 91 percent operating ratio, inverse of operating margin, during the fourth quarter and at 90.8 percent for full-year 2020. Midvale, Ohio Currently, the market can be divided into three categories with respect to weight sensitivity and the percent of time that fleets are requested to gross out. Category 1: Trucks that currently travel at the 80,000-pound limit at some point along nearly 100 percent of their routes. This represents a small percentage of the industry (about 2 percent). This segment consists of bulk carriers. Category 2: Trucks that are loaded to the maximum weight (gross out) on a minority, perhaps 10 percent, of their trips. This represents about 10 percent of the trucks on the road, mostly refrigerator units but also some dry van routes. Category 3: Dry van units that rarely (2 percent of the time) or never travel at maximum weight, either because they are filled to maximum volume (cube out) before they gross out, or simply because their routes and cargo patterns are not conducive to traveling full. About 88 percent of the trucking industry falls into this category. The study found that bulk carriers are willing to pay $6 to $11 up front cost per pound of weight saved, and that the majority of bulk haulers have already invested in lightweight technologies. Meanwhile, reefers and some dry van fleets are willing to pay $2 to $5 per pound of weight saved, and fleets with dry van units that rarely travel at maximum weight are willing to pay up to $2 per pound of weight saved. NACFE found that over the next 5 to 10 years, shippers will request that Category 2 and Category 3 trucks double the percent of time they gross out, to 20 percent of the time for Category 2 and 4 percent of the time for Category 3. In order to meet these trends head-on and accommodate the heavier, denser freight, Category 2 and 3 fleets will have two options – add more trucks to the road, or explore light-weighting so that at least some of their trucks will be able to carry more freight. Light- weighting is by far the better option, NACFE officials said. Along with improving the overall freight efficiency of a fleet, light-weighting is a good investment because it opens the door for the adoption of additional beneficial technologies that might otherwise make a truck unacceptably heavier than it currently is. Clearly, the pandemic’s consequences sparked new entry. The most obvious impetus was the surge in spot market volumes and rates that began in June as the goods economy rebounded from the spring contraction. Accompanying this “pull” factor was a big “push” factor – furloughs and sharply reduced miles and driver pay stemming from the contraction itself. Many trucking companies diverted freight from leased owner-operators to company drivers to keep utilization as high as possible. Suddenly, many displaced leased operators and company drivers were looking for a way to earn more money, and the spot market offered that opportunity. However, to post trucks in the spot market or accept a load from an intermediary, owners need operating authority. These pandemic-related factors surely accelerated a couple of trends – one legal and one technological – that were already encouraging new entry. Yet the number of coronavirus- related employment complaints filed against companies across the country has already sailed well over 1,000, records show. That means how the pandemic negatively affects trucking’s workers – especially drivers on the front lines of America’s response to the crisis – is becoming a risk factor for fleet managers. Law firms are all over this issue, with some providing free informational resources on their websites. One such could be labeled “Cautionary Tales,” as it goes into detail on how lawsuit after lawsuit came into being due to the pandemic. Many of the suits claim management failed to act – or adapt – to the times. Fleets can save 2,000 pounds by investing to a limited degree in light-weighting and as much as 4,000 pounds with an aggressive investment. Light-weighting can take place in various areas of the tractor and trailer, including the power-train, axle suspensions, wheel ends, drive shaft, frame and fifth wheel. The study team developed the following recommendations based on the trends officials recorded: Category 2 and Category 3 fleets should begin to explore and spec light-weighting technologies in order to improve freight efficiency. By doing so, they may even produce economies of scale that bring down the upfront cost of these technologies, while perhaps opening up new options for Category 1 fleets to adopt technologies that are currently too expensive. • To bring down costs the industry should collaborate in order to address current redundancy in the development, testing, and product availability cycle among product developers, tractor- trailer integrators, and fleets. • The study also found that: • Aluminum frame rails that were looked at five years ago are no longer available. • Lightweight frame cross members are becoming more popular with new developments on the horizon. • Both steel and aluminum wheel manufacturers have reduced wheel weight by five pounds since 2015. • Electric trucks are 2,500 to 5,000 pounds heavier than their diesel counterparts for the same duty cycle. • There are a number of new products in development, from film to replace paint to new frame processing and composite cab structures. He claims that he was terminated for refusing to return to work to avoid exposure to an area that had been occupied by coworkers who had contracted COVID-19. He also alleges the company failed to properly clean the area, thereby intentionally exposing him to COVID-19. Samuel versus JB Hunt Transport Inc. A truck driver alleges he was terminated in violation of the New Jersey Conscientious Employee Protection Act (CEPA). The plaintiff alleges that, in conflict with a state- issued order, drivers were not being provided adequate protection or being required to wear masks. He also claims that he was forced to work around other drivers who had symptoms of COVID-19. The plaintiff alleges that his “complaints about the health and safety of workers was ignored.” Later, the plaintiff was involved in a work-related accident, which he claims was not his fault but that his employer determined was “preventable.” A few days later, he was terminated allegedly “in retaliation for the complaints he made about health and safety issues in violation of the CEPA.” Luna versus Penske Logistics LLC The plaintiff, on behalf of himself and a putative class of current and former non-exempt employees in California, sued his employer for various violations of the California Labor Code. In particular, the plaintiff alleges that non-exempt employees are not paid for time spent waiting in line to be screened for COVID-19 with temperature checks. Based on that and other allegations, the plaintiff claims the defendant failed to pay both minimum and overtime wages due, and thus failed to provide accurate wage statements. The plaintiff also alleges that after complaining about the company’s failure to take the appropriate precautionary measures and adhere to COVID-19 public safety guidance, he was terminated shortly after. The plaintiff alleges, on his own behalf, that he was wrongfully terminated in violation of public policy. Currently, Roberts indicated there was “a lot of pent-up demand” in the network, pointing to a large queue of ships sitting off the West Coast awaiting a berth to unload, a process he conceded might take until June to cure. However, he believes the near-term service issues on the railroads will not deter longer- term growth opportunities for the mode. He remains “optimistic” on the macro environment but noted several smaller businesses are feeling a pinch from COVID, which he described as “concerning.” (J.B.
