Thanks to an improved economy, the U.S. chemical market has been gaining strength in recent years and continues to grow. The word “chemical’’ covers a vast array of substances, including many that are sitting in kitchen cabinets. But when people talk about the challenges of chemical logistics, they're often referring to substances that must be treated with special care. Such hazardous products include substances that might explode, ignite, emit toxic gases, corrode the skin, or otherwise cause serious harm if not handled properly. Some training is dictated by the U.S. Department of Transportation (DOT), which regulates how companies prepare hazardous materials (hazmat) for transit. At Pacific Coast Warehouse Co.’s (PCWC) chemical third-party logistics distribution center in Chino, Calif., each employee takes one full day of DOT hazmat training every three years, plus an in-house course on hazard awareness, said Mark Burks, the facility's manager. PCWC's chemical distribution center (DC) provides third-party warehousing services for companies that use hazardous and non-hazardous chemicals in manufacturing. PCWC also handles various finished goods chemical products for retailers, distributors, and other customers. At distribution centers owned by chemical distributor Brenntag North America in Reading, Pa., some employees require specialized training in handling chemicals. Brenntag buys chemicals in bulk from manufacturers, then repackages them in smaller containers – ranging from 55-gallon drums to 1,000- gallon bulk tanks — for delivery to local customers, using a private fleet. “Employees who load the trucks learn to segregate materials that aren't supposed to come into contact with one another,’’ said David Garner, senior vice president of operations. They also learn to affix the correct placards, indicating which hazardous materials the truck is carrying, according to the DOT's hazmat regulations.’’ Workers who repackage chemicals take a further level of training, focused on personal protective gear. DC staff follow rules laid out by DOT and OSHA, as well as the Environmental Protection Agency (EPA), which governs cleanup in case of a spill. 2. Be Reasonable Beyond adhering to the letter of the law, many chemical distributors ensure safety by complying with the Responsible Distribution program, developed by the National Association of Chemical Distributors (NACD). This program, which is mandatory for NACD members, stipulates a series of safety measures every three years. A third-party auditor, chosen by the NACD, visits the company to make sure it's following those procedures to the letter. Another safety program, called Responsible Care, is mandatory for ACC members. (Chemical transporters continued on page 15) After the first Chem System installation on a Carbon Express truck, Rush’s veteran driver of 24 years called to inform the president it was “the best piece of equipment you’ve added to my truck.” Currently, two dozen of PT’s Chem Systems are on Carbon Express trucks with plans to install a system on each of the individual 72 trucks in the fleet over the next few years. When asked why Rush chose a PT product and specifically the Chem System, he praised the safety and ease of use. “It’s safer, it’s more efficient, it’s easier to operate, it’s equivalent in my opinion to having a vacuum truck, which is kind of dummy- proof. Where now the operator is pulling and controlling, you can go forward, you can go backward, and it’s just a great pump.” Based in Enid, Okla., PT is a fourth-generation family business that was founded in 1951. (Chemical media continued from page 1) (Chemical transporters continued from page 10) “To conduct business in the chemical industry, you need to be up to speed with the Responsible Care program,’’ said Glenn Riggs, senior vice president, corporate strategy at Odyssey Logistics and Technology (OLT) in Danbury, Conn. Like Responsible Distribution, this program requires careful monitoring to make sure a company adheres to all of its standards. Another practice for companies that ship via common carrier is to vet the firms that will transport hazardous chemicals. “About 10,000 truck suppliers are out there,’’ Riggs said. “How do you screen that huge supplier base and create a list of carriers you can rely on to deliver your chemicals across the public domain?’’ One best practice is to conduct regular carrier surveys. “We send carriers a form that asks questions about how they train their people. Do they keep records? Do they do background checks? How about security? What kind of training do they offer, and how often are drivers trained?\" said Douglas Brown, president of Brown Chemical Co. in Oakland, N.J., and vice chairman of NACD. If a carrier doesn't give satisfactory answers, doesn't have adequate insurance, or just isn't making the right effort, Brown won't use that company. Brown's employees also check carriers' safety records on federal websites. Many safety procedures are designed to keep hazardous chemicals from spilling or leaking – events that cause enough disruption and trouble to leave a strong impression on everyone involved. PCWC is focused on safety and preventive measures. Chemical haulers must know regulations Lab chemicals are an essential part of many research laboratories, and chemical transport is often a component of laboratory moving and maintenance. While many chemicals are harmless, some fall into the category of hazardous materials. Legal compliance when relocating potentially hazardous chemicals requires planning, care and expertise in U.S. Department of Transportation regulations. 1. Many Common Laboratory Chemicals Are Classified as Hazardous: Any chemical with the potential to cause harm to living things, the environment, or property can be classified as hazardous. Typically, this includes any liquid, solid, or gas with properties that are flammable, combustible, toxic, pathogenic, corrosive, oxidizing, unstable, or irritating to the eyes, lungs, or skin. Federal and state laws carefully control the transport of these chemicals over public roads to reduce the risk of spills or accidents. 2. U.S. Government Regulates Transport of Hazardous Chemicals: The Environmental Protection Agency (EPA) enforces the Hazardous Materials Transportation Act (HMTA) to control how potentially dangerous chemicals are moved across the United States. The HMTA includes detailed provisions for procedures, labeling, packaging requirements, employee training, and operational rules involved in chemical transport. Violations of the HTMA are federal offenses and can carry serious criminal penalties including jail time and fines up to $75,000. 3. It Can Be Difficult to Ship Chemicals with Standard Shipping Services: Many researchers find that it is a hassle to ship hazardous chemicals with USPS, FedEx or UPS due to extensive paperwork and packaging specifications. The average shipping company employee may not be trained in chemical transport, so general purpose shipping companies are often subject to additional regulations when accepting hazardous materials. Utilization of a shipping service that specializes in chemical transport can save time and headaches when moving hazardous chemicals. Chemical transport professionals have the trained employees, specially designed chemical-safe vehicles, and chemical logistics experience to move hazardous materials rapidly and safely. 4. Hazardous Chemical Transport Requires Permits: In addition to federal regulations, many hazardous chemicals cannot be transported across state lines without proper documentation. Unique permits may be required for each state that a chemical shipment travels through, and some states require a permit for the transport of hazardous chemicals within the state. Companies that specialize in chemical transport can help with the extensive paperwork that is often required for chemical shipments. 5. Trailstar expanding Ohio plant Trailstar International Inc. of Smith Township, Ohio, broke ground in May on an 85,000-square-foot manufacturing facility that is expected to add about 50 jobs. It is located at 20700 Harrisburg-Westville Road. “This is a tremendous achievement,” said Trailstar President Tom Hahn as he welcomed honored guests and employees, along with government officials who helped secure the project and the construction workers who will all have a hand in the expansion. Hahn thanked his employees, his wife Amy and all those who have supported his business endeavors through the years. The expansion project is valued at about $9.3 million, company officials said. “Growth is what we need to bring jobs into the community,” Hahn said. The project adds production space, an office and showroom. Cummins, Isuzu formalize agreement Cummins Inc. and Isuzu Motors Limited have taken another step forward in their partnership by entering into the Isuzu Cummins Powertrain Partnership agreement. Ralph Nappi, 77, dies in N.J. Ralph L Nappi, a longtime leader in the tank truck-cleaning industry, died peacefully at his home in Jackson, N.J., on May 22 after a long battle with cancer. Nappi was 77. Nappi’s career in the tank-truck industry began in 1959 at the age of 18, cleaning tank-trailer interiors for the family trucking company. He quickly advanced through the industry, and later in his career worked successfully in executive capacities for a number of industry leaders such as Peerless Transport, Allwaste Container Services, Transport Resources Inc, Matlack Inc, and Niagara National Corp. He also served in leadership roles for many years on the National Tank Truck Carriers Inc. (NTTC) Tank Truck Cleaning Advisory Council. Like his father and grandfather, Nappi’s reputation of honesty and integrity encouraged his son and grandson to carry on in the tank-truck industry for a total of five generations, or 106 years. Nappi is survived by his wife of 57 years, Delores (Meglio) Nappi; his sons Louis Nappi and his wife, Dawn, of South Carolina; and Joseph Nappi and his wife, Victoria, of Jackson; and his daughter, Jacqueline (Jackie) Nappi Stump and her husband Donald of North Carolina; 12 grandchildren; and seven great-grandchildren. Besides giving employees safety training, and implementing meticulous procedures, chemical shippers and their partners use information technology to make sure chemicals flow smoothly and safely through the supply chain. “Having a good transportation management system (TMS) that allows us to receive rich information from our customers, provide the best information to our carriers quickly, and get updates from carriers as events happen, is a best practice,’’ said Mike Challman, vice president of North American operations at CLX Logistics in Blue Bell, Pa. “If the right information doesn't get to the right person at the right time, that can cause big issues.’’ 3. Procedures for Plastics Even chemicals that don't pose safety hazards require special procedures and careful handling. Consider plastic resin – a commodity well known to Houston-based A&R Logistics. Most of A&R's business involves dry bulk transportation, warehousing, packaging, and 3PL services for large companies that make plastic resins used in manufacturing. In its transportation business, A&R primarily provides last-mile services. It transfers bulk loads of resins, which come in the form of pellets, from rail cars to its own tank trailers, and then moves them to consignees' manufacturing plants. The big concern with resin is the risk of contamination. “All it takes to contaminate a load is a few pellets from a previous load that are a different color or a different type of chemistry,’’ said Mark Holden, A&R's chief executive officer. “We have to be very disciplined in our material handling and trailer cleaning.’’ 4. Complex Compliance The sheer number of government agencies that regulate chemicals turns compliance into an especially demanding job. “We have to directly interface with nine federal agencies just to open the doors every day,’’ Brown said “Along with OSHA, the DOT and EPA, those agencies include the Food and Drug Administration (FDA), U.S. Customs and Border Protection, the Drug Enforcement Agency (DEA), the Transportation Safety Administration (TSA), and the FBI,’’ he said. State agencies regulate chemicals, too. At Barton Solvents in Des Moines, Iowa, David Richards, vice president of regulatory compliance, oversees a staff of four people dedicated to fulfilling all regulatory requirements. “But even with a staff that size, it's difficult to do. Many companies are a lot smaller than ours, and I don't know how they do it,’’ said Richards, who chairs NACD's regulatory committee. 5. Wanted: More Space Chemical shippers might face an abundance of regulations, but in another realm, many struggle with continual scarcity. Tight capacity, exacerbated by the ongoing driver shortage, is an issue for all kinds of shippers. But some say the problem is especially tough for companies that move chemicals. Working for a 3PL that serves the energy market, as well as the chemical industry, Voelkel gets a firsthand look at the capacity situation for different commodities. “It's definitely harder to find trucks for the chemical loads,’’ he said. In part, that's because the chemical business often involves regional trips, and many drivers these days find those long-distance hauls unattractive. “Most professional drivers want to get home every night,’’ Voelkel said. For bulk deliveries to customers, Brenntag operates a private fleet with 750 tractors and 1,500 tanker trailers. “Some of those trucks are specialized,’’ Garner said “A company might need a lined tanker or a different setup involving valves.’’ In all, the fleet encompasses about 40 different types of equipment. Each of Brenntag's drivers is qualified to handle six to 10 of those varieties, but no one driver can handle them all. The need for specialized training reduces the pool of drivers in a market that's already constrained. Barton Solvents also operates its own trucking fleet. But for chemical shippers that rely on common carriers, things can get tough. “Shippers must allow for longer lead times as they work to secure the necessary equipment,’’ Richards said. To compound the problem, suppliers are also extending lead times, and putting tighter controls on how and when distributors can pick up their products. “It's a logistics nightmare trying to get all the shipments scheduled in a timely fashion,’’ Richards said. We’re lucky we (didn’t) die.”Pamela Burnett tried to avoid it, but ended up driving through the plume.“It wasn’t smoke,” she said. “I thought to myself this is some kind of chemical. The next thing I knew, I couldn’t breathe. It was such a strong smell. I thought to myself, ‘Lord this is it. I’m done now.’” The National Transportation Safety Board sent a team of four to investigate the incident. The spill began about 4:30 a.m. in the area of Green Bay Road and 29th Street, according to Sgt. Christopher Covelli, a spokesman for the Lake County Sheriff’s Office. Investigators think a tractor was towing a pair of two-ton tanks containing anhydrous ammonia when they began to leak. Covelli said investigators do not believe the vehicle was involved in a traffic collision. “Basically, it caused the substance to go airborne,” Covelli said, “which released the plume into the air, which is extremely dangerous.” That substance can cause “unconsciousness, and at worst case even death,” Covelli said. According to Covelli, among those injured were emergency personnel responding to the scene. “Deputies arrived on the scene — our first responding deputies — (and they) exited their vehicles to try to aid the individuals who were at the scene, including individuals who were lying on the ground,’’ Covelli said. “The deputies were immediately overcome by the fumes that were in the air. Those deputies had to retreat and get out of the area. Both of them were subsequently transported to a local hospital, treated and released.’’ Covelli said 37 people were transported to hospitals “due to breathing in these toxic fumes. Of those 37, seven in critical condition with what was considered to be life-threatening injuries.’’ One of those listed in critical was the son of Ana Laura Garza, who lives on West Maplewood Road, just 20 yards away from ground zero for the leak near Green Bay Road and 29th Street. She said her son, Juan Jose Hernandez, 28, was in the intensive care unit at Vista Medical Center East in Waukegan. “It was so bad,” she said hours after the scene had been cleared. She said that, after the anhydrous ammonia began to leak before dawn, she and her fiancée, Elizonda, 53, could hear their neighbor yelling for help. “The smoke, it was so thick you couldn’t see, and we could hear our neighbor screaming,” she said. “We couldn’t see, so I went back inside,” Garza added, saying she gathered her two grandchildren, Isabel, 12, and Miranda, 8, and took them to the basement. The fire department came quickly and they had to walk down to 29th Street to get into an ambulance. “The smoke was following us,” Garza said. They were transported to Beach Park Middle School, about a half-mile down the road, where authorities had set up operational headquarters. From there, ambulances took arrivals to various hospitals, with Garza and her grandchildren heading to Northwestern Lake Forest Hospital, while her son went to Vista Medical Center East in Waukegan. Burnett, 57, said she was driving to her job at a grocery store in Kenosha when she went through the cloud of toxic gas. Burnett, an unincorporated Warren Township resident, said she was on Green Bay Road when she saw the car ahead of her brake, and she started to slow down. She added that she could see a cloud, but she wasn’t sure if it was smoke or dust from someone peeling out on the shoulder of the road. “It kept on getting bigger and bigger — this wasn’t going away. I tried to slow down and not go through it,” she said, but it was too late. Speaking to a group of media assembled near the scene, Burnett said she pulled off the road while “spitting up and coughing” and called 911. She said she saw a man laying on the roadway nearby. Burnett was transported to Advocate Condell Medical Center in Libertyville. Covelli said a total of 11 firefighters and three police officers were transported for treatment, including a firefighter/EMT from the Newport Township Fire Protection District who was in critical condition. According to Covelli, most of the victims had “non-life-threatening” conditions, and several dozen others had been evaluated by paramedics but not transported. U.S. Rep. Brad Schneider said he will also request the U.S. Environmental Protection Agency look into the incident to see if any needed updates to the Clean Air Act and Toxic Substances Control Act are appropriate. (from the Chicago Tribune) (Ammonia spill continued from page 1) Texas trucking companies was in addition to $5 million in compensatory damages in favor of Lauro Lozano, who had been one of Marin’s drivers, in a May 7 order filed in Hidalgo County, Texas district court. Lozano’s lawsuit, filed in 2017, stemmed from allegations that in 2015, Marin had pressured him to alter his logbook so that he could take on an 1,800-mile reefer haul from Texas to Maryland despite hitting federal hours-of-service (HOS) limits. Lozano fell asleep at the wheel early in the morning on the trip while traveling in Alabama, rear-ending another truck and suffering serious injuries. “This was a case where the plaintiff’s lawyer asked the jury to send out a message to the community and to the trucking industry that certain types of behavior would not be tolerated — overworking drivers and making them drive beyond legal limits,” said Hector Torres, who represented the owners. “We of course disagree that my clients engaged in that kind of conduct, but the jury chose to believe otherwise, and a large amount in damages resulted.” According to court documents, Lozano and his lawyer argued that the company he worked for, JNM Express, breached duties owed to Lozano and the general public, including using ordinary care in providing a safe workplace and in supervising an employee’s activities. The lawsuit pointed out that the defendants did not carry workers’ compensation insurance, and that they created JNM Express and two other companies, Anca Transport and Omega Freight Logistics, as a way to shield their personal assets “in a scheme to defraud creditors, including any employees injured or killed on the job.” Operating through several entities was also “part of a scheme to defraud regulators by evading safety regulations,” such as HOS, the lawsuit contended. Torres acknowledged that his clients’ choosing to not carry workers’ compensation insurance — which he said was voluntary in Texas — ended up being a major detriment for them. “If you opt out, then you lose certain common law defenses that you would otherwise have if you get sued by an employee,” he said. “In this case, we couldn’t argue that the accident was partially the driver’s fault. According to the agreements, the four companies will pay penalties ranging from $4,000 to $9,900 to settle claims by EPA that they each violated federal laws meant to prevent oil spills. These settlements were reached under an expedited settlement program whereby EPA agreed to resolve these cases for reduced penalties with companies that were able to quickly correct violations of the oil pollution prevention regulations. The companies involved in settlements were GCA Logging of Avon, Maine; Superior Fuel Oil Co., of Waterbury, Conn.; Academy Bus of Bridgeport, Conn., and GBC Metals of Waterbury. “Each of these companies stores oil in quantities that require plans to prevent spills and minimize damage from oil spills, so they need to have spill prevention plans that comply with federal clean water regulations,’’ said Deb Szaro, EPA’s New England acting regional administrator. “Companies that store oil must follow the laws designed to protect the public and the environment.’’ Federal oil spill prevention, control and countermeasure rules provide requirements for businesses that store oil and prevent oil discharges into nearby water resources. The rules require certain businesses to prepare, amend and implement oil spill prevention and response plans, which are part of the oil pollution prevention regulation requirements of the Clean Water Act. These cases include the following: • GCA Logging of Avon, Maine, on Sept. 20, 2018 agreed to pay a $4,000 penalty and to address violations of the Oil Pollution Prevention regulations of the Clean Water Act. In February 2018, a fuel delivery company over-filled an above-ground storage tank, causing a spill that resulted in oil discharging into a nearby stream that flows into the Sandy River. At the time of the spill, the facility did not have a required spill prevention, control and countermeasure plan. In a separate action, the Maine Department of Environmental Protection penalized both GCA Logging and the fuel delivery company for causing the oil spill. • Superior Fuel Oil Co. of Waterbury on Sept. 6, 2018, agreed to pay a $9,900 penalty and to address violations of federal oil pollution prevention regulations. During an inspection at the company, EPA saw that the facility did not have adequate spill containment for oil truck-loading racks and wasn’t fully implementing its oil spill prevention, control and countermeasure plan. • Academy Bus of Bridgeport, Conn., on Aug. 13, 2018, agreed to pay a $4,700 penalty and address violations of the oil pollution prevention regulations. The state responded to an oil spill at the company and referred the facility to EPA. During an inspection at the company, EPA saw that the facility did not have an adequate oil spill prevention control and countermeasure plan. Academy Bus amended its plan and put in place measures to prevent future spills. • GBC Metals of Waterbury, also known as Somers Thin Strip, agreed in June 2018 to pay a $6,100 penalty and to take measures to prevent future spills. In January, piping associated with an external valve on an oil cooling tower system at the facility failed, causing a release of about 5,790 gallons of oil from the system into a nearby storm drain. Between 625 and 650 gallons of oil was recovered from the Naugatuck River. The company responded promptly to the spill and did a cleanup, according to federal officials. This move is being driven by e-commerce and a lot of new technologies coming together. And we think these 10 fleets that will be in “Run on Less Regional’’ really showcase all the different aspects of this application.” Regional is challenging, Roeth added. “In some ways, it’s tougher than a long-haul route where you drive 300 or 500 miles, sleep and then do it all over again. There’s a lot of diversity in regional haul. You often have multiple drops and hook-ups. Geography is often a major operational factor. Some drivers go out and come home every night. Others stay out a night, come home for a night, and then repeat. So there’s a lot going on, depending on where a fleet is and what their operations require.” Roeth said the fleets participating in “Run on Less Regional’’ run the gamut of common business models currently seen in regional haul. He pointed to Pepsi and UPS as examples of private retail or manufacturing fleets, while Southeastern Freight Lines, Hogan Transportation, Ploger Transportation and Hirschbach Transportation represent traditional regional haul fleets that have been doing this work for years. “And then we have two newcomers to this with J.B. Hunt and Schneider,” Roeth said. “Some people look at our list and see those two and wonder what they’re doing on it. They’re on there because this is what we’re talking about — a movement to this new way of hauling freight. And both of these fleet divisions have grown significantly over the past year. So it will be interesting to see how they’re coming into this with fresh ideas.” Like its predecessor, “Run on Less 2017,’’ “Run on Less Regional’’ will feature real-time monitoring of a number of factors, including miles traveled, fuel consumed, pickups and deliveries, elevation change, and vehicle speed. “With the growth of e-commerce, we are able to provide drivers with more opportunities to take on regional routes, which ultimately allows them to spend more time with their families,” said Craig Harper, executive vice president and chief operations officer at J.B. Hunt, in a press release. “With this program, we can learn how to make these routes more efficient and beneficial for our drivers, J.B.
