In its Freight Transportation Forecast: 2020 to 2031, a report produced annually by IHS Markit, the ATA shows that while there is a definite shrinkage in the overall industry this year, the long-term trend for both trucking and overall freight shipments is still positive. “The COVID-19 pandemic has had an unprecedented impact on many parts of the economy and trucking is no exception,” said Bob Costell, ATA’s chief economist. “However, despite significant contractions in 2020, the forecast makes it clear that the long-term trend for trucking, as well as for the overall freight economy is positive.” The forecast is predicting that total freight volumes this year will likely decrease by 10.6 percent to 14.6 billion tons, with truck freight volumes falling 8.8 percent. This will change next year, with volumes expected to rise almost 5 percent and increase an average of 3.2 percent per year through 2026. According to the report, overall freight revenues will rise from $879 billion in 2020 to $1.435 trillion in 2031. U.S. Xpress highlighted three specific areas affected by the coronavirus: rising driver turnover, diminishing truckload capacity, and overwhelming load volumes. With decreased lower CDL school enrollment and the recent launch of the Drug and Alcohol Clearinghouse, the industry has seen a significant driver turnover that has yet to be restocked. THANK YOU! Trailer orders ‘explode’ Preliminary U.S. net trailer orders for September “exploded” to the third-highest month ever, at 52,000 units, according to research firm FTR. September’s orders were 23,500 units above August and 33,400 more than September 2019. With this latest activity, trailer orders for the last 12 months now equal 224,100 units. The great majority of the September orders were for dry vans, according to FTR. Refrigerated van orders were also “comparatively” robust. Flatbed orders are expected to continue their sluggish recovery. Rail rates spiking on West Coast The average national spot rate for intermodal shipments by rail increased in early fall 58 percent compared to June, or 79 cents per mile. The normally rational intermodal market, a safe haven for many shippers, has succumbed to the pressure of the surging freight volumes arriving on the West Coast. What is more impressive than the absolute rate, which is the highest in five years, is the rate of increase. It has taken only three months for the U.S. average intermodal spot rate to increase beyond the 2018 peak level, which was the previous multi-year high. It took rates over a Court overturns convictions A federal appellate court overturned the convictions of former Pilot Flying J President Mark Hazelwood and two members of his direct sales team, ruling a lower court judge shouldn’t have allowed jurors to hear a recording that included “deeply offensive racist and misogynistic language.” In its two-to-one panel ruling, the U.S. Court of Appeals for the 6th Circuit, struck down the convictions of Hazelwood and two former sales team executives, Scott Wombold and Heather Jones, over allowing prosecutors to play a secret recording of Hazelwood spewing “profanities about African

NEW PRODUCTS - MANUFACTURING - INDUSTRY NEWS Unibloc Pump relocates its headquarters Unibloc Pump, a manufacturer of sanitary positive displacement pumps and products, has relocated its headquarters from Marietta, Ga., to nearby Kennesaw, company officials said. The new facility is three times larger than the previous building. “With the move to Kennesaw, Unibloc is well-positioned for future growth and to better meet the needs of its customers,” said Eric Soderstrom, sales engineer at Unibloc Pump. The strong order totals from the last two months should push production up to pre-pandemic levels in the fourth quarter, with more increases expected, starting early next year. The Congressional stimulus package “infused a tremendous amount of funds’’ into the economy, FTR suggested. This cash is being spent overwhelmingly in the consumer goods sector, as the service sector remains constrained during the pandemic. This has boosted dry van freight, constraining capacity, and lifting freight rates. Fleets have responded by ordering dry vans in near-record quantities. Also, despite reduced restaurant sales, many consumers have more disposable income available to spend on food, which is helping reefer sales. “There is expansion demand, replacement demand, dealer demand— just an enormous amount of demand for dry vans to keep consumer goods on the move,” Don Ake, FTR vice president of commercial vehicles, said. “Fleets are expecting the hot freight market to continue into 2021 and want to be prepared with adequate capacity. Reefer demand should also continue to be strong, and benefit from more restaurant activity as 2021 progresses.’’ Ake also noted the surge appears to be a repeat of late-2018 when fleets ordered trailers in record numbers in September and October because of tight capacity and perceived limited build slots at the manufacturers. “There could be some irrational exuberance behind orders this high. Fleets are expecting the current conditions to continue well into 2021, and this may not be the case,” he said. “The trailer market has seen incredibly wide swings in 2020 and it is difficult to determine how long the current momentum can last. Orders may stay elevated if fleets compete to lock up future build slots as they did in 2018-2019.” ENHANCING YOUR COMPANY’S VALUE Spencer Tenney Tire ‘resistance’ saves money Given the impact rolling resistance has on a fleet’s fuel consumption, it makes sense to spend some time figuring out just which tires will be the best value over their useful life based on a fleet’s own operating parameters and needs. Rolling resistance accounts for 30 percent to 33 percent of the total fuel cost of a modern, aerodynamic, Class 8 truck, or about $0.012 per mile with dual tires. The rolling resistance of a tire is defined as the force needed to keep the tire rolling at a constant speed on a level surface and is usually expressed in the form of a rolling resistance coefficient. As tires move underneath the weight of the truck, they deform against the ground. Overcoming that deformation and keeping a tire rolling forward requires energy, and therefore fuel. Today, fleets can choose from a wide array of tires, but low rolling resistant (LLR) tires are their best option because these tires – whether in a dual or wide-base configuration – will save significant amounts of fuel when compared to tires that are not designed for low rolling resistance. Which tire configuration a fleet chooses should be based on total cost of ownership, including fuel consumption. Traditionally, tire per-mile cost was defined solely in terms of initial purchase price. But fleets that are purchasing tires without considering the fuel economy impacts of those tires are going to be miscalculating the impact of tires on their bottom line. The reality is that the cost of the fuel that a tire consumes due to its rolling resistance is five times greater than the initial purchase price of the tire. This is important to keep in mind because it may be necessary to replace LRR tires more frequently due to the thinner tread in the tires. Labor department wants economic test The U.S. Department of Labor (DOL) announced a proposed rule that aims to clarify who’s an employee and who’s an independent contractor under the Fair Labor Standards Act (FLSA), which could be good news for some trucking companies using owner-operators. The proposed rule adopts an “economic reality” test to determine a worker’s status as an FLSA employee or an independent contractor. The test considers whether a worker is in business for himself or herself (independent contractor) or is economically dependent on a putative employer for work (employee). In its Notice of Proposed Rulemaking, the department points out, “the multi-factor test for determining independent contractor status under the FLSA, as currently applied, has proven to be unclear and unwieldy.” Secretary of Labor Eugene Scalia said: “The department’s proposal aims to bring clarity and consistency to the determination of who’s an independent contractor under the Fair Labor Standards Act. Once finalized, it will make it easier to identify employees covered by the Act, while respecting the decision other workers make to pursue the freedom and (entrepreneurship) associated with being an independent contractor.” The department believes that “streamlining and clarifying the test to identify independent contractors will reduce worker misclassification, reduce litigation, increase efficiency, and increase job satisfaction and flexibility,’’ according to Scalia. “The proposal marks a more significant venture for the DOL than its previous efforts to define the parameters for determining independent contractor status generally under the FLSA,” said the transportation attorneys at Scopelitis, Garvin, Light, Hanson & Feary in an email alert. “The proposal synthesizes various courts’ approaches to implementing the Supreme Court’s economic realities test.” Under the proposal, they explain, a court must evaluate whether a worker is economically dependent on a putative employer or is in business for him/herself. To do this, a court would examine two “core” factors: 1. the nature and degree of control the worker has over the work; and 2. the opportunity for profit or loss based on initiative and/or investment. 3. If both core factors indicate either independent contractor status or employee status, no further inquiry would be needed under the proposed rule. The proposal identifies three other factors that may serve as additional guideposts in the analysis: the amount of skill required for the work; the degree of permanence of the working relationship between the worker and the potential employer; and whether the work is part of an integrated unit of production. The attorneys at Scopelitis advised that “in the customary and usual fact patterns found in trucking, both core factors should most often point in the direction of independent contractor status.” The secondary factors, however, “could present challenges to maintaining independent contractor status based on some existing case law addressing driver work classification under various state laws.” The proposal also advises that the actual practice is more relevant than what may be contractually or theoretically possible in determining whether a worker is an employee or an independent contractor. However, the rule may not help California trucking companies in their fight against the AB5 ABC test, which is currently not being enforced against the trucking industry while a legal challenge works its way through the courts. Many believe if it stands, AB5 would largely preclude the use of owner- operators by trucking companies in the state. “Because the FLSA does not preclude states and localities from establishing broader wage and hour protections than those that exist under the FLSA, workers in some states may be unaffected by this proposed rule,” a DOL document said of the relationship between a new federal standard and state laws like AB5. Once the notice is published in the Federal Register, there will be a 30-day comment period. Driver shortage looming again Many signs in the trucking industry are pointing to strong demand for freight as 2020 ends and 2021 draws near, though individual fleets are grappling with a multitude of factors, making it more difficult to find drivers to move that freight. The for-hire segment’s driver supply is dwindling due to the retirement of veteran truckers, drivers’ ability to pass drug tests, and competition from other “blue-collar” industries such as manufacturing and construction, as well as local delivery and private fleets. At the same time, the economy is preparing to awaken from the long slumber it’s been in since COVID-19 hit. FTR Transportation Intelligence projected utilization will accelerate in the first quarter of next year pushing freight rates higher than the 10-year average by the next summer. That would be on par with 2018 numbers. The National Transportation Institute (NTI) is hearing that a major recovery could start this fall. In this regard, the fourth quarter may have a 2018 feel, “but with complications,” said Leah Shaver, NTI’s chief executive. “Most fleets report that they could do four times the amount of work that they are doing, if only they had qualified drivers,” Shaver said. Due to the pandemic, training schools and the Department of Motor Vehicles installations have reduced capacity or closed – with some schools dropping by 40 percent, limiting the amount of newly certified drivers available. Furthermore, 71 percent of fleets halted training programs, according to an NTI survey. All together, Shaver said the new pool of drivers could be reduced by 30 percent to 40 percent. Now there is a mad dash to find qualified drivers. “After stalling the recruiting pipeline for at least the second quarter and even part of the third quarter, most fleets are reporting extreme challenges and increases in cost as they rebuild their pipeline,” Shaver said. Private fleets and local delivery jobs negate some of these hardships. According to the U.S. Bureau of Labor Statistics, heavy and tractor- trailer drivers’ median pay is $45,260. By contrast, a machinist median wage in 2019 was $45,750. That requires up to two years of training, done on-the-job, and/or through vocational schools and community colleges, but the job is more predictable and there are no long periods away from home. Making matters worse, the generation gap has created a situation where the drivers who love what they do simply can’t rack up miles like they used to, the spirit willing but the body always isn’t. Retirement accounts for 54 percent of the driver shortage, NTI said. And when Baby Boomers retire, the smaller Generation X pool is not a large enough source from which to draw. Chris Polenz, vice president of recruiting at Werner Enterprises, said maintaining the right equipment can go a long way in keeping the right drivers. A younger fleet can retain drivers, he said. Werner’s fleet age is currently two years, slightly up from the 1.8- year average. Another side effect of COVID-19 has been that new truckers have been harder to obtain, Polenz said. Lowering the age of trailers from more than seven years down to about four has also helped Werner, Polenz said. “We focus on the million-mile driver and making sure that their equipment is backed, and they can custom order those trucks the way they want them,” he said. Part of this is ensuring the fleet has the truck they want. “They’re certainly brand loyal,” Polenz explained. “And everybody’s got an uncle who would rather push a Chevy than drive a Ford. It’s the same thing with the truck manufacturers. So you’re going to have Freightliner, Kenworth, International-type of drivers and you’re going to want to do everything you can to put them in the right equipment.” The key for retention is in using data and analytics software to “understand when the right time to pay them” is. “There are other companies out there that might advertise what a 10-year driver makes, maximizing every incentive bonus under the sun, but that’s not going to get you long- term drivers,” Polenz said. He said that may get a driver in the door, but they could get easily discouraged in a month and leave. “So I tell our recruiters to be honest with the pay; we’re proud of the pay, and it’s going to be real,” he concluded. 18 TANK TRANSPORT TRADER I NOVEMBER 2020 www.TankTransport.com

Unlike trucking, which has seen capacity tighten in every corner of the U.S., the rise in intermodal rates has largely been driven by the surging demand on the West Coast. Rates from Los Angeles to Dallas, Texas, are exceeding trucking spot rates by 30 cents per mile, according to Truckstop.com. By comparison, westbound rates in lanes like Kearny, N.J., to Chicago and Kearny to Los Angeles remain relatively suppressed, averaging slightly higher than the same period in 2019 and well under the current dry van truckload spot rate moving in a similar direction. Mike Baudendistal, intermodal and rail market expert at FreightWaves, said, “Due to the record volume at the LA ports, there is a greater imbalance than usual, with too many containers going eastbound and not enough loaded containers going back westbound so rates are high to discourage more eastbound moves and low to encourage more westbound moves.” Empty containers typically signal increasing demand when they are heading into a market. Empty trailers have tripled moving into the LA market since early June, an indication that carriers are expecting increasing demand or already experiencing container shortages. Rail carriers have implemented peak season surcharges for customers operating outside of normal contracts. These surcharges are as much as $1,500 per container, which means only the most desperate shippers will utilize the service. The fact that shippers are willing to pay more for rail than trucking is a strong indicator that the market has lost most of its rationality. Rail moves tend to take longer and involve more transitions. Getting the container to and from the rail yards involves drayage providers who specialize in short- haul moves from ports and railheads and adds to the days of service. Essentially, shippers are willing to pay more for less in this scenario, which is why typically there is a 15-percent to 20-percent discount on rail moves versus dry van truckload. Initiative would open access to telematics data Voters in Massachusetts will decide in November whether independent after-market dealers should eventually be given access to crucial vehicle telematics data – a change that could drive down the cost of maintaining and repairing heavy-duty trucks. The “Right to Repair Law” Vehicle Data Access Requirement Initiative, which is on the ballot in Massachusetts for the Nov. 3 elections, requires manufacturers that sell vehicles with telematics systems in the state “to equip them with a standardized open data platform beginning with model year 2022 that vehicle owners and independent repair facilities may access to retrieve mechanical data and run diagnostics” through a mobile device such as a “smart phone.’’ The initiative would update and “protect” the current law, enacted in 2013, which exempts telematics systems from wireless accessibility by vehicle owners and independent repair facilities.
