2NC Supreme Court Decision - Teacher TenureSUMMARY OF SUPREME COURT OPINION:  The North Carolina Supreme Court upheld the Court of Appeals’ decision that it is unconstitutional to strip career status from those teachers who had already earned it.  The Supreme Court’s decision did not affect earlier rulings upholding the abolishment of career status for teachers who had not yet earned it, including teachers who were in “probationary” status at the time the statute was enacted.  Nor did the Supreme Court’s decision affect earlier rulings overturning the “25%” provision, which required school districts to offer four-year contracts and bonuses to some teachers but was ruled unconstitutional and never went into effect.  In short, the Supreme Court’s decision ended this litigation and made it clear that teachers who had career status as of July 26, 2013 in OCS will keep the protections they had under the repealed career status provisions, including appeal rights and standards for dismissal. Teachers who had not earned career status by that date will not have the opportunity to earn it but may be eligible for renewable contracts under the statutory provisions that were upheld.SUMMARY OF THE STATE OF THE LAW, AS OF TODAY, REGARDING TEACHER CONTRACTS:  All teachers who had career status in OCS on July 26, 2013 maintain that status, including the appeal rights and standards for dismissal. No other teachers will be eligible to obtain career status.  All teachers who did not have career status in OCS as of July 26, 2013 will be employed on one-year contracts from now until 2018.  Beginning July 1, 2018, non-career status teachers may be offered a 1, 2, or 4 year contract.  Any teacher who has been employed by the district for less than three years can only receive a one-year contract.  The superintendent may recommend a teacher for a contract of a term longer than one school year if the teacher “has shown effectiveness as demonstrated by proficiency on the evaluation instrument.” Outside of these requirements, however, the law does not offer guidance on how districts are to decide whether a teacher should be offered a 1, 2, or 4 year contract. Additional guidance may be provided in advance of 2018.  School districts must offer renewable contracts to teachers in full-time, permanent positions—including lateral entry teachers in full-time permanent positions. Part-time teachers are not entitled to renewable contracts.  Terminating contracts with a fixed ending date and no renewal protections may be issued to: (1) part-time teachers, (2) teachers working in non-permanent positions, and (3) teachers hired to work for six months or less in a school year.
