The Central Agency for Remedying Illegal Residents, Status Services and facilities provided by The State of Kuwait to illegal residents Pursuant to Council of Ministers Decree No. (409 / 2011) are as follows: Free Education The State of Kuwait is concerned in providing Education for all residents settled on its land, the Central Agency in accordance with the Ministry of Education witnessed an enrollment of the illegal residents as son/grandsons of Kuwaiti mothers, sons/grandsons of Military personnel, in addition to registering sons of the employees in Ministry of Education at Government schools, the number of registered students reached (13682) student during the academic year 2018/2019, divided as follows; Elementary- Preparatory- High school 11670 Kindergarten 740 Senior & Religious Education 1219 Special Needs Education Total 53 13682 12

The Central Agency for Remedying Illegal Residents, Status As the State of Kuwait established an Educational charity fund that ensures all the expenses for all educational levels from Elementary until High school level. The number of beneficiaries of this fund during 2018/2019 reached (15,448) male/female student with cost of about (5,478,115) KD (Educa- tion & book fees are included). Illegal residents also who have been registered in higher levels of education at Kuwait University and in the Public Authority for Applied Education and Training. Kuwait University includes total number of (1265) illegal residents’ male/female students for the aca- demic year 2017/2018. (97) Is the number for the illegal resident’s male/female graduates from Kuwait University for second semester 2017/2018 academic year. (588) male/female students admission during 2017/2018 academic year in the faculties and Public institutes. (1995) is the total number of the illegal residents’ male/female students were enrolled in the Public Authority for Applied Education and Training, and the number of the accepted admissions reached (488) during 2018 and the number of the graduates for the same academic year reached (246). (408) male/female students are being been accepted in 10 Faculties and private colleges in Kuwait for the academic year 2017/2018 and 2018/2019, so the total number reached (1155) student in the faculties and private universities. 13

The Central Agency for Remedying Illegal Residents, Status The number of illegal residents are being registered reached (141) male/female student for (Master & P.H.D.). Some of the employees of the Central Agency are assigned to coordinate with Kuwait University for the illegal residents’ students admission process for the academic year 2018/2019, those employ- ees attend at the University during the electronic admission period, in order to facilitate the admission process and provide any needed information or “To whom it May Concern” certificates, also they can help in overcoming any obstacle may face the admission process. 14

The Central Agency for Remedying Illegal Residents, Status Free Medical Treatment The illegal residents are being treated similar to Kuwaiti citizen in terms of fees and wages in accor- dance with Ministerial decree No. (86/2011), the Kuwaiti government committed for a full medical treatment cost for illegal residents. On May 2018, the Central Agency had an assemble with the Representatives of the Ministry of Health when they agreed that all illegal residents whom are registered and hold a valid (Review Card) that is being issued by the Central Agency to be exempted from all medical treatment fees, and whom are not registered to issue for them (Health Insurance Card) to have same privileges. The State of Kuwait also bears the expenses of treatment for Military personnel and the wives of Kuwaiti citizens who needed to be sent abroad for treatment. From 15/10/2018 till 6/8/2019, The Military of Defense sent 112 cases for medical treatment abroad. 16

The Central Agency for Remedying Illegal Residents, Status Official Documents Extraction Extracting all types of civil documents is an inherent right guaranteed by the state of Kuwait for any- one who settled on its land, as it is a mean of protection for all residents. The Central Agency in cooperation with both Ministries of “Justice & Health” work on extracting all official documents for illegal residents, and the below table shows the number of documents are be- ing extracted during 2018; 1 Birth Certificates A number of 1948 2 Death Certificates A number of 214 3 Marriage Contracts A number of 1027 4 Divorce Certificates A number of 477 5 Marriage reversing document A number of 74 6 Determination of Inheritance A number of 2131 7 Legal Documentation A number of 1617 8 Ratification A number of 6132 9 Legal Allotment A number of 5771 10 Official Notification A number of 3702 17

The Central Agency for Remedying Illegal Residents, Status Traffic Services 1. Illegal residents are excluded from the “License Issuing Terms” which are being applied on Non- Kuwaiti residents, as any illegal resident can get a driving license with conditions of having a valid “Review Card”, reached the age of (18 years old) and to pass the theoretical & practical driving tests, either male or female. 2. During 2018, the Interior Ministry “Traffic Administration” issued and renewed total number of (25,723) driving licenses for illegal residents, divided into (1861) newly issued licenses and (23862) renewed licenses. 18

The Central Agency for Remedying Illegal Residents, Status Employment • The Central Agency in coordination with state stakeholder has employed illegal residents (male/ female) at both Private & Public sectors depend on the available job vacancies, according to the terms and conditions are adopted by the Central Agency for those who are registered in popula- tion census survey for year 1965; as only the following category are excluded from this “census 1965” condition; • Kuwaiti Mothers' sons. • Military personnel sons. • Captives & Martyrs sons. 1. A placement of number (324) illegal residents at Public sector during 2018 so the total number became 2066 person. 2. A placement of number (549) illegal residents at Kuwaiti Petroleum Institute and their companies as they offer many privileges like accommodation (or accommodation allowances), flight tickets, med ical insurance, transportation allowances and others. 3. A placement of (739) illegal residents at Cooperative Societies. 4. Kuwaiti Army was opening up for illegal residents for Sons of Kuwaiti mothers and the sons of Kuwaiti Military Personnel working at the Ministry of Defense, their number reached (2981) during the previous years. 5. As the Central Agency “Executive Chief” had a meeting with the Chamber of Commerce and Industry “Chairman and Board Members” together to identify and approving all cards “Review Card” and “Health Insurance Card” in order to facilitate illegal residents employment process in both Public and Private sectors. 19

The Central Agency for Remedying Illegal Residents, Status Persons with Special Needs A total number of (1491) illegal residents with disabilities are registered and benefited from ser- vices provided by the Supreme Council for the Disabled according to the Public Agency law and International agreements licensed about the rights of the disabled. Below are the numbers of disabled and the provided services for them during 2018; Categories No. 1 The number of total who has a Disability Valid Card is 1491 2 The number of the issued Disability Identity Card is 595 3 The number of the issued license plate is 347 4 The number of the issued “To whom it may concern” letter is 54 Nursing Home: The number of residents at Nursing Homes reached (211) resident during 2018 as follows; Sectors No. 1 Resident at Juvenile Welfare 199 2 Resident at Nursing Home 3 Family Fostering 9 Total 3 211 20

The Central Agency for Remedying Illegal Residents, Status Supply Cards The state of Kuwait has a monthly allotment share of food supply offered with low prices for the citizens. As a “Supply Card” is being issued to determine the share for individual from the listed food- stuff (rice, sugar, vegetal oil, milk, infant formulas, cheese, lentils, frozen chicken meat and tomato paste), and the illegal residents are being granted a “Supply Card” similar to Kuwaiti citizen, a number of about (85,000) illegal residents benefited from this scheme at a cost of (18,000,000) milion KD during year 2018. 21

The Central Agency for Remedying Illegal Residents, Status The State of Kuwait also provides other services to the illegal residents not men- tioned in the Council of Ministers Decree No. (409 / 2011) The Governmental and Private Charity Commissions provide financial and in-kind assistance for the illegal residents during 2018, are as follows: First: Governmental Charities 1- Kuwait Zakat House: • The Social Society provided financial aids to the illegal residents during 2018 in amount of (16,311,022) KD “Sixteen Millions, Three hundred Eleven thousand and Twenty Two” Kuwaiti Di- nars”. 1- In-kind Assistance: The in-kind assistance (Clothes, Electric appliances, foodstuff, school bags and others); No. of Beneficiaries Amount 4636 Family 958,037 KD 2- Financial Aids: Paid No. of Beneficiaries Amount Monthly Family 2106 4,827,120 KD Separate Family 14397 10,525,865 KD Total amount Family 16503 15,352,985 KD 22

The Central Agency for Remedying Illegal Residents, Status 2- The Kuwaiti Red Crescent Society: • The society provided financial aids for illegal residents during 2018 in amount of (110,154) KD . • The financial aids include (undertake a number of orphans - Eid Al Fitr & Eid Al Adha clothing - winter clothing - foodstuff - Electric appliances - adult diapers - school bags). 23

The Central Agency for Remedying Illegal Residents, Status Second: Society Charities: 1- Social Reform Society: • The social society provided financial aids for illegal residents during 2018 in amount of (1,058,810) KD for about (3652) families, divided in to (194,907) KD in-kind assistance and (863,903) KD fi- nancial aids. 2- Al Najat Kuwait Charity Society: • The Social Society provided financial aids during 2018 in amount of (2,405,178) KD, include (finan- cial, in-kind assistance, financial aids for education, in addition to a variety educational courses. 3- Islamic Heritage Revival Society: • The Society provided financial aids to the illegal residents during 2018 in amount of (1,006,630) KD this amount includes monthly wages and intermittent assistance for a number of (4730) ben- efited family. 8- Al Amal Center (Al Sager Charity Society) • The center provided (124,000) KD during 2018 including (Sports & Cultural programs and activi- ties, “food baskets and coupons in Ramadan, distributing dates, water, zakat money” and feeding fasting people in Ramadan and others). 24

The Central Agency for Remedying Illegal Residents, Status 4- Patient Assistance Fund Society: • The society provided financial and medical assistance for illegal residents during 2018 with a value of (279,036) KD for a number of (1559) beneficiaries, including (lenses, eyeglasses, hearing and speech aid, prosthetic limbs, sterility treatment, organs planting, Dental care and heart diseases). • In addition to in-kind assistance is being provided with an amount of (292.030) KD “Two hundred, ninety two thousand and thirty” Kuwaiti Dinar, during 2018, including (winter clothing, foodstuff, school bags and additional projects) 5- Bashayer Al Khayr Charity Society: • The society provided financial assistance in amount of (20,501) KD “Twenty thousand, five hun- dred and one” Kuwaiti Dinar, during 2018, including (rents, debts, monthly wages and car fixing). 6- Solidarity Society for Prisoners Welfare: • The society provided financial assistance in amount of (91,839,00) KD “Ninety One million, eight hundred and thirty nine” Kuwaiti Dinar for (102) prisoners’ families and (97) prisoners. 7- Food & Rescuing Bank: • Kuwait food Bank provides an amount of (81000) KD monthly aids for illegal residents in Kuwait during 2018 for (270) beneficiaries, and an annual aids with amount of (125,000) KD for (5000) family for the same year. 25

The Central Agency for Remedying Illegal Residents, Status Services of Public Authority for Housing Welfare • The State provided houses with lower costs; illegal Residents got a number of (4800) residential units. • “Defense & Interior” Ministries provided accommodation allowances. “Social Insurance of Public Services” is paying pensions for Army and Police retired Personnel. • The number of registered retired persons of illegal residents at the (Social Development Associa- tion) for whom entitled for pension is (1527) from the Ministry of Defense and (6) from Interior Ministry. • The number of sons and related persons for deceased illegal residents who are registered and earn assessments from the (Social Insurance) is (8154) from the Ministry of Defense, (336) from Interior Ministry and (15) from the Headship of National Guard. 26

The Central Agency for Remedying Illegal Residents, Status Second: The Central Agency’s technical & executive efforts are shown through First: Adjusting the status of the illegal residents. Second: Considering the eligibility to acquire the Kuwaiti nationality and the issuance of an Amiri decree concerning this. First: Adjusting the Status of the illegal residents • The Central Agency adjust the status of illegal residents by extracting their original nationalities or travel passports, then they would be granted the residency in Kuwait, in accordance with Article (24) of the Kuwaiti Code of residence of foreigners No. (1959/17). • Around (8710) illegal residents had their situation adjusted since the establishment of the Central Agency, from 2011 up to April 30, 2019. This indicates many of illegal residents have hidden their passports or have destroyed their original nationality passports and documents. • Number of (5332) illegal residents their status adjustment is still in process. • The number of the illegal residents is subject to increase due to the Central Agency process of sorting documents, investigating and gathering information concerning all those who claimed they are illegal residents and those who have been affected by their situation such as parents, children and grandchildren. 27

The Central Agency for Remedying Illegal Residents, Status The Activities that the Central Agency is doing in the field of Human Rights: 1. Co-operation with United Nations (Commissioner of Refugees) through the re-settlement program which is shown in the procedures given facilities for the exit of the illegal residents to foreign countries as well in the re-union process. 2. Co-operation with the Ministry of Interior (General Administration for Citizenship and Passports Department) through issuing (Article 17 Passports) to facilitate the illegal residents exit to foreign countries and remedying their situation besides giving them passports particularly issued for these countries. 3. The Central Agency collaborate with the Ministry of Foreign Affairs (Human Rights Affairs) through involving and sharing in the agreements that are related to Human Rights issue, besides providing them with all statistics and received responses, then participating in (State of Kuwait Human Rights Report) discussion the is held in in the United Nations and the League of the Arab States. 29

The Central Agency for Remedying Illegal Residents, Status Second: Naturalization: The Central Agency researches and studies files of some illegal residents to prepare reports of the candidate who may obtain the Kuwaiti nationality in accordance with the Kuwaiti Nationality Law No. (15/1959), and the approved road map being submitted to the Council of Ministers noting that Naturalization is a sovereign right to the state. We would like to clarify that since 1992 until 2018 of (17,285) Individuals of illegal residents became a national. 32
