From the President In the next few weeks, we will be sitting down to our Pesach Seder and reading of the four sons. I have always wondered how these sons represent different types of Jews, and in turn, do each of them represent a type of congregant at Nanuet Hebrew Center. So here is my attempt at being a rabbi. The wise one, what does he say? \"What are the testimonies, the statutes and the laws which the L-rd, our G-d, has commanded you?\" You, in turn, shall instruct him in the laws of Passover, [up to] `one is not to eat any dessert after the Passover-lamb.' To me, this son represents the devoted congregant. The one who comes to services on a regular or semi-regular basis. This is also the congregant that is fully involved in synagogue life. He or she shows up to volunteer, is involved in Sisterhood, or Men’s Club, or Hazak, and is always available to lend a hand. This congregant is invested in NHC. The simpleton, what does he say? \"What is this?\" Thus, you shall say to him: \"With a strong hand the L-rd took us out of Egypt, from the house of slaves.\" This son represents the congregant that is searching for a purpose at NHC. He or she comes to some events but wants more. This is the congregant that needs the programming, so they can feel part of a larger community. This congregant may also want to contribute more of his/her time but doesn’t know where to start. It is thus the obligation of the “wise son” congregant to guide them along. The wicked one, what does he say? “What is this service to you?!” He says `to you,’ but not to him! By thus excluding himself from the community he has denied that which is fundamental. You, therefore, blunt his teeth and say to him: “It is because of this that the L-rd did for me when I left Egypt”; `for me’– but not for him! If he had been there, he would not have been redeemed!” I would like to believe that we do not have any congregants who can be represented by the wicked son. If you are a member of Nanuet Hebrew Center, it is because you want to be here. You want a connection to the Jewish community and to G-d. However, one thing I hear often at NHC is “when are you going to do…”. Much like the wicked son these congregants exclude themselves from making things happen. They expect things to get done by others. I am writing this a few days after the successful dinner theater production of Beauty and the Feast. people came up to me and spoke of the wonderful time they had. They asked if we could have more events like this in the future. It pleased me to hear such enthusiasm from our congregation. It seems that people are very willing to come out to fund- raisers if we have the right idea, program, and of course food. However, some of the people asked, “can you run more programs like that?” I am sure these people are not like the wicked son but isn’t it a shame that they don’t feel enough of a part of NHC to say, “how can we get more programs like that, and how can I help?’. As for the one who does not know how to ask, you must initiate him, as it is said: \"You shall tell your child on that day, `It is because of this that the L-rd did for me when I left Egypt.'\" This son represents the congregant who does not know what we have to offer. He or she may be new and searching for their place. They may also be the one that doesn’t know anyone, and may feel uncomfortable engaging others, or attending programs or fundraisers. It is everyone’s obligation, therefore, to make this congre- gant feel welcome and introduce them to others. So, this was my first attempt at being a rabbi. I hope that Rabbi Kurland can at least, appreciate the effort. Let me close by saying, I hope there comes and day when we are all the wise sons, and we all become fully invested in our kehillah and the greater Rockland community. A DISPUTE INVOLVING AMERICA’S OLDEST JEWISH CONGREGATION Nancy Savitt I was involved in an interesting case involving the nation’s oldest Jewish congregation and the nation’s oldest synagogue. The congregation is Congregation Shearith Israel in New York, established in 1654, and the synagogue is the Touro Synagogue in Newport, Rhode Island. Among the first Jews in the New World were those fleeing from the Inquisition. They established Sephardic congregations in New York, Newport and other cities. About a century later, shortly before the Revolutionary War, the Newport congregation solicited contributions to build an edifice in Newport. The synagogue opened in 1763. Its active life in the eighteenth century was short-lived, however. The Newport Jews fled the area during the Revolutionary War. Many went to New York, where they became members of Shearith Israel. Some returned to Newport after the war, but by the first decades of the nineteenth century, there were no Jews left in Newport. Shearith Israel became the owner of the synagogue and its religious paraphernalia, and arranged for the Newport Jewish cemetery to be maintained. As Henry Wadsworth Longfellow wrote in his 1852poem The Jewish Cemetery at Newport: Gone are the living, but the dead remain, And not neglected; for a hand unseen, Scattering its bounty, like a summer rain, Still keeps their graves and their remembrance green. Longfellow’s final line – “And the dead nations never rise again” – however, was thankfully inaccurate. In the late 1800s, Ashkenazi Jews arrived in Newport. Seeing the Touro Synagogue sitting there vacant, they applied to Shearith Israel for the opportunity to worship there, and also sought the loan of the “appurtenances of worship” so they could daven. Among the “Sepharim, Bells, Books, Shofar and all other appurtenances for worship” Shearith Israel sent up to Newport were one set of bells – Torah finials or rimonim – that features prominently in our story. They were crafted by colonial silversmith Myer Myers, the first Jewish member of the guild of silversmiths(which had excluded Jews for the roughly four centuries it had by then existed). Myers had crafted several pair of rimonim, one of which still resides at Shearith Israel, where Myers had been parnass (president). Page 16 NHC Bulletin Adar I I — Nisan —5779 April 2019

All did not proceed smoothly, alas. The new Newport congregation – Congregation Jeshuat Israel (CJI) – wanted to wrest control of Touro Synagogue from Shearith Israel. At the turn of the last century, there were lock-outs and occupations, petitions and lawsuits. At the beginning of 1903, CJI lost a major litigation, and swiftly entered into a settlement with Shearith Israel. CJI agreed to “admit and recognize without qualification the title and ownership” of Shearith Israel; agreed to make an “absolute surrender” of the property to Shearith Israel; and agreed to accept Shearith Israel’s form of lease for Touro Synagogue at the rent of $1 a year. The lease applied not only to the building, but also to “the paraphernalia belonging thereto.” Fast forward 105 years. In the intervening decades, CJI had made its lease payments sporadically, and admitted on its website to the lease and to the rent payments. But Shearith Israel’s role, the terms of the settlement, and the other terms of lease were all but forgotten. In 2008, the global economic collapse caused CJI to look at “their” assets to see if any could be sold to set up an endowment. Time passed and their finances regained their footing, but CJI still pursued the endowment idea. In 2012, CJI paid its $1 rent to Shearith Israel. That same year, CJI voted to sell a pair of Myer Myers rimonim that it had received from Shearith Israel to the Museum of Fine Arts in Boston, where they were (and are) displayed on loan. Some CJI congregants asked, “Do we even own them?” and Shearith Israel was alerted to the vote. Shearith Israel objected to the sale not only as owner but on the religious grounds that the rimonim partake of the holiness of the Torah and could not be sold. It sought to resolve the dispute via a Beit Din, but CJI filed a lawsuit in Rhode Island. Not only did CJI seek a ruling that it owned the rimonim, it also sought a ruling that Shearith Israel only held Touro Synagogue as a trustee – and further sought to remove Shearith Israel from even that position and to take over Touro Synagogue itself. History was repeating itself. This time, all did not go well for Shearith Israel, at least initially. A trial was held in Rhode Island, and the court issued a 106 page decision in May 2016 finding against Shearith Israel on all claims. Shearith Israel owned nothing, and CJI was free to sell the rimonim. Shearith Israel appealed to the federal appellate court in Boston, which is where I got involved. We argued that the settlement agreement, the lease, and two other contracts made clear that CJI was a lessee who owned nothing and who could not challenge Shearith Israel’s ownership. The appellate court agreed. In an August 2017 opinion written by former Supreme Court Justice Souter, the appeals court completely reversed the trial court decision. CJI kept fighting, however. First they asked the appellate court for a rehearing. That request was denied in June 2018. Shearith Israel delegates traveled to Newport that summer in an attempt to move ahead harmoniously. CJI, though, wanted to take its last shot in the litigation, and sought to have the United States Supreme Court step in. On March 18, 2019, the Supreme Court declined to hear the case. That should be the end of the legal battle. CJI has now joined Shearith Israel in publicly stating that they want to put the fighting behind them and move ahead cooperatively. Continued from cover Why Is Elijah the Prophet Invited to the Seder? After the conclusion of the Seder’s Grace After Meals, there is a universally accepted custom to pour a cup of wine (the “Cup of Elijah”), open the front door of the home, and recite several verses (mostly from Psalms) wherein we beseech G-d to pour His wrath upon our persecutors and oppressors. According to tradition, at this moment our homes are graced by the presence of Elijah the prophet. There are multiple reasons and meanings behind this age-old tradition. Here are some of them: Opening the Door for Elijah 1) The Torah describes the night of Passover as leil shimurim, a “guarded night.” It is the night when long ago G-d protected the Jews from the plague which slew all the Egyptian firstborn, and the night when G-d’s protection over His chosen nation is most apparent. Opening the door expresses our trust in G-d’s protection. 2) When opening the door, we take the opportunity to invite in the prophet Elijah. Elijah is the one who visits the circumcision ceremony of every Jewish child, and testifies that the Jewish people are scrupulous regarding the mitzvah of circumcision. Males were permitted to partake of the paschal offering only if they were circumcised. Thus, Elijah comes to the Seder to “testify” that all present are indeed circumcised. Cup of Elijah 1) There is an open question in the Talmud whether we are obligated to have four or five cups on the night of Passover. Since the issue was never resolved, we pour a fifth cup, but do not drink it. After heralding the coming of the Messiah, one of Elijah’s tasks will be to resolve all hitherto unanswered halachic questions. Thus, this fifth cup whose status is in doubt is dubbed “Elijah’s Cup,” in anticipation of the insight he will shed on the matter. 2) The four cups correspond to the four “expressions of redemption” promised by G-d: “I will take you out from the suffering of Egypt, and I will deliver you from their bondage; I will redeem you with an outstretched arm and with great judgments. I will take you to Myself as a nation . . .” The fifth cup corresponds to the fifth expression of redemption, which comes in the following verse: “I will bring you to the Land . . .” This expression, however, is an allusion to the future messianic redemption, which will be announced by Elijah. This is also why we do not drink, “enjoy,” the fifth cup—as we have not yet experienced this redemption. The timing of the pouring of the “Cup of Elijah” is also apropos, right before we start reading the Hallel, whose focus is on the future redemption. After commemorating the very first redemption of the Jewish people from Egypt we express our hope and firm belief in the coming of Mashiach, the Messiah who will usher in the new and final redemption very very soon.
