ศนู ยปฏิบตั กิ ารตอ ตานการทุจริต ความเปนมา จากปญหาการทุจริตที่ผานมา มีความรุนแรงอยางตอเนื่อง คณะรักษาความสงบแหงชาติไดมีคําสั่งท่ี๖๙ /๒๕๕๗ เร่ืองมาตรการปองกันและแกไขปญหาการทุจริตประพฤติมิชอบ ลงวันที่ ๑๘ มิถุนายน ๒๕๕๗ ใหทุกสวนราชการและหนว ยงานของรฐั กําหนดมาตรการหรือแนวทางการปอ งกนั และแกไขปญหาการทุจริตประพฤติมิชอบในหนวยงานโดยมุงการสรางธรรมาภิบาลในการบริหารงาน และสงเสริมการมีสวนรวมจากทุกภาคสวนในการตรวจสอบ เฝาระวังเพ่ือสกัดก้ันมิใหเกิดการทุจริตประพฤติมิชอบ รัฐบาลไดเห็นถึงความสําคัญของการแกไขปญหาการทุจริต ซ่ึงไดกําหนดเปนวาระแหง ชาติ โดยรัฐบาลไดเสริมสรางกลไกขับเคลื่อนในการปองกันและแกไขปญหาการทุจริต ขึ้นมา ๓ ระดับคือคณะกรรมการตอตานการทุจริตแหงชาติ เปนกลไกระดับนโยบาย มีนายกรัฐมนตรี /หัวหนาคณะรักษาความสงบแหงชาติเปนประธาน กรรมการจัดต้ังศูนยอํานวยการตอตานการทุจริตแหงชาติใหเปนกลไกขับเคล่ือนภาพรวมประดับประเทศ และกลไกระดบั ปฏบิ ตั กิ าร โดยการออกมาตรการเพม่ิ ประสิทธิภาพศูนยปฏิบัติการตอตานการทุจริต ซ่ึงประจําอยูทุกสวนราชการระดับกระทรวง หรือเทียบเทา ปจจุบันมีจํานวน 35 ศูนย ใหเปนกลไกประสานงาน กํากับ ติดตาม และรายงานผลการดําเนินงานท่ีเก่ียวของกับนโยบาย ขอส่ังการ ในการปองกันและแกไขปญหาการทุจริต กับหนวยงานภายใตกํากับทั้งหมดซง่ึ ไดแ กหนว ยงานสว นกลาง สวนภูมภิ าค สว นทอ งถ่นิ รวมท้งั รัฐวสิ าหกิจ และองคก ารมหาชน โดยมีสํานักงานคณะกรรมการปองกนั และปราบปรามการทุจริตในภาครัฐ เปนกลไกขับเคลื่อนประสาน กํากับ ติดตามผลการปฏิบัติงานของศูนยปฏิบัติการตอ ตานการทจุ รติ ในฐานะทส่ี าํ นกั งาน ป.ป.ท. เปนฝายเลขานุการของคณะกรรมการตอตานการทจุ รติ แหงชาติ ศูนยปฏิบตั กิ ารตอ ตานการทจุ ริต มีบทบาท ภารกิจ อํานาจหนาท่ี ดานการปองกันและปราบปรามการทุจริตและประพฤตมิ ชิ อบ และดา นคุม ครองจรยิ ธรรม ดังนี้

Anti-Corruption Operation Centre Background Since corruption has been a severe problem in Thailand, on 18 June 2014, the National Committee of Peace and Order (NCPO) issued an Order No.69/2014 on “Measures to Prevent Corruption and Misconduct” assigning all government and state agencies to define the measures and procedures to prevent and eliminate corruption and misconduct in their organisations. The order focused on building good governance at work and encouraging all relevant sectors to participate in inspecting and monitoring government activities in order to prevent corruption in the public sector. A strong focus on combating corruption is vital, the Royal Thai Government, therefore, held the war on corruption as a national agenda. RTG has strengthened the 3 level mechanisms to prevent and eliminate corruption as follows; 1. At the policy level: the National Anti-Corruption Committee chaired by the Prime Minister/Head of NCPO 2. At the national level: the National Anti-Corruption Centre driving the overall domestic performance. 3. At the operational level: the Anti-Corruption Operation Centre established in all ministries or their equivalent which their efficiency have been significantly improved. Recently, there are 35 Anti-Corruption Operation Centres to coordinate, direct, monitor, and report agencies’ anti-corruption performance. These agencies are from central, regional and local as well as state enterprises and public organisations. PACC as the secretary to the National Anti-Corruption Committee is regarded as a mechanism to coordinate, direct and monitor the activities of Anti-Corruption Operation Centres’ operation. Roles, missions and authorities of the Anti-Corruption Operation Centre to prevent and suppress corruption and misconduct and protect ethics are as follows;

อํานาจหนา ที่ กลมุ งานปอ งกนั และปราบปรามการทจุ รติ และประพฤติมิชอบ๑. ศึกษา วิเคราะห รวบรวมขอมูลสภาพปญหา เพ่ือจัดทําขอเสนอแนะมาตรการ แนวทางการปองกันและปราบปรามการทจุ ริตและประพฤตมิ ชิ อบของสว นราชการเสนอตอ หวั หนา สวนราชการ๒. จัดทาํ แผนปฏิบตั กิ ารปอ งกันและปราบปรามการทุจริตและประพฤตมิ ิชอบของสว นราชการ๓. ใหคาํ ปรกึ ษาแนะนาํ ประสานงาน เรง รัด กํากับและตดิ ตาม ใหส วนราชการ และรัฐวิสาหกิจ องคการมหาชนในกํากับของกระทรวง ดาํ เนินการขับเคลอื่ นภารกิจตามแผนปฏบิ ัติการปองกนั และปราบปรามการทุจรติ และประพฤตมิ ชิ อบ๔. รับขอรองเรียนเร่ืองการทุจริต การปฏิบัติหรือละเวนการปฏิบัติหนาท่ีโดยมิชอบของเจาหนาท่ีของสวนราชการและรัฐวิสาหกิจองคการมหาชนในกํากับของกระทรวง และสงตอไปยังสวนราชการและหนวยงานที่เกี่ยวของ รวมถึงประสานตดิ ตามอยางตอ เนื่องจนไดขอ ยุติ๕. เปนกลไกการปฏิบัติหรือประสานการปฏิบัติงานรวมกับศูนยอํานวยการตอตานการทุจริตแหงชาติ (ศอตช.) สํานักงานป.ป.ท. สํานักงาน ป.ป.ช. หรือหนวยงานอ่ืนที่เกี่ยวของ ตามที่ ศอตช. มอบหมายและกํากับติดตามการดําเนินการตามมติ-ขอสงั่ การ ของ คตช. ทเ่ี ก่ียวของ๖. ทําการตรวจสอบเปรียบเทียบผลการดําเนินการปกครอง วินัยของหนวยงานในสังกัด เสนอความเห็นตอปลัดกระทรวงหรอื รัฐมนตรีแลว แตละกรณี แลว แจงใหศ อตช. ทราบ๗. เปน ศูนยก ลางในการเผยแพรขา วสารเกี่ยวกับการปอ งกนั และปราบปรามการทุจรติ และประพฤติมชิ อบในสว นราชการ๘. สงเสรมิ ใหท กุ ภาคสวนมีสว นรวมในการปอ งกนั และปราบปรามการทจุ รติ และประพฤตมิ ิชอบในสว นราชการ๙. ตดิ ตามประเมนิ ผลการดาํ เนนิ งานของสวนราชการ และรัฐวิสาหกิจ องคการมหาชน และจัดทํารายงานผลการดําเนินงานการปอ งกันและปราบปรามการทจุ รติ และประพฤติมชิ อบในภาพรวมของสวนราชการสงสํานักงาน ป.ป.ท. สํานักงาน ป.ป.ช.สาํ นกั งาน ก.พ. และหนวยงานท่เี กี่ยวของ

Role, Mission, Power and Duties of the Prevention and Suppression of Corruption and Misconduct Unit1. Study, analyse and gather information for drafting recommendations, measures and guidelines to prevent andsuppress corruption and misconduct in a public sector to the heads of the organisations.2. Prepare the action plan to prevent and suppress corruption and misconduct in the public sectors.3. Advise, coordinate, expedite and monitor the public sectors, state enterprises and public organisations undersupervision of each Ministry according to the action plan.4. Receive complaints against officials in the public sectors, state enterprises and public organisations undersupervision of each Ministry involving corruption activities, wrongfully performing or failing to perform their duties.These complaints will be forwarded to agencies in charge as well as other relevant authorities and will befollowed-up by the Prevention and Suppression of Corruption and Misconduct Unit until the final outcome isreached.5. Operate and coordinate with the Anti-Corruption Administration Centre, PACC, NACC, or other relevantorganisations as assigned by the Anti-Corruption Administration Centre and direct/monitor the implementation ofother related National Anti-Corruption Committee’s resolutions and orders.6. Compare and inspect the administrative and disciplinary actions of accountable agencies and submit therecommendations to the Permanent Secretary or the Minister of each Ministry depending on circumstances andsubsequently notify the Ministry’s Anti-Corruption Centre.7. Publicize news on prevention and suppression of corruption and misconduct in the public sector.8. Encourage all sectors to participate in the prevention and suppression of corruption in government activities.9. Monitor the performance of the public sector, state enterprises and public organisations, and report the overallresults on prevention and suppression of corruption and misconduct to PACC, NACC, OCSC and other relevantorganisations.

อาํ นาจหนาที่ กลมุ งานคมุ ครองจรยิ ธรรม๑. คุมครองจรยิ ธรรมตามประมวลจริยธรรมขาราชการพลเรือน และประมวลจริยธรรมอ่นื ๆ๒. ทาํ หนาท่ฝี า ยเลขานกุ ารของคณะกรรมการจรยิ ธรรมประจาํ สวนราชการ๓. ประสานการดําเนนิ งานเกยี่ วกบั จัดทําแผนปฏิบัติราชการประจําป แผนงาน/โครงการ ตลอดจนบูรณาการแผนงาน/โครงการเก่ียวกับการคุมครองจริยธรรม การสงเสริมคุณธรรม จริยธรรม จรรยาขาราชการ และเสริมสรางวินัยของสวนราชการและรัฐวิสาหกิจ องคก ารมหาชนในกาํ กับของกระทรวง๔. รวบรวมปญหาการปฏิบัติตามประมวลจริยธรรมของสวนราชการ และรัฐวิสาหกิจ องคการมหาชนในกํากับของกระทรวง ตลอดจนเสนอแนะแนวทางการปรบั ปรุงประมวลจรยิ ธรรมตอ สาํ นกั งาน ก.พ.๕. ติดตาม ประเมินผลการดําเนินการสงเสริมคุณธรรม จริยธรรม จรรยาขาราชการ การเสริมสรางวินัย และการดําเนินการตามประมวลจริยธรรมขาราชการของสวนราชการและรัฐวิสาหกิจและองคการมหาชนเสนอหัวหนาสวนราชการ และสงผลการดําเนินการใหกลุมงานปองกันและปราบปรามการทุจริตและประพฤติมิชอบ จัดทํารายงานผลการดาํ เนินงานการปองกันและปราบปรามการทจุ รติ และประพฤติมชิ อบในภาพรวมของสวนราชการ

Role, Mission, Power and Duties of Ethics Protection Unit1. Protect ethics as prescribed in the Civil Servant’s Code of Ethics and other Code of Ethics.2. Serve as the secretary to the Ethics Committee in the public sector.3. Coordinate on the annual Action Plan and work plan/project, integrate work plan/project onethics protection and promotion of virtue, ethics, and civil servants’ morality as well asstrengthening the discipline in the public sectors, state enterprises and public organisations.4. Gather information from the public sectors, state enterprises and public organisations under thesupervision of each Ministry when implementing the Code of Ethics. Recommend the guidelines toimprove the Code of Ethics to the Office of the Civil Service Commission (OCSC).5. Monitor/evaluate the organisations’ operation to promote virtue, ethics, and civil servants’morality, strengthen officers’ self-discipline and follow the Code of Ethics of public sectors, stateenterprises and public organisations present the outcome to the head of each organisation. TheEthics Protection Unit will submit the organisations’ operations report to the Prevention andSuppression of Corruption and Misconduct Unit and prepares an overall performance report ofprevention and suppression of corruption and misconduct in the public sectors.
