The following Policies and Guidelines are intended to make living at the Villages comfortable by promoting the safety, well being and quiet enjoyment of each guest. They also set guidelines for the appearance of individual RV’s and Resort homes and the site they occupy, thus preserving the value of each guests property and the resort. The resort reserves the right to amend the Policies and Guidelines as the needs of the Resort and guests change. These Policies and Guidelines will be enforced consistently, fairly and equally with reasonable notice to correct violations. Val Vista Village reserves the right to terminate or refuse renewal in the event there have been infractions of these Policies and Guidelines. This includes home site care, architectural infractions and conduct by guests and /or their visitors that interferes with the safety, quiet and enjoyment of the resort. AMENITIES ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY AS TO COVID-19 CAUTION: This is a release of legal rights. Read and understand it before entering or using any of the Facilities. ALL USE OF THE FACILITIES IS AT RESIDENT’S OWN AND SOLE RISK AND IS PURSUANT TO THE TERMS AND CONDITIONS SET FORTH HEREIN IN CONSIDERATION OF RESIDENT BEING PERMITTED to use the Resor t’s facilities and equipment, and subject to the limitations of A.R.S. § 33-2106, Resident, by using the Resort’s Facilities as defined hereunder, freely and willfully agrees to the following terms: 1. Resort management is excited to welcome all residents back, and to meet all fir st-time residents! The Resort offers amenities for residents’ use, though these amenities are all subject to temporary or permanent closure at management’s sole discretion. Reasons for temporary or permanent closure include but are not lim- ited to remodeling, force majeure, pandemic (including but not limited to COVID-19), community spread of COVID-19 or other pandemic, replacement of a facility, obsolescence, and the like. Use of amenities is not guaranteed, and Resident’s rent allows Resident the use of the rented home site but does not guarantee that any or all Resort amenities will be open, existing, or available during Resident’s stay. Amenities that may be available, without guarantee, include (without limitation) the clubhouse, pool, gym, billiards room if any, and facilities and equipment within the clubhouse and other areas of the Resort. These amenities and facilities are collectively referred to herein as the “Facilities.” 2. COVID-19 is a constantly evolving situation. The Resor t’s approach to COVID-19 has been fluid and phased, and conducted in accordance with all state, local, and federal government directives. Many factors affect the Resort’s decisions in determining the timing of when various Facilities and activities at the Resort will reopen in a responsible way. Among other approaches, the Resort is taking enhanced protective measures, including requiring that all residents wear face coverings when in any Resort Facilities or common areas. The Resort has also reduced the capacity of certain Facilities (for example, pool areas) in accordance with government directives and in an effort to ensure physical distancing. Additionally, the Resort has adopt- ed enhanced cleaning and sanitation protocols wherever possible. Due to COVID-19, the Resort anticipates that it will look different from the last time that you visited (or, if you are visiting for the first time, from what you might expect), but the Resort is doing its best to ensure that you will enjoy your stay and make great mem- ories in as safe a setting as possible! 3. RISKS: Resident is awar e of the Cor onavir us (COVID-19). Resort strongly advises Resident to visit https://www.cdc.gov/coronavirus/2019-nCoV/index.html for information about COVID-19. COVID-19 may cause severe illness and even death. Arizona has community spread of COVID-19. COVID-19 is a viral illness that spreads from person to person via various methods, including but not limited to touch and airborne parti- cles. Symptoms can range from mild (or no symptoms) to severe illness. A person can become infected by coming into close contact (about 6 feet) with someone who has COVID-19. A person may become infected from respiratory droplets when an infected person coughs, sneezes, or talks. A person may also become infect- ed by touching a surface or object with the virus on it, and then touching the person’s face. There is no vaccine for COVID-19. 4
AMENITIES ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY AS TO COVID-19 (cont.) RISKS (cont.): The best protection is to avoid being exposed to the virus that causes COVID-19. The U.S. Centers for Disease Control and Prevention’s (“CDC”) COVID-19 Guidance suggests, in relevant part: (a) staying home as much as possible and avoiding close contact with others; (b) wearing a cloth face covering over your nose and mouth in public settings; (c) cleaning and disinfecting frequently-touched surfaces; (d) washing your hands often with soap and water for at least 20 seconds or using an alcohol-based hand sanitizer containing at least 60% alcohol; (e) completing activities online as much as possible (rather than in person); (f) if you must go somewhere in person, staying at least 6 feet away from others and disinfecting items you must touch; (g) getting deliveries and takeout and limiting in-person contact as much as possible; and (h) staying home if you are sick, except to get medical care. Everyone is at risk of getting COVID-19. Older adults and people with serious underlying medical conditions may be at higher risk for more severe illness. Resort has made Resident aware of the risk of contracting COVID-19. Resident understands that if Resident uses Facilities, Resident may con- tract COVID-19. Resident will review the CDC’s Guidance and website and the Arizona Department of Health’s website and guidance regarding COVID-19, available at https://www.azdhs.gov, before using any Fa- cilities. Resident has reviewed those sources and is willing to accept the risk of contracting COVID-19 in using any Facilities. Resident uses any Facilities at Resident’s own, sole risk. 4. HEALTH/SAFETY: Resident should consult with a medical doctor r egar ding Resident ’s use of Facilities. Resident should have and maintain health insurance. Resident will not use any Facilities if Resident has COVID-19 symptoms, a fever, cough, or feels ill. Resident will obey all posted signs and instructions, and di- rectives of management, while visiting the Resort. Resident agrees to wear a protective face covering when using any Resort Facilities or common area if so required by posted signage or management directives. 5. WAIVER, RELEASE, INDEMNIFICATION: To the fullest extent allowed by law, Resident, on behalf of Resident’s self and Resident’s heirs, successors, and assigns, by using any Resort Facilities or amenities, releas- es and forever discharges and holds harmless the Resort from any and all liability and any and all claims, de- mands, rights of action, or actions, of whatever kind of nature, either in law or equity, which arise or may here- after arise from Resident’s use of Facilities, which relate to COVID-19 or any related illness. Resident under- stands and acknowledges that Resident’s use of any Resort Facilities or amenities discharges and will discharge the Resort from any liability or claim that Resident may have against the Resort with respect to any bodily inju- ries, personal injuries, illnesses, contraction of COVID-19, death, death from COVID-19, injury from COVID- 19, property damage, or any and all other claims that may result from Resident’s use of Facilities. Resident hereby agrees to indemnify, defend, and hold harmless Resort and its officials, officers, employees, agents, vol- unteers, sponsors, and contractors from and against any claim that Resident, Resident’s guests, visitors, legal guardian, heirs, successors, assigns, or any other person may have for any losses, damages, death, or injuries arising out of or in connection with Resident’s use of Facilities. ALL USE OF THE FACILITIES IS AT RESI- DENT’S OWN AND SOLE RISK, AND BY USING THE FACILITIES, RESIDENT AGREES TO THIS WAIVER, RELEASE, AND INDEMNIFICATION. 6. BROADEST RELEASE POSSIBLE: This Release is intended to be as br oad as per mitted by Ar izona law, subject to the provisions of A.R.S. § 33-2106. REGISTRATION / RESERVATIONS Minimum Age Policy: Val Vista Village, Fiesta & Ranchos are resort communities for persons age 55 and older. A second person occupying a site must be a minimum of 40 years of age. Visitors may stay on an occasional temporary basis. Arrival-Registration: All guests must register at the Val Vista Village Guest Services office. Courtesy Patrol & the Ranger volunteers will escort RVs to their site after they register. ANNUAL residents will be required to complete an annual registration form and provide current proof of insurance each year. (Declarations page) Check Out Time: The RV site check-out time is 12:00 NOON. Please notify Guest Services of your departure in order to make arrangements for any unpaid charges for rent and final electric. Any unpaid balance will be charged to your credit card. Return badges to Guest Services. Fiesta residents must return Post Office key to Guest Services. Val Vista Village residents must return their keys to the Val Vista Post Office. Badges: Name Badges must be wor n at all times when using the amenities or facilities as a means of identifica- tion. Persons who are not wearing a badge may be asked to leave the facilities. Annual residents 1st badge free. Replacements can be purchased at Guest Services. (Homeowner must register their guest at Guest Services to receive their name badge). Occupancy: All rates are based on a maximum of two (2) persons per site. There is a charge for any additional person and they must be registered with Guest Services. Visitor fees: Rent is based on a maximum of two (2) persons per home or RV. Your overnight visitor(s) using any of the facilities including children must be registered in Guest Services upon arrival. They will be issued a name badge which is to be worn at all times while using any of the facilities. A visitor host must accompany all visitors in any of the facilities; regardless of age. Residents are responsible for the actions and conduct of their visitors. Visitors are allowed only when the owner is residing at the unit. Rents are payable in advance for the time reserved: Your site is guaranteed for the period of time you paid for at the time of registration. Annual reservations have first priority. Owners of permanently set Resort Homes in Val Vista Village and Fiesta must pay the current annual rate each year on or before the anniversary date of September 1. Ranchos residents pay by the month as set by the manufactured home community guidelines on or before the 1st of each month. Rent and utilities: Cal-Am Properties is offering you the ability to pay your charges via electronic check or credit card (convenience fees apply) as well as traditional bank check. United States checking accounts only for E Checks and Visa, MC, American Express and Discover cards which can transact in the United States are also required. Foreign or other transaction fees from your provider may apply. Please call 480-832-2547 to make payment. Rent late charges: If rent is not received within five (5) days after the date due, there will be a late charge of $25.00 and $5.00 per day from your original due date for each day thereafter that the account remains unpaid. NSF RETURNED CHECKS FEE- $25.00 Reservations: We will accept reservations for daily, weekly, monthly, seasonal and annual periods. The appropriate deposit will hold the reservation. The deposit guarantees you a site but not a particular site number. The rent will begin the first day of the reservation, not the first day of your arrival should it be later or earlier. Site Rental Priority: Annual r esor t home site r eser vations have fir st pr ior ity of site choice. If ther e is a r equest to place a resort home on the site you are occupying, you will have the choice of either placing a resort home on the site with an annual reservation or moving to another site. All monthly reservations will be moved for a resort home reservation request. 9
RESERVATION POLICY All stays other than annual will be on a first come, first serve basis with returning guests of two months or longer getting first priority (2 months or longer must fall under peak season-Jan., Feb., Mar.) RETURNING GUESTS OF TWO MONTHS OR LONGER (during peak season-Jan., Feb., Mar.) MUST MAKE THEIR RESERVATION ON OR BEFORE FEBRUARY 15TH TO EXERCISE THE FIRST PRIORITY RIGHT. A $250.00 deposit is required to reserve the site. On FEBRUARY 16TH if you have not made your res- ervation, your site will be open for others to reserve. As stated in the guidelines, we cannot guarantee a specific site. We do, however, try our best to accommodate requests for specific sites. Annual resort home placements trump RV reservations. Please Note: Any unpaid balances at time of check out will be charged to your credit card. We thank you for choosing Val Vista Villages RV Resort and we look forward to your arrival! Refund Cancellation Policy RV Sites: There will be no refunds on previously paid rent or electric. Final electric bills where applicable, must be paid before the RV leaves the resort. No refunds on daily or weekly deposits or rents. There is a $50.00 processing fee on ALL cancellations. Guests who choose to cancel their monthly space reservation prior to its expiration date must give a 30-day written notification to vacate and will be charged on a monthly, weekly, and daily basis as opposed to pro-rating. Refund Cancellation, Intent to Vacate Policy Resort Homes: Annual Home Owners who wish to cancel their reservation must give 30 day written notice by completing an “Intent to Vacate” form obtained from Guest Services Office. NO refunds will be issued on annual home owners rent. 10
RESORT GUIDELINES Age / Condition of RVs and Resort Homes: Management reserves the right to refuse any resort home or RV based on age, condition and length. The only type of RVs accepted in Val Vista Village and Fiesta are Motor Homes, Travel trailers, 5th Wheels and Park Models, NO exceptions. The Ranchos home sites are set up for multi section manufactured homes and the pull through sites are set up for Motor Homes, Travel Trailers and 5th Wheels. All units must be a minimum of 22 Ft. in length, not including hitch. Bicycles & Golf Carts: Must, both obser ve the same tr affic patter ns as motor ists. Bicycles: It is strongly recommended that bicycles have the proper reflectors and that the rider wear helmets. Bicycles must have both the appropriate front and rear lighting when riding at night. It is highly recommended that you lock your bicycle at night with a secure chain and lock for safe keeping. Golf Carts: For safety reasons, only licensed drivers are allowed to drive a golf cart within the resort. The golf cart must be proper- ly lit for night driving. Driving/Walking Through sites: Driving through vacant sites is not permitted. Any damage to utilities will be billed to the person responsible. Please do not walk through other guests’ occupied sites. Telephone Service: Resor t does not guar antee telephone landline to ever y site. Home site maintenance: Home site, patio and dr iveway ar e to be fr ee of weeds and over gr own shr ubs, clutter , unsightly items, loose items such as boxes, unattached canopies, or additional trash containers other than the one provided by the City of Mesa. Flowers or vegetation which need special care are to be removed before you depart. NO indoor furniture is allowed on patio such as oversized sofa and chairs. Appliances are not permitted on your patio, driveway or behind home, i.e. washers and dryers, freezers, refrigerators, etc. Clothes lines and hanging laundry are prohibited outside on your site. When you leave your home for an extended period of time, please make arrangements for a caretaker. If it becomes necessary for the resort staff to clean up your site, a charge of $20.00 per man hour will be charged and billed to you. * It has been recommended by Mesa Police Dept. that when you leave you do not put up ropes or chains across the driveway or aluminum on the windows. Resort Employees of the Villages are prohibit- ed from performing tasks for individual guests except in emergencies and /or specifically authorized by management. Please see Guest Services for more details. Home Owner Insurance: Resident must pr ovide r esor t annually with adequate “Fire and Extended Coverage” on their Resort Home and must maintain reasonable “General Liability” insurance. Val Vista Villages strongly recommends that all residents with RVs or park models install a surge protector designed for their type of RV or park model. This recommendation is for the protection of the electrical system in your home or RV. The resort will not be held responsible for any damage to your electrical system. Home & site improvements: All site & resort home improvements require management approval, please see the Architectural Guidelines section of this booklet. Patio Sales: ar e not per mitted except dur ing Resor t wide events which ar e typically held twice a year . Check with Activities Office for dates. Speed Limit: 14 1/2 mph thr ough out the r esor t. Parking on the Street: All vehicles must be removed from the street by 10:00 PM. Overnight or extended parking on streets must have a special overnight parking permit. Street parking during the day is permitted for short term only. Parking must not create a hazard or impede emergency vehicles. Parking in vacant sites is prohibited and may result in towing vehicle off property at your expense. Be a Good Neighbor: To par k in another Guest’s site requires written permission from that guest, which must be on file with Guest Services. With permission, you may park a car, pickup or van type vehicle. RVs and trailers are NOT permitted. Please do not drive or walk through your neighbors’ site that is occupied. Note* Driving through vacant sites could damage the underground utilities which would be repaired at your expense. Guest Parking and Additional Vehicles: The driveway area on each home site is the designated parking area for vehicles. This is the only area to be utilized for vehicle parking. This area is designed to accommodate two vehicles. If the guest chooses to construct a room addition or shed in this area, it is that guest’s responsibility to make arrangements for parking of vehicles in accordance with these guidelines or park any additional vehicles off property. Parking at Community buildings parking areas is for Guests and Visitors only. Overnight parking is not permitted in these areas unless a special overnight parking permit has been obtained from Guest Services. No vehicles are allowed to park on empty sites. Vehicles in violation of these guidelines are subject to towing. All vehicles parked or stored in the Village Resorts must be currently licensed, registered, operable and may not be in unsightly condition. All Residents & Guests must have a current Resident Resort Village vehicle ID sticker or vehicle ID pass for the rear view mirror. Parking Towed Vehicles: RV’s towing enclosed cargo trailers may park the trailer on the site only when they fit properly and do not infringe proper vehicle parking. Cargo trailers will not be allowed to park on Resort home (park model) sites. No boats or open trailers are to be parked on any site. 11 7
RESORT GUIDELINES (con’t) Vehicle loading or unloading: We allow ample time to load or unload a second vehicle or RV befor e it must be removed from the street. No vehicles are allowed to be parked on the street overnight. Under no circumstances may a vehicle be parked in such a way that will block the street or impair the passage of any emergency vehicles, RV or motor vehicle. No vehicle of any type may be parked or stored on a vacant home site. Vehicles in violation of this guideline are subject to towing. Visitor Policy: Guests will be char ged the visitor fee of $3.00 per day per per son or $50.00 per month plus tax. Annual park model residents are allowed two (2) guests total, to stay free of charge for up to two consecutive weeks at any one time and no longer than 30 days in any calendar year at Val Vista Village/Fiesta & Ranchos. Management re- serves the right to limit the number of visitors a guest may have at one time. Visitors / Guests staying longer than 30 days must have management approval and complete the annual resident requirements. Residents are responsible for the actions and conduct of their visitors. Visitors are allowed only when the owner is residing at the unit. Underage guests are not allowed to occupy your home in the summer or winter unless the homeowner is on premise or your guest meets our age requirements and is registered at Guest Services. Visiting Children: Val Vista Village is a 55+ community. Due to the adult or ientation, guests must r emember that certain restrictions exist for visiting children. 1) Guests are responsible for the conduct and actions of the children visiting them. 2) All children must be supervised (accompanied by a guest or parent) at all times when they are using any facilities. 3) Only persons 18 or over are permitted to use the Hot Tubs/Jacuzzi (accompanied with resident) 4) NO skateboards allowed. Roller blades ar e allowed on str eets only. 5) Children under 16 are not allowed to drive golf carts in the resort, only licensed drivers. 6) Visiting children under 18 are not allowed to use the Computer Room 7) Visiting children under 18 are not allowed in the Billiards Room 8) No one under the age of 16 is allowed to use any equipment without supervision Quiet Time: Please observe quiet time and keep noise to a minimum between the hours of 10:00 PM & 7:00 AM. Proper Attire: No bathing suits, bar e feet or without a shir t will be allowed in the Community Building or other resort facilities. Maintenance Requests: Contact the Guest Ser vices Office by phone or in per son, a wor k or der will be written up. After hours emergencies contact the Welcome Center. Smoking: Val Vista Village falls under the City of Mesa smoking or dinance. Ther e is no smoking per mitted within 20 feet of any building, facility, or amenity. The Resort prohibits smoking in the Courtyard and all pool areas. This includes E-Cigarettes. Fire Pits: Wood bur ning fir e pits ar e pr ohibited. RV Storage: No longer have on site stor age or stor age in Ranchos. Soliciting: Soliciting is not permitted in the Resort. If you see someone soliciting, please call Guest Services or Courte- sy Patrol so that appropriate action may be taken. Residents may not enter other residents’ spaces without a prior invita- tion and may not engage in door-to-door solicitation. Caregiver: Per sonal Car egiver must be at least 18 year s of age and r egister at Guest Ser vices to r eceive a name badge and vehicle pass. Caregivers do not have the rights and privileges to use any of the resort facilities. Caregivers do not have any rights of tenancy. Trees, Citrus fruit: You may only harvest citrus fruit from the tree located on your home site, DO NOT harvest fruit from any occupied home site, whether Resort Home or RV, without permission from the guest. Weapons / Firearms / Dangerous instruments: The Resort prohibits the use or carrying of firearms or other weapons in the resort except for transfer between home and vehicle and law enforcement personnel. Including but not limited to BB guns, air guns, sling shots, bow & arrows. Feeding Animals: Feeding bir ds, r abbits or str ay cats or dogs is not per mitted. Rules Posted: Guests and their Visitors must observe all rules posted by management at facilities in the resort. All posted rules shall be considered a part of these Resort Guidelines. Conduct: Guests and Visitor s must behave in a r easonable and r espectful manner towar ds other Guests and Visi- tors in the resort and towards Resort management, employees, volunteers, and contractors. Guests and Visitors may not disturb the quiet enjoyment of the premises of other Guests or Visitors. Offensive or harassing conduct will not be toler- ated. 12
Pet Policies 1) Val Vista Village is 100% Pet Friendly. All pets must be r egister ed with Guest Ser vices at time of check-in to the Resort. Resort homeowners with pets must update and sign a Pet Agreement annually. Failure to disclose that you have a pet or accurately advise the number of pets you have is a violation of the Pet Policy and Management may request that the pet be removed from the resort or the guest may be requested to vacate the resort. 2) Vaccinations: Guests ar e r equir ed to pr ovide a copy of cur r ent vaccinations for their pet(s). Shots r equir ed for dogs are Distemper, Bordetella, and Rabies. Pets not current with their vaccinations will be required to have vac- cinations completed after arrival at a veterinarian of the guest’s choice. Guest certifies that all pets are licensed with the proper authorities. 3) Two Pet limit per site. Size and weight limits: upon Manager ’s approval. 4) Pets are to be in the presence and control of the owner or responsible person at all times. Guest agrees pets will be on leashes no longer than 6’ at all times. Pets are to be in the presence and control of their owner or responsi- ble person at all times. Pets are not to be left unattended at any time. Pets are not allowed in any of the Resort facili- ties. Outdoor kennels, fencing or other enclosures are not permitted to be left on the site when not in use. 5) Five Pet Runs have been pr ovided thr oughout the r esor t and ar e for the enjoyment of you and your pet. (See the resort map for the exact locations.) PLEASE walk briskly or drive your pet to the pet runs. Please don’t allow your pet to meander onto your neighbors site or on the vacant sites on the way to the pet run. Pets must be supervised in the pet runs and you must always pick up after your pet. 6) Pet Droppings: Car r y appr opr iate means for cleaning up the pet’s droppings and pick up immediately. (Doggie bags are provided at the pet runs for your convenience) 7) Pets are not to invade the privacy of any other guest’s site or must not interfere with other guests’ peaceful en- joyment of the resort such as: excessive barking, aggressive behavior etc. Pets are not allowed in or near the com- mon areas of the resort, including the grassy areas. 8) The guest agrees to be responsible for the pet(s) and to immediately reimburse the RV Resort and or any other guest or any other persons for any damages caused by the pet(s). In any event the guest expressly agrees to indemni- fy and hold harmless the management and owner of this RV community of any and all liability or claims of liability arising in connection with the pet (s), including attorney’s fees. 9) If pet (s) is/are loose on premises, guest agrees that management may, but is not obligated to, retrieve and return it to the guest, or cause appropriate officials to impound it. Guest agrees to indemnify management and owner for any damages or expenses it may incur carrying out any of these foregoing options. 10) Guest agrees that if any violation of the Pet Guidelines is observed or another guest makes a valid complaint, the pet (s) owner will receive an official written warning to correct the problem, remove the pet (s) or vacate the RV Re- sort. If a second violation is noted or a second valid complaint is received, the pet (s) owner will receive notice to vacate for behavior in violation of the Pet Guidelines. 11) Guest certifies that pet (s) vaccinations are current and will be kept current for the duration of stay in the RV Re- sort. Guest certifies that pet (s) is/are licensed with the proper authorities. 12) Guest will be required to sign an agreement of understanding of the resort pet policies and list identification in- formation of their pet (s). 13) Exceptions are made to these rules for assistive animals. 13

All sign-in/sign out sheets will be maintained in the Activity Office. There will be a “Volunteer Appreciation Day” each year. Val Vista Village will recognize all volunteers who qualify. Courtesy Patrol: The Welcome Center at the Val Vista Village is staffed ever yday. They will assist you with information and direction when the Guest Services office is closed. The Ranger patrol and escort volunteers are on duty in season at various times. These services are not security staff. Please use common sense and take precautionary measures to assure your personal safety and protect your belongings by locking your doors, windows, sheds, etc. It is recommended that you lock your bicycles/scooters with a cable and sufficient lock at night. Report any suspicious situations FIRST to the police and then to Courtesy Patrol-Welcome Center or the Guest Services. You are required to STOP at the Welcome Center each time you enter the resort. Welcome Center Entrances: The main entr ance is at Val Vista Village due to the location of the Guest Ser vices office for the entire Village. Exits: There are 3 exit gates, one on Park Place in Val Vista Village, exiting on University Dr. This gate will remain closed at all times, opening only when a vehicle approaches it to exit. The other gates exiting onto Main St., and E. University Dr. will also remain closed at all times, opening only when a vehicle approaches them to exit. Park model owners and Rancho homeowners may purchase a remote for entering through the Main St., and E. University Dr. gates from Guest Services. 14
Amenities & Services (con’t) Laundry Facilities: Building “J” in Val Vista and Building “T3” in Fiesta are the locations for the laundries. They are open daily from 6:00 AM to 11:00 PM. The laundry in Building “J” of Val Vista Village has the new convenience of the card system. (Purchase the card at Guest Services & the W elcome Center on weekends). The laundry in Building “T3” in Fiesta uses coins. Clothes lines & laundry are prohibited from hanging outside on your site. Post Office: is located in Val Vista Village building “D”. Certified, registered, flat rate mail, priority, packages and stamps are all available at this US Postal Service Contract Station. The hours are Mon.-Fri. 9:00amto 2:00pm Sat. 9am-12pm during the winter. Summer hours Mon. - Fri. 9am to 12pm. Mail is picked up ever y day except Sunday & Holidays. Address: 233 N. SWIMMING POOLS AND HOT TUBS Please read & follow the posted guidelines at each pool & hot tub There are no lifeguards on duty, swim safely at your own risk. No one under the age of 16 is allowed in the Hot tubs. The pools are open 24 hours except when they are being cleaned. To Maintain a Clean Pool: Please use the shower prior to entering the pool and after applying suntan lotions. Suntan lotions effect the chemical balance of the pool. The Pool Temperature: The pool is heated from October to May at a safe temperature, per Maricopa County Health Department. The Resort maintains our pools at 84 degrees but will vary due to outside temperatures. Children under 16 year s of age ar e allowed to swim with the r esponsible r esident dur ing the hour s of 9am to 11am in Val Vista Village outdoor pool only. At Fiesta and Rancho pools, childr en hour s: 11am to 1pm and 4pm to 6pm. Childr en age 3 and under must wear a swimming diaper. NO r egular diaper s allowed. Childr en ar e not allowed in the VVV indoor pool. Name Badges: Your name badge must be with you when using the pool to show staff if asked. Swimwear: Appr opr iate swimwear must be wor n at all times. Speedos and thongs are not allowed. TRASH and RECYCLING: Val Vista Village, Fiesta and Rancho’s pr ovides tr ash and r ecycling collection to all sites. The City of Mesa Sani- tation Department collects trash each Friday. Recycling pickup is every other Tuesday. Please place your trash in the container provided and have it curb side on the designated side of your street by 6:00am. Large items Please contact Guest Services for assistance and prices for removal of all large items. Brush and trimmings will be picked up by Val Vista Village if r equested. Please put in 4 ft. bundles. Call Guest Services to place a work order request. Utilities: Each Village Resort has some variation to the utilities that are not included in the rent. All sites are equipped with a minimum of 30 AMP service. Please inquire at the Guest Services business office regarding the utility billing procedure for your site. UPGRADES : Resident (s) or commercial service companies are not to make any upgrades or repairs to the electric service without prior management approval. PLEASE CALL Guest Services for any needed re- pairs. If you call for an outside electrician or plumber it will be your responsibility to pay for the services. Val Vista Village strongly recommends that all residents with RVs or park models install a surge protector designed for their type of RV or park model. This recommendation is for the protection of the electrical system in your home or RV. The resort will not be held responsible for any damage to your electrical system. Generator use is not permitted in the resort unless permission is given by resort manager. PROPANE: Please contact Guest Services for information on local propane companies servicing the Resort. Note: Fire Ordinance does not allow propane bottles to be filled in the resort.. They will pick up your tank and leave a replacement one. The propane bot- tles must be on concrete blocks and must be secured with a chain to prevent tipping. Residents must comply with all state and lo- cal requirements for use of propane on resort property. 16
SELLING, BUYING AND RENTING RESORT HOMES & RV’s 1) Resort Site Evaluations must be completed by Resor t management for any Resor t Home that is intended to r e- main in the Village Resorts. The evaluation is based on current setback requirements and city codes. NOTE* To “Grandfather” an existing code violation is not possible if it was a violation of the City of Mesa Building Code at the time the improvement was made. Other existing “grandfather” rights cease with the ownership change unless speci- fied in writing by Resort Management prior to the transfer of title. The seller must correct any violations prior to the sale, or the buyer must agree in writing to make the necessary changes within a limited agreed upon time frame. Refusal to comply with required corrections can result in the sale not being finalized and/or the removal of the home from the resort. 2) Compliance Inspection: Inquir e at Sales Infor mation Center for this inspection, or to r eceive a FSBO packet. The homeowner is required to complete the necessary changes required by the Resort prior to the sale. *See A rchitectur- al standards-Permits Required. 3) Transfer of Ownership: The seller is to notify Sales Infor mation Center of the sale with a completed Tr ansfer of Ownership form. Proof of Val Vista Village compliance must be furnished prior to the transfer of ownership. Re- sponsibility for the site and rent remains with the seller until this step is completed. 3a) All New Residents: The resort requires authorization to process a Credit and Criminal Background Screening before completion of a home sale. There is a fee to the new home buyer for this screening. 4) Registration of new owner: The buyer must contact Sales Infor mation Center to complete the Village r egistr a- tion requirements PRIOR to the sale. If the buyer is to reside in the Villages, he/she must meet the age requirements and have Prior management approval. There is a $150.00 administration-processing fee for all transfer of owners, payable at the time of the transfer. *See Sales Associate for more detailed information 5) For Sale and For Rent: You may adver tise your Par k Model for sale or for r ent by listing all per tinent infor - mation on a FSBO card provided by the Sales Information Office. This information will be posted at the Sales Infor- mation Office. If and when your unit sells or rents, please notify the Sales Information Center so the FSBO card can be removed. Information flyers may be displayed on your deck or by the entrance door to your home. The holders must be clear or white in color only. *See Sales Associate for more detailed information. 6) Brokering: State of Ar izona allows an individual to buy and sell no mor e than two (2) vehicles (Par k Models) per year without a Dealer’s License (D-9), therefore a Resident operating as a Re-seller without the proper license is in violation of the Resort Guidelines and management reserves the right to terminate or refuse renewal of rental. 7) Guests are limited to owning no mor e than two (2) homes within the r esor t, one in which they r eside. 17
RENTING YOUR HOME OR RV: Resident may rent their RV or Resort Home under the following conditions: 1) Guest Services office is to be notified of the pending ar r ival of the r enter and may r equir e a copy of any rental agreement between the two parties. A renter staying beyond six (6) months must complete all the annual registration requirements including a background check. Resort management limits the rights to the number of rentals and or sub leases that will be allowed in a calendar year or 12 month period. 2) The renter (s) must conform to the age requirements of the Resort and abide by all Resort Rules and Regulations. 3) Tenants may not use websites like AirBNB, VRBO, HomeAway, and the like to sublet their RV/space. The Resort is intended for Tenants who either reside in the Resort full-time or who return seasonally. Subletting using AirBNB, VRBO, HomeAway, and the like constitutes running a business from the Resort in violation of these Rules and Regula- tions. Residents who use advertisements for VRBO’s will be issued compliance notices, if 3 compliance notices have been issued resort management will be forced to start the eviction process. 4) Arrangements for payment of electric bills must be made between owner and renter. The monthly billing for electric usage will remain in the owner’s name. The owner will be responsible for any unpaid electric bills. 5) An administration-processing fee for each time the home/unit is r ented of $30.00 is payable at the time of r egis- tration of the renter. Renter’s mail cannot be handled until proper registration in Guest Services is completed. 6) Homeowners relinquish his/her resort privileges and resort Club privileges during the time the home/unit is rented. MOVING YOUR RESORT HOME OUT OF THE RESORT AND CANCELING YOUR ANNUAL RESERVATION Tenant must provide the Park with a request for a Intent to Vacate not less than thirty (30) days prior to move-out (this time is necessary for management to make arrangements to enable the move-out). The seller is responsible for the site maintenance and all rent until the home is removed. The Resort requires all contractors to be certified and to be registered in Guest Services and must provide a proper certificate of liability insurance prior to removal of any RV and/or park model. All work must be conducted during regular business hours 8 AM - 4 PM, Monday through Friday only. Contractors must report to Guest Services before starting any type of tear down. NO EXCEPTIONS! Tenant must pay all rent and other charges through the removal date before the Intent to Vacate will be issued. When the RV or park model is removed, all necessary and accessory structures such as sheds, awnings, carports, fences, Arizona rooms and the like must also be removed unless the Park requests or agrees otherwise in writing. When a park model home is removed, all concrete and asphalt on the space (including but not limited to concrete pads and driveways), and all landscaping and landscaping materials, must be removed unless the Park requests or agrees otherwise in writing. When a park model home is removed, the space must be left completely clear, with all holes and depressions filled in with clean fill dirt, so that is restored to a condition as if no home had ever been placed on it, and so that it is ready for the place- ment of a new home. The space must be left clean, free of trash, building materials and construction debris. All holes and depressions must be filled in. The space must be graded and level, and approximately the same level as adjoining lots. If fill dirt is necessary, Tenant is responsible for supplying clean fill dirt. Resident or contractor must notify Guest Services when the home is ready to be moved off the site. Val Vista Villages Site In- spector must conduct a site evaluation before home is allowed to be removed from the Resort. The resident nor contractor are authorized to discard any items in resort dumpster. NO EXCEPTIONS! If after Intent to Vacate 30 days expire, home/shed have been removed and site has not been cleaned up, 72 hours will be given to complete clean up. After 72 hours a $25 charge per man (minimum of $100) will be assessed to homeowner. Homeowner will continue to be charged rent for 30 days from the date of office’s receipt of notice or until lot is vacated; which ever occurs first. Specific information is outlined in Notice Of Intent To Vacate Form - Forms are available in Guest Services Office. 18
ARCHITECTURAL STANDARDS Residents are expected to keep their homes and accessory structures up to the Resort Architectural Standards. This includes repairing or replacing damaged skirting, air conditioners, evaporative coolers, trellises, storage enclosures, etc., as needed. Homes, carports, patios and other structures, which in the judgment of management, have become obsolete through neglect, basic design or age may require remodeling or removal from the Resort at the time of re- sale, or with at least (90) ninety days notice at any time by management.. APPROVED RV’S AND HOMES: VAL VISTA VILLAGE RESORT is a zoned RV Resort. We welcome Class A and Class C Motor Homes, Travel Trailers, 5th Wheels Park Models. All RV’s must be a minimum of 22 feet in length and maximum of 400 sq. feet of livable space, including all bays, tip- outs or slide-outs. All RV’s must be no more than 10 years old and or in good condition. Park Models units 1985 or older will be allowed to remain in the resort with a year to year inspection and approval by management each year. Management reserves the right to approve or reject any unit. SITE IMPROVEMENTS: All site improvements including new Resort Homes for outside painting, deck carpeting, awnings, sheds, concrete, land- scaping, etc. requires Management approval. Homesite improvement request forms are available at the Guest Services office. Your intended home improvement will need to be explained on the form and returned to Guest Services. You will be notified within (5) five working days of approval or disapproval. Approval is based on current requirements of Val Vista Village Resort and the City of Mesa Building code requirements and is not subject to prior conditions. Absolutely no work will commence on a Val Vista Village site without written Management approval and the appropriate Building Permit. Modifications attempted without approval will be subject to removal at the owners expense. All improvements that require a permit must be permitted through the City of Mesa. CONTRACTORS/SERVICE COMPANIES/PERSONS: It is the residents’ responsibility to inform the Guest Services office of the Company name performing services on the residents site. Only properly licensed and insured ven- dors/contractors are allowed to work in the Resort.. The resort must have a copy of their current proof of insurance for liability and workers compensation. 19
REQUIRED PERMITS VAL VISTA VILLAGE RESORT REQUIRED PERMITS To Place a Resort Home (Park Model) or other permanent unit. Previously owned Resort Homes (Park Models) must be inspected and approved prior to delivery and must have written permission from Resort Management before delivery and setup. Installing or replacing awnings, skirting, fencing , air conditioners and evaporative coolers. Modifying any electrical or plumbing. (i.e. washer & dryers) Landscaping, digging or adding concrete. Structural modification to any home. Any exterior “Project” involving any contractor and /or delivery from any vendor from outside the Resort. Paint colors for home, decks and or driveways. CITY OF MESA REQUIRED PERMITS: Electric additions or modifications. * All utility lines must be buried. Plumbing additions or modifications. Raised Decks if weight-bearing, such as below patio enclosures. No improvements that extend into setbacks will be approved, because of the hazard to buried electrical and plumbing lines. AIR CONDITIONERS & EVAPORATIVE COOLERS: Are to be on the ground only at the rear of the home and out of the rear easement. Note* Devices of any type, such as, air conditioners, evaporative coolers and solar panels are not to be mounted on the roof of the home or other structures. Evaporative coolers on park models are to be connected to the existing duct work. Existing evaporative coolers currently mounted on the roof or in the window are “grandfathered” until replacement is needed due to age/malfunction or the home is sold to a new owner. At the time the home is placed “For Sale” they must be removed and placed properly. (NO WINDOW A/C IS ALLOWED IN ANY WINDOWS OR WALL) AWNINGS A maximum length 40’ awning is allowed on permanent set resort homes. Subject to set backs, see page 15, Placement Settings Permanent Homes. RV awnings must be permanently attached to the RV. No free standing awnings are allowed at any site. Window awnings must not infringe upon the access to the side space and are not to protrude less than (7’) seven feet from the ground. Awnings placed over a permanent shed must be 20lb weight. In the event you have storm damage to your awning, it is your responsibility to send a reliable person/company to clean up and repair the awning. Due to liability reasons, resort staff will not be involved. Do not use an auger to anchor your RV, shed, or awning in the setback area.. 20
ARIZONA ROOMS/ PATIO ENCLOSURES: The enclosure may not exceed the length or width of the awning and must not restrict the parking for at least one vehicle. The Arizona rooms set back must be at least (18’) Eighteen feet from the front edge of the existing patio pad. It must be of similar exterior material to the permanent home and must conform to the City of Mesa building codes. Lattice is not allowed. Drawings for elevation, window and door locations, types, including descriptions of all materials, must be submitted together with any interior improvements on the building permit request. Maximum square footage is 400 square feet. Bay Windows must be noted on permit applications. Bay windows are considered in the calculations of square footage. (Sample worksheets are available at the Guest Services office). Firewalls are required by the City of Mesa between structures built next to the park model home. Electric service to the Arizona room is to be up to code and wired direct to the pedestal. DECKS: May not hinder or restrict the use of any exit from the unit and must not obstruct parking for at least one vehicle. The setback must be inline with the front edge of the home. FENCES/PRIVACY WALLS: No fencing of any kind is permitted. Those in existence may r emain in place until the home sells, repair is needed or management requests removal. Privacy walls must be of similar material to the exterior of the permanent unit. Fiberglass plastic or lattice is not permitted. Planting borders may be rock or clay colored brick. Those in existence of other colors or types may remain in place until the home sells, they become unsightly or management requests removal. LANDSCAPING: One citrus tree is the responsibility of Val Vista Resort. All other planting on annual sites is the sole responsibility of the resident. Location and type of plants must be submitted for approval by management. (Exception is small flowers). A minimum of three feet (3) of unobstructed passage must be maintained between sites. No large trees or cactus will be allowed in the side easement. Management reserves the right to limit the type of plantings and their heights and location. Management also reserves the right to remove objectionable plantings and bill the resident/renter at the rate of $25.00 per man hour. A thirty day notice will be given prior to management removing the plant/tree to allow the resident the option of removing them. LANDSCAPING will NOT be allowed in the rear easement, unless it is of a temporary nature, such as patio blocks & flower beds. NO CONCRETE other than the parking area/patios. Pavers ONLY. Plants Restricted : Val Vista Villages Resort home sites: Oleanders, Caster plants, Bougainvillea, Large Leaf Cactus, Chollo Cactus, Clinging Vines, Century Plants. Trees Restricted: No other trees other than the citrus tree furnished by the resort. Dwarf Trees allowed in boxes only. SIGNAGE: Prior written permission is required from the Resort management before adding or displaying any signage to your site or the exterior of the recreation vehicle or resort home, including but not limited to banners and/or flags. Obscene, offensive, political or inappro- priate flags will not be approved. FLAG POLES: Prior written permission is required from the Resort management before adding or installing an in ground flag pole . DRONES / RC PLANES: Drones / RC Planes cannot not be flown at any time on or above the resort property by residents / guests / third parties. The resort management reserves the right to use drones for marketing, special events and or activities PLACEMENT/SETTING PERMANENT HOMES VAL VISTA: MINIMUM SETBACKS: (Easement): Rear, will be (3’) feet. Guest Services Business office must be notified (2) two days prior to the arrival of a permanent home. A. Any deviations from these setbacks must have written approval from Management. B. No permanent home will be set without written approval of Val Vista Village Resort management. SATELLITE DISHES: Approval by Val Vista Resort management is required to guarantee placement of the dish. The dish should not be visible from the street. Maximum diameter of the dish will be (18”) eighteen inches in diameter, except for those permanently mounted on the mobile RV’S. STORAGE SHEDS: Only one (1) storage per Park Model site. No sheds on RV sites. Effective September 1, 2007 all new placements of permanent sheds must be located under the awning, extended all the way to the ceiling of the awning and covered with similar or like material and color as the home and meet City codes. Existing homes that have a permanent shed that is not of the same material, will be evaluated at the time of the sale to determine if the shed must be upgraded to meet current architectural standards or removed. Shed maximum size is 120 square feet. No sheds on RV sites. PERMITS are required by the City of Mesa for all new shed constuction. Firewalls are required by the City of Mesa on the wall of the shed adjacent to any structure closer than 6 feet. Temporary shed placement r equir es Val Vista Village per mit. They ar e to be used as a second ar ea for small stor age in addi- tion to the permanent shed. The permanent shed will be considered the primary storage area. Sheds on sites occupied on an Annual basis ar e highly r ecommended and may be placed on the site with a Val Vista Villages permit and approval. The shed must be movable and secured by tie down stakes and cable or brackets made to secure the shed. It is acceptable to place the storage shed on gravel but pavers is recommended. Placement will require a permit from Val Vista Resort. The area under the RV may not be used for storage. SKIRTING Skirting is required on permanent units and must be installed within four weeks of placement of the unit on the site. Skirting material must be new and of like material that is on the permanent unit. It is recommended that all skirting be on a 4” wide concrete base. This will deter rotting and termite damage and alkaline attack to the metal runner. RV’s, 5th Wheels and Trailers occupying the site annually must have wheel covers and skirt the forward (Hitch) area with Canvas and proper attachments or manufactured material to match the RV unit. UTILITIES: INSTALLATIONS: ELECTRIC: Each site has one (1) 50AMP, 220 volt circuit and one (1) 30 AMP, 110 volt circuit. These are maintained by the Resort. The cost of modifications is the financial responsibility of the resident. Electric lines on all permanent homes are to be buried and neoprene-covered. ARIZONA ROOM electric service is to be wired direct to the pedestal. Electric service to the storage shed will be done to City Code in romex and covered with drywall material. WASHERS & DRYERS: Must have management approval prior to installation. WATER lines on permanent homes are to be 3/4” copper tubing and buried below ground. SEWER lines shall be approved hard plastic line and buried below ground. (Note: Feminine products are prohibited from being flushed down the sewer pipes. Residents may be held responsible for sewer cleaning fees, if appropriate). NONCOMPLIANCE – INDEMNITY & ATTORNEY’S FEES Noncompliance with the Resort Guidelines: All the Village Resorts reserve the right to terminate or refuse renewal in the event that there have been rule infractions. This also includes site care infractions and conduct by Guests and/or their visitors that interferes with other guests quiet and enjoyment of the Resort. Indemnity and Attorney’s fees: Management is not responsible to guest, his visitors, employees or agents for loss, damage, death or injury of any kind by the use of the Resort, or by fire, flood, vandalism or other casualties, except those incidents resulting from the gross negligence or intentional acts of Resort, Resort management or Resort owners. Guest (s) hereby agrees to indemnify and waive all claims and demands against the Resort, Resort management or Resort owners, and will hold them harmless for liability for all claims unless arising from negligence and willful acts of Resort management or Resort owners. Guest further agrees to obtain and keep in full effect at his own cost, the extended insurance coverage for homeowner, fire and other liabilities to protect guest (s) and all others from loss and liability. Proof of this insurance is to be provided to Guest Services annually. All RV sites in the Village Resorts remain under the control of management at all times. 22
GENERAL ASSUMPTION OF RISK & RELEASE OF LIABILITY Caution: This is a release of legal rights. Read and understand it before accepting these terms by agree- ing to abide by all resort Rules & Regulations, of which this is incorporated. Cal-Am Resorts operates Recreational Vehicle Resorts throughout the State of Arizona. References to Cal-Am Resorts (\"Cal-Am\") include all of the Cal-Am Recreational Vehicle Resorts in the State of Arizona, the individual entities that own them, the entities that manage them, their officers, officials, employees, volunteers, contractors, agents, and assigns. Each Resort offers a wide variety of recreational and other amenities for use by its residents. These include (without limi- tation), therapy spas, hot tubs, swimming pools, exercise facilities, tennis courts, pickle ball courts, and facilities within clubhouses and in other areas of the Resort. These facilities include such things as wood working shops, weight rooms, lapidary shops and the like. Each Resort also offers organized activities. These include entertainment performances, pickleball tennis and other sports tournaments, swimming classes, exercise classes, dance classes, and field trips. Some activities are organized and spon- sored by the Resort; others by voluntary resident associations. Some activities entail payment of an additional fee to par- ticipate. Cal-Am Resorts are “dog friendly”. Additionally some are located in areas where certain varieties of wildlife may be en- countered. I/we, by electing to reside in a Cal-Am Recreational Vehicle Resort, may participate in one, some or all of the activities referred to above, and to use some or all of the facilities and amenities offered by any Cal-Am Resort as described above. In consideration of my participation in activities or use of facilities and amenities, I agree as follows: RISKS INVOLVED: I agr ee to closely inspect all facilities befor e using them. I under stand that some facilities such as therapy spas, hot tubs, swimming pools, exercise rooms, wood working shops, and other facilities represent a risk to health and safety. I understand that some activities such as tennis, swimming, pickleball, jogging, and participation in exercise, dance and swimming classes can be strenuous and can also pose a risk to my health and wellbeing. With respect to such activities I understand that I will participate only in those which I am medically and physically able to. I under- stand that some activities involve risks in traveling to, within, and/or returning from different areas, including, but not lim- ited to, political, legal, social, and economic conditions; different standards of design, safety, and maintenance of build- ings, public places, and conveyances; and local medical and weather conditions. I agree that in deciding to use any facility or participate in any activity, I will make my own investigation, will obtain materials from a variety of sources, and am willing to accept these risks. I understand the risks posed by animals and agree to use care when outside in a Resort espe- cially when encountering dogs or wildlife. HEALTH AND SAFETY: I have been advised to consult with a medical doctor with r egar d to my per sonal medical needs. I state that there are no health-related reasons or problems that preclude or restrict my participation in any activities that I elect to participate in or use any facilities that I choose to use. I have obtained all required and recommended immun- izations, if any. I recognize that Cal-Am is not obligated to attend to any of my medical or medication needs, and in fact may expressly instruct its employees to not attend to such needs, and I assume all risk and responsibility therefore. In case of a medical emergency occurring during my participation in any activities or use of any facility, I understand that I may receive no as- sistance from Cal-Am employees or volunteers, I am responsible for my own medical treatment and emergency care as needed, and agree to pay all expenses relating thereto and release and agree to hold harmless, defend and indemnify Cal- Am from all liability of any nature whatsoever for any actions. ASSUMPTION OF RISK AND RELEASE OF LIABILITY: Knowing the r isks descr ibed above, and in voluntar y consideration of being permitted to participate in the activities and use the facilities and amenities referred to above, I agree to release, indemnify, and defend Cal-Am and its officials, officers, employees, agents, volunteers, sponsors, and contractors from and against any claim which I, the participant, my legal guardian or any other person may have for any losses, damages or injuries arising out of or in connection with my participation or use. I also agree to fully acquaint all guests and invitees I permit to engage in such activities and/or use these facilities, with the foregoing and to defend, indemnify and hold Cal-Am harmless from any claims by any such guest or invitee arising out of such use or activity. I expressly understand that this assumption of risk and release of liability also applies to injury resulting from encounters with dogs, wildlife and other animals in the Resort. SIGNATURE: I indicate that by my r esidence at this Resor t, and/or signatur e on the Resor t r egistr ation car d, that I have read the terms and conditions of participation and use, and agree to abide by them. I have carefully read this Release Form and acknowledge that I understand it. No representation, statements, or inducements, oral or written, apart from the foregoing written statement, have been made. This Release Form shall be governed by the laws of the State of Arizona which shall be the forum for any lawsuits filed under or incident to this Release Form or to the participation in an activity or use of a facility.
