Gripz Fishing Hooks A totally new hook design, not just a new hook pattern Made from high grade Japanese wire, the key improvement has been the introduction of a se- ries of minute horizontal grooves on the inside of the specially designed arrow shaped hook point, where historically the barb would have been. These grooves allow the hook to grip se- curely in the fish’s mouth when pressure is applied, as the flesh presses into the grooves re- sulting in a firm hook hold with no slippage. As soon as the pressure is removed the hook re- turns to a barbless format allowing for easy and safe removal. LIABILITY The Company will be under no liability for any loss or damage howsoever arising from the use or conversion of the goods supplied and the Customer will indemnify the Company in respect of any claim brought by a third par- ty against the Company in respect of such loss or damage, providing always that nothing herein shall exclude, or purport to exclude, any liability of the Company where such exclusion of liability is prohibited, void, or unen- forceable under English Law. RETURN OF GOODS All representations or notifications regarding goods which clients wish to return to us for any reason or in the case of non-delivery of goods, either of which could result in the adjustment of an invoice, must be submitted within 10 days to us in writing and must be sent to our Office. Verbal notification or written notifications given to our staff in the field will not be accepted as being properly received by the Company. No deduction on the payment of the invoices may be made for goods returned to the company until the Company has issued an appropriate Credit Note to the purchaser. RETURNS All returns of goods must be sent Mon-Fri between the hours of 10am to 4pm, to the following address: Pallatrax Angling International Ltd, Higher Ashmansworthy, Woolsery, Bideford, Devon EX39 5RE. Returns must be accompanied by a letter giving a full explanation as to why the goods are being returned. Returns, wherever possible, should be accompanied by an invoice/dispatch note number. Returned goods must be in ‘as new’ con- dition and without price tags etc. RE-WAREHOUSING/ADMINISTRATION CHARGE Goods ordered in error will be subject to a 10% re-warehousing charge. No part packs are to be returned unless the goods are faulty. No orders, cheques or enquiries are to be enclosed with returns. We reserve the right to levy a re-warehousing charge of up to 10% at our discretion, or substantially more if the goods are marked, sub- standard or damaged in any way. Returned goods must be in ‘as new’ condition and without price tags etc. Carriage charges will also be charged at our cost. SETTLEMENT TERMS Invoices are due for payment within 30 days from the date on the invoice. Payment of cash or equivalent will only be deemed to have been paid when it has been received by the Company at its address. Payment by cheque will only be deemed to have been paid when the cheque has been cleared by the Payer’s bank. The goods remain the property of the Company until the account and invoice have been cleared in full. No deduc- tion in the payment of invoices may be made for returned goods until the Company has issued an appropriate credit note to the Purchaser. OVERDUE ACCOUNTS Any invoices that exceed our credit terms of 30th day after the date of invoice will be classified as overdue. Any overdue account may be passed out to our collection agents at the Company’s sole discretion and without no- tice. Should this become necessary, a collection surcharge of 15% of all amounts due will be added. In the event that legal action becomes necessary, late payment, interest and collection surcharges will be added to your account before a Summons is issued and all court fees and legal costs will be claimed in addition. We re- gret that deliveries will be suspended on all accounts that are overdue for settlement. TRADE PRICES Most items are sold in trade packs of five or ten single units, other than the Stonze®, which are sold in trade packs of 20, and all are subject to VAT at the current rate. PRO FORMA The first two orders are offered on a Pro Forma basis. Pro forma invoices are Nett. No settlement discount is allowed. Please allow 10 working days for cheque clearance before goods can be dispatched. RE-PRESENTED OR ‘BOUNCED’ CHEQUES and ‘MISSED’ BANKERS ORDER PAYMENTS If a cheque fails to clear your Bank on presentation or your Bank fail to make payment against your Bankers Or- der, we will separately surcharge your account by £30.00. These charges are made to offset our administration and cost of banking. WEIGHTS AND MEASURES All items sold are approximate weights, sizes and volumes. Any Trade Catalogue and our website do not consti- tute an offer for sale. All goods are offered subject to availability. The appearance of any item does not consti- tute an ‘offer for sale’. RETENTION OF TITLE Ownership of all the goods supplied by the Company shall remain the property of the Company and title shall not pass to the Buyer until cleared payment in full for all such items has been made. If payment in full for the goods is overdue, in whole or part, the Company shall have the right to repossess the goods and the Buyer hereby irrevocably grants permission to the Company or its representatives to enter upon such premises owned or under the control of the Buyer and to remove and, if necessary, detach the goods from such premises or from any other goods or property. GENERAL Unless otherwise agreed in writing by the Company, all orders are accepted and all goods dispatched under these Terms and Conditions, which will at all times apply to the exclusion of any other terms and conditions in- consistent herewith of purporting to modify the same. These Terms and Conditions shall be construed in ac- cordance with English Law and shall be subject to the jurisdiction of the English Courts. PREFERENCE We will give preference on deliveries of goods to our customers whose accounts are kept within our agreed trading terms. CANCELLATIONS A charge of 10% plus all carriage charges will apply if the Customer cancels an order after it has been dis- patched. Cancellation of all orders before dispatch must be confirmed in writing. Page 41
