over to the cessionary his/her right, title and interest in and to all the book debts of the cedent, both future and present of whatsoever nature and from whatsoever cause arising, as security for the abovementioned indebtedness of the cedent to the cessionary arising out of the obligation referred to in the recitals hereto or any payment made or liability incurred thereunder.1 1 A s t o t h e e f f e c t o f a c e s s i o n o f b o o k d e b t s s e e Goode, Durrant and Murray (Pty) Ltd v Glen and Wright NNO 1961 4 SA 617 (C) 621622. 2 Duration The cession which is the subject matter of this agreement shall endure and be of force and effect until the undertaking referred to in the recitals hereto has been cancelled and all liability of the cedent to the cessionary has been paid by the cedent to the cessionary or otherwise discharged.2 2 For the limited scope of such a term, see the remarks in Sasfin (Pty) Ltd v Beukes 1989 1 SA 1 (A) 10D et seq. 3 Undertakings by cedent 3.1 The cedent hereby undertakes and warrants3 that he/she: (a) has not entered into any agreement restricting or excluding the transferability of the claims that form the object of this cession; (b) has no knowledge of any counterclaims that may extinguish the claims that form the object of this cession; (c) has not, prior to this cession, ceded the claims that form the object of this cession to any other person or concern; (d) but if it should so happen that the cedent is in breach of this, then this cession shall operate as a cession of the cedent's reversionary rights, including all rights of action against the prior cessionary. 3.2 During such time as the cession which is the subject matter of this agreement remains of force and effect, the cedent agrees that he/she will: (a) deliver to the cessionary at intervals of not less than one month (or other suitable period) a list reflecting all debtors of the cedent, with their names and addresses, the nature and amount of the indebtedness of each of them, particulars of any bills of exchange, promissory notes, cheques, agreements, documents of title or other securities of whatsoever nature held in respect thereof, a statement showing whether the indebtedness is on open account or on credit, and in the latter event the terms of such credit; (b) upon demand deliver, cede, transfer or negotiate to the cessionary all or such of the bills of exchange, promissory notes, cheques, documents of title or other securities referred to in subparagraph (a) hereof as may be demanded, duly endorsed, ceded, transferred or negotiated in such form as shall render the cessionary the absolute owner thereof entitled in his/her own name to enforce payment thereof; (c) make available for inspection by the cessionary or his/her authorised agent at any time during normal business hours at the cedent's place of business all books of account, receipt and other books, papers and correspondence relating to the said book debts and the cedent's dealings with the debtors in respect of the indebtedness of each of them to him/her in his/her said business; (d) give the cessionary all such information concerning the said debtors as may be reasonably required by the cessionary to enable him/her to recover the amount owing by each of them. 3 The parties may, of course, come to a contrary agreement, ie that the cedent warrants the existence and validity of the claim. Inclusion of such a warranty will render this instrument liable to stamp duty in terms of s 6(2) of the Stamp Duties Act 77 of 1968: for the rate payable see item 20 of the First Schedule. 4 Undertakings by cessionary The cessionary agrees that he/she will during such time as the cession which is the subject matter of this agreement remains of force and effect: (a) not cede the rights ceded to him/her further;4 (b) not claim from or enter into negotiations with the debtor; (c) not notify the debtors of the cession until the cedent's debt falls due and he/she is unable to pay (or a fixed date or as the case may be); (d) pay the surplus of the proceeds of the claim to the cedent after he/she has satisfied his/her claim against the cedent; (e) recede to the cedent all the remaining rights after the cessionary's claim 4 This is a protection measure for the cedent and amounts to a pactum de non cedendo (an agreement prohibiting or restricting cession). 5 Authority5 5.1 The cessionary authorises the cedent to collect the said claims in his/her own name and keep the proceeds
until such time as the cessionary may determine.6 5.2 The cedent authorises the cessionary during the currency of this agreement from time to time (or under certain circumstances or in the absolute discretion of the cessionary) to give notice to all or any of the debtors of the cedent both present and future of the said cession. 5 Inclusion of an authorisation (power of attorney) will render this instrument liable to stamp duty in terms of s 6(2) of the Stamp Duties Act 77 of 1968. The stamp duty is R1, see item 19 of the First Schedule. 6 This procedure will be followed where the parties have decided on a confidential revolving security cession. 6.1 The pledgor authorises the pledgee to notify the debtors of the pledge.6 6.2 The pledgor authorises the pledgee, after maturity of the pledge,7 to claim from all or any of the debtors the whole or any portion of the debt and to keep so much of the proceeds for him/herself as are needed to satisfy the principal debt.8 (Alternatively: The pledgor authorises the pledgee, after maturity of the pledge, to sell the claim to the highest bidder at an execution sale and to keep so much of the proceeds for him/herself as are needed to satisfy the principal debt.9) 5 Inclusion of an authorisation (power of attorney) will render this instrument liable to stamp duty in terms of s 6(2) of the Stamp Duties Act 77 of 1968. The stamp duty is R1, see item 19 of the First Schedule. 6 Depending on the intention of the parties, this authorisation may be subject to a certain condition or time limit. MEMORANDUM OF AGREEMENT entered into between: (name of debtor) of (address) (\"the Debtor\") and the several persons, firms and companies whose names, the amounts of whose claims, and whose signatures appear in the schedule attached hereto marked Annexure \"A\" (\"the Creditors\") and (name of guarantor) of (address) (\"the Guarantor\") and (name of agent) of (address) (\"the Agent\")
WHEREAS (1) the Debtor is truly and lawfully indebted to the Creditors in the various sums set out in the schedule hereto; (2) the Debtor is not in a financial position forthwith to discharge all his said liabilities in full; (3) the Debtor and the Creditors wish to avoid the sequestration of the Debtor's estate, and to save further costs being incurred by the Creditors instituting or continuing legal proceedings for the recovery of their claims; (4) the Debtor is able to furnish security for the due payment to each of the Creditors of part of his or its claim in full settlement; (5) each of the Creditors has agreed, upon certain terms and conditions, to accept such part payment in full and final settlement of his or its claim; (6) the Creditors have appointed the Agent as their agent for the purposes of giving effect to this agreement; NOW THEREFORE it is agreed as follows: 1 Compromise of claims The Creditors hereby accept the sum of (specify) cents in the rand on the amount of their claims,2 in full and final settlement thereof. 2 This precedent envisages that the claims include the costs, if any, incurred by creditors in respect of legal proceedings already taken against the debtor prior to the compromise. If it is desired to provide for a situation where the compromise relates only to the original claims and the debtor is otherwise to pay in full costs which may already have been incurred, the following clauses may be inserted: \"(a) In addition to the amount payable in terms of clause 1, the Debtor shall pay the taxed party and party costs of those of the Creditors who have instituted proceedings against him for the recovery of their claims in full. (b) Payment of such costs to each such Creditor shall be made within (state) days after the total amount payable in terms of clause 1 hereof shall have been paid.\" It is considered that clause (b) is necessary because if the debtor is required to pay the costs forthwith, and he defaults, the creditors concerned could proceed to his sequestration and thus frustrate the whole compromise. Even if the debtor is required to pay the costs in instalments pari passu with the instalments payable in respect of the claims, the difficulty is not removed: because, in the event of default, enforcement of the claims for costs by the creditors concerned would again be potentially destructive of the whole compromise, they being entitled to proceed to sequestration of the debtor. The aforegoing assumes, of course, that only some of the creditors have additional claims for costs, so that there exists this conflict of interests between them and those who do not have such claims. Where, therefore, the creditors with additional claims for costs are not prepared to compromise such claims, or to agree to a postponement of the payment thereof as contemplated by clause (b) above, it is suggested that there would have to be a postponement of the right to enforce such payment by legal proceedings until the compromise has been discharged. For this contingency the following is suggested: omit clause (b) above and insert a clause after clause 2 reading: \"The total amount payable in terms of clause (state) (which is the amount compromised of all those amounts reflected in the schedule hereto which are (describe, for example, preceded by the letter C or whatever form is used to identify amounts representing costs) shall be paid by the Debtor to the Agent in (state) equal monthly instalments of R.................... (.................... RAND) (or as the case may be) pari passu with the payment of the instalments referred to in clause 2.1, and upon receipt of each of the firstmentioned instalments the Agent shall distribute the amount thereof pro rata among the Creditors concerned.\"; amend the existing clause 4 to indicate that it applies to instalments payable in terms of the existing clause 2, and after clause 4 insert the following clause: \"In the event of the Debtor failing to pay any one of the instalments referred to in clause (state) on due date, each of the Creditors concerned shall be entitled to take whatever steps he or it may deem advisable against the Debtor for the recovery of the full amount of his or its claim for costs as at the date of default, provided that no such steps shall be taken until the total amount payable in terms of clause 1 shall have been paid unless the Debtor has also defaulted in effecting payment of any one instalment in terms of clause 2.1.\" 2 Payment 2.1 The total amount payable to the Creditors in terms of clause 1 shall be paid by or on behalf of the Debtor to the Agent in (state) equal monthly instalments of R.................... (.................... RAND), the first on or before (day, month, year), the second on or before (day, month, year) and the third on or before (day, month, year). 2.2 Upon receipt of each instalment the Agent shall distribute to each of the Creditors that portion thereof to which he or it is entitled in terms of clause 1. 3 Guarantee The Guarantor irrevocably and in rem suam hereby binds himself as surety for and coprincipal debtor with the Debtor for the due payment of the instalments in terms of clause 2.1. 4 Default in payment of instalment 4.1 In the event of any one of the said instalments not being paid on due date the Creditors shall have the right forthwith to institute legal proceedings against the Debtor and/or the Guarantor for the recovery of the full amount payable by the Debtor in terms of clause 1 which is outstanding at the date of the Debtor's default. 4.2 Alternatively to clause 4.1, in the event of any one of the said instalments not being paid on due date the
Creditors shall have the right jointly to declare this agreement to have lapsed and each Creditor shall then be at liberty individually to take whatever steps he or it may deem advisable against the Debtor for the recovery of the full amount of his or its claim as set out in the schedule hereto less whatever amount he or it may have already received in terms of this agreement. 4.3 Should the Creditors elect to proceed in terms of clause 4.1, the Agent shall be entitled in his own name to act on behalf of all the Creditors in connection with the institution and prosecution of the aforesaid legal proceedings. 5 Agent's costs The costs incurred by the Agent in connection with the collection and distribution of the said instalments shall be paid by the Debtor to the Agent as and when demanded; if the Debtor fails to effect any such payment, it shall be payable by the Guarantor upon demand. This clause shall operate also in the situation where any such costs have been incurred and there has been default by the Debtor in respect of any obligation undertaken by him in terms of this agreement. 6 Agreement conditional on signing of schedule by each creditor This agreement shall have no force or effect unless on or before (day, month, year) the schedule hereto shall have been signed by each of the Creditors. 7 Agreement conditional on payment by debtor of costs of preparation and execution hereof The costs of the preparation and execution of this agreement shall be borne by the Debtor, who shall pay the same by not later than (day, month, year) and, failing such payment, this agreement shall have no force or effect. die bank toevertrou word tot die krediet van die tjekrekening van die applikant, en sal dit aan die aansoeker, na klaring daarvan, as kontant beskikbaar stel. Indien die bank enige betaling teen 'n dokument maak wat nie geklaar is nie, sal dit op die risiko van die aansoeker gedoen word, en sal die bank nie aanspreeklik gehou word vir sodanige betaling nie. 2 Die bank sal betaling teen enige tjek, wissel, promesse of enige ander verhandelbare dokument of betaling wat deur die aansoeker getrek word maak en sal sodanige betaling teen die tjekrekening van die aansoeker debiteer ongeag of sodanige rekening kredietwaardig is of nie. 3 Indien die aansoeker die tjekrekening sou oortrek sonder om vooraf reëlings met die bank te tref, of indien die aansoeker die oortrekkingsbedrag waartoe voorheen met die bank ooreengekom is oorskry sonder om vooraf reëlings met die bank te tref, sal die bank, sonder enige kennisgewing aan die aansoeker, geregtig wees om: 3.1 te weier om enige betaling te maak teen die dokument wat die gevolg sal hê dat die bank 'n betaling moet maak waartoe nie ooreengekom is nie; of 3.2 sodanige betaling te maak en te vereis dat enige bedrag waarmee die rekening oortrek is onmiddellik betaal word; 3.3 die betaling van rente op die bedrag waarmee die rekening oortrek is te vereis teen 'n koers volgens die goeddunke van die bank, maar nie die regtens voorgeskrewe maksimum rentekoers oorskry nie; 3.4 sodanige rente teen die rekening op 'n maandelikse basis te debiteer. 4 Die bank sal 'n retensiereg verkry oor enige dokument met monetêre waarde wat in sy besit geplaas word deur die aansoeker en sal daarop geregtig wees om sodanige dokument in te vorder vir die krediet van enige rekening van die aansoeker wat oortrek is. 5 Die bank sal daarop geregtig wees om die tjekrekening van die aansoeker te debiteer met sodanige bankkostes as waarop met die aansoeker ooreengekom word, of wat gebruiklik is vir die tipe besigheid wat deur die bank bedryf word, en hierdie kostes sal fooie, kommissies, rente en heffings insluit. 6 Die bank sal daarop geregtig wees om die skuldlas van die aansoeker te bewys, of die bedrag van rente verskuldig of die rentekoers by wyse van 'n sertifikaat wat deur die bestuurder van die bank onderteken is, en die korrektheid van die gesertifiseerde bedrag of inligting verskaf in die sertifikaat sal aanvaar word totdat die teendeel deur die aansoeker bewys word. 7 Die bank sal daarop geregtig wees om enige inligting wat die aansoeker aan die bank beskikbaar gestel het en wat verband hou met die aansoeker en sy/haar besigheid aan enige verwante besigheid in die groep waarvan die bank deel vorm bekend te maak, en sal daarop geregtig wees om die wyse waarop die aansoeker sy tjekrekening bedryf op versoek aan enige kredietburo bekend te maak. 8 Die aansoeker waarborg dat alle inligting wat hy/sy in die toekoms aan die bank mag verskaf in verband met sy f i n a n s i ë l e p o s i s i e a k k u r a a t e n b e t r o u b a a r s a l w e e s , e n d a t s o d a n i g e i n l i g t i n g d i e b a s i s s a l v o r m v a n d i e voortgesette bank en finansieringskontrak tussen die aansoeker en die bank. Die aansoeker sal die bank onmiddellik in kennis stel sodra enige wesenlike verandering plaasvind wat verband hou met enige inligting wat te enige tyd aan die bank verskaf word. 9 Indien die aansoeker van die bank vereis om 'n verpligting vir die betaling van enige bedrag getrek op die bankrekening van die aansoeker op enige wyse te verskaf, sal die aansoeker nie daarop geregtig wees om sodanige opdrag nadat dit uitgereik is terug te trek nie, tensy die aansoeker ook die dokument wat deur die bank uitgereik is wat die verpligting bevat ook aan die bank beskikbaar stel. 1 0 Die adres wat deur die aansoeker verskaf is in die besonderhede hierbo sal dien as domicilium citandi et executandi sowel as die adres vir die lewering van alle kennisgewings wat die bank aan die aansoeker wil rig. Die aansoeker mag sodanige adres verander nadat kennis van sodanige adresverandering aan die bank gegee is, maar die adresverandering sal slegs van krag word nadat die bank die aansoeker van 'n kwitansie wat kennisgewing van die adresverandering erken, voorsien het. Alle kennisgewings wat deur die bank aan die aansoeker gegee word sal geag word aan die aansoeker gelewer te wees op die dag waarop dit aan die aansoeker oorhandig word, of drie dae nadat dit aan die aansoeker gepos is. 1 1 Die aansoeker stem toe tot die jurisdiksie van die landdroshof wat jurisdiksie het oor sy/haar persoon soos b e p a a l d e u r a r t i k e l 4 5 v a n d i e W e t o p L a n d d r o s h o w e 3 2 v a n 1 9 4 4 v i r e n i g e g e d i n g e w a t d i e b a n k t e e n d i e aansoeker mag instel. Nieteenstaande hierdie ooreenkoms, sal die bank daarop geregtig wees om aksie in die Hooggeregshof in te stel indien die bank van mening is dat dit noodsaaklik en geregverdig is. E k , d i e o n d e r g e t e k e n d e , (o f O n s d i e l e d e / d i r e k t e u r e / v e n n o t e / l i k w i d a t e u r / t r u s t e e v a n ( v o e g n a a m v a n b e s l o t e korporasie, maatskappy, bestorwe boedel of trust in)) van adres (voeg die adres van die aansoeker vir tjekrekening in) versoek die volgende (o f het die volgende besluit geneem, onderworpe aan die voorwaardes hieronder uiteengesit): 1 Dat 'n tjekrekening in die naam van (voeg naam van aansoeker in) geopen word by die DEF tak van die ABC Bank. 2 Daar word van die bank vereis om die handtekeninge van die behoorlik gemagtigde ondertekenaars op alle tjeks, wissels en promesses of enige ander verhandelbare dokument wat aan die bank voorgelê word te aanvaar, en om in ooreenstemming met die opdragte vervat in sodanige dokumente te handel, om kragtens sodanige opdrage te betaal of die rekening in krediet is al dan nie en om enige betaling teen die rekening van die aansoeker te debiteer, om enige ooreenkoms of dokument wat voorgee deur die gemagtigde ondertekenaars van die aansoeker onderteken te wees wat verband hou met deposito's, waarborge, kredietbriewe, spaarrekeninge, telegrafies, elektronies of toonbanktransaksies te betaal en in ooreenstemming daarmee te handel. 3 Die name van die ondertekenaars mag van tyd tot tyd gewysig word, maar die wysiging sal slegs van krag wees wat die bank aanbetref nadat kennisgewing daarvan deur die bank ontvang is. 4 Die bank word versoek om te handel op die versoek van enige van die ondertekenaars wat die betaling van verhandelbare dokumente kanselleer of enige ander versiek vir betaling of debietorder, en om te reageer op die draer van skriftelike versoeke vir tjekboeke, depositostrokies, bankstate en balanssertifikate met betrekking tot die betrokke rekening, deposito of transmissie. 5 Die bank word versoek om enige stuk wat in die besit van die bank mag wees vir die doel van veilige bewaring aan die draer van 'n skriftelike versoek wat voorgee om deur enige van die gemagtigde ondertekenaars onderteken te wees, te oorhandig. 6 Hierdie magtiging sal gehou word by die tak van die bank waar die rekening geopen word, en sal van krag bly totdat dit gewysig of herroep word. 7 Die bank sal nie aanspreeklik gehou word vir die verlies wat vloei uit enige onopsigtige wysiging aangebring aan enige tjeks, wissels of promesses wat met skryfmateriaal wat uitgevee kan word, ingevul word nie. 8 Alle tjeks, wissels of promesses, onttrekkingstrokies, oordrag of betalingsopdragte aangaande die rekening wat redelik geag word geteken te wees of aanvaar te wees deur 'n ondertekenaar van die aansoeker en wat aan die bank gerig is vir uitvoering sal geag word 'n reëlmatige opdrag aan die bank te wees om daarkragtens te handel. 9 Die aansoeker onderneem om die bank onmiddellik in kennis te stel indien enige van die tjekboeke, rekeninge, state, depositoboeke of strokies of kaarte wat deur die bank voorsien word aan die aansoeker verlore sou raak of gesteel sou word. Die aansoeker onderneem om redelike sekerheidsmaatreëls te tref vir die veilige bewaring van alle bankgegewens wat deur die bank voorsien is aan die aansoeker en in besonder om enige PIN nommer veilig te bewaar. 10 Enige batige saldo wat op enige rekening wat deur die aansoeker met die bank of enige geaffilieerde besigheid bedryf word mag volgens oordeel van die bank gebruik word om enige debiet op enige rekening wat deur die aansoeker met die bank of enige geaffilieerde besigheid bedryf word te likwideer. 11 Die bank sal daarop geregtig wees om enige aanspreeklikheid van die aansoeker teenoor die bank aan enige party van sy keuse te sedeer. 1 2 Niks wat in hierdie opdrag vervat word, sal uitgelê word om 'n afstanddoening deur die bank van enige gemeenregtelike reg, of enige reg wat kragtens bankpraktyk aan die bank toekom, te wees nie. 1 3 Indien die bank toelaat die rekening oortrek word, of toelaat dat betaling teen ongeklaarde dokumente of effekte wat die gevolg het dat die rekening oortrek word, sal dit nie die gevolg hê dat 'n vermoede van estoppel teen die bank geskep word nie.
1 4 Indien die rekening in die naam van 'n vennootskap, maatskappy, beslote korporasie, trust of vereniging geopen word, moet alle dokumente wat deur die aansoeker uitgereik word deur (voeg getal in) v a n d i e ondertekenaars wat hierby aangeheg word, onderteken word. Indien die kaart of PIN verlore raak of gesteel word sal die bank daarop geregtig bly totdat skriftelike kennisgewing van die diefstal of verlies deur die bank ontvang is. Die bank sal geregtig wees om rente te hef op die betaling van enige bedrae indien die rekening oortrokke raak. 4 . 2 D i e b a n k m a g p e r k e s t e l a a n d i e a a n t a l o n t t r e k k i n g s w a t g e m a a k m a g w o r d s o w e l a s d i e a a n t a l o o r d r a g t e tussen rekeninge. 4.3 Die kaart en/of die spaarrekeningboek bly die eiendom van die bank, en moet op versoek van die bank aan die bank terugbesorg word. 4 . 4 R e n t e s a l b e t a a l w o r d o p e n i g e r e k e n i n g w a t o o r t r o k k e i s t e e n d i e r e n t e k o e r s t o e p a s l i k o p r e k e n i n g e w a t oortrokke is sonder dat vooraf reëlings met die bank getref word. 4.5 Die bank moet onmiddellik skriftelik in kennis gestel word van die verlies of diefstal van die kaart of PIN of boek wat na die betrokke rekening verwys. 4.6 Ek/ons onderneem om nie enige derde party toe te laat om die kaart te gebruik nie of om die PIN nommer aan enige derde party bekend te maak nie. 4.7 Ek/Ons kies die adres hierbo verskaf as domicilium citandi et executandi. 4.8 Ek/Ons stem toe tot die jurisdiksie van die landdroshof vir die doel om enige eis wat uit hierdie ooreenkoms mag voortvloei te bereg, en stem toe tot 'n kostebevel op die prokureurenkliënt skaal. 4.9 Ek/Ons stem toe dat 'n sertifikaat deur die bankbestuurder onderteken prima facie bewys sal wees van my/ons verskuldigdheid aan die bank, en prima facie bewys sal verskaf van die gebruik van 'n bankkaart of PIN vir enige besondere transaksie. Dit sal nie nodig wees om bewys te verskaf vir die aanstelling van die ondertekenaar van die sertifikaat nie. 5 Ek/Ons erken dat die inligting hierbo verskaf akkuraat is en dat dit die basis van die aansoek van die rekening verskaf. Ek/Ons erken dat niks hierin vervat op enige wyse van die toepassing van die normale prosedures en praktyke van die bank afbreuk sal doen nie. 1.1.1 \"die bank\" beteken ABC Bank (hierna \"die Bank\" genoem); 1.1.2 \"Aanvaarbaar\" beteken aanvaarbaar ingevolge standaard boupraktyk of wat voldoen aan die vereistes van die Nasionale Bouregulasies. 1.2 Voldoening aan bouregulasies Alle werk moet voldoen aan en uitgevoer word in ooreenstemming met die Nasionale Bouregulasies en Plaaslike Owerheid Verordeninge. Planne wat ingedien is by die bank moet deur die betrokke owerheid goedgekeur word en moet vergesel word van 'n skedule waarin alle afwerkings aangetoon word. 1.3 Materiaal en konstruksiemetodes Aanvaarbare materiaal en konstruksiemetodes word hieronder aangedui. Indien daar om enige rede verlang word om nuwe tipes boumateriaal of nuwe konstruksiemetodes te gebruik, moet die toestemming van die bank vooraf verkry word. Die bank behou die reg voor om enige materiaal of konstruksiemetode of te aanvaar of te verwerp sonder enige verhaal tot die bank. 1.4 Perseel identifikasie Die kliënt sal voor die aanvang van die bouwerk die grenspale of bakens van die bouperseel aan die bank se inspekteur aandui. Indien die pale of bakens nie identifiseerbaar is nie, moet die kliënt die dienste van 'n landmeter verkry ten einde die posisies te bepaal. 1.5 Kennisgewing van fondamentvore Die kliënt moet die bank drie dae kennis gee van die tyd waarop die fondamentvore of enige ander saak waarvoor inspeksie benodig word gereed sal wees vir inspeksie. Geen bouwerk sal begin of voortgesit word tensy sodanige inspeksie plaasgevind het nie. 1.6 Vorderingsbetalings Geen vorderingsbetalings sal gemaak word nie tensy: 1.6.1 die goedgekeurde planne of kennisgewing van goedkeuring, bouer se afstanddoenig van retensiereg, kontrakteurs se alle risiko versekeringspolis en alle ander dokumente wat verband hou met die lening voltooi is en deur beide die kliënt en die bouer onderteken is; 1.6.2 die vereiste kennis gegee is. 2 Voorbereiding van die perseel 2.1 Skoonmaak van die perseel 2.1.1 Die bouperseel moet skoon gemaak word en alle rommel en plantegroei moet verwyder word. Die perseel moet ondersoek word vir termietbedrywighede en, indien nodig, behandel word kragtens SABS 0124 wat verband hou met grondvergiftiging. 2.1.2 Waar bome of boomwortels binne die bouarea verwyder word, moet die grond gekonsolideer word. 2.2 Onstabiele grondtoestande 2.2.1 Die bank mag versoek dat die kliënt toetse laat neem van die grond deur 'n geregistreerde geotegniese grondingenieur. Indien bevind word dat die grond onstabiel is, moet 'n geregistreerde struktuuringenieur spesifikasies en tekeninge voorberei vir die versterking van beide die fondamente en die bostruktuur in samewerking met die geotegniese grondingenieur, tot die bevrediging van die bank. 2.2.2 Die ingenieur sal toesig hou oor die werk en 'n sertifikaat van goedkeuring lewer by voltooiing van die werk. 2.3 Uitgrawings 2.3.1 Enige uitgrawing vir enige fondamente sal tot op vaste natuurlike grond gegrawe word tensy andersins gespesifiseer deur 'n struktuuringenieur. 2.3.2 Alle uitgrawings sal afgewerk word om horisontaal en vertikaal te wees. Enige uitgrawing in soliede rots met vlakke wat nie horisontaal of vertikaal is nie, sal vasgeheg word soos bepaal in item 2.3.3. 2.3.3 Waar enige fondament op soliede rots geplaas word, moet die draarea skoon gemaak word en vasgeheg word om laterale beweging van sodanige fondament te voorkom. 2 . 3 . 4 Behalwe waar die fondament vir enige messelwerkbuitemuur op soliede rots geplaas word, moet die uitgrawing ten minste 300 mm onder die aangrensende afgewerkte grondvlak wees. 2 . 3 . 5 V o r e m o e t g e l y k g e m a a k e n a f g e v l a k w o r d . D i e l e n g t e v a n d i e v l a k k e m o e t d i e s e l f d e d i k t e w e e s s o o s gespesifiseer vir die betonsteunstukke in verhouding tot die berekende steenlae. Enige uitgrawings wat te diep uitgegrawe word moet tot op die korrekte vlakke opgevul word met Klas A beton; teruginvulling en vasstamp sal
nie aanvaar word nie. 2.4 Afmetings van fondamentsteunstukke vir messelwerkmure 2.4.1 Geag die reëls vir fondamente te bevredig Die volgende is algemene afmetings soos uiteengesit in die Nasionale Bouregulasies maar is onderworpe aan verandering soos bepaal deur die plaaslike owerheid of struktuuringenieur. Afmeting van strookfondament: minimum dikte: 200 mm minimum wydte: 600 mm 2.4.2 A l g e m e n e g i d s v i r d i e g r o o t t e s v a n f o n d a m e n t e ( o n d e r w o r p e a a n d i e p l a a s l i k e o w e r h e i d o f struktuuringenieur se goedkeuring): Buitemure 345 mm 715 mm x 200 mm Buitespoumure 270 mm 645 mm x 200 mm Buitemure 230 mm 600 mm x 200 mm Binnemure 110 mm 450 mm x 200 mm 2.4.3 Skoorstene, trappies en hoë gewels Beton mag nie minder as 150 mm verder as die buiterand van die steenwerk x 200 mm dikte wees nie. 2.5 Afmetings van fondamentsteunpunte onder houtraammure Fondamente moet opgerig word in ooreenstemming met SABS 082. (Verwys na die Nasionale Bouregulasies.) 2.6 Afmetings van fondamentsteunpunte onder messelsteenwerk grensmure Beton fondamente moet die wydte van die muur wees plus 300 mm en mag nie minder as 150 mm breed wees nie. 3 Beton en messelwerk 3.1 Fondamente 3.1.1 Fondamente moet gewapen wees waar vereis en die dikte mag nie minder as 200 mm wees nie. Trappe sal 'n minimum diepte hê afhangende van die helling van die grond met 'n oorhang van ten minste 150 mm. 3.1.2 Fondamentsteunpunte in onstabiele grondtoestande moet uitgevoer word soos beskryf in paragraaf 2.2 hierbo. 3.2 Waar enige betonvloerblad verdik is om 'n fondament te vorm: 3 . 2 . 1 moet die dikte, met inbegrip van sodanige vloerblad nie minder wees nie as wat vereis word vir 'n aaneenlopende strookfondament van 200 mm; 3.2.2 moet die breedte van die verdikte gedeelte onder sodanige vloerblad nie minder wees nie as wat vereis word vir 'n aaneenlopende strookfondament soos vereis deur die plaaslike owerheid; 3.2.3 sal die gebruik van hierdie sisteem slegs toelaatbaar wees op voorwaarde dat die grond met masjinerie gekompakteer en gekonsolideer word tot 'n digtheid van 90% gemodifiseer AASHO wat geverifieer en nagegaan sal word deur 'n ingenieur wat 'n sertifikaat van sodanige toets aan die bank moet lewer. 3.3 Beton 3.3.1 Onderworpe aan vooraf goedkeuring word slegs beton wat met masjiene gemeng is toegelaat. 3.3.2 Waar toegelaat, moet beton wat op die perseel gemeng word, as volg saamgestel word: 6 dele growwe aggregaat SABS 1083 3 dele skoon sand SABS 1083 1 deel sement SABS 471, 831 en 626 20 tot 44 liter water tot elke 50 kg sak sement Die beton wat gebruik word sal 'n saampersende sterkte hê van nie minder nie as 10 MPA teen 28 dae. Die nominale grootte van die growwe aggregaat wat gebruik word moet van 19,00 mm tot 26,5 mm wees. 3.3.3 Aangemaakte beton moet voldoen aan SABS 878. 3.3.4 Gewapende beton Alle gewapende beton moet in ooreenstemming met planne en spesifikasies voorberei word en 'n geregistreerde siviele of struktuuringenieur moet daaroor toesig hou en dit sertifiseer by voltooiing.
3.4 Fondamentmure 3 . 4 . 1 F o n d a m e n t m u r e m o e t v a n s o l i e d e s t e e n m e s s e l w e r k , h a r d g e b a k t e k l e i s t e n e , k l i p , b e t o n b l o k k e o f a n d e r goedgekeurde materiaal wees. Fondamente moet voldoen aan paragraaf 3.4.3. 3.4.2 Die hoogte van enige fondamentmuur mag nie 1,5 m oorskry nie. Waar die opvulling 'n hoogte van een meter oorskry, moet die beddingslaag voldoende gewapen word. Alle betonoppervlakke moet gekap, deeglik gewas, skoon gemaak en met sementbry bedek word onmiddellik voordat gidspleister gelê word. (ii) moet die betonmengsel aangemaak word soos beskryf in paragraaf 3.3. 3.6 Termiete Waar daar tekens van termiete is, moet die grond vergiftig word met 'n goedgekeurde grondvergiftigingsmateriaal. 'n Klaringsertifikaat moet deur 'n geregistreerde plaagbestrydingsmaatskappy ingedien word. 3.7 Vogweringslaag 3.7.1 Onder mure en vensterbanke (i) Vogwering moet onder alle mure op 'n minimum hoogte van 150 mm bokant die grondvlak geplaas word en moet voldoen aan SABS 248 (bitumen vogweringslae) of Klas B van SABS 952 (poliëtileenblad vir waterdigting van struktuur 375 mikron verhewe) of SABS 298 (steenlym asfalt waterdigting) of ander goedgekeurde materiaal. (ii) Die vogweringslaag moet tot die volle breedte gelê word onder mure en muurplate vir hangvloere sonder lengtelaste. Die oorhang by die ente, hoeke en laste moet 'n minimum van 150 mm wees. (iii) Vogwering wat onder vensterbanke gelê word moet afgewerk word binne die dikte van die muur en onder die eerste volle laag van steenwerk. Die vogweringslaag moet nie direk onder die vensterbankbedmateriaal gelê word nie. 3.7.2 Onder beddingslae (i) 'n Vogweringsmembraan SABS 952 Tipe C, gladde oppervlak, 250 mikron dik, moet gelê word in klam areas waar 'n hoë watertafel aanwesig is of waar die bank dit nodig ag. (ii) Die blaaie moet in die wydste praktiese wydtes gelê word ten einde laste te verminder en moet teruggevou word in die vogweringslae in die mure. Enige laste moet geseël word met druksensitiewe band wat aangewend moet word oor die hooflas. 3.7.3 Kante van tenks (i) Vogwering van horisontale en vertikale tenks, tensy anders bepaal, moet in ooreenstemming met SABS Praktykskode 021 wees, of waterdig gemaak met EVA poliëtileen SABS Spesifikasie 952, Tipe C, gladde
oppervlak, 1 000 of 500 mikron, soos gespesifiseer. (ii) Alle laste aan plaatbekleding moet gelas word met 'n spesiaal geformuleerde lasstrook om 'n ten volle waterdige seël te vorm, streng ooreenkomstig die vervaardiger se spesifikasies. 3.7.4 Houtraammure (i) In enige houtraammuur moet 'n vogweringslaag geïnstalleer word tussen die onderste plaat van die muur en die fondamentmuur of betonvloerblaaie. (ii) Die vogweringslaag, 375 mm mikron dik, moet oor die volle dikte van elke muur strek. 4 Steenmesselwerk 4.1 Stene Kleistene moet onbeskadig, hard, goed gebak en aanvaarbaar wees vir die bank en in ooreenstemming met SABS 227. Kalkstene moet voldoen aan Sand SABS 285 (kalsiumsilikaat steenmesselwerkeenhede). Sementstene moet voldoen aan SABS 987 (sementstene). 4.2 Blokke Holstene moet voldoen aan SABS 559 (hol kleiboublokke) en betonblokke aan SABS 527 (betonboublokke). 4.3 Dagha Dagha moet as volg saamgestel word (per volume gemeet): Sementdagha 6 dele skoon sand Kompodagha 1 deel sement 1 deel sement (1 pak = 50 kg) 1 deel kalk (SABS 523) (1 pak = 25 kg) Nie meer nie as 10 dele sand Daghamengsel vir gebruik met sementblokke en stene moet in ooreenstemming met die vervaardiger se aanbevelings gemeng word. Blokverbinding of tanding van die steenwerk word nie toegelaat nie. 4.5.2 Stene van verskillende samestellings mag nie gemeng en in dieselfde muur ingebou word nie.
4.5.3 Alle uitsettingslaste in steenwerk moet voorsien word van 'n goedgekeurde bitumendeurdrenkte sagtebord, \"compribond\", polisulfied verseëlaar of 'n uitsetbare poliëtileen strook. 4.5.4 Buitemure moet met balke gevul word tot die onderkant van die dakbedekking. 4.5.5 Steengewelmure bokant dakplaatvlak moet nie minder nie as 140 mm dik wees. (Let wel: Waar konstruksie van die beskrywing hierbo verskil, moet spesiale toestemming van die bank verkry word.) 4.6 Skoorstene 4.6.1 Die hoogte van enige skoorsteenuitlaat mag nie minder nie as een meter bokant die hoogste punt van aanraking tussen die skoorsteen en die dak wees. 4.6.2 Waar die hoeke van die hellings van die dak minder as 10 grade en die skoorsteen nie meer nie as 600 mm van die lyn van die rif af is, moet die hoogte van die skoorsteen nie minder nie as 600 mm bokant die lyn van die rif wees. 4.7 Leunmure 4.7.1 'n Leunmuur moet nie minder nie as 190 mm of 1/6de van sy hoogte dik wees, welke ookal die grootste is. 4.7.2 A l l e l e u n m u r e m o e t g e s e ë l w o r d t e e n v o g i n d r i n g i n g m e t ' n g o e d g e k e u r d e b e d e k k i n g o f vogweringsmembraan van 375 mikron dik wat onder die laaste laag van steenwerk gelê moet word 4.7.3 Leunmure mag nie minder nie as 300 mm bokant die dakbekleding wees nie. 4.8 Keermure van steenmesselwerk 4.8.1 Waar enige keermuur hoër is as 1,5 m moet die muur deur 'n struktuuringenieur ontwerp word. 4 . 8 . 2 Daar moet voorsiening gemaak word vir ondergrondse dreinering agter sodanige muur tesame met voldoende drupgate ten einde die opdamming van water agter die muur te voorkom. 4.8.3 Geen horisontale vogweringslaag van plaatmateriaal moet in enige sodanige keermuur gebruik word nie. 4.9 Toelaatbare afmetings vir houtraammure Tipe Spyker Spasies Maksimum Maksimum Maksimum muur grootte tussen paneellengte hoogte vloerhoogte spykers (mm) (m) 114 x 38 Struktureel 114 x 38 Ondersteun Slegs aan Nie 76 x 38 114 x 38 aan beide een kant struktureel 76 x 38 kante ondersteun (mm) (m) (m) (m) (m) 400 4,8 2,4 6,0 4,0 600 4,0 2,0 6,0 3,0 450 3,6 1,8 3,0 3,0 600 4,8 3,0 4,0 600 4,2 2,4 3,0 4.9.1 Enige eksterne steenmesselwerk bedekking of invullingspaneel in 'n raamgebou moet sekuur aan die struktuur geanker word. 4.9.2 Waar die area van vensteropening in sodanige paneel meer as 25% van die aansigarea beslaan, moet die paneel geanker word aan die struktuur op so 'n wyse dat dit sal toelaat vir relatiewe vertikale beweging maar die muur van laterale beweging sal weerhou. 4.9.3 Sodanige bekleding moet ondersteun word op toepaslike balke, blaaie of punte op elke vlak en voldoende voorsiening moet gemaak word vir relatiewe vertikale beweging tussen die messelsteenwerk en die struktuurraam aan die onderkante van sodanige stutte. 4.9.4 Bewegingslaste moet voorsien word in sodanige bekleding op intervalle van nie meer nie as 10 meter om voorsiening te maak vir relatiewe horisontale beweging. 4.10 Voorsiening vir dakverankering 4.10.1 I n d i e g e v a l v a n ' n g e b o u v a n h o u t r a a m k o n s t r u k s i e , m o e t v o o r s i e n i n g g e m a a k w o r d v i r d i e s e k u r e vashegting van enige houtdakkap, spar of balk aan die muur op die wyse beskryf in SABS 082. 4 . 1 0 . 2 I n d i e g e v a l v a n ' n m u u r w a t o p g e r i g w o r d v a n m e s s e l s t e e n w e r k e e n h e d e v a n b e t o n , m o e t ' n gegalvaniseerde staalband of draad in die muur op paslike posisies vir die vashegting van enige houtdakkap of balk aan sodanige muur voorsien word. 4.10.3 Sodanige band of draad moet in die muur vir 'n diepte van ten minste 300 mm strek in geval van 'n swaar dak (beton of kleiteëls of leidak), of ten minste 600 mm in die geval van 'n beplate dak. In gevalle waar die diepte
van die steenmesselwerk of in situ beton minder as 300 of 600 mm onderskeidelik dik is, moet sodanige band of draad so ver as moontlik in sodanige messelsteenwerk of beton strek. 4.10.4 Die grootte van sodanige band moet nie minder wees nie as 30 mm wyd en 1,2 mm dik of sodanige draad moet nie bestaan uit minder as twee stringe van 4mm in omtrek nie. 4.11 Lateie 4.11.1 Alle spanwydtes van steenmesselwerk oor vensters, deure en openinge groter as 2 meter moet gesteun word deur 'n voorgespanne latei of of steenmesselwerk lateie soos ontwerp deur 'n struktuuringenieur. 4.11.2 Lateie moet dragedeeltes van nie minder nie as 225 mm op mure aan die punte hê. 4.12 Gewapende steenlateie 4.12.1 Gewapende steenlateie moet gebou word van onbeskadigde masjiengemaakte stene in 3:1 verhouding sement dagha, met all vertikale en horisontale laste solied gevul met dagha dwarsdeur die vereiste aantal lae en tot 'n afstand van ten minste 330 mm aan elke kant van die opening. 4.12.2 Die aantal lae oor lateie in die verskillende groottes opening moet wees soos gespesifiseer in die tabel hieronder, en bewapende staaldrade of stawe moet in die eerste horisontale las oor die onderste laag ingebou word soos hieronder bepaal. 4.12.3 Gewapende steenlatei Oop of daglig wydte Aantal lae Bewapening Nie groter nie as 1 m 4 Meer as 1 m tot 1,5 m 6 Een ry van 74 mm wye Meer as 1,5 m tot 2 m 7 steenbewapening soos beskryf hieronder vir elke halfsteenwydte binnewelwing Een ry van 74 mm wye steenbewapening soos beskryf hieronder vir elke halfsteenwydte binnewelwing Drie 6,3 mm omtrek sagte staal stawe vir elke halfsteenwydte binnewelwing 4.12.4 Steen bewapening moet gemaak word van getrokke sagte staal bestaande uit twee 3,15 mm omtrek hoofdrade 75 mm van mekaar en 2,8 mm omtrek kruisdrade nie meer nie as 300 mm van mekaar wat aan die hoofdrade vasgesweis is. 4.12.5 Die gewapende drade en stawe moet in lengte ten minste gelyk wees aan die wydte van die opening plus 330 mm op elke punt. Die bewapening moet ewe ver van mekaar in die steenlas wees, en die buitenste drade of stawe moet ten minste 20 mm bedekking hê van die aansig van die steenwerk. 4.13 Steps 4.13.1 Trappies moet van steen of beton wees soos gespesifiseer in paragraaf 3.1 met 'n granolitiese of ander aanvaarbare afwerking, en gebou op 'n geskikte fondament. 4.13.2 Stygstukke moet eenvormig wees en moet nie 200 mm oorskry nie. 4.13.3 Loopvlakke moet nie minder nie as 250 mm wees en moet afgewerk word met 'n glyvrye oppervlak. 4.13.4 Handreëlings moet 850 mm vertikaal van die bopunt van die loopvlak wees. 4.14 Beddingslae 4.14.1 Die beton wat gebruik word vir enige ongewapende betonblad moet 'n saamgeperste sterkte hê van nie minder nie as 10 MPA teen 28 dae of gemeng word in die verhouding per volume van: 1 deel sement 4 dele sand; en 5 dele growwe aggregaat en die dikte van sodanige blad moet nie minder wees nie as 75 mm. 4.15 Deure en vensters 4.15.1 Deure en vensterrame moet van 'n goedgekeurde tipe fabrikaat wees. 4.15.2 Waar nodig moet staaldeure en rame wat binne 'n 20 kilometer radius van die kus gebruik word vervaardig word van warmgedompelde galvanisering in ooreenstemming met SABS 763. 4.15.3 Alle staal deur en vensterrame moet gepas word met ten minste drie hingsels aan elke kant van die raam, wat in die muur ingebou moet word. 4.15.4 Alle hout deur en vensterrame moet 1,6 mm dik gegalvaniseerde hoepelyster kramme 32 mm wyd met
ente wat 50 mm teruggedraai is teen style van rame en elk twee keer aan die raam geskroef en 450 mm in die mure ingebou. Die kramme moet nie meer as 0,85 mm ver van mekaar op enige raam gespasieer word nie. 4.15.5 Verbindingsdeure tussen die motorhuis en huis moet brandbestand wees in ooreenstemming met vereistes van die plaaslike owerheid. 5 Timmerwerk en skrynwerk 5.1 Strukturele houtwerk Alle houtwerk moet voldoen aan en die SABS merke 563, 653, 876, 1089 en./of 1245 dra, en waar vereis deur regulasies, behandel word teen houtpesinfestasie. Waar nodig, moet alle houtwerk wat aan steen of klip raak behandel word in ooreenstemming met SABS 05. 5.2 Dakwerk 5.2.1 Alle laste van dakkappe wat op die perseel gemaak word, behalwe vir ligte dakbedekkings, moet met vier 90 x 4 mm spykers aan mekaar vasgesit word en aanmekaar geskroef word met 10 mm skroewe. Alle spykers moet ten minste 25 mm ver uitsteek en moet stewig vasgeklink word. 5.2.2 Houtwerk van kleiner afmetings as hierbo gespesifiseer is aanvaarbaar in die vorm van voorafvervaardigde dakstoele ontwerp en gemaak deur spesialismaatskappye. The strukturele stabiliteit van die dak moet gewaarborg word deur 'n waarborg van sodanige maatskappy. 5.2.3 Hoeksparre moet nie minder nie as 228 x 38 mm wees ten einde 'n halwe hoofspar te vorm. Alle stutdele moet ten minste 38 x 114 mm Graad 4 materiaal wees. Dakbinte moet gebruik word vir leidakke of teëldakke. 5.2.4 Dakkonstruksie moet voldoende kruisstutte hê wat teen 'n goedgekeurde hoek in ooreenstemming met goeie boupraktyke. 5.2.5 Dakkappe moet nie gestut word op interne nievragdraende mure nie. Klas A swaargewig: Betonteëls Tensy andersins gespesifiseer, moet elke derde teël in elke laag en alle teëls wat oop oorhange en geweldakrande vasgeheg word met stormklemme ooreenkomstig die vervaardiger se spesifikasies. Klas C liggewig: Gegalvaniseerde geriffelde yster Vashegting moet geskied met roesbestande skroewe, self groef of masjiengroef tipe skroewe met goedgekeurde tipe wassers. Dakplate moet vasgeheg word met 'n sydelingse oorhang van ½ dakplaat. In kusgebiede mag dit nodig wees om die helling van die dak te vermeerder volgens die goeddunke van die bank. Nokdekking mag nie minder as 450 mm wyd wees nie en moet dieselfde dikte wees as die dakplate. Klas C liggewig: Metaalteëls Alle teëls moet vasgeheg word met twee roesbestaande spykers. Teëls op oop oorhange, gewels en geute moet met meer spykers vasgeheg word. Klas C liggewig: Geribte trog metaalplate Vashegting moet geskied met roesbestande skroewe van 90 mm met no 14 koolstofstaal tipe heksagonale koppe. Alle sy en kantoorhange moet geseël word met seëlstrook en vasgeheg word met 25 mm x no 14 selftapskroef. Alle gate vir vashegting moet geboor en nie ingeslaan word nie. Alle dakke moet op die spits geseël word met poli en metaalafsluitings. Die gleuf van die plate moet op die spits of parapets opgedraai word en teruggedraai word in die geute ten einde 'n drup te vorm (spesial gereedskapstuk vir buiging). Alle dakhoutwerk moet geseël word teen die weer met 'n roesbestande geutlap langs die dele van die fassieborde en versteekte geute ens.
Klas A swaargewig: Leidak Leidakbedekking moet vasgeheg word in \"gebroke band\" patroon en met dubbel anti roes spykers vasgeheg word. 'n Drie of vyflaag aluminiumaansig malthoid bladmetaal moet onder die heglatte geplaas word. Leidakspane moet voldoen aan SABS 995. K l a s B m e d i u m g e w i g : G r a s D e k g r a s m o e t v a s g e h e g w o r d a a n d i e h e g l a t t e m e t t e e r d e u r d r e n k t e t o u . Daksparlaste moet paslik vasgebind of vasgeskroef word aan die buitemure. Alle pale moet behandel word teen houtboorder, kewers en termiete soos beskryf in SABS Kode 05. Voorsiening moet gemaak word vir geskikte weerligafleiers soos beskryf in SABS Kode 03. 5.3 Vloere 5.3.1 Alle vloere moet vasgeheg word in ooreenstemming met gesonde boupraktyke. 5.3.2 Alle ondervloerse houtwerk moet behandel word met 'n verduursamingsmiddel om infestasie met insekte en peste te voorkom. 5.3.3 Geskikte kruisventilasie moet ook voorsien word. 5.3.4 V l o e r b e d e k k i n g s m o e t s t r e n g o o r e e n k o m s t i g d i e v e r v a a r d i g e r s e s p e s i k f i k a s i e s g e l ê w o r d e n S A B S praktykskodes. 5.3.5 Boonste vloere (i) Vloerbalke met spanwydtes van tot 3 meter moet 228 x 38 mm groot wees en spanwydtes groter as 3 meter moet deur 'n ingenieur ontwerp word. (ii) Vloerbalke moet nie verder as 450 mm van mekaar af wees nie en sparre moet waar nodig, voorsien word. Alle vloere bo grondvlak moet aanvaarbare vir klank geïnsuleer word. 5.4 Plafonne Goedgekeurde materiaal moet vir plafonne gebruik word en dit moet op 'n aanvaarbare wyse vasgeheg word. Waar van toepassing, moet gewellyste van geskikte materiaal wees en netjies in lang lengtes vasgeheg word. Ten minste een valdeur van 'n minimum grootte van 600 mm x 600 mm moet voorsien word en plafonhoogtes moet voldoen aan die Nasionale Bouregulasies. 5.5 Ysterwerk Alle deure, swaairmae, boligte, ens moet met geskikte skarniere, slotte en toebehore vasgeheg word, waar van toepassing. Ysterwerk wat aan die weer blootgestel is, moet roesbestand wees. 6 Pleisteraar en muurteëlaar 6.1 Sand Die sand moet vry van leem en organiese materiaal wees. 6.2 Sement Die sement moet voldoen aan SABS 471. 6.3 Kalk Kalk vir onderlae moet Tipe A2 of A2P of SABS 523 wees en fynpleister moet Tipe A1P wees. 6.4 Eksterne pleister Eksterne pleister moet gemeng word met 5 dele sand en een deel sement. Alle muuroppervlakke moet skoongemaak en natgemaak word, soos benodig. Pleister moet eenvormig ongeveer 12 mm dik wees. 6.5 Interne pleisterwerk 6.5.1 Interne pleister moet eenvormig ongeveer 12 mm dik wees en sal gepleister word tot 'n aanvaarbare afwerking en sal saamgestel word van ses dele sand en een deel sement. 6.5.2 Wanneer kalk gebruik word moet die pleister in die volgende verhouding per volume gemeng word: Sand Kalk Sement 15 20 4 0 3 1 2 2 1 3 6.6 Vloergidspleister 6.6.1 Gidspleister moet gemeng word van een deel sement tot drie dele growwe sand en moet nie minder nie as 20 mm dik wees. 6.6.2 Die gidspleister moet haaks en waterpas gelê word en tot bevrediging van die subkontrakteurs wat die
onderskeie afwerkings moet lê. 6.6.3 A l l e o p p e r v l a k k e m o e t d e e g l i k s k o o n g e m a a k w o r d m e t ' n s t a a l b o r s e l e n ' n s e m e n t b r y v u l l i n g m o e t aangewend word voordat die grano gelê word. 6.7 Geglasuurde teëls 6.7.1 Geglasuurde muurteëls moet van 'n aanvaarbare kwaliteit wees en moet voldoen aan die vereistes van SABS Spesifikasie 22, en moet vasgeheg word met 'n daghamengsel van 4:1 of 'n aanvaarbare kleefstof, soos beskryf in SABS Kode 010769. 6.7.2 Geglasuurde vloerteëls moet vasgeheg word streng ooreenkomstig die vervaardiger se spesifikasies. 7 Loodgieter 7.1 Geute en afvoerpype 7.1.1 Geute, afvoerpype en reënwaterpype moet voldoen aan SABS spesifikasies en moet vasgeheg word in ooreenstemming met die vervaardiger se spesifikasies. 7.1.2 Alle reënwater moet van die mure weggevoer word verby die voglaagvlak in ooreenstemming met die vereistes van die plaaslike owerheid. 7.1.3 Waar geute nie aangeheg word nie, moet 'n betonblad reg rondom die gebou gelê word ten einde water van die geboue weg te lei. 7.1.4 Kiele, geute en onderlood sal van goedgekeurde materiaal, grootte en ontwerp wees en mot vasgeheg word in ooreenstemming met SABS spesifikasies. 7.2 Geutlappe Geutlappe moet van goedgekeurde en duursame materiaal vervaardig word en moet vasgeheg word in ooreenstemming met die vervaardiger se spesifikasies. 7.3 Watertoevoer 7.3.1 Die watertoevoer moet voldoen aan die vereistes van die plaaslike owerheid. 7.3.2 Ten minste een pyp sal opgerig word in 'n geskikte posisie en alle materiaal en toebehore moet voldoen aan SABS Spesifikasie 509. 7.3.3 Waar water nie beskikbaar is van die plaaslike owerheid nie, moet water wat van 'n boorgat gebruik word vir huishoudelike doeleindes voldoen aan die nodige gesondheidsvereistes. 7.3.4 Boorgatwater vir huishoudelike gebruik moet 'n aanvaarbare opbrengs lewer. 'n Ondersteunende sertifikaat van die wateropbrengs moet ingedien word. 7.4 Dreinering 7.4.1 Alle rioleringswerk aan geboue moet uitgevoer word deur 'n geregistreerde loodgieter en dreine moet akkuraat tot die lyne en hellings getoon op die dreineringstekening soos goedgekeur deur die plaaslike owerheid gelê word. 7.4.2 Alle dreine moet getoets word in ooreenstemming met die vereistes van die plaaslike owerheid en aanvaar word voordat die eiendom geokkupeer mag word en die dreine in gebruik geneem mag word. 7.5 Stormwaterafvoering Stormwater moet weggevoer word van die geboue deur middel van voorafgegote betonstormwaterkanale, oppervlak of ondergrondse dreine, en moet voldoen aan die vereistes van die plaaslike owerheid. 7.6 Septiese en konserveringstenks Die grootte en ontwerp van septiese en konserveringstenks moet deur die plaaslike owerheid goedgekeur word. 7.7 Stapelriole, weekputte en dreineringsklaringsertifikate 7.7.1 Stapelriole en weekputte Stapelriole en weekputte moet in ooreenstemming met die vereistes van die plaaslike owerheid se regulasies gekonstrueer word. 7.7.2 Dreineringsklaringsertifikate Die bank mag versoek dat 'n dreineringsklaringsertifikaat gelewer word vir enige tipe drein. 8 Glaswerker 8.1 Glas
Alle glas moet vry van defekte wees en moet met stopverf ingeplaas word, en moet waar nodig vasgetik word en vasgeheg word in ooreenstemming met die vervaardiger se spesifikasies en die SABS praktykskode. Toelaatbare dikte en grootte van glasruite Minimum dikte Maksimum area 3 mm 0,75 m2 4 mm 1,5 m2 6 mm oor 3,5 m2 8.2 Veiligheidsglas Maksimum area Minimum dikte 1 m2 6 mm 8.2.1 Waar enige glasruit wat in 'n venster geïnstalleer is minder as 300 mm van die grondvlak af is en nie veiligheidsglas is nie, moet sodanige ruit deur 'n versperring beskerm word ten einde te voorkom dat mense in fisiese kontak daarmee kom. 8.2.2 W a a r e n i g e b a d i n s l u i t i n g o f s t o r t h o k k i e d e u r g l a s p a n e l e g e v o r m w o r d , m o e t s o d a n i g e p a n e l e v a n veiligheidsglas voorsien word. 8.2.3 Enige glas gebruik in enige winkelvenster en wat groter is as 1m2, moet van veiligheidsglas voorsien word. 8.2.4 Waar glas in enige muur of trapreling of opgang gebruik word en wat minder as 1.8 meter bo die hellingslyn van die trappe, die oppervlak van die opgang of trapportaal is, moet sodanige glas veiligheidsglas wees. 9 Verwer 9.1 Verf en vernis Alle verf, beits, vernis, lynsaadolie, kwaste, muurkalk en muurafwerkings moet van 'n goedgekeurde vervaardiger aangekoop word en moet presies soos voorsien en streng volgens die vervaardiger se instruksies en kragtens die SABS praktykskodes gebruik word. 10 Elektrisiën en gasinstallasie 1 0 . 1 Alle elektriese en gasinstallasies moet streng in ooreenstemming met die vereistes van die plaaslike owerheid of diensverskaffer uitgevoer word. 10.2 Die bank behou die reg voor om te vra vir 'n sertifikaat van die goedkeuring van die installasie. 11 Omheining van die perseel Die perseel moet met aanvaarbare materiaal omhein word, tensy andersins met die bank ooreengekom. 12 Skoonmaak van die perseel By voltooiing van die werk moet alle bourommel van die perseel verwyder word van en moet die perseel skoon gelaat word. Alle grondbanke van hoër as 1,2 meter moet teruggewerk word kragtens die SABS praktykskode en volgens goedkeuring van die bank. 13 Stormwater dreinering en beheer van sypelwater 13.1 Voldoende voorsorg moet getref word om oppervlak en sypelwater weg van die geboue af te dreineer. 13.2 Die nodige voorsorg moet ook getref word oorstromings en skade aan geboue te voorkom kragtens die vereistes van die plaaslike owerheid en die bank. 13.3 Die bank behou die reg voor om dreineringsplanne wat deur 'n ingenieur ontwerp is aan te vra en sodanige werk moet streng in ooreenstemming met die planne en spesifikasies van die plaaslike owerheid uitgevoer word. 14 Swembaddens 14.1 Die bank behou die reg voor om planne en spesifikasies van die swembad aan te vra voordat daar met konstruksie begin word. 14.2 Voldoende voorsorg moet getref word teen enige stormwaterskade aan elektriese pompe en oorstroming van swembaddens. 14.3 Die konstruksievereistes met betrekking tot omheinings en hekke moet aan die vereistes van SABS 1390 voldoen.
15 Die volgende bykomende werk moet uitgevoer word: (Voeg lys van bykomende werk wat uitgevoer moet word hier in.) 1 2 (Handtekening van aansoeker) (Handtekeninge van getuies) Voorwaardes 1 Die kaart sal geldig wees vanaf die aanvangsdatum aangedui op die kaart tot die laaste dag van die maand van die vervaldatum wat daarop aangedui word, onderworpe daaraan dat die kaart deur die kaarthouer geteken is in die spasie wat daarvoor voorsien is. 2 Die kaart mag slegs deur die kaarthouer aan wie dit uitgereik is gebruik word en is nie oordraagbaar nie. 3 Die kaarthouer moet 'n ontvangsbewys onderteken elke keer wanneer die kaart gebruik word om geld te verkry (tensy die geld by 'n geldoutomaat getrek word) of om goedere of dienste aan te koop. 4 Indien 'n aankoop gemaak word of 'n diens verkry word deur middel van 'n elektroniese fonds oordragseenheid, moet 'n verkoopsbewys eweneens onderteken word tensy die verskaffer van die goedere of dienste uitdruklik van die ondertekening van 'n aankoopbewysstrokie afstand doen. 5 Versuim om 'n skriftelike magtiging te teken wanneer kontant, goedere of dienste verkry word, skeld die kaarthouer nie vry van verantwoordelikheid indien die bank 'n betaling maak aan die verskaffer van sodanige kontant, goedere of dienste nie. 6 Die bank onderneem om namens die kaarthouer die koopprys van goedere of dienste of 'n kontantvoorskot te betaal wat aan die kaarthouer verskaf word deur 'n verskaffer in die bedrag wat aangedui word op die aankoopbewysstrokie of, indien 'n elektronies fondsoordrageenheid gebruik is, die bedrag van die transaksie wat gemagtig is en na die rekening van die verskaffer oorgedra is. Die bank sal die kaartrekening van die kaarthouer debiteer met elke sodanige transaksie. 7 Geen aanspreeklikheid van welke aard ook al of wat uit enige oorsaak vloei sal aan die bank toekom as gevolg van die koop of gebruik van die kaart deur die kaarthouer wanneer enige transaksie met 'n verskaffer aangegaan word. 8 Die bank onderneem om die rekening van die verskaffer te krediteer in ooreenstemming met die opdrag vervat op die aankoopbewysstrokie. 9 Die kaart is en bly die eiendom van die bank. Die bank sal te enige tyd darop geregtig wees om te vereis dat die kaart aan hulle teruggegee word en mag vanaf die tyd waarop hulle teruggawe eis van die kaart weier om enige betaling te maak van enige skuld aangegaan terwyl die kaart gebruik is. Sodanige vereiste sal geag word geldig te wees indien dit mondelings aan die kaarthouer gerig is, of indien dit gedoen word deur 'n geregistreerde brief te pos wat aan die adres van die kaarthouer soos hierbo verskaf, te rig. 10 Indien die bank sou besluit om die kaart te kanselleer, sal die bank daarop geregtig wees om alle skulde wat aangegaan is deur die gebruik van die kaart te konsolideer, en sal daarop geregtig wees om al sodanige skulde as verskuldig en betaalbaar te beskou. Die bank sal daarop geregtig wees om die skuld na enige rekening van die kaarthouer na sy keuse oor te dra. 11 Die bank sal daarop geregtig wees om alle verskaffers daarvan in kennis te stel dat die kaart gekanselleer is, en dat die bank nie langer sy reg sal uitoefen om die skuld wat deur die kaarthouer aangegaan is in ooreenstemming met die aankoopbewysstrokies wat aan die bank voorgelê word, te betaal nie. 1 2 Die kaarthouer mag nie die kaart gebruik om geld of krediet te verkry wat die bedrag oorskry waarop daar ooreengekom is. 1 3 Die kaart mag sonder kennisgewing aan die kaarthouer gekanselleer word indien enige van die volgende gebeure plaasvind: 13.1 die dood van die kaarthouer; 13.2 die sekwestrasie of likwidasie van die kaarthouer; 13.3 misbruik van die kaart en die kredietfasiliteit deur die kaarthouer. In sodanige geval sal die totale uitstaande bedrag verskuldig en betaalbaar wees aan die bank sonder verdere kennisgewing. 14 Die kaarthouer sal maandelikse betalings aan die bank maak in ooreenstemming met die bedrag aangedui op die rekeningstaat, en op die datum aangedui op die rekeningstaat. Daar sal rente gehef word op enige uitstaande bedrag teen die koers waarop daar ooreengekom is, of, indien daar nie sodanig ooreengekom is nie, teen die maksimum rentekoers wat regtens toelaatbaar is. 1 5 Die kaarthouer sal daarop geregtig wees om rente te ontvang op alle batige saldo's vir die tydperk wat die rekening 'n batige saldo het teen die koers wat tans betaal word deur die bank op rekeninge van 'n soortgelyke aard. 1 6 Die gebruik van die kaart buite die SuidAfrikaanse monetêre area word beheer deur die valutabeheer regulasies wat van tyd tot tyd deur die Reserwe Bank gepubliseer word.
17 Indien die bank hom tot die hof moet wend om enige bedrag verskuldig deur die kaarthouer in te samel, sal die bank daarop geregtig wees om alle uitgawes sowel as kostes op die prokureurenkliënt skaal van die kaarthouer te eis. Die bank sal daarop geregtig wees om enige verskuldigde bedrag op die kaartrekening van enige bedrag wat tot die krediet van die kaarthouer is in enige rekening van die kaarthouer wat deur die bank bedryf word. 18 Indien die kaart verlore raak, of indien die persoonlike identifikasienommer bekend raak aan enigiemand anders as die kaarthouer, moet die kaarthouer dadelik die bank skriftelik daarvan in kennis stel. Die kaarthouer sal in elk geval aanspreeklik wees vir die betalings wat die bank mag maak ten opsigte van enige transaksie aangegaan voor sodanige kennisgewing. Hierdie aanspreeklikheid van die kaarthouer kan vermy word indien die kaarthouer 'n lid is van die verlore kaart beskermingskema en die reëls van sodanige skema nagekom het. 1 9 Indien die kaarthouer van mening is dat hy/sy nie aanspreeklik is teenoor die bank vir die betaling van enige debiet wat op die kaartrekening aangebring is nie, sal hy/sy binne 30 dae na die datum van die rekening waarop die debiet verskyn, die saak na die bank verwys en sal andersins geag word aanspreeklikheid te aanvaar vir die rekeningstaat. 2 0 D i e b a n k s a l d a a r o p g e r e g t i g w e e s o m ' n j a a r l i k s e f o o i v a n d i e k a a r t h o u e r t e v e r h a a l o m b a n k k o s t e s t e d e k teen 'n bedrag wat van tyd tot tyd deur die bank vasgestel word, ten opsigte van elke kaart wat deur die bank aan die kaarthouer uitgereik is of elke transaksie wat aangegaan is deur die gebruik van sodanige kaart. Die fooi sal gedebiteer word teen die kaartrekening op 'n jaarlikse basis en elke transaksie wat bankkoste meebring, sal op 'n maandelikse basis gedebiteer word. 21 Die bank mag op versoek sekondêre gekoppelde kaart(e) uitreik en die kaarthouer stem ooreen dat alle skulde aangegaan op sodanige sekondêre kaart(e) teen sy kredietkaartrekening gedebiteer mag word en dat sodanige debiete nie op enige wyse die kredietooreenkoms tussen homself en die bank sal beïnvloed nie. Betaling van sodanige debiete en die toepaslike rentekoers sal in die diskresie van die bank geskied. 2 2 'n Sertifikaat geteken deur enige bestuurder, assistentbestuurder of rekenmeester van die bank wat die bedrag van die kaarthouer se verskuldigdheid teenoor die bank en die toepaslike rentekoers sertifiseer, sal prima facie bewys wees van die kaarthouer se verpligting en die rentekoers. 23 Die landdroshof wat jurisdiksie het oor die kaarthouer sal by ooreenkoms jurisdiksie hê kragtens artikel 45 van die Wet op Landdroshowe 32 van 1944, soos gewysig. 2 4 Die bank sal daarop geregtig wees om inligting in verband met die kaarthouer se kredietwaardigheid en die kaartrekening aan enige kredietburo volgens die oordeel van die bank, bekend te maak.
