Where the headache arises is with California regulations that still contain ballast water exchange, reporting, and recordkeeping requirements applicable to all vessels of at least 300 gross tons capable of carrying ballast water that call at California ports. The new regulations authorize the CSLC to pursue civil penalties not to exceed $27,500 per violation for each of these requirements.
