Amendment to Sec 14-A of The Advocates Act by the Hon’ble High Court has generated so much of heat & dust. I do not attempt to make a postmortem of the new formula killing the old system. But lawyers are painfully suffering. 80% of the amendments are unsavory in as much as the District Judges are empowered to debar the Advocates from practice without any enquiry. No man shall be deprived of his liberty except by a due trial in a Court of Law with ample opportunities to defend him. S. Sathiyamurthi, a well known lawyer and Secretary of Indian National Congress, at a speech in Nagpur said. “But what can judges do - even the most superior among them-unless they have the assistance of a well-trained efficient, honest, independent Bar? Ask any experienced judge, and he will tell you his success depends upon the excellence of the Bar which practises before him” Let us not detach one from the other. Now the subordinate judiciary has assumed the role of a dictator. Both are siblings. Let not the amended provisions harm the brotherhood of the Bench and the Bar. 2. The assumption that all Judicial officers or Presiding officers or Judges are aboveboard is falsified by recent newspaper reports about judges. That one lady Judge is alleged to have received Rs. 1 crore and 5 persons were arrested in connection with that will go a long way to show that some of the Judges are corrupt. The Bar is the sensor of the corrupt practices of the judge. The clients are able to find who the corrupt judges are. Incognito visit by a Judge of the High Court to the court premises will unfold who is corrupt. Advocates do not level corruption charges against all the Judges. If any member of the Bar ventures to make a complaint to the higher echelons in the Judiciary and his incapacity to procure and lender acceptable evidence will result in the advocate being debarred from practice is something which cannot be digested. 3. Not all Judicial officers are sober. When not less than 60,000 lawyers are agitating, the Hon’ble High Court should have felt that there are ‘irritating features’ in the amendments. A Magistrate working in Coonoor was arrested on a complaint by a woman police. No doubt, the Hon’ble High Court took cognizance of the matter and passed orders. But the lawyers stood in support of the judicial officer. Similarly, some 30 years ago one Chief Judicial Magistrate was arrersted in the State of Gujarat. The entire lawyer community of our country stood up in protest and condemned the behavior of the polilce. 74

The Judiciary is now determined to take action against Advocates or lessen the importance of the advocates in general and the Hon’ble High Court has instructed the judicial officers to direct the clients who appear before the court and prevail upon them to get a memo from advocates to give up vakalat by the advocates. This is the saddest part of the episode. Now the dispute is not between judges and lawyers but two ideologies. The conflicting interest should be resolved by discussion. Some of the judicial officers are engaged in making vituperative attacks on advocates. When the clients submit applications they are not accepted. They query, quiz and want to find out whether it was prepared by an Advocate. When they find some application or statement in English they instruct the client to go and get the same typed in Tamil. The judicial officers are systematically engaged in attacking the lawyers. This attitude will not ease the tension. E-filing counter is closed. No papers are received even when the clients themselves file. The clients are made to wait from dawn to dusk (i.e. 10.30 to 5.30). To put it in a nutshell, peaceful court atmosphere is spoilt. 5. The profession of lawyers is an essential and integral part of the judicial system and lawyers may figuratively be described as the priests in the temple of justice. They assist the court in dispensing justice and it can hardly be disputed without their help. It would be well nigh impossible for the court to administer justice. They are really and truly officers of the court in which they daily sit and practise. They have, therefore, a special interest in preserving the integrity and independence of the judicial system and if the integrity and independence of the judiciary is threatened by any act of the State or any Public Authority, they would naturally be concerned about it, because they are equal partners with the judges in the Administration of Justice (Dictum in Supreme Court case). Legal Profession... a Noble Profession At the outset, my heartfelt and sincere congratulations to Shri K.Ratnasamy on attaining golden jubilee in legal profession as an Advocate. It is a very rare occasion, which we come across in legal profession or even any other profession. To attain such a rare feat, is not easy. One has to pass over so many hurdles and most important is health. At this juncture, I can undoubtedly say “his health is his wealth” and this credit surely goes to him. In legal profession as an Advocate, maintaining health and pursuing the profession from 1969 onwards and still going on is a very rare and highly commendable journey. Shri K.Ratnasamy, Advocate, Nagercoil is a good human being. As a practising Advocate, maintaining humanity and legal profession successfully for five decades and still going on, is a very rare combination which we come across. “Face is the index of mind” – Shri K.Ratnasamy always welcomes people with a smile, which releases half of one’s grief/tension. He is a clean and a fair personality. “No mind is as precious as a mind jeweled with noble thoughts” – Shri K.Ratnasamy, fits exactly in this. His thoughts are always noble and caring.
