Article Seventeen: ϥϭέηόϟ΍ϭΔϳΩΎΣϟ΍ΓΩΎϣϟ΍ Arbitration If any dispute shall arise, God Forbid, between both parties out of or in Γέ΍ίϭϟ΍Ε΍έ΍έϘΑϡ΍ίΗϟϹ΍ connection with the interpretation of any article in this Agreement or due to the financial disputes, it shall be amicably settled. If the amicable ΩϭϧΑϟ΍ϥϣϱ΃ϝΩόϳϭ΃ϲϔϧϳΓέ΍ίϭϟ΍ϥϣέ΍έϗϱ΃έϭΩλΔϟΎΣϲϓ agreement can't be reached, then it shall be referred for resolution to the ΍ΫϫϥΎϳέγΓέΗϓϝϼΧϪΑϝϣόϟ΍ϭϩΩΎϣΗϋ΍ϡΗϳΩϘόϟ΍΍ΫϫϲϓΔΟέΩϣϟ΍ Hajj and Umrah National Committee and the resolution issued in this regard shall be binding on both parties. ΩϘόϟ΍ Article Eighteen: Penalties ϥϭέηόϟ΍ϭΔϳϧΎΛϟ΍ΓΩΎϣϟ΍ The Second party shall be liable for the following expenses immediately after receiving the invoice of the First Party: ΩϘόϟ΍Δϐϟ 1- All the expenses resulting from the delay or absence of the pilgrim to travel including the accommodation, catering and travel ticket, in case of its expiration. ΩΎϣΗϋϹ΍ϡΗϳϭΔϳίϳϠΟϧϹ΍ΔϐϠϟϡΟέΗϭΔϳΑέόϟ΍ΔϐϠϟΎΑΩϘόϟ΍΍ΫϫέέΣ 2- Penalties imposed by the Ministry, the Passport Control Department or any other ϪΗ΍έϳγϔΗϭϩΩϭϧΑϲϓϝλϔϠϟΔϳΑέόϟ΍ΔϐϠϟ΍ϰϠϋ penalties issued from any official authority in Saudi Arabia. 3- Penalties imposed by the First Party. ϥϭέηόϟ΍ϭΔΛϟΎΛϟ΍ΓΩΎϣϟ΍ 4- The expenses of transferring the pilgrim to other companies due to lack of notifying ΩϘόϟ΍Φγϧ the First Party with the arrival of the pilgrim to Saudi Arabia in all the air, sea and land ports. ϕΩΎλϣϭϥϳϓέρϟ΍ϥϣΔόϗϭϣΔϳϠλ΃ΦγϧϊΑέ΃ϥϣΩϘόϟ΍΍ΫϫϡέΑ΃ 5- Compensation for any damages resulting from the misconduct of the Umrah Pilgrim. ϝϛϡϠΗγ΍ˬΔϳϣϭϛΣϟ΍ΕΎϬΟϟ΍ϭΔϳϠΛϣϣϟ΍ϭΔϳϣγέϟ΍ΕΎϬΟϟ΍ϥϣΎϬϳϠϋ ˬˬˬˬˬϖϳϓϭΗϟ΍ϰϟϭௌϭ ϡϭίϠϟ΍ΩϧϋΎϬΑΟϭϣΑϝϣόϠϟΎϬϧϣΔΧγϧϑέρ Article Nineteen: The Contract Obligation Neither parties can subcontract this contract to any third party to perform all his obligations hereunder. Article Twenty: Observing the Pilgrims' Departure The Second Party acknowledges that the departure of the pilgrims and the visitors of the Prophet's Mosque from Saudi Arabia after the expiration of their program shall be performed legally, thus he is hereby obliged to observe his pilgrims and visitors and to ensure their legal departure after the end of their programs, lest they will be considered as absent subject to the Umrah automatic system. If otherwise is proved, then he shall be obliged to inform the First Party. Article Twenty One: Abidance by the Ministry's Decisions In case of the issuance of any decree by the Ministry eliminating or amending any of the articles stated herein, it shall be authenticated and followed during the term of this contract. Article Twenty Two: Contract Language This contract is entered into Arabic Language and has been translated into English, while the Arabic copy shall be considered in the judgment and interpretation of this contract. Article Twenty Three: Counterparts This contract was executed in four copies signed by both parties and authenticated by the official authorities, representative office and governmental authorities and each party has received a copy work accordingly when necessary. Article Twelve: έηϋΔόΑΎγϟ΍ΓΩΎϣϟ΍ Pilgrim Contract ϡϳϛΣΗϟ΍ The Second party shall sign a contract with the pilgrim in which all the benefits, έϳ˰γϔΗϭ΃ΫϳϔϧΗΏΑ˰γΑௌ΢ϣ˰γϻϥϳϓέρϟ΍ϥϳΑϑϼΧΏϭ˰ηϧ ΔϟΎΣϲϓ required services and the costs to be paid by the pilgrim according to the type έΫ˰όΗϥΈ˰ϓΎ˰ϳΩϭϪ˰ϠΣϡΗϳΔ˰ϳϟΎ˰ϣϟ΍ΕΎ˰ϓϼΧϟ΍ϭ΃Ω˰Ϙόϟ΍΍Ϋ˰ϫΩϭϧΑϥϣΩ˰ϧΑϱ΃ and level of the service program selected by him from the promotions list, έΑΗόϳϭω΍ίϧϟ΍΍Ϋ˰ϫϝ˰ΣϟΓέϣόϟ΍ϭΞΣϠϟΔ˰ϳϧρϭϟ΍Δ˰ϧΟϠϟ΍ϰϟ·ϝΎ˰Σϳϙ˰ϟΫ program package and the fares presented by the first party shall be entered. The Second party shall provide the First Party with a copy thereof, and the ΩϘόϟ΍ϲϓέρϟϡίϠϣιϭλΧϟ΍΍ΫϫϲϓέΩΎλϟ΍έ΍έϘϟ΍ Second Party shall insert the following articles in the contract entered between him and the pilgrim in order to oblige the pilgrim with its execution έηϋΔϧϣΎΛϟ΍ΓΩΎϣϟ΍ accompanied with detailed description of these articles as follows: ΕΎϣ΍έϐϟ΍ x Compliance with rules, regulations and instructions effective in Saudi Arabia. x Abiding by departure from Saudi Arabia without any delay after the end of the ϝϭϷ΍ϑέρϟ΍ΓέϭΗΎϓϪϣϠ˰γΗέϭϓϑϳέΎ˰λϣϟ΍ϊϓΩϲϧΎΛϟ΍ϑέρϟ΍ϝϣΣΗϳ ϲϫϭ defined term of program as entered in his visa issued by the representative office for the performance of Umrah and Visit. ϥϣέϔ˰γϟ΍ϥϋέϣΗόϣϟ΍ϑϠΧΗϥϋΔΟΗΎϧϟ΍ϑϳέΎ˰λϣϟ΍ϊϳϣΟ -˺ x Refrain from working in the Kingdom with or without salary. ΎϬΗΩϣ˯ΎϬΗϧ΍ϝΎΣϲϓέϔγΓέϛΫΗϭΔϳΫϐΗϟ΍ϭΔϣΎϗ· x Refrain from staying in the Kingdom to perform the Hajj for whatever reasons. ϱ΃ϭ΃Ε΍ί΍ϭΟϟ΍Γέ΍Ω·ϭ΃Γέ΍ίϭϟ΍Ύ˰Ϭ˰˰˰˰οέϔΗϲΗϟ΍ΕΎϣ΍έϐϟ΍ -˻ Article Thirteen: ΔϛϠϣϣϠϟΔόΑΎΗΔϬΟϱ΃ϥϣέΩλΗΕΎϣ΍έϏ ϝϭϷ΍ϑέρϟ΍ΎϬοέϔϳϲΗϟ΍ΕΎϣ΍έϐϟ΍ -˼ Overseas Agent Contracts 1- The overseas agent may not contract with any licensed entity except after έΎό˰˰˰η·ϡΩόϟϯέΧ΃Δϛέ˰˰˰ηϟϥϳέϣΗόϣϟ΍ϝϳϭΣΗϑϳέΎ˰˰˰λϣ -˽ ΫϓΎϧϣϟ΍ϊϳϣΟϰϠϋΔϛϠϣϣϠϟϥϳέϣΗόϣϟ΍ϝϭ˰λϭΑϝϭϷ΍ϑέρϟ΍ obtaining final clearance from the last contract with such entity. 2- The Second Party acknowledges that there is no effective contract between ΔϳέΑϟ΍ϭΔϳέΣΑϟ΍ϭΔϳϭΟϟ΍ έϣΗόϣϟ΍ϡ΍ΩΧΗ˰γ·˯ϭ˰γϥϋΔΟΗΎϧΕΎϳϔϠΗϱ΃ϥϋνϳϭόΗϟ΍ -˾ him and any natural person or institution, whether Saudi company or association, of whatever legal form licensed to perform the Umrah pilgrims  services works in Saudi Arabia. 3- The Second Party may not, throughout the whole term of this contract, enter έηϋΔόγΎΗϟ΍ΓΩΎϣϟ΍ into contracts with any natural persons or institutions of whatever legal form licensed to perform the Umrah pilgrims services works in Saudi Arabia, or to ΩϗΎόΗϟ΍ϡ΍ίΗϟ· request the Ministry to register or authenticate such contract, with compensating the First Party for any damages due to violating this article, Ω˰Ϙόϟ΍έϳϳΟΗϭ΍ϥρΎ˰Αϟ΍ϥϣΩ˰ϗΎ˰όΗϟ΍Ω˰Ϙόϟ΍ϑ΍έρ΃ϥϣϑέρϱϷϖΣϳϻ however the Saudi Company can authenticate more than one agent from the ΩϘόϟ΍΍ΫϫΏΟϭϣΑϪΑΔρΎϧϣϟ΍ΕΎϣ΍ίΗϟϻ΍ΔϓΎϛ˯΍ΩϷΙϟΎΛϑέρϰϟ΍ same country of the Second Party. ϥϭέηόϟ΍ΓΩΎϣϟ΍ Article Fourteen: Rate Card ϥϳέϣΗόϣϟ΍ΝϭέΧΔόΑΎΗϣ The programs rate card shall be defined in a separate contract annex subject to the willingness of both parties. 16- The Second Party shall provide confirmed round trip bookings to the ϩΩΣϭϝϣΣΗϳϥ΃ϰϟ΍ϱΩ΅ϳγϩϼϋ΍έϛΫΎϣϳϓϪϧϭΎόΗϡΩϋϥ΄ΑϲϧΎΛϟ΍ϑέρϟ΍έϘϳ -˻˽ pilgrims on the scheduled airline flights. If the Second Party violates this ΔλΗΧϣϟ΍ΕΎϬΟϟ΍ΎϬοέϔΗϪϳϟΎϣΕΎϣ΍έϏϭ΃ΕΎϔϟΎΧϣϱ΃ article, he shall be fined with any expenses related to the rebooking and accommodation during the delay period besides any additional costs. έηϋΔϳϧΎΛϟ΍ΓΩΎϣϟ΍ 17- The Second Party shall abide by grouping the pilgrims according to the έϣΗόϣϟ΍ΩϘϋ timing of pilgrims entrance and leaving of the hotels legally, accordingly, calculating the actual nights of entrance and leaving of hotels, and the Δ˰ΑϭϠρϣϟ΍ ΕΎ˰ϣΩ˰Χϟ΍ϭ Ε΍ίϳϣϣϟ΍ ϝ˰ϛ Ϫ˰ϳϓ ΩΩ˰Σϳ ˬ έϣΗόϣϟ΍ ϊϣ ˱΍Ω˰Ϙϋ ϲϧΎ˰Λϟ΍ ϑέρϟ΍ ϊϗϭϳ Second Party shall bear the financial consequence of the dates and timings ϱΫϟ΍ΩΩΧϟ΍ΞϣΎϧέΑϯϭΗ˰˰˰γϣϭωϭϧΏ˰˰˰γΣέϣΗόϣϟ΍ΎϬόϓΩϳ˰˰˰γϲΗϟ΍ϑϳϟΎϛΗϟ΍έ΍ΩϘϣϭ differences. ϝϭϷ΍ϑέρϟ΍ΎϬϣΩϘϳϲΗϟ΍έΎό˰γϷ΍ϭΞϣΎϧέΑϟ΍ϡίΣϭνϭέόϟ΍Δϣ΋Ύϗϥϣ˰οϥϣϩέΎΗΧ΍ ΔϳϟΎΗϟ΍ΩϭϧΑϟ΍Ν΍έΩΈΑΎΛϟ΍ϑέρϟ΍ϡίΗϠϳΎϣϛ ˬΎϬϧϣΔΧ˰˰γϧΑϝϭϷ΍ϑέρϟ΍Ωϭίϳϥ΃ϰϠϋ 18- The Second Party shall commit his pilgrims regarding the suitability of the ΩϭϧΑϟ΍ϩΫϬϟϲϓ΍ϭΡέ˰˰ηϊϣϩΫϳϔϧΗΑέϣΗόϣϟ΍ϡ΍ίϟϹέϣΗόϣϟ΍ϥϳΑϭϪϧϳΑϡέΑϣϟ΍ΩϘόϟ΍ϲϓ size and weight of the baggage with the agreed means of transportation, whereby the baggage of the pilgrims will not exceed the dedicated place in ϲϠϳΎϣϛϲϫϭ the means of transportation. The baggage may not be loaded in the places dedicated for the passengers inside the means of transportation. If the ΔϛϠϣϣϟΎΑΔϳέΎγϟ΍ΕΎϣϳϠόΗϟ΍ϭ΢΋΍ϭϠϟ΍ϭΔϣυϧϷ΍ΓΎϋ΍έϣ x baggage will exceed the capacity of the means of transportation, then the ΞϣΎ˰ϧέΑϟ΍ΓΩ˰ϣ˯Ύ˰ϬΗϧ΍Ω˰όΑΎ˰ϬΑϑϠΧΗϟ΍ϡΩ˰ϋϭΔ˰ϛϠϣϣϟ΍ΓέΩΎ˰ϐϣΑϡ΍ίΗϟϻ΍ x First Party shall rent a means of carriage to transport the extra luggage and ΓέΎϳίϟ΍ϭ΃Γέϣόϟ΍˯΍ΩϷΔϳϠΛϣϣϟ΍ϥϣϪϟΔΣϭϧϣϣϟ΍Γέϳη΄Ηϟ΍ϲϓΓΩΩΣϣϟ΍ the Second Party shall bear the value without referring back to him. x  x 19- The Second Party shall ensure that the pilgrims are coming for the purpose έΟ΃έϳϐΑϭ΃έΟ΄ΑΔϛϠϣϣϟ΍ϲϓϝϣόϟ΍ϡΩϋ x of Umrah only and not for medical purposes, for vising their relatives or for ΏΎΑγϷ΍ΕϧΎϛΎϣϬϣΞΣϟ΍Δοϳέϓ˯΍ΩϷΔϛϠϣϣϟ΍ϲϓϩ΅ΎϘΑϡΩϋ any other reasons. ΍Ϋ˰ϫϲϓΎ˰ϬϳϠϋϖϔΗϣϟ΍ϭϝϭϷ΍ϑέρϟΎ˰ΑΔ˰˰˰˰˰λΎ˰Χϟ΍Ε΍˯΍έΟϹ΍ϭ΢΋΍ϭϠϟ΍ 20- The Second Party represents that he shall keep the addresses of the ΩϘόϟ΍ pilgrims, visitors or their relatives (if any) during their stay in the kingdom. Δϣ΍έϐϟ΍ΦϳέΎΗϥϣϝϣϋϡΎϳ΃ 10ϝϼΧ e Penalties imposed by the Ministry of Hajj. ϥΈ˰ϓΔ˰ϛϠϣϣϟ΍ΝέΎ˰ΧϥϣΞϣ΍έΑϟ΍Δ˰ϣϳϗϝ˰ϳϭΣΗΑϲϧΎ˰Λϟ΍ϑέρϟ΍ϡΎ˰ϳϗΔ˰ϟΎ˰Σϲϓ -́ e Penalties imposed by the Passport Control Department or any other ϑέρϟ΍ϝϣΣΗϳϻϭρϘϓΔϣϠΗγϣϟ΍ώϟΎΑϣϟ΍ϻ·ϪΗΎΑΎ˰γΣϲϓΩϣΗόϳϥϟϝϭϷ΍ϑέρϟ΍ official authority in Saudi Arabia. ϙϭϧΑϟ΍ϥϣΔ˰˰οϭέϔϣϟ΍ΔϳϠΣϣϟ΍ϭ΍ΔϳϟϭΩϟ΍ϝϳϭΣΗϟ΍ΕϻϭϣϋϭΕΎϓϭέ˰˰λϣϝϭϷ΍ The expenses of transferring the pilgrim to other companies due to lack of notifying the First Party with the arrival of the pilgrim to Saudi Arabia in all ϯέΧϷ΍ΕΎϣϭϛΣϟ΍ϭ΃ the air, sea and land ports. ϥϳόΟ΍έΗϣϟ΍ϥϳέϣΗόϣϠϟΔ˰ϳϧϭέΗϛϟϹ΍ΕΎ˰ϣΩ˰Χϟ΍ϡϭ˰˰˰˰γέϊϓΩ˰ΑϲϧΎ˰Λϟ΍ϑέρϟ΍ϡίΗϠϳ -̂ 2- N The Second Party is obliged to purchase the services packages provided by the First Party. ˯ΎϧΛΗγ΍ϥϭΩϭΏΑγϟ΍ϥΎϛΎϳ΃ϲϟΎΗϟ΍ΏγΣΓέϣόϟ΍ΞϣΎϧέΑϥϋ 3- The Second Party should feed the Umrah automatic system with his ϰΗΣέϔ˰˰λέϬ˰˰ηϥϣΓέΩ˰˰λϣΔϘϓ΍ϭϣϝϛϥϋ் ˺˾˹ϥϭ˰˰γϣΧϭΔ΋Ύϣ x communication data (mobile number — email) to enable the Umrah Corporate Affairs Department in the Ministry to communicate with him ϲϧΎΛϟ΍ ̵ΩΎϣΟέϬηΔϳΎϬϧ directly and to ensure that he has received all the regulations and ϥΎοϣέϭϥΎΑόηϭΏΟέέϭϬηϝϼΧ் 400Δ΋ΎϣόΑέ΃ x instructions directly. x Temporarily suspending the automated visa issuing system by the ministry ϥϳϣΩΎϘϟ΍ϥϳέϣΗόϣϟ΍Ω΍ΩϋϷΔΣ˰˰˰ο΍ϭΔϳϠϳϐ˰˰˰ηΗΔρΧϡϳΩϘΗΑϲϧΎΛϟ΍ϑέρϟ΍ϡίΗϠϳ x from any Saudi company or institution in any country around the world if ϥϣϝϭϷ΍έϬ˰˰˰˰ηϟ΍ϝϼΧΔρΧϟ΍ϩΫϫϡΩϘΗϥ΃ϰϠϋˬϡ˰˰˰˰γϭϣϟ΍ϝϼΧϪϘϳέρϥϋ the automated monitoring system will report that (1 %) from the number of pilgrims presented by this company or association has been delayed until ΎϫέϳΧ΄ΗίϭΟϳϻϭΩϗΎόΗϟ΍ their departure (the minimum number of total pilgrims may not be less than 100). έϔ˰˰˰˰γϟ΍ϥϋϡϫέΧ΄ΗϭΓέϣόϟ΍ΞϣΎϧέΑΓΩϣϥϋϥϳέϣΗόϣϟ΍ΔϣΎϗ·ίϭΎ˰ΟΗΔϟΎΣϲϓ x ϥϣΩΩΣϣϟ΍ΞϣΎϧέΑϟ΍ϥϋϑϠΧΗϟ΍ΔΑ˰ ˰˰γϧίϭΎΟΗΗϥϳέΧ΄Ηϣϟ΍ΔΑ˰ ˰˰γϧΕΣΑ˰ ˰˰λ΃ϭ x Suspending the automated visa issuing system by the ministry if it was ϡΎυϧϑΎϘϳ·ϡΗϳϪϧ΄ϓΔϳΩϭό˰γΓέϣϋΔϛέ˰ηϭ΍ΔϟϭΩϭ΍ϲΟέΎΧϟ΍ϝϳϛϭϠϟΓέ΍ίϭϟ΍ reported that the second party hasn't issued any visas 30 days (thirty days ϡϬΟϣ΍έΑ ΩϳΩϣΗ ϭ΃ ϡϬΗέΩΎϐϣ ϡΗΗ ϥ΃ ϰϟ΍ ( Εϗ΅ϣ ϝϛ˰ηΑ  ˱Ύϳϟ΁ Ε΍έϳ˰η΄Ηϟ΍ έ΍Ω˰λ΍ -one month) after the start of his activation on the system. ϝϭϷ΍ϑέρϟ΍ΔϘϓ΍ϭϣΑϡϭϳ 30ϰλϗ΃ΩΣϛ x Temporarily suspending the automated visa issuing system by the ministry if it was reported that the number of arrivals through these visas is less ϝϭΩϑϠΗΧϣϲϓΔϛϠϣϣϟ΍ΕΎϳϠΛϣϣϟΕ΍έϳ˰˰˰η΄Ηϟ΍έ΍Ω˰˰˰λϹΔϳΟΎΗϧϹ΍ΔϗΎρϟΎΑΩϳϘΗϟ΍ x than 50 % of the ϡΎ˰ϘϣϥϣΓέΩΎ˰ ˰˰˰λϟ΍ΕΎ˰ϣϳϠόΗϟ΍Ϋ˰ϳϔϧΗΑϡ΍ίΗϟϹ΍Ύ˰ϫίϭΎ˰ΟΗΑΔ˰ΑϟΎ˰ρϣϟ΍ϡΩ˰ϋϭϡϟΎ˰όϟ΍ ΎϳϠόϓϥϳϣΩΎϘϟ΍ϥϳέϣΗόϣϠϟίΟΣϟ΍ϭϥϳέϣΗόϣϟ΍ΞϣΎϧέΑϖϳϭ˰γΗΑΔ˰λΎΧϟ΍ϭΓέ΍ίϭϟ΍ x number of visas issued (issued since thirty days)for each overseas agent, until they actually arrive (the minimum number of total pilgrims may not ΓέΩΎλϟ΍ϡϳϣΎόΗϟ΍ϭ΢΋΍ϭϠϟΎΑϡίΗϠϳΎϣϛˬϡϬΟϣ΍έΑΏγΣΓΩϭόϟ΍ϭΓέϣόϟ΍˯΍ΩϷ be less than 100). ΔϧϣΎΛϟ΍ΓΩΎϣϟ΍ x The second party shall abide by presenting clear operational plan for the ΔϣΎόϟ΍ρΑ΍ϭοϟ΍ number of pilgrims contracting with him during the season. ϡΎυϧϟ΍ϲϓϪϟιΧέϣϕΩϧϓϲϓϻ΍έϣΗόϣϱ΃ϥΎϛγ·ϡΗϳϥϟ -˺ x If the residency of the pilgrims shall exceed the Umrah program term and ϲϓϖΣϟ΍ϪϟϭέϣΗόϣϟ΍ΓΩϭϋϥϋΔϠϣΎϛΔϳϟϭ΋˰˰˰γϣϝϭ΋˰˰˰γϣϲϧΎΛϟ΍ϑέρϟ΍ϥϭϛϳ -˻ delayed from return, thus the number of the delayed pilgrims will exceed the percentage set by the ministry for the overseas agent, country or Saudi ϪϳέϣΗόϣϥϣΔΑγΎϧϣΎϫ΍έϳϲΗϟ΍ΕΎϧΎϣοϟ΍ΔϓΎϛΫΎΧΗ· Umrah Company, then the automated visa issuing system shall be ΔϓΎϛΑ ϪϏϼΑ·ϭ έϣΗόϣϟ΍ έΎϳΗΧ· ϥϋ ΔϠϣΎϛ Δϳϟϭ΋˰γϣ ˱ϻϭ΋˰γϣ ϲϧΎΛϟ΍ ϑέρϟ΍ ϥϭϛϳ -˼ temporarily suspended until they leave or their programs are extended for \"thirty days maximum\" with the approval of the First Party. ΔϳΩϭόγϟ΍ΕΎϣϳϠόΗϟ΍ϭρΑ΍ϭοϟ΍ ΔρΧϟ΍ϥϣΓΩϣΗόϣϟ΍Ε΍έϳ˰η΄Ηϟ΍ϊϳίϭΗϭϑέ˰λΗϟ΍ϲϓϖΣϟ΍ΔϳΩϭό˰γϟ΍Δϛέ˰ηϠϟ -˽ x To abide by the production capacity of issuing visas from the Kingdom ϖΣϳϭϲϧΎΛϟ΍ϑέρϟ΍ϥϣν΍έΗϋ·ϥϭΩΎΑ˰γΎϧϣϩ΍έϳΎϣΑϪϟΔΣϭϧϣϣϟ΍ΔϳϠϳϐ˰ηΗϟ΍ representative offices from the various countries around the world and not ϩ΍έΗΎϣΏ˰ γΣϲΟέΎΧϟ΍ϝϳϛϭϠϟΕ΍έϳ˰ η΄Ηϟ΍ΓΩΎϳίϭνϳϔΧΗΔϳΩϭό˰ γϟ΍Δϛέ˰ ηϠϟ claim any exceeding of such capacity. ΔϳϣΎυϧϟ΍ΔϠ΋ΎγϣϠϟνέόϣϪϧ΄ϓϙϟΫΑ ϲϠϳΎϣΑϲϧΎΛϟ΍ϑέρϟ΍ϡίΗϠϳ -˿ Article Eight: Γέϳ˰η΄Ηϟ΍΢ϧϣϡΗϲΗϟ΍ΕΎϣΩΧϟ΍ΔϣίΣϥϣ˰οϪϟΩΩΣϣϟ΍Εϗϭϟ΍ϲϓέϣΗόϣϟ΍ϡϭΩϗ x General Regulations ΎϬΑΟϭϣΑ 1- No Umrah pilgrim shall be accommodated in any hotel not licensed by law. ϥϳέϣΗόϣϠϟΓΩϭϋϭΏΎϫΫέϔγϟ΍έϛ΍ΫΗέϳϓϭΗ x 2- The second party shall be fully liable for the return of the Umrah pilgrim and Δ˰ϣίΣϥϣ˰˰˰˰οϡΎ˰υϧϟΎ˰ΑΔ˰ϠΟ˰˰˰˰γϣϟ΍ϡϬΗΩϭϋΩ˰ϳϋ΍ϭϣϥϋϥϳέϣΗόϣϟ΍ϑϠΧΗϡΩ˰ϋ x shall have the right to take all the suitable guarantees subject to his ΕΎϣΩΧϟ΍ discretion. 3- The Second Party shall be fully liable for the good selection of the Umrah ϲϧϭέΗϛϟϻ΍ϡΎ˰υϧϟ΍ϝϼΧϥϣϩΩ˰ϠΑϲϓϥϳέϣΗόϣϟ΍ϥϳΑϭϪ˰ϧϳΑΔ˰ϳϣΎ˰υϧΩϭϘϋϡ΍έΑ΍ x pilgrim and informing him with all Saudi regulations and instructions. ΎϬϧϣΔϳϗέϭΔΧγϧΑέϣΗόϣϟ΍ΩϳϭίΗϭ 4- The Saudi company shall have the right of conduct and distribution of the approved visas from the operational plan given to it, and subject to its έϣΗόϣϝϛϟΓέΩΎϐϣϟ΍ΔϠΣέϭϡϭΩϘϟ΍ΔϠΣέΕΎϧΎϳΑϝΎΧΩ΍ x discretion, without any objection from the Second Party, and the Saudi Company may decrease or increase the number of visas for the overseas έϣΗόϣϟ΍έϔγί΍ϭΟϰϠϋέϣΗόϣϟ΍ΞϣΎϧέΑϖλϠϣΔϋΎΑρ x agent subject to the Saudi Company's discretion without any objection from the agent. ϝϣ˰˰˰˰ηΗΩϭϛέΎΑϡ˰˰˰˰λόϣϟ΍Γέϭ˰˰˰˰γ·ϭ΍έϣΗόϣϝϛϟΔϳϔϳέόΗϟ΍ΔϗΎρΑϟ΍ΔϋΎΑρ x 5- To assure the second party that he is not permitted to provide any services in έϣΗόϣϟ΍ΞϣΎϧέΑ Saudi Arabia, and that the services packages in Saudi Arabia are maintained through the First Party and his officials. If the second party shall violate such ˬΔϳΩϭό˰γϟΎΑΔϣΎϗϹ΍Δϣυϧ΃ΔϳϟΎΗϟ΍Ώϧ΍ϭΟϟ΍ϲϓΔϳϭϋϭΗΓέ˰ηϧΑέϣΗόϣϟ΍ΩϳϭίΗ x rule, then he shall be liable for legal accountability. ιΧέϣϟ΍ϊϣϖϳ˰˰γϧΗϟΎΑΎϫΩ΍Ωϋ΍ϡΗϳΓέΎϳίϟ΍ϭΓέϣόϟ΍ϭΞΣϟ΍ρΑ΍ϭ˰˰οϭΔϣυϧ΃ 6- The Second Party is committed to the following: ϱΩϭόγϟ΍Ϫϟ x Not to present any services in Saudi Arabia and that the services packages inside Saudi Arabia fall under the responsibility of the first party and his ΔόγΎΗϟ΍ΓΩΎϣϟ΍ officials. ϥϳϓέρϟ΍ΕΎϣ΍ίΗϟ· x The arrival of the Umrah pilgrim in the time planned within the services package subject to which he was given the visa. Ύ˰ϫέΩ˰˰˰˰˰λΗ ϲΗϟ΍ ϥϳϧ΍ϭϘϟ΍ϭ Ε΍˯΍έΟϻ΍ϭ ΢΋΍ϭϠϟ΍ ϊϳϣΟΑ ϥΎ˰ϓέρϟ΍ ϡίΗϠϳ -˺ ϱ΃ϲϓΓέϣόϟ΍ϥϭ΅˰˰˰ηΑιΗΧΗΔϳΩϭό˰˰˰γΔϳϣϭϛΣΔϬΟϱ΃ϭ΃Γέ΍ίϭϟ΍ -˻ Εϗϭ ϥϳΑΔϠ˰˰˰γ΍έϣϠϟΔϳϣ˰˰˰γέϝ΋Ύ˰˰˰γϭϛΩϘόϟΎΑΔϧϭΩϣϟ΍ϥϳϭΎϧόϟ΍ϊϳϣΟΩϣΗόΗ ϥϳϓέρϟ΍ 5

1- The two parties relation shall not expire hereunder unless after the ϰϠϋϲϧΎΛϟ΍ϑέρϟ΍ϝϭ˰λΣΑϻ΍ΩϘόϟ΍΍ΫϫΏΟϭϣΑϥϳϓέρϟ΍ΔϗϼϋϲϬΗϧΗϻ -́ second party obtains final written clearance from the First Party at the ϝϳϛϭϠϟϖΣϳϻϭϡγϭϣϟ΍ΔϳΎϬϧϲϓϝϭϷ΍ϑέρϟ΍ϥϣΔϳΑΎΗϛΔϳ΋ΎϬϧΔλϟΎΧϣ end of the season, and the overseas agent shall not make contracts except after obtaining the clearance from the first party. ϝϭϷ΍ϑέρϟ΍ϥϣΔλϟΎΧϣϰϠϋϪϟϭλΣΩόΑϻ·ΩϗΎόΗϟ΍ϲΟέΎΧϟ΍ ΕΎΑϭϘόϟ΍ΔΣ΋ϻϖϳΑρΗΔϳΩϭό˰˰γϟ΍Δϛέ˰˰ηϠϟϖΣϳέϣΗόϣϱ΃ϑϠΧΗϝΎΣϲϓ -̂ 2- If any pilgrim shall be delayed, the Saudi company shall have the right to apply the sanctions list issued from the concerned authorities. ΔλΗΧϣϟ΍ΕΎϬΟϟ΍ϥϣΓέΩΎλϟ΍ ϙϭϧΑϟ΍ΩΣ΃ϥϣρϭέηϣέϳϏϲ΋ΎϬϧΎϳϛϧΑΎϧΎϣοϡϳΩϘΗΑϲϧΎΛϟ΍ϑέρϟ΍ϡίΗϠϳ -˺˹ 3- The second party shall provide final unconditioned bank guarantee from ΔΣϠ˰λϣϟϱΩϭό˰γϟ΍ϲΑέόϟ΍ΩϘϧϟ΍Δ˰γ˰γ΅ϣϥϣϝϭΑϘϣϭϪΗϟϭΩϲϓΓΩϣΗόϣϟ΍ one of the banks approved in his country and accepted by SAMA to the ϰϧΩ΃ΩΣϛϱΩϭό˰γ்ϑϟ΃ϥΎΗ΋ΎϣϱΩϭό˰γ் ˹˹ က ˹˹ϑέρϟ΍ benefit of the First Party with an amount of 200.000 Saudi Riyals (two ΓΩϣΩϳΩΟΗΑΩΩΟΗϳϭΩϘόϟ΍΍ΫϫΓΩϣϝ΍ϭρϝϭόϔϣϟ΍ϱέΎ˰γϥΎϣ˰οϟ΍΍Ϋϫϝυϳϭ hundred thousand Saudi Riyals) as a minimum and this guarantee shall νόΑϭ΃ϥΎϣ˰˰˰˰οϟ΍ΔϣϳϗϝϳΩόΗΑϲϧΎΛϟ΍ϑέρϟ΍ϡίΗϠϳΎϣϛώϠΑϣΑϝϭϷ΍ΩϘόϟ΍ stay valid throughout the term of contract and shall be renewed with the ΔϳΑέόϟ΍ΔϛϠϣϣϟ΍ϲϓΔ˰˰λΗΧϣϟ΍ΕΎϬΟϟ΍ϥϣΕΎϣϳϠόΗέϭΩ˰˰λϝΎΣϲϓϩΩϭϧΑ renewal of contract term. The second party represents to amend the guarantee value or a number of its articles if any instructions shall be ϙϟΫϝΎϳΣΔϳΩϭόγϟ΍ issued from the concerned authorities in Saudi Arabia in this regard. ϖΣϳϪϧ΄ϓϲϧΎ˰Λϟ΍ϑέρϟ΍ϱέϣΗόϣϟϑϠΧΗΕϻΎΣΔϟΎΣέϭϬυΔϟΎΣϲϓ -˺˺ ϝϳϛϭϠϟωϭΟέϟ΍ϥϭΩϲϛϧΑϟ΍ϥΎϣ˰ ˰˰οϟ΍ϝϳ˰ ˰˰γΗΏϠρΔϳΩϭό˰ ˰˰γϟ΍Δϛέ˰ ˰˰ηϠϟ 4- In case of any absence case / cases from the pilgrims of the second party, the Saudi Company shall have the right to request liquidating the bank ϪΗϘϓ΍ϭϣΑϥΫϻ΍ ΫΧ΍ϭ΍ϲΟέΎΧϟ΍ guarantee without any referral or permission of the overseas agent. ΔγΩΎγϟ΍ΓΩΎϣϟ΍ Article Six: ίΟΣϟ΍νϳϔΧΗϭ΍˯ΎϐϟϹ΍ΕΎϣ΍έϏ Cancellation or lowering booking penalties ώϟΎΑϣϝϭϷ΍ϑέρϟ΍ϝϣΣΗϳϥ΃ΏϠρΗΗϝϘϧϟ΍ϝ΋Ύ˰γϭϭϥϛ˰γϟ΍ϲϓΕ΍ίϭΟΣϟ΍ΕϧΎϛΎϣϟϭ ϖΣϳ Ϫ˰ϳϠόϓ ˬ Ϫ˰ϣϭΩ˰ϗ ϝ˰ϳΟ΄˰Η ϭ΃ έϣΗόϣϟ΍ ϡϭΩ˰ϗ ϡΩ˰ϋ Δ˰ϟΎ˰Σ ϲϓ Ύ˰ϬόϓΩ ϡίϠϳ ϭ΃ ˱Ύ˰ϣΩ˰Ϙϣ ϊϓΩ˰Η Whereas the booking of housing and means of transportation require the First Party to bear cash amounts or penalties to be submitted in case of ϲϟΎΗϟΎϛϲϧΎΛϟ΍ϑέρϟ΍ϰϠϋ νϳϔΧΗϟ΍ϭ΍˯ΎϐϟϹ΍ΕΎϣ΍έϏνέϓϝϭϻ΍ϑέρϠϟ the absence or delay of the pilgrim, thus the First Party has the right to apply the cancellation or lowering booking penalties on the Second Party ϥΎοϣέέϬηϝΑϗνϔΧϧϣϟ΍ϡγϭϣϟ΍ϝϼΧ -˺ as follows: -˻ ΔϣϳϗϲϟΎϣΟ·ϥϣ 80ΔΑ˰γϧΑνϳϔΧΗϭ΃˯Ύϐϟ·Δϣ΍έϏνέϓ x 1- During the low season (before Ramadan): Ω΍Ω˰ϋ΃νϳϔΧΗϭ΃ϝ˰ϳΟ΄˰Ηϭ΃˯Ύ˰ϐϟ·Δ˰ϟΎ˰ΣϲϓΎ˰ϬϳϠϋϖϔΗϣϟ΍ΕΎ˰ϣΩ˰Χϟ΍ To apply cancellation or booking lowering penalty by (80 %) from the ϪϳϠϋϖϔΗϣϟ΍ϝϭλϭϟ΍ΦϳέΎΗϥϣϡϭϳ ˻˺ϥϣϝϗ΃ϝΑϗϥϳέϣΗόϣϟ΍ total value of agreed services in case of the cancellation or lowering the pilgrims' numbers less than (21) days prior to the agreed date of arrival.  To apply cancellation or booking lowering penalty by (100 %) from the total value of agreed services contract in case of the cancellation or ϲϟΎ˰ϣΟ·ϥϣ ˺˹˹Δ˰Α˰˰˰˰γϧΑνϳϔΧΗϭ΃˯Ύ˰ϐϟ·Δ˰ϣ΍έϏνέϓ x lowering of the pilgrims' numbers before (21) days or less prior to the νϳϔΧΗϭ΃ϝϳΟ΄Ηϭ΃˯Ύϐϟ·ΔϟΎΣϲϓϪϳϠϋϖϔΗϣϟ΍ΕΎϣΩΧϟ΍ΩϘϋΔϣϳϗ agreed date of arrival. ϪϳϠϋϖϔΗϣϟ΍ϝϭ˰λϭϟ΍ΦϳέΎΗϥϣϡϭϳ ˻˺ϰϘΑΗ΍Ϋ·ϥϳέϣΗόϣϟ΍Ω΍Ωϋ΃ 2- During the other seasons (Ramadan): ϝϗ΃ϭ΃ The second party shall be required to pay cancellation penalty equal to ϥΎοϣέέϬηϯέΧϷ΍ϡγ΍ϭϣϟ΍Ε΍έΗϓϝϼΧ 100 % from the total agreed services contract value in case of the cancellation or lowering of pilgrims' numbers 30 days prior to the agreed Ω˰ϘϋΔ˰ϣϳϗϲϟΎ˰ϣΟ·ϥϣ100Δ˰Α˰˰˰˰γϧΑ˯Ύ˰ϐϟ·Δ˰ϣ΍έϏϊϓΩ˰ΑϡίΗϠϳ x date of arrival or less, and the second party shall transfer the liabilities Ω΍Ω˰ϋ΃νϳϔΧΗϭ΃ϝ˰ϳΟ΄˰Ηϭ΃˯Ύ˰ϐϟ΍Δ˰ϟΎ˰ΣϲϓΎ˰ϬϳϠϋϖϔΗϣϟ΍ΕΎ˰ϣΩ˰Χϟ΍ of this obligation to the pilgrim in the contract entered with. ϝϗ΍ϭ΃ϪϳϠϋϖϔΗϣϟ΍ϝϭ˰λϭϟ΍Φϳέ΄Ηϥϣϡϭϳ 30ϰϘΑΗ΍Ϋ·ϥϳέϣΗόϣϟ΍ Ω˰Ϙόϟ΍ϲϓέϣΗόϣϟ΍ϰϠϋϡ΍ίΗϟϻ΍΍Ϋ˰ϫ˯Ώ˰ϋϝ˰Ϙϧϳϥ΃ϲϧΎ˰Λϟ΍ϑέρϠϟϭ Article Seven: Regulations related to issuing visas from the Ministry ϪόϣϡέΑϣϟ΍ 1- Applying the grouping of visas issued from the ministry on partial groups from the ΔόΑΎγϟ΍ΓΩΎϣϟ΍ beginning of Umrah season, with him. putting the following into consideration:- Γέ΍ίϭϟ΍ϥϣΕ΍έϳη΄Ηϟ΍΢ϧϣΑΔϘϠόΗϣϟ΍ρΑ΍ϭοϟ΍ ϊϣΓέϣόϟ΍ΓέΗϓΔϳ΍ΩΑϥϣΔϳ΋ίΟΕΎόϓΩϰϠϋΓέ΍ίϭϟ΍ϝΑϗϥϣΕ΍έϳη΄Ηϟ΍ΞϳϭϔΗϖϳΑρΗ x Temporarily suspending the automated visa issuing system by the ministry from any overseas agent if the automated monitoring system will report that (1 %) of ϲΗϻ΍ϡΗϳγϪϧ΍ΔυΣϼϣ the number of pilgrims presented by this agent has been delayed, until their departure (the minimum number of total pilgrims may not be less than 100). ϱ΃ϥϋΕϗ΅ϣϝϛ˰˰˰ηΑΕ΍έϳ˰˰˰η΄Ηϟ΍έ΍Ω˰˰˰λϹϲϟϵ΍ϡΎυϧϟ΍ϑΎϘϳ· x ϑϠΧΗΔΑ˰˰˰γϧύϭϠΑΔϳϟϵ΍ΔόΑΎΗϣϟ΍ϥϣΩ˰˰˰λέΎϣϰΗϣϲΟέΎΧϝϳϛϭ x Ύ˰ϳϠόϓϡΩ˰ϗϥϣΩΩ˰ϋϥϣ 1ϡϫΩϼΑϰϟ΍ΓΩϭόϟ΍ϥϋϥϳέϣΗόϣϟ΍ ϰϠϋϡϬΗέΩΎ˰ϐϣϡΗΗϥ΃ϰϟ΍ˬϝ˰ϳϛϭϟ΍ϙ˰ϟΫϖϳέρϥϋϥϳέϣΗόϣϟ΍ϥϣ έϣΗόϣΔ΋ϣϥϋϥϳϣΩΎϘϟ΍ϥϳέϣΗόϣϟ΍ΩΩϋϲϟΎϣΟϹϰϧΩϷ΍ΩΣϟ΍ϝϘϳϻ΃  ϥϣΕϗ΅ϣϝϛ˰ηΑΕ΍έϳ˰η΄Ηϟ΍έ΍Ω˰λϹϲϟϵ΍ϡΎυϧϟ΍ϑΎϘϳ· ΔϟϭΩϱ΃ϲϓΔϳΩϭό˰γΔ˰γ˰γ΅ϣϭ΃Δϛέ˰ηϱ΃ϥϋΓέ΍ίϭϟ΍ϝΑϗ ϲϟΎϣΟ΍ύϭϠΑΔϳϟϵ΍ΔόΑΎΗϣϟ΍ϥϣΩλέΎϣϰΗϣϡϟΎόϟ΍ϝϭΩϥϣ ϥϣ 1ϡϫΩϼΑϰϟ΍ΓΩϭόϟ΍ϥϋϥϳέϣΗόϣϟ΍ϑϠΧΗΔΑ˰γϧ ϖϳέρϥϋΔ˰ϟϭΩ˰ϟ΍ϙ˰ϠΗϥϣϥϳέϣΗόϣϟ΍ϥϣΎ˰ϳϠόϓϡΩ˰ϗϥϣΩΩ˰ϋ ϥ΃ϰϠϋϡϬΗέΩΎϐϣϡΗΗϥ΃ϰϟ·ˬΔ˰γ˰γ΅ϣϟ΍ϭ΃Δϛέ˰ηϟ΍ϙϠΗ Δ΋ϣϥϋϥϳϣΩΎϘϟ΍ϥϳέϣΗόϣϟ΍ΩΩϋϲϟΎϣΟϹϰϧΩϷ΍ΩΣϟ΍ϝϘϳϻ έϣΗόϣ 4

1- Provision of the health conditions required by the Ministry of Health in the Kingdom. ΔΛϟΎΛϟ΍ΓΩΎϣϟ΍ 2- Provision of valid passport to travel to the kingdom. ΔϳϠΛϣϣϟ΍Γέϳη΄ΗϰϠϋϝϭλΣϟ΍ΕΎρ΍έΗη· 3- Round trip confirmed tickets from the country of the pilgrim to the ϲϧΎΛϟ΍ϑέρϟ΍έΑϋϡΗϳΔϳϠΛϣϣϟ΍ϥϣΓέϳ˰˰η΄Ηϟ΍ϰϠϋέ΋΍ίϟ΍ϭ΃έϣΗόϣϟ΍ϝϭ˰˰λΣϥΎϛΎϣϟ ΏΟϭΗϳ ϪϧΈϓ ˬ Γέϣόϟ΍ ϡΎυϧϟ ΔϳΫϳϔϧΗϟ΍ ΔΣ΋ϼϟ΍ ϥϣ Γέ˰˰˰ηϋ ΔόΑΎ˰˰˰γϟ΍ ΓΩΎϣϟ΍ ϡΎϛΣϷ ˱ΎϘϓϭ Kingdom, whether individual or group trips. ΔϳϟΎΗϟ΍ρϭέηϟ΍˯ΎϔϳΗγ΍ϥϣΩϛ΄Ηϟ΍ΩόΑΔϳϠΛϣϠϟΏϠρϟ΍ϡΩϘϳϥ΍ϲϧΎΛϟ΍ϑέρϟ΍ϰϠϋ 4- Ensuring the validity of all the annexed documents as required from the Δ˰ϳΑέόϟ΍Δ˰ϛϠϣϣϟΎ˰ΑΔ˰Σ˰˰˰˰λϟ΍Γέ΍ίϭΎ˰ϬΑϠρΗϲΗϟ΍Δ˰ϳΣ˰˰˰˰λϟ΍ΕΎ˰ρ΍έΗ˰˰˰˰ηϻ΍έϳϓϭΗ -˺˿ consulates (Kinship — accompanied women — sex — age — profession ΔϳΩϭόγϟ΍ nationality - ..). 5- Obtaining valid reference numbers. ΔϳΣϼλϟ΍ϱέΎγϭΔϳΩϭόγϟ΍ΔϳΑέόϟ΍ΔϛϠϣϣϠϟέϔγϠϟ΢ϟΎλέϔγί΍ϭΟέϓϭΗ -˺̀ 6- of that the costs of accommodation, transportation etc have been paid έϣΗόϣϟ΍ΔϟϭΩϥϣίΟΣϟ΍ΓΩϛ΅ϣϭΔϳΣϼ˰˰λϟ΍ΔϳέΎ˰˰γϩΩϭϋϭΏΎϫΫέϔ˰˰γέϛ΍ΫΗ -˺́ fully to the first party by a bank transfer made to the first party account ˱΍ϭΟϭ ˬ ΃έΑ ΕϧΎϛ ˯΍ϭ˰γϭ  ΔϳϋΎϣΟ ϡ΍ ΔϳέΩέϓ ΕϼΣέ ΕϧΎϛ ˯΍ϭ˰γ ΔϛϠϣϣϟ΍ ϰϟ΍ or by the electronic payment method approved by the ministry of hajj either at the Al-Rajhi Bank, IBAN (SA31 8000 0364 6080 1000 6807)or any  ˱΍έΣΑ ϭ΃ other official bank.The costs paid for the first party cover the services ΔϠ˰˰˰λΕΎϳϠ˰˰˰λϧϘϟ΍ϥϣΔΑϭϠρϣϟ΍ΔϘϓέϣϟ΍Ε΍ΩϧΗ˰˰˰γϣϟ΍ϊϳϣΟΔΣ˰˰˰λϥϣΩϛ΄Ηϟ΍ -˺̂ which will be provided for the umrah performer . ΔϳγϧΟϟ΍ –ΔϧϬϣϟ΍ -έϣόϟ΍ -αϧΟϟ΍ -ϡέΎΣϣϟ΍ –ΔΑ΍έϘϟ΍ Article Four: ΔϳΣϼλϟ΍ΔϳέΎγϊΟ΍έϣϡΎϗέ΃ϰϠϋϝϭλΣϟ΍ -˻˹ Requlations related to services provision 1- Both parties shall abide by the instructions and regulations of the Umrah ϭ΃Εϼ˰˰λ΍ϭϣϟ΍ϭϥϛ˰˰γϟ΍ϑϳϟΎϛΗΎϬϳϓΎϣΑϝϭϷ΍ϑέρϟ΍ΕΎϘΣΗ˰˰γϣϝϣΎϛΩ΍Ω˰˰γΕΑΛϳΎϣ -˻˺ ΏΟϭϣΑˬΓέΎϳίϭ΃ΓέϣϋΓέϳη΄ΗΏϭϠρϣϟ΍έϣΗόϣϠϟΔΑϭϠρϣϟ΍ϯέΧϷ΍ΕΎϣΩΧϟ΍ϥϣΎϫέϳϏ services, especially those related to services provision. Δϔϧλϣϟ΍Δϳϧϛγϟ΍Ε΍ΩΣϭϟ΍ϭϕΩΎϧϔϟ΍ϲϓΔϛϠϣϣϟ΍ΝέΎΧϥϣϥϳϣΩΎϘϟ΍ϥϳέϣΗόϣϟ΍ϥΎϛγ·ϡΗϳ -˾ Article Five: Regulations related to the overseas agent as issued from the Ministry ιΎλΗΧϻ΍ΔϬΟϥϣΔλΧέϣϟ΍ϭ of Hajj and Umrah ϝΎΑϘΗ˰γϻ΍Δϛέ˰ηέΎό˰η·ϭϥϳέϣΗόϣϟ΍ϝϭ˰λϭΩϳϋ΍ϭϣϝΎ˰γέΈΑϡ΍ίΗϟϹ΍ϲϧΎΛϟ΍ϑέρϟ΍ϰϠϋ -˿ 1- The second party, located in any country around the world, shall be an ϡΎυϧϟ΍έΑϋΓΩΩΣϣϟ΍Ωϳϋ΍ϭϣϟ΍ϲϓϝϘϧϟ΍ϝ΋ΎγϭέϳϓϭΗϟϡϬϟϭλϭϥϣϲϓΎϛΕϗϭϝΑϗϙϟΫΑ authenticated member in IATA for issuing airline tickets, while no overseas agent shall be approved except after showing his IATA membership. ΔγϣΎΧϟ΍ΓΩΎϣϟ΍ 2- The last date to approve the overseas agents contracts shall be the end of Jumada al-Thani of each Hegira Year or as defined by the ministry Any ΞΣϟ΍Γέ΍ίϭϥϋΓέΩΎλϟ΍ϲΟέΎΧϟ΍ϝϳϛϭϟΎΑΔϘϠόΗϣϟ΍ρΑ΍ϭοϟ΍ requests exceeding that date shall not be accepted. 3- The second party shall work on balancing the arrival of Pilgrims around the ΎΗΎϳ΃Δϣυϧϣϲϓ΍ΩϣΗόϣ΍ϭ˰ οϋϡϟΎόϟ΍ϝϭΩϊϳϣΟϲϓϲϧΎΛϟ΍ϑέρϟ΍ϥϭϛϳϥ΃ -˺ Umrah season without overcrowding them during the months of Sha'baan ί΍έΑ΍Ωϧϋϻ΍ϲΟέΎΧϝϳϛϭϱ΃ΩΎϣΗϋ΍ϡΗϳϻϭϥ΍έϳρϟ΍έϛ΍ΫΗέ΍Ω˰˰˰˰λϹΔϳϣϟΎόϟ΍ -˻ and Ramadan. -˼ 4- To refrain from authenticating or renewal of any overseas agents who were Δϣυϧϣϟ΍ϩΫϫΔϳϭοϋ -˽ reported with 1 % or more absence in the previous year (while the minimum ϱΩΎϣΟέϬ˰ηΔϳΎϬϧϭϫϥϳϳΟέΎΧϟ΍˯ϼϛϭϟ΍ΩϭϘϋϰϠϋΔϗΩΎ˰λϣϠϟΩϋϭϣέΧ΁ϥ΃ -˾ number of total Umrah pilgrims may not be less than one hundreq). Preamble ΩϳϬϣΗ Whereas the First Party holds and has the capabilities and capacities to provide the necessary ϥϳέϣΗόϣϠϟΔ˰ϣίϼϟ΍ΕΎ˰ϣΩ˰Χϟ΍ϡϳΩ˰ϘΗϟΕΎ˰ϳϧΎ˰ϛϣϻ΍ϭΕ΍έΩ˰Ϙϟ΍Ϫ˰ϳΩ˰ϟϝϭϷ΍ϑέρϟ΍ϥΎ˰ϛΎ˰ϣϟ services to the Umrah Pilgrims and the visitors of the Prophet’s Mosque, subject to ΕΎϬΟϟ΍ΎϬΗΩΩΣϲΗϟ΍ΕΎϔ˰˰λ΍ϭϣϟ΍ϭρϭέ˰˰ηϠϟΎϘΑρˬϑϳέ˰˰ηϟ΍ϱϭΑϧϟ΍ΩΟ˰˰γϣϟ΍έ΍ϭίϭ the conditions and specifications defined by the official entities in Saudi Arabia and is licensed ϑέρϟ΍ϥΎϛΎϣϟϭΕΎϣΩΧϟ΍ϙϠΗ˯΍Ω΄ΑϪϟιΧέϣϭΔϳΩϭό˰γϟ΍ΔϳΑέόϟ΍ΔϛϠϣϣϟΎΑΔϳϣ˰γέϟ΍ to perform these services, and whereas the Second Party is officially licensed and fulfils all ϲϓΔϳϣ˰γέϟ΍ΕΎϬΟϟ΍ΎϬΑϠρΗϲΗϟ΍ ρϭέ˰ηϟ΍ ΔϓΎϛϟ ϲϓϭΗ˰γϣϭ ˱Ύϳϣ˰γέ Ϫϟ ιΧέϣ ϲϧΎΛϟ΍ the conditions required by the official authorities in the Umrah pilgrim country of origin to ΔϛϠϣϣϟ΍ϰϟ΍ΓέΎϳίϟ΍ϭΓέϣόϟ΍ΕϼΣέϭΔΣΎϳ˰˰γϟ΍ϭέϔ˰˰γϟ΍ΕϼΣέϡϳυϧΗϟέϣΗόϣϟ΍ΔϟϭΩ organize the travel, tourism, Umrah trips and visits to Saudi Arabia, and the Second as ϝϭϷ΍ϑέρϟ΍ΕΎϣΩΧΞϣ΍έΑϊϳΑϭϖϳϭ˰˰γΗϟΓέΩϘϟ΍ϭΔΑϏέϟ΍ϪϳΩϟϭΔϳΩϭό˰˰γϟ΍ΔϳΑέόϟ΍ the wish and capability to market and sell the services of the first party in his country / ΩΩόϠϟΎϬΑϑϳέόΗϟ΍ϖϘΣϳΎϣΑϥϳΩϳΩ˰˰ηρΎΑ˰˰οϧ΍ϭΔϗΩΑΔϟϭΩϲϓϩΩϠΑϲϓ territory ………….
