Today civilization has caught up with us. 01BRBHAI AOI Articles (I – XI)

ARTICLE I. DECLARATION OF PURPOSE The purposes of this association are those set forth in its Articles of Incorporation. Its primary concern is to facilitate the delivery of adequate social services and economic advantages for the association to improve the quality of life and well-being of its members. ARTICLE II. NAME AND LOCATION The name of this Association is BLUE RIDGE B HOMEOWNERS ASSOCIATION, INC. Its principal Office shall be located at Moonlight Loop, Blue Ridge B, Quezon City, Philippines. ARTICLE III. MEMBERSHIP Section 1. Members - Every homeowner shall be qualified to be a member of the association. Unless otherwise provided in the contract to Sell, Deed of Sale, or other instruments of conveyance, or annotated in the title of the property, membership in the association is optional. The right of membership, including the right to vote and to be voted for, shall be exercised by the head of the family of each homeowner, lot owner/buyer, or bonafide occupant, of a house or lot. A lessee of a homeowner under a contract with a term of at least one (1) year may qualify to be a member and shall have the rights of a member upon complying with the requirements of membership under the by-laws and the law. Section 2. Member in Good Standing - Every member in good standing is one who complies faithfully with all the duties and obligations of a member as determined by the Board of Directors. Section 3. Rights and Privileges of Membership – Every member of this association shall be entitled to participate in any meeting and vote on the following matters: a. Amendment of the articles of incorporation; b. Adoption and amendment of by-laws; c. Sale, lease exchange, mortgage, pledge or other disposition of all or substantially all of the association’s assets BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 0 7

d. Incurring, creating, or increasing bonded indebtedness; e. Increases or decreases of association capitalization or dues; f. Merger or consolidation of the association with another association or other association, g. Investment of association funds in another association; h. Dissolution of the association; and, i. The use, enjoyment, and to benefit from, or take advantage of all facilities, amenities and services of the association. Unless otherwise stated in the Articles of incorporation or in these by-laws, and in addition to the foregoing rights and privileges, every member in good standing of this association shall have the following rights; a. To vote at all elections of directors or trustees, either in person or by representative authorized to act by written proxy; b. To be eligible to any elective or appointive office of the association; c. To participate and vote on all matters brought before any meeting or deliberation of the members of the association; and, d. To use, enjoy, benefit from, or take advantage of all facilities and services of the association. Section 4. Duties of Members – Every member of this association shall have the following duties; a. To pay his membership fee, association dues, special assessments, and such other fees which may be levied on him by the association; b. To participate in important activities or social affairs of the association as may be determined by the board of directors or trustees. c. To affect all meetings, assembly, and seminars as may be called by the association, the board of directors or trustees or its committees; and, d. To obey and comply with this by-laws and such other rules and regulations as may be promulgated by the board of directors or trustees and approved by the majority of the members. Section 5. Delinquent Member – Unless otherwise provided in the by-laws, a member who has failed to pay three (3) cumulative monthly dues or membership fees, or other charges/assessment despite demands by the association, or has repeatedly violated the association’s by-laws and/or declared policies, may be declared delinquent by the Board of Directors in accordance with the procedure in the succeeding section. Section 6. Procedure in Declaring a Member Delinquent - The Board or a committee assigned by the Board shall observe the following procedure in declaring a member delinquent or not in good standing; a. The Board of the committee shall determine whether a member (1) failed to pay at least three (3) cumulative monthly dues, fees or other charges based on the report of the treasurer or as reflected in the association’s financial records, or (2) repeatedly or grossly violated the by-laws or policies of the association as reflected in the book of records of the association. The president or the designated officer of the association shall forthwith b. notify the said member in writing of the violation and require him to explain in writing, within fifteen (15) days from receipt of notice, why he should not be declared delinquent. After the lapse of fifteen (15) days, with or without a written explanation, c. the President of the designated officer shall submit the matter to the Board or Committee for hearing and deliberation. Thereafter, the member may be declared delinquent by the majority vote of d. all the members of the Board. Section 8. Reinstatement of a Delinquent Member – The Board shall, by majority vote, reinstate the membership of the delinquent member, provided that unpaid dues, fees or charges are paid or the sanctions imposed are satisfied. Nothing in this Rule shall prevent the association from imposing other sanctions against the delinquent member in accordance with the by-laws. Section 9. Membership Roll – The association shall keep and maintain under the custody of the Secretary, a membership roll containing the list of all members and such additional members as may be admitted from time to time, including information and data, which may be required by the board of directors and trustees. Section 10. Expulsion from the Association – Any member may be expelled from the association on the following grounds; Default in the payment of association dues specified in Article IV hereof, for a period of thirty (30) days from written demand; Ceasing to be a member in good standing, as determined by the board of directors and trustees, after due to notice and hearing; and, Repeated violation of any of the provisions of the articles of Incorporation, this by-laws or existing rules and regulations of the association and exhibiting conduct inimical to the interest of the association as determined by the board of directors or trustees, after due notice and hearing. ARTICLE IV. FEES AND DUES Section 1. Membership Fee – Upon the organization of this Association, or the admission of any person as member hereof, every member of the association shall pay a membership fee of _____________________ or in such amount as may be determined by the Board of Directors upon approval of the majority of the general membership in a meeting duly called for the purpose. Section 2. Association or Maintenance Dues – Monthly association and/or maintenance dues of __________________________________________ shall be collected from every member to defray the administrative cost and operational expenses of the association. Section 3. Contributions – The association may raise funds for its programs and activities, through contributions, donations and/or other forms. Section 4. Special Assessments – The Board of directors or trustees, may from time to time, assess and collect from each member reasonable amounts as may be necessary to fund special community projects for the common good and benefit of the association as approved by the majority of the members of the board and members of the association. ARTICLE V. BOARD OF DIRECTORS OR TRUSTEES Section 1. Powers and Duties of the Board of Directors – Unless otherwise provided in the articles of incorporation and this by-laws, the powers of this association shall be exercised, all business conducted and all of its property controlled and held by the board of directors or trustees elected from among the members in good standing of this association. In addition to the duties and responsibilities stated in the by-laws of the association, the board shall have the following duties and responsibilities; a. Regularly maintain an accounting system using generally accepted accounting principles, and keep books of accounts, which shall be open for inspection to any homeowner and duly authorized representatives of government agencies upon request, during reasonable hours on business days; b. Collect reasonable fees, dues and assessments that may be provided for in the by-laws and approved by the majority of the members; BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 1 0

c. Collect reasonable charges for assessments, and after due notice and hearing by the board in accordance with the procedures as provided in the by-laws, and rules and regulations adopted by the board, charge reasonable fines for late payments and for violation of the by-laws, rules, and regulations of the associations, in accordance with a previously established schedule adopted by the board and furnished to the homeowners; d. Propose measures to raise funds and the utilization of such funds and submit the same for consideration of the members of the association; e. Undergo a free orientation by the HLURB or any other competent agency deputized by it on how to conduct meetings, preparation of minutes, handling of accounts, laws and pertinent rules and regulations within thirty (30) days after election or appointment; f. Discharge the duties and responsibilities provided for in the association’s by-laws; and, g. Exercise such other powers as may be necessary and proper in the accordance with this act and for the accomplishment of the purposes for which the association was organized. The board shall act in all instances on behalf of the association was organized. Except to amend the articles of association, to dissolve the association, to elect members of the board or to determine the qualifications, powers and duties, or office of the board, and other instances that require the vote or approval of the members themselves. In the performance of their duties, the officers and members of the board shall exercise the degree of care and loyalty required by such position. Section 2. Number of Directors or Trustees and Qualifications – The board of directors and trustees of this association shall be composed of eleven (11) elected members. No person shall be elected as director or trustee unless he is a member in good standing of this association. Section 3. Nomination – Not less than seven (7) days or more than fourteen (14) days before the annual meeting at which the directors or trustees are to be elected, any fifteen (15) or more members may, by written petition, nominate candidates to the Board and post their name in the bulletin of the association. Section 4. Election and Term of Office – Directors shall be elected by secret ballot at the annual meeting of the members of the association. The directors or trustees so elected shall hold offices for a term of two (2) years and until their successors are elected and qualified. Provided, however that on the first annual meeting of members of the association after the incorporation. BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 1 1

One and half (1/2) of the directors or trustees with the lowest number of votes will be replaced so that an election will be held every year to replace half of the directors or trustees. Provided further that no director or trustee shall be nominated and/or elected after completing two (2) consecutive terms as director or trustee. Section 5. Verification and Validation of Petition for Removal of Directors or Trustee – The following procedure shall be observed in case of removal of a director or trustee of an association; a. A director or trustee may be removed from office, through a verified petition duly signed by the majority members in good standing of an association, for any cause provided in the by-laws of the association; b. The duly signed petition, subscribed and sworn to before a notary public shall be submitted to the Regional office of the HLURB for purposes of verification and validation. Within five (5) days from the receipt of the petition, the Regional Office shall determine whether the petition complies with the required formalities and based on any of the grounds or causes for removal provided under the by-laws, upon being satisfied that the petition is sufficient in form and substance, the Regional Office shall determine, based on its record, whether the petition is signed by majority of the members of the association concerned. c. If the Regional Office determines that the petition is not signed by the required number of the members of the association, It shall then dismiss the petition and shall inform the member who filed the petition of its decision, furnishing a copy thereof to the board and the director or trustee subject of the petition; if, on the other hand, the petition is signed by the required number of the members of the association, the Regional Office shall then proceed with the validation of the petition. The Homeowners Association Administration division of the regional office shall compare the signature appearing in the petition with the records on file with the Regional office. d. The Homeowners association Administration Division shall then prepare a report on the conduct of validation and submit the same to the Regional Director/officer shall then issue an order validating the petition and the removal of the director or trustee, furnishing a copy thereof to the director/trustee concerned and the board; e. Within (60) days from the receipt of the order from the Regional Director/Officer, an election shall be called by the remainder of the board for the purposes of determining who shall hold office for the unexpired term of the removed director or trustee; BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 1 2

f. The director or trustee who has been removed shall have the right to question his removal on the sole ground of the validity of the cause relied upon by the members of the association, through a petition filed before the Regional Office within fifteen (15) days from the receipt of the order of his removal; and, g. The pendency of the petition filed by the director or trustee shall not prevent the board from conducting the special election called for the purpose of filing up the vacancy. In the event the HLURB decides that the removal is invalid, the removed director or trustee shall then be reinstated to his former position and served the remainder if his term. The tenure of the person who replaced the removed director from the time of his election up to the time of the reinstatement of the latter shall be respected. Section 6. Dissolution of the Board – In the event two-thirds (2/3) of the association’s members submit a verified petition for the dissolution of the board. The following procedure shall be observed; a. The petition for the dissolution of the board shall be based solely on the grounds or causes provided in the association’s by-laws. b. The procedure provided in the subsections (b) to (g) of the immediately preceding section shall be observed; and, c. Until the new board members shall have been elected and qualified, the HLURB shall designate an interim board; Provided, That such board shall be composed of association members in good standing; Provided, further, That such interim board members shall not be eligible to run in the election called for the purpose of replacing the member of the dissolved board. This procedure shall also be adopted if a majority of the members of the board is removed, which shall be considered as dissolution of the entire board. Section 7. Vacancies – Except as herein above provided, any other vacancies occurring in the board either by resignation, death or incapacity, shall be filled by a majority vote or the members entitled to vote at a special meeting duly called and held for the purpose without compliance with the foregoing provisions with respect to unexpired term(s) of the resigning, incapacitated or deceased director(s) or trustee(s). Section 8. Regular Meeting of the Board - The first regular meeting of the Board shall without notice be held immediately after the annual meeting of the members. Thereafter, the regular meeting of the Board shall also be held on the third Saturday of February at the principal office of the association and no notice thereof shall be required. Section 9. Special Meeting of the Board – Special meeting of the board may be called by the president or majority of the members of the board and it shall there upon be the duty of the secretary to cause the notice of such meeting to be sent to each directors at least (2) days before the meeting. Section 10. Quorum – A majority of the directors or trustees shall constitute a quorum at any6 meeting of the Board. Section 11. Compensation – Granting of per diems only to officers who are not members of the Board of Directors. ARTICLE VI. OFFICERS Section 1. Officers – The officers of the association shall be the President, Vice- President, Secretary, Treasurer, Auditor, Area Coordinator and such other officers as may from time be determined by the Board. Long-term leases and tenants are not qualified to be elected or appointed as president, vice-president, and treasurer of the association. Section 2. Election and Terms of Office – The officers mentioned in Section 1 hereof shall be elected at the annual meeting of the Board held immediately after the annual meeting of the members shall hold office for a term of two (2) years, and until their successors shall have been elected and qualified. If the election of officers cannot be held at such meeting, the election shall be held during the next regular meeting. Section 3. Compensation – The officers of the association who are not members of the Board may receive such honoraria as may be determined by the board of directors or trustees. Section 4. Removal of Officers – Any officers of the association may be removed by a majority vote of the members of the Board constituting a quorum whenever in its judgement the best interest of the association will be served thereby. Section 5. President – The president shall be elected by the board of directors or trustees from their own number. He shall exercise such powers and perform such duties incident to his office and such other duties as may from time to time be delegated to him by the Board. Among others, the president shall; a. Preside at all meetings of the members and of the board of directors or trustees; b. Exercise generals supervision over all the other officers of the association; c. Represent the association in all activities to which it is a party or participant; d. Preside , in consultation with the appropriate officers and committees, a yearly program of activities and submit and annual report of the operations of the association to the members at the annual meeting, and to the board of directors or trustees such statement, reports, memoranda and accounts as may be requested by the latter; e. Organize and supervise work groups among the members of the association; f. Post a fidelity bond sufficient to answer for the association’s cash assets and its equivalent at the time of his/her assumption of office, provided, that the posting of the said bond shall be for the personal account of the officer concerned; and, g. Exercise the power to create additional committees as maybe necessary. Section 6. Vice-President – The Vice-President shall be elected by the board of directors or trustees from their own number. He shall be vested with the all the powers and authorities of, and required to perform all the duties of the President during the absence or incapacity of the latter for any cause, and he shall also perform such other duties as the board of directors or trustees may from time to time assign to him. Section 7. Treasurer - The Treasurer shall be elected by the board of directors or trustees, and he/she may or may not be a director or trustees of the association. He/she shall hold office at the pleasure of the board, and shall perform the following duties. a. Have custody of, and be responsible for, all the funds, securities, and bonds of the association, and keep a complete and accurate record of receipts and disbursements and other of commercial transactions in the corresponding books of accounts of the association, and see to it that all disbursements and expenditures are evidenced by appropriate vouchers; BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 1 5

b. Disburse the funds of the association, for specific purpose/s authorized by a resolution of the board of directors or trustees. c. Receive and give receipts for all moneys paid to the association from any source whatsoever and take charge and have custody of petty cash funds as may be fixed by the board; d. Be responsible for keeping the financial records of the association and the liquidation of any and all accounts liabilities and obligations owing on dues from association; e. Shall monitor all delinquencies and send notices on overdue association’s dues and/or demand latters; f. Post a fidelity bond sufficient to answer for the association’s cash assets and its equivalent at the time of his/her assumption of office provided, that the posting of the bond shall be for the personal account of the officer; and, g. In general, perform all the duties incident to the office of the treasurer and such other duties as may from time to time be assigned to him by the board of directors or trustees. The treasurer may delegate the routine duties of his office to one or more employees of the association with the approval of the president. Section 8. Secretary – The Secretary shall be elected by the board of directors or trustees, and he\\she may not be a director or trustee of the association. He/she shall hold office at the pleasure of the board, and shall perform the following; a. Keep full minutes of all meetings of the members of the board and of the members, in one more books provided for this purpose; b. Deliver or submit all notices in accordance with this by-laws or as required by law or rules of the HLURB; c. Keep all corporate records and the seal of the association which shall affixed such instruments as may be required by the HLURB and thereupon be attested by his signature or that of the treasurer; d. Keep a register or membership roll of the names and post office addresses of all members; e. Provide each member a copy of the by-laws and all amendments thereto; and, f. In general, perform all duties incident to the office of the secretary and such other duties as may from time to time be assigned by the board. BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 1 6

Section 9. Auditor – The Auditor shall be appointed by the board of directors or trustees, and he/she may not be a director or trustee of the association. He/she shall hold office at the pleasure of the board, and shall perform the following duties; a. Serve as the chairperson of the audit and inventory committee of the association; b. Examine and audit all financial transactions of the association including all the books, ledgers, journals and other supporting records pertaining thereto; and, c. Perform all duties incident to the office of the auditor and such other duties as may from time to time be assigned by the board. Section 10. Area Coordinators – The Area Coordinator shall be appointed by the President having jurisdiction over an assigned area or street/s. An area Coordinator shall have the following functions and responsibilities; a. To personally represent the BRBHAI in their assigned areas; b. To ensure that BRBHAI communications are disseminated, received and understood by the residents in their area; c. To promote the integration into the community of new residents/association members; d. To encourage participation of area residents in BRBHAI activities and programs; and, e. To attend Board and Officers meetings when available. ARTICLE VII. ASSOCIATION COMMITTEES Section 1. Committees – The association, by a vote of the majority of the members thereof, shall organize and create the following committees; a. Grievance and Adjudication Committee. The members of the grievance and adjudication committee, who should have experience in counseling shall be elected by the members in the annual meetings of the members. The committee shall accept and investigate complaints filed by a member against any other member or officer, and shall settle or arbitrate any dispute within its power in the community. In the event that the grievance is not settled by the committee, its decision may be appealed to the board of directors. Any controversy or dispute shall first be brought before the board prior to elevating the same to HLURB. The board of directors shall issue a certification as to the non-settlement of a dispute before HLURB shall take cognizance of the dispute or controversy. b. Finance Committee. The finance committee shall be responsible for auditing the accounts of the association. It shall conduct such audit at least semi-annually and submit its reports thereon to the board of directors. This committee shall also, subject to the approval of the Board of directors, prepare the budget of the association and plan, adopt and implement canvassing, procurement and disbursement guidelines for projects that will or may require the use of the association funds. The committee shall also serve as a coordinating body for all financial matters involving external institutions and shall evolve a savings campaign and other fund raising activities. c. Infrastructure Committee. The infrastructure committee shall take charge of planning, coordination and actually operating the facilities and services of the association. It may be organized into groups or councils, which shall form as the backbone of the community service delivery system. These groups or council shall be formed as the need arises. d. Membership and Education Committee. The membership and education committee shall take charge of the development of human resources in the community. It shall conduct information, educational and motivational campaigns and shall prepare and implement training activities designed to make the residents productive members of the association. e. Committee on Election. The board shall constitute an election committee COMPOSED OF Chairman and two (2) members who shall not be officers or members of the board. They shall serve a term of two years. The Board shall likewise, in case of any vacancy in the election committee arising from resignation or for any other reason, appoint a new member to serve the unexpired term of the member of the committee. f. Livelihood Committee. The livelihood committee shall plan and coordinate all economic programs designed to supplement the income of the members. As such, it shall closely coordinate with the financial management committee in the preparations of feasibility studies and other proposals. g. Beautification Maintenance Committee. The maintenance committee shall take charge of the upkeep and repair of community facilities and services. It shall form and organize the beautification/ecology team or group to maintain cleanliness and beauty in the community. h. Security Committee. The peace and other committee shall take charge of maintaining peace and order in the community. It shall form and organize the members into tanod brigades to safeguard the security of the area and emergency/disaster brigade to meet any natural or man-made calamity. i. Social, Sports and Cultural Affairs Committee. It shall be tasked with planning, organizing and implementing social activities that will help improve inter-personal relations among the members. It shall also develop programs and activities to deepen cultural awareness among the members. Finally, it shall form and organize sports and recreation brigade. Section 2. Social Committee – Other special committees, council, or groups may be created by the board of directors or trustees as the need arises. ARTICLE VIII. ELECTIONS Section 1. Holding of Elections – A homeowners association shall hold regular membership meetings or elections on the time or date set forth in its by-laws. Section 2. Proxies - Association members may vote in person or by proxy in all meetings of members. Proxies shall be in writing, signed by the member and filed before the scheduled meeting with the association secretary. Unless otherwise provided in the proxy, it shall be valid only for the meeting which it is intended. No proxy shall be valid and effective for a period longer than three (3) years at any one time unless earlier revoked by the member. Section 3. Failure of Election – when a regular or special election cannot be held or conducted due to lack of quorum as defined under association by-laws or for any other serious causes of such as violence, terrorism, force majeure, and other analogous causes of such a nature that the holding of a free, orderly and honest election should become impossible, the election committee shall call for another election within a period of thirty (30) days from the date of the failed election or the cessation of the cause for such failure of election. Section 4. Hold-Over – Where there is a failure to elect a new set of directors or officers, the incumbent directors/trustees/officers shall be allowed to continue in a hold-over capacity until their successors are elected and qualified. Section 5. Election Contests – Election contests and their resolutions shall be governed by-laws of the association. Unless otherwise provided by the Association’s by-laws. The election contest shall be in writing and filed by any aggrieved candidate/s within five (5) days after the proclamation of the winning candidates. Section 6. Turnover of Records and Properties by Outgoing Directors/Officers - To ensure the orderly turnover of the management of the association, the outgoing directors and officers of the association shall turn over all association books, records, properties and other assets, to the new set of directors and officers within sixty (600 days from the election of the new Board. ARTICLE IX. MEETING OF MEMBERS Section 1. Place of Meeting – The meeting of members shall be held at the principal office of the association. Section 2. Annual Meeting – The annual meeting of the members shall be held on the Third (3rd) Saturday of February of each year at which meeting, the members shall elect the directors and transact such other business as may properly be brought during the meeting. Section 3. Special General Meeting – At any time during the interval between annual meeting, special meeting of the members may be called by the president or by a majority of the board, provided, however, that ten (10) percent or more of the members in good standing may in writing, petition the board of directors or trustees to call a special meeting of the members. Section 4. Notice of Members Meeting – A written notice stating the date, place and hour of the meeting and, in case of special notice is to be transacted, shall be personally delivered to each member not less than five (5) days before the date of the meeting. Section 5. Quorum – Majority of the members in good standing present in person or by proxy shall constitute a quorum at any meeting of the members for the transaction of business. Section 6. Voting – Each household shall be entitled to only one vote. Voting by proxy shall be allowed. All questions shall be decided by a vote of majority of those present otherwise provided by law, the articles of incorporation and this by-laws. Section 7. Proxies – Proxies shall be writing, dated, signed by the member, notarized, and filed before the scheduled meeting with the Secretary. Section 8. Annual Statement – A true and full statement of the affairs of the association shall be submitted at the annual meeting for consideration by the members. Section 9. Minutes - Minutes of all meetings of the members shall be kept and carefully preserved as a record of the matters and business transacted at such meetings. The minutes shall contain such entries as may be required by law. ARTICLE X. FINANCIAL TRANSACTIONS Section 1. Contracts – The Board shall by specific resolution, authorize any officer or officers, or member/s to enter any contract or execute and deliver any instrument in the name or in behalf of the association. Section 2. Signing of Checks, etc. – All checks, drafts, or other orders for payment of money, and all notes, bond or other evidence of indebtedness issued in the name of the association shall be signed jointly by the treasurer and the president or other officers authorized by the Board. Section 3. Deposit – All funds of the association such as association dues and membership fees shall be deposited from time to time to the credit or account of the association in such bank or banks as the board may be designate. Section 4. Fiscal Year – The fiscal year of the association shall begin on the 1st day of January and end on the 31st day of December of each year. The treasurer shall cause to be made a full and complete audit of the books, accounts and financial condition of the association. Such audit shall be made available for purpose, the association shall conduct such audit at least three (3) months before the end of the fiscal year, make pertinent recommendations to the Board and render a report to the members at the annual meeting. ARTICLE XI. MISCELLANEOUS PROVISIONS Section 1. Board Rules and Regulations – The Board shall have the power to promulgate such rules and regulations consistent with law, the articles of incorporation or this by-laws. Section 2. Amendments – These by laws or any portion or provision hereof may be amended, repeated or otherwise changed, upon initiation of the Board in any manner not contrary to law, the articles of incorporation, contracts, or agreements, at a duly called and held regular meeting or special meeting, by the affirmative vote of a majority of the members, provided, however, that notice of such meeting whether regular or special, shall contain a fair statement of the proposed amendments. Section 1. ISSUANCE OF IDS 1.1. All household staff, family drivers, employees, whether stay in or stay out are required to obtain a BRBHA ID in order to freely enter and exit our village gates. These IDs shall be for a period of one year and shall be renewed upon expiry. 1.2 All construction workers are required to obtain a BRBHA Construction ID before they can start working inside our village. This ID shall have a validity of 3 months and must be renewed if work will be extended. 1.3 Resident IDs/Barangay *Please attach forms* Section 2. NON-RESIDENTS AND CONSTRUCTION WORKERS PEDESTRIAN TRAFFIC 2.1 All visitors, non-residents, construction workers, and household employees without a BRBHA ID will be allowed access through the Main Gate Only. All other pedestrians belonging to this group bound for Blue Ridge A will be directed to use the gate/s of Blue Ridge A. 2.2 The rear gate at Evening Glow Road will be for the exclusive use of BRA and BRB residents and their household employees with BRB/BRA IDs, which must be left with the guard upon every exit and claimed upon reentering. 2.3 All visitors are to be thoroughly screened. They must state their business/purpose and the person they intend to visit. The guard must call the person to be visited for confirmation of the identity of the visitor. A valid photo-bearing ID must be surrendered in exchange for a BRB Visitor’s pass. 2.4 Anyone entering the subdivision who appears to be intoxicated or under the influence of drugs should be denied entry. 2.5 All registered construction workers must surrender their BRBHA Construction ID before they can be allowed to enter the main gate. Unless registered as a stay-in worker, all workers must leave the Subdivision before 6:00 p.m. everyday. In case an ID is unclaimed after working hours, the guard on duty must report the same to the chairman of the Security Committee for proper fines/sanctions to be levied against the contractor or owner builder. 2.6 All items being brought out by house helps or staff of residents will be allowed passage through Twin Peaks Main gate only. Baggage should be thoroughly inspected by the recording guard and should be accompanied by an official BRB Baggage Gate Pass duly signed by the resident or his/her authorized representative. The guard should call the resident employer for confirmation. Baggage gate passes shall be available at both Guardhouses and BRBHA Office. Section 3. VEHICULAR TRAFFIC 3.1. Except to allow vehicles in or out of the subdivision, the gate barriers shall remain in CLOSED position at all times. 3.2 For vehicles with current BRB, BRA and St. Ignatius car stickers, the guard shall open the barrier, permit entry without delay and salute the driver of the vehicle. The Express Lane shall be for the exclusive use of BRB, BRA and SIV vehicles with current stickers only. 3.3 When only one (1) gate is open to traffic (rear gate and front exit gates are closed during night time) and vehicles entering and exiting arrive at the main gate at the same time, preference shall be given to the entering vehicle. Section 4. VEHICLES WITHOUT CURRENT BRB, BRA AND CAR STICKERS 4.1. As a general rule, all taxis and unstickered vehicles should exit at the gate of entry, except if the driver/passenger is a resident of BRB and BRA. 4.2 With the barrier in CLOSED position, the guard must ask the driver the purpose of his/her visit. The guard should then call the resident to get clearance for entry of the visitor. 4.3 The driver must surrender his/her driver’s license in exchange for BRB Entry Pass. In the case of taxis, photo bearing ID of the passenger should also be deposited with the guard. ID cards without photos are not acceptable. Guards are to check that the photo in the ID bears very close resemblance to the driver and the passenger. 4.4 Recording guard shall record name of visitor, name of resident visited, vehicle details, i.e. make, color, plate number and time of entry and exit. 4.5. In the case of out dated or unstickered vehicles driven by residents, the gate guard, with the barrier at closed position, shall approach the resident, salute and remind him/her politely to obtain a sticker to avoid any unnecessary delays in entering the subdivision. If the driver or passenger claiming to be a resident is not known to the guard, a photo ID with address at Blue Ridge must be shown to the guard, and advised to obtain a sticker to avoid delay in entering and leaving the subdivision. 4.6 BRB and BRA residents on board taxis or unstickered vehicles may be allowed to exit thru gates other than the one they entered provided that the guard at the point of entry advises the guard at the point of exit. This will be restricted to BRB and BRA Main gates (Twin Peaks and Rajah Matanda only). If in doubt whether the passenger is indeed a resident, the guard must ask for proof of identity as explained above. 4.7 Request for hailing of taxis, shall be the exclusive privilege of BRBHA paying members only. Under no circumstance, however, shall a guard personally escort a taxi to pick up the resident passenger. All exiting taxis, cargo trucks, etc. must be thoroughly searched (including boot) before leaving the subdivision irrespective of whether the passenger is a resident or not. Section 5. PARKING REGULATIONS: Fines will be imposed to violators of Parking Ordinance as follows: 5.1 Off-street parking within Blue Ridge B is permitted in parking slots on one side of the street only and shall be on a first come, first served basis. 5.2 There shall be NO PARKING 5.2.1 Along Boni Serrano Road 5.2.2 Along roadsides opposite the designated sides for parking 5.2.3 On the portion of the road side where parking is permitted, when a vehicle gate is located on the opposite side. However, No parking slot located directly across the resident’s gate may be used by said resident. 5.2.4 Within five (5) meters of all road corners. BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 2 8

5.2.5 Along the sidewalks 5.2.6 At any time of day or night for the following: 5.2.6.1 Trailer trucks, cargo trucks, delivery vans or any similar 5.2.6.2 commercial vehicle Nonoperational vehicles 5.3 All NO PARKING areas are considered TOW-AWAY ZONES and any illegally parked vehicle will be tire locked and towed away if not removed within seven (7) days. 5.4 The following will be constitute as illegal parking in violation of Barangay Ordinance 95-02 and will be subject to tire lock or towing, as follows: 5.4.1 Vehicles improperly parked outside the designated parking slots. All four wheels and Bumper to bumper should be 5.4.2 inside the parking slot and shout not occupy any part of the 5.4.3 sidewalk. Vehicle repair, body works, painting activities and the like 5.4.4 along the street. 5.4.5 Overnight parking of vehicles without current year’s BRB car sticker without prior arrangement with the Security Committee. Commercial Vehicles Non-operational vehicles parked for more than seven (7) days. Section 6. BLOWING OF HORNS 6.1 Blowing of horns is prohibited from 10:00 p.m. to 6:00 a.m. 6.2 BLUE RIDGE B SECURITY DETAIL 6.2.1 GUARDS SCHEDULE DAY SHIFT 7:00 A.M. TO 7:00 P.M. NIGHT SHIFT 7:00 P.M. TO 7:00 A.M. 6.3 CONDUCT OF GUARDS AND PROPER DECORUM 6.3.1 Except for uniformed guards on duty, no one will be allowed to loiter in and around the premises of the front and rear guard houses. 6.3.2 Guards on duty should be in full uniform at all times and 6.3.3 should extend proper courtesy to everyone especially residents 6.3.4 and their immediate families. 6.3.5 For easy identification, it is required that names of guards on 6.3.6 duty shall be conspicuously posted at the guard house. Guards on duty are required to keep the guard house, its surroundings and toilet clean and tidy at all times, free of trash, foodstuffs, empty bottles, etc. The telephone shall be for official use only for guards on duty and extreme emergencies. Under no circumstance shall the telephone be used for more than three (3) minutes per call. Unless otherwise authorized in writing by the security committee, guards are not allowed to take in or remove anything from the guardhouse. Corresponding monetary penalties will be imposed for any of the following offenses of BRB Security Guards: TYPES OF OFFENSE: Use of alcohol or prohibited drugs* Abandonment of post/ Absence without leave* Insubordination* Discourtesy, Disobedience, improper/immoral behavior* Sleeping while on duty Leaving gate boom/s in open position ** Allowing entry/exit of unauthorized vehicles (no sticker) or persons (no ID) ** Not assisting in traffic control ** Allowing unauthorized person in guardhouse premises (Bawal and Istambay) ** Failure to update Guard-on-Duty board after every shift ** Tardiness Improper Uniform NOTE: * Violations 1 to 5 may result in immediate dismissal/termination of the offender based on the majority vote of the BRBHA Board, depending on the gravity of the offense. ** In the case of violations 6 to 10, Penalty shall be shared equally by the guards on duty. RULES AND REGULATIONS GOVERNING HOUSE CONSTRUCTION, RENOVATION & REPAIRS BRBHA CLEARANCE: A Blue Ridge B Homeowners’ Association (BRBHA) Clearance is necessary before any house construction, renovation or repair is undertaken within the Subdivision which will include the following: a. All construction, renovation or repairs employing more than two (2) workers for periods exceeding two (2) weeks. b. New construction and /or demolition. c. Renovations whether major or minor which involve structural alterations. d. Any construction, renovation or repair which will entail the use of the sidewalk. Note: All minors repairs employing two (2) workers or less and /or works which shall not exceed two weeks (without making use of the sidewalks) will not be required to obtain a BRBHA Clearance or Worker IDs but nevertheless are required to submit to BRBHA, a list of workers and the nature of work to be done so the guards can be notified to allow them entry. The grant of BRBHA Clearance for Construction binds the Owner/Contractor to adhere to the following rules and regulations, and pay the corresponding fees, fines and penalties imposed hereon. Fines will be strictly imposed for every subsequent offense after a written warning shall have been served after the first offense. 1. CONCRETE MIXING: Mixing of concrete shall not be allowed on Subdivision roads or paved sidewalks. Likewise, materials for concrete mixing (i.e. Sand, Gravel, Cement) or any construction materials or equipment shall not overflow into or placed along the road as to cause defacing, obstruction or clogging of the drainage system, or damage to the sidewalk, curbs, gutters and roadways. 2. STOCKPILING &/OR DUMPING OF CONSTRUCTIONS MATERIALS, DEBRIS AND FILL: Stockpiling of construction materials on the sidewalks should be done in a neat and orderly manner and should not overflow into a gutter or roadway. Under no circumstances shall dumping of landfill or debris be allowed along the sidewalks and should be contained well inside the property lines. FINE: P500.00 3. WORKING HOURS: Official working hours shall be from 8:00AM to 5:00PM, Mondays to Saturdays. Overtime work may be allowed provided the nature of work will not create noise or disturbance to immediate neighbors. A written consent from adjoining neighbors should first be obtained before any overtime work is undertaken. All workers (except stay-in crew and those authorized to do overtime work) are not allowed to stay inside the Subdivision beyond 6:00PM. FINE: P200.00 per offense per worker 4. STAY – IN CREW AND CURFEW HOURS / DRESS CODE: Stay-in workers shall be limited to a maximum of five (5) persons only. Curfew hours 8:00PM to 6:00AM shall be strictly observed. All stay-in workers should be quartered inside the job site during this time. No worker will be allowed entry into the Subdivision during said curfew hours. All tank tops, bareback or barefoot are not allowed. FINE: P200.00 per offense per worker. 5. PLAYING OR LOITERING around the Subdivision, playground, park area and sports facilities as well as sitting along the sidewalks is prohibited at all times. Uttering obscene language at passers-by especially female residents or mingling with maids is likewise prohibited. FINE: P200.00 per worker per offense. 6. CONSTRUCTION WORKERS’ I.D.: The NO ID NO ENTRY RULE WILL ALWAYS APPLY. Contractor/Owner is required to submit a list of workers and apply for BRBHA Workers I.D.’s. Except for the stay-in crew, all workers shall leave their IDs with the guard upon entry and shall claim the same upon exit from the Subdivision. All Worker IDs not claimed from the guards after normal working hours will be considered as an infraction of the rules and regulations. Corresponding fines shall be applied on a per day basis. In case of termination of any worker, the owner/contractor should immediately inform BRBHA, his ID cancelled, his name be stricken off from the active workers’ list and barred from entering the Subdivision. FINE: P200.00 per worker per day. Loss or irreparable damage of BRBHA Worker’s ID – P 200.00 BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 3 3

7. NO OPEN FIRES OR BURNING: Whatsoever shall be allowed anywhere inside the job site. FINE: P500.00 per offense without need of warning. 8. NOISE GENERATING MACHINERY OR EQUIPMENT: Is prohibited unless the express written consent of immediate neighbors and BRBHA is first obtained. FINE: P500.00 9. GAMBLING, STEALING, ILLEGAL POSSESSION OF FIREARMS OR OTHER DEADLY WEAPONS, INFIGHTING, INDULGING IN OR POSSESSION OF INTOXICATING LIQUOR OR ILLEGAL DRUGS. FINE: P500.00 per worker per offense. PENALTY: Depending on the gravity of the offense, outright dismissal and detention of worker/s or person/s and their immediate turn-over to the nearest police station. 10. CANTEEN SERVICES: No canteen or store shall be operated within the job site without express written consent of BRBHA. FINE: P500.00 11. CONSTRUCTION DEPOSIT AND BRBHA DUES: A cash construction bond and advanced payment of BRBHA dues equivalent to one (1) year per dwelling is required prior to the grant of a BRBHA Clearance for Construction. The construction deposit shall be refundable without interest upon presentation of the Certificate of Occupancy issued by the Building official of Quezon City, the premises and sidewalks, curbs, gutters and other facilities restored to their original state prior to construction, and Barangay Clearance to refund deposit. Said deposit will also be used to answer for any outstanding accounts of the owner such as but not limited to, unpaid BRBHA dues, fines, fees of delivery trucks, etc. Including the cost of restoring damaged facilities caused by the construction. All cash deposits not redeemed within sixty (60) days after the termination of construction activities or occupancy of the premises, whichever comes first shall automatically be deemed forfeited in favor of BRBHA without need of notice. Likewise, cash construction deposit shall also be forfeited in case construction work is not completed six months after estimated completion date. Cash construction deposits are as follows: a. FIFTY THOUSAND PESOS (₱ 50,000.00) for single detached new construction or demolition b. TWENTY FIVE THOUSAND PESOS (₱ 25,000.00) for renovation and repairs with structural alterations. a. TEN THOUSAND PESOS (₱ 10,000.00) for any construction , renovation or repair which will employ more than two (2) workers for a period of more than two (2) weeks or those which will b. necessitate the use of the sidewalk or any other Subdivision facility. FIFTY THOUSAND PESOS (₱ 50,000.00) for the first unit and TWENTY FIVE THOUSAND PESOS (PhP25, 000.00) for each succeeding unit for multi dwelling structures. Any person found to be undertaking any construction, renovation and /or alteration within Blue Ridge B Subdivision without first obtaining Barangay and BRBHA Clearances and Building Permit will constrain BRBHA to instruct the guards to bar all construction workers and delivery vehicles intended for his/her job site from entering the Subdivision. FINE: P1, 000.00 plus work stoppage and forfeiture of construction bond. Any construction activity which violates the National Building Code shall be fined ₱1, 000.00 plus work stoppage and forfeiture of construction bond. BRBHA shall likewise instruct the guards to bar all construction workers and delivery vehicles intended for his/her job site from entering the subdivision. The above amended BRBHA Guidelines, Rules and Regulations governing house construction for all new and on-going projects within Blue Ridge B Subdivision shall take effect on April 4, 2008 and will cancel and supersede all previous memoranda issued regarding this matter. RESOLUTION GOVERNING LEASE OF PROPERTIES IN BLUE RIDGE B WHEREAS, there is a need to regulate the lease of properties in Blue Ridge B to ensure that tenants are of good moral character and are aware of the rules and regulations of BRBHA. RESOLVED THAT: 1. New tenants shall be required to submit the following before they can move in: Completed Application for Membership in BRBHA Copy of the Contract of Lease NBI Clearance Authority to Move In 2. Lessors should make their tenants aware of the homeowner’s association due and other rules and regulations of BRBHA. 3. The Lessor shall be responsible for all unpaid dues of his/her tenant per unit or dwelling. Full payment of unpaid association dues shall be made by the Lessor to BRBHA before the end of each calendar year. Otherwise, interest based on prevailing bank loan rate shall be levied on unpaid association dues and future tenants will not be allowed to move in. 4. An Authority to Move Out shall be submitted by the Lessor to the Association before his/her tenant can be given Clearance to move out. RESOLUTION GOVERNING BUYERS OF PROPERTIES IN BLUE RIDGE B WHEREAS, there is a need to regulate the sale of properties in Blue Ridge B to ensure that buyers are aware of the unpaid association dues of the property for sale which need to be fully settled by the owner. RESOLVED, that: 1. The association dues of properties for sale must be fully paid by the seller up to the time of sale. In the event that the sale is already consummated, the buyer shall be liable in paying BRBHA for any unpaid association dues before moving in or before any construction can be done on the property. 2. The buyer of the property must complete the Application for Membership in BRBHA before moving in. BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 4 1

3. The buyer of the property must obtain a BRBHA CLEARANCE TO MOVE IN before he can move in. 4. To allot a budget for the repainting of all No Parking Slots. RESOLUTION REGARDING HIRING OF EMPLOYEES OF ANOTHER HOMEOWNER WHEREAS, for the sake of peace and harmony among BRB homeowners, there is a need to regulate the hiring of employees of another BRB homeowner. RESOLVED, that: Any BRB homeowner who wants to hire an existing or former employee (driver, household help, office employee) of another BRB homeowner should advise the previous employer in writing of his/her intention to hire said employee. This is to prevent any misunderstanding among the homeowners, and at the same time give the new employer a chance to get feedback from the previous employer about said employee. RESOLUTION TO LIMIT THE ISSUANCE OF CAR STICKER TO LESSEES OF MULTI DWELLING UNITS WHEREAS, due to the difficulty in parking along our streets, the issuance of car passes to lessees of rooms or multi dwelling units shall be limited to only one car pass so as to give priority parking to our registered homeowners along the streets of Blue Ridge B. RESOLVED, that: The issuance of car passes to lessees of rooms or multi dwelling units, who only pay 50% of the association dues, be limited to only one car pass to give our registered homeowners, who pay full association dues, priority parking privilege along the streets of Blue Ridge B. RESOLUTION DISALLOWING THE TRANSFER OF VEHICLE/CAR STICKER TO ANOTHER VEHICLE WHEREAS, for the sake of security and safety of our residents, there is a need to ensure that BRBHA issued Vehicle/Car Sticker is used only by the vehicle stated in the Application for Vehicle/Car Sticker Form. RESOLVED THAT: Vehicle/ Car Pass issued to a particular vehicle upon application with BRBHA is used only by the vehicle stated in the Application for Vehicle/Car Sticker. Any vehicle found to be using a vehicle/car sticker issued to another vehicle/car shall be tire locked and be subjected to penalties imposed on tire locked vehicles. Furthermore, said vehicle/car shall be banned from entering Blue Ridge in the future. RESOLUTION IMPOSING RESTRICTIONS ON MEMBER SPONSORED VEHICLE/CAR STICKERS WHEREAS, due to parking space problems in the streets of Blue Ridge B, there is a need to regulate the use of our roads by vehicles/cars with Member Sponsored Car Stickers. RESOLVED THAT: The vehicles/cars with member sponsored vehicle/car stickers shall be allowed to freely enter our gates. However, the following restrictions shall be imposed on them: They will be allowed to park on our roads only when visiting a resident. They will not be allowed to park overnight. REPUBLIC ACT NO. 9904 AN ACT PROVIDING FOR A MAGNA CARTA FOR HOMEOWNERS AND HOMEOWNERS’ ASSOCIATIONS, AND FOR OTHER PURPOSES Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: CHAPTER I 'I’ITLE AND DECLARATION OF POLICY Section 1. Title. — This Act shall be known as the \"Magna Carta for Homeowners and Homeowners’ Associations”. Section 2. Declaration of Policy. — In fulfillment of the constitutional principles directing the State to encourage , promote and respect nongovernmental, community-based and people's organizations in serving their legitimate collective interests in our participatory democracy, it in hereby declared the policy of the State to uphold the rights of the people to form unions, associations, or societies, and to recognize and promote the rights and the roles of homeowners as individuals and as members of the society and of homeowners' associations. To this end, the State shall endeavor to make available resources and assistance that will help them fulfill their roles in serving the needs and interests of their communities, in complementing the efforts of local government units (LGUs) in providing vital and basic services to our citizens, and in helping implement local and national government policies, programs, rules and ordinances for the development of the nation. SECTION 3. Definition of Terms. — For purposes of this Act, the following terms shall mean: a. “Accounting period” refers to the fiscal or calendar year adopted by a homeowners’ association in the recording and reporting of its fiscal transactions. b. “Association” refers to the homeowners' association which is a nonstock, nonprofit corporation registered with the Housing and Land Use Regulatory Board (HLURB), or one previously registered with the Home Insurance Guarantee Corporation (now Home Guaranty Corporation) or the Securities and Exchange Commission (SE C), BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 4 6

organized by owners or purchasers of a lot in a subdivision/village or other residential real property located within the jurisdiction of the association; or awardees, usufructuaries, legal occupants and/or lessees of a housing unit and/or lot in a government socialized or economic housing or relocation project and other urban estates; or underprivileged and homeless citizens as defined under existing laws in the process of being accredited as usufructuaries or awardees of ownership rights under the Community Mortgage Program (CMP), Land Tenure Assistance Program (LTAP) and other similar programs in relation to a socialized housing project actually being implemented by the national government or the LGU. c. “Association member” refers to a homeowner who is a member of the association where his/her housing unit or lot is situated and those defined in the articles of incorporation and bylaws of the association. d. “Basic community services and facilities” refer to services and facilities that redound to the benefit of all homeowners and from which, by reason of practicality, no homeowner may be excluded such as, but not limited to: security; street and vicinity lights; maintenance, repairs and cleaning of streets; garbage collection and disposal; and other similar services and facilities. e. “Board” refers to the board of directors or trustees of the association which has primary authority to manage the affairs of the association. f. “Common areas” refer to property owned or otherwise maintained, repaired or administered in whole or in part by the association including, but not limited to, roads, parks, playgrounds and open spaces as provided in Presidential Decree No. 1216. g. “Common expense” refers to costs incurred by the association to exercise any of the powers provided for in this Act. h. “Economic housing” refers to a type of housing project with lower interest rates and longer amortization periods provided to moderately low-income families, as defined under existing laws, rules and regulations. i. “Governing document” refers to the articles of incorporation, bylaws, conditions, rules and regulations of the association, or other written instrument by which the association has the authority to exercise any of the powers provided for in this Act, BLUE RIDGE B HOMEOWNERS ASSOCIATION INC PAGE 4 7

j. “Homeowner” refers to any of the following: 1. An owner or purchaser of a lot in a subdivision/ village; 2. An awardee, usufructuary, or legal occupant of a unit, house and/or lot in a government socialized or economic housing or relocation project and other urban estates; or 3. An informal settler in the process of being accredited aa beneficiary or awardee of ownership rights under the CMP, LTAP, and other similar programs. k. “Residential real property” refers to any real property, the use of which is limited by law to primarily residential purposes. l. “Simple majority” refers to fifty percent (50%) plus one (1) of the total number of association members. m. “Socialized housing” refers to housing programs and projects covering houses and lots or home lota only undertaken by the government or the private sector for the underprivileged and homeless citizens which shall include sites and services development, long-term financing, liberalized terms on interest payments, and other benefits in accordance with the provision of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992 (UDHA). n. “Subdivision/Village” refers to a tract or parcel of land partitioned into individual lots, with or without improvements thereon, primarily for residential purposes. Section 4. Registration with the HLURB. — Every association of homeowners shall be required to register with the HLURB. This registration shall serve to grant juridical personality to all such association that have not previously acquired the same by operation of the General Corporation Law or by any other general law. The procedure for registration shall be specifically provided for in the implementing rules and regulations to be promulgated by the HLURB pursuant to Section 28 of this Act. Such procedure shall provide for a n adjudicatory mechanism that will be observed in the event there is a dispute involving two (2) or more associations established within the same subdivision/village, community/area, or housing project seeking registration. In resolving this type of dispute, the HLURB shall take into account the date each association was legally established, the date of submission of its application for registration, the number of members, and other similar factors. The existence of associations previously registered with the Home Insurance Guarantee Corporation or the SEC shall be respected, and the said associations shall not be charged a penalty when they register with the HLURB after this Act takes effect. CHAPTER II HOMEOWNERS Section 5. Rights and Duties of Every Homeowner. — Every homeowner has the right to enjoy the basic community services and facilities: Provided, that he/she pays the necessary fees and other pertinent charges Section 6. Qualification of a Member. — A homeowner as defined under this Act shall be qualified to be a member of an association: Provided, however, that a lessee, usufructuary, or legal occupant shall have the right of a homeowner as set forth under this Act upon procurement of a written content or authorization from the owner of the lot or housing unit. Until such consent or authorization is revoked in writing, the owner of the lot or housing unit is deemed to have waived his/her rights enumerated under Section 7 of this Act, except subsection (b) of the same section which can be simultaneously enjoyed by both the owner and the lessee. For purposes of this Act, the lessee authorized in accordance with this section shall qualify as a member with all the rights enumerated in this Act, including the duties and obligations enumerated under Sections 7, 8 and 9 hereof: Provided, further, that lessees in government socialized housing projects or urban estates and those in communities of underprivileged and homeless citizens covered under the term under Section 3 of this Act will be considered as homeowners for the purpose of qualifying as a member of a homeowners' association without need of such written consent or authorization.
