Highlighted Cases Advance Kodak Technologies IAM magazine deemed this case one of the top 10 patent market developments of 2019. It is noteworthy because the patent owner is a US NPE asserting in China against a large Chinese-domestic company and received a win. Doubled Award to $24.5M in Water Balloon Patent Defense DBL won a massive victory in the Eastern District Texas Federal Court. A federal judge doubled a jury award to $24.5 million and tacked on $4.75 million in attorney fees and expenses for a toy company that won a case against Telebrands for infringing on two patents on a water balloon device, finding that the infringer’s misconduct wasted court resources. Rescue Phone, Inc. v. Enforcement Technology Group Inc. et al Dunlap Bennett & Ludwig litigated a patent infringement, antitrust, and business conspiracy claim through a motion to dismiss. The case was settled favorably for the client following this win. DPX Gear, Inc. v. Prince et al. Dunlap Bennett & Ludwig defended Erik Prince in a $2.6 million counterclaim concerning the contract governing his company Blackwater’s copyrights, contracts, and involvement in Somali piracy. Swimways Corporation et al v. Zuru, LLC Dunlap Bennett & Ludwig defended infringement allegations in Federal District Court, resulting in a major win at summary judgment invalidating the opposing party’s patent for robotic fish. Meet Our IP Partners Thomas Dunlap is the founding partner of DBL in Washington, DC. In 20 years of litigating, Tom has won millions of dollars of jury verdicts in Texas, Virginia, and a host of other states in IP cases, with five major appellate victories in the United States Federal Circuit in the past 18 months. David Ludwig is a partner in Washington, DC. His practice focuses on patent, trademark, and copyright. He has served as an attorney for local and national clients in federal and state court litigation and arbitration matters. Ellis Bennett is an experienced trial lawyer having tried more than 100 cases and is co-chair of our litigation group. He has litigated many complex matters in the state and federal courts of Virginia, DC, and West Virginia, including commercial, contract, non-compete, and employment disputes.
