Debarment Dunlap Bennett & Ludwig’s Debarment team provides strong legal support and decades of experience representing government contractors facing government disciplinary investigations. Investigations leading to suspension and debarment are initiated by the government when circumstances call into question a government contractor’s “present responsibility.” In analyzing whether a federal contractor lacks present responsibility, the procuring agency’s suspension and debarment officials will analyze many factors, including the contractor’s honesty, integrity, ethics, responsibility, and competence. Contractors debarred, suspended, or proposed for debarment are excluded from competing for or receiving contracts and grants. Meet Our Government, National Security, David Verhey is a partner in Washington, DC. His practice concentrates on clients with business interests in national security, information technology, cybersecurity, and government contracts. David’s career has spanned almost 20 years, including stints in private practice and government service. He formerly served as a Senior Advisor and Counsel in the Department of Defense, where he supported IT development, cybersecurity, classified contracts, and counter-terrorism programs. David is a frequent conference speaker and an author of articles on security and technology, including big data, the internet of things, insider threat mitigation, and privacy policy. He is also the founder and principal of SDS Advisors LLC, a technology consulting firm. He holds a TS/SCI clearance. David Ludwig is a partner in Washington, DC. His practice focuses on civil litigation in the areas of patent, trademark, copyright, internet/domain names, commercial transactions, government contracts, community associations, bankruptcy law/ creditors’ rights, and corporate and small business law. He is co-chair of the firm’s litigation group, and he has served as an attorney for local and national clients in federal and state court litigation and arbitration matters as well as in government contract bid protests and Tucker Act litigation, and numerous other forums and proceedings. Thomas Dunlap is the founding partner of DBL in Washington, DC. In 20 years of litigating, Tom has won millions of dollars of jury verdicts in Texas, Virginia, and a host of other states, with five major appellate victories in the United States Federal Circuit in the past 18 months. & Cybersecurity Team Ellis Bennett is an experienced trial lawyer having tried more than 100 cases in the state and federal courts of VA, DC, and WVA. While a member of the United States Army Judge Advocate General’s Corps, Ellis was Honor Graduate of the 155th Officer Basic Course and served as lead trial counsel in numerous courts-martial tried at various military installations. Ellis also served as a federal prosecutor in the United States District Court for the Eastern District of Virginia, Alexandria Division. Since entering private practice, Ellis has represented numerous government contractors in commercial disputes and has also maintained a robust white-collar criminal and investigations practice. He serves as co- chair of our litigation group. Robert J. Eatinger, Jr. has practiced national security law for more than three decades, including 24 years with the CIA, where he served as the Acting General Counsel for a time. His experience in national security litigation includes supporting major espionage prosecutions, such as against Jonathan Pollard, Aldrich Ames, and Robert Hanssen; terrorism prosecutions, such as bombers of Pan Am Flight 103 over Lockerbie, Scotland, and the bombers of the World Trade Center in 1993; and dozens of cases involving state secrets or the Classified Information Procedures Act. As the CIA’s senior operations lawyer for 6 years, he worked on some of the nation’s most sensitive human and technical intelligence programs, including counterterrorism and cyber operations and helped develop Presidential and National Security Council policies and directives. He understands and can assist businesses meet the unique legal needs of sensitive services for the United States. David Keesling is a partner in Tulsa and a top-rated attorney with more than 17 years of experience in private law practice. His practice is centered around many facets of business and corporate law, and he has tried many cases and obtained excellent results, including numerous large monetary resolutions for clients both at trial and through negotiated settlements.
