Bob Murray motioned to accept the Treasurer’sReport and seconded. Report was accepted as written.Legislative Report was given by Allison Carvajal & Janet Mabry. They reported on thepolitics involved in the recent attempt to pass the bills that tried to allow temporarylicenses in our profession. Questions and answers session.President Russ reminded everyone to stay for Keynote Speaker Marilyn Allen, AmericanMassage Council and to attend the reception in the exhibit hall.Meeting adjourned at 6:05 pm. 2

EXECUTIVE OFFICER REPORTSExecutive State President: Ralph V. RussWhat we saw in 2011-June 2012 and what we see as the future of FSMTA. It is the responsibility of the Executive Officers to conduct business between quarterly meetingswith the support from the entire Executive Board, State Committee Chairs, Chapter Presidents, ChapterOfficers and Chapter Committees. Additionally, FSMTA retains the services of Legal Counsel, two StateLobbyists, a CPA and a Publication Designer. We also employ an Executive Director and three full timeemployees. The housing of our employees had two problems this year. One was an accident that causedthe office to be closed for structural repairs. The other change was more acceptable. One blessing in ourpoor economy is that business real estate finally got to a point that with the careful listing of needs by ouroffice personnel and help of an excellent committee, we were able to purchase a unit in a businesscomplex. We used funds that had been earmarked for this purpose and the terms of the loan are veryfavorable. FSMTA has 5237 members at this writing. We have an excellent student recruitment program provided by the MPA Media. MPA providedmonies for 1000 student memberships in 2011. Many of those student members have now converted tofull membership. We will have the student oriented “Successful Start” program on Thursday, June 28 thisyear so that they may also experience the Exhibit hall and see more of the organization in process. Youmay confidently depend on FSMTA to continue to offer networking opportunities, continuing education,legislative protection, quality professional liability insurance in addition to providing a forum for theexchange of ideas among massage therapy professionals. FSMTA continues with its goal to establishrelationships with other professions in the health care field. During this past year, our members participated in an Annual Convention,Massage Therapy Awareness Days; we attended monthly Chapter Meetings offering low cost or no costCEs and we enjoyed access to many BOMT approved provider seminars. Our members challenge usdaily and I continue to be energized by the forward momentum of our association and the enthusiasm ofour membership. We are a membership driven organization in support of all aspects of the massageindustry.EXECUTIVE OFFICER REPORTS: Checklist of functions performed  The FSMTA Board of Directors held 4 quarterly meeting. The June board meeting is Thursday, June 28 and then there will be a convention follow-up that will evaluate the presenters and the total experience while the events are fresh in our minds.  Board members attended the Florida Board of Massage Therapy meetings in Tampa and Orlando. Maureen has filed email and Massage Message reports to keep our members aware of this important regulatory board functions. We have also consulted with the BOMT regarding the impact of current and proposed legislation.  This will be the 72nd year for FSMTA and our convention is returning to the Omni Hotel at ChampionsGate. Our message this year is Believe: Invest: Grow.  Our Annual Report was filed with the Department of State - Division of Corporation (Sunbiz.org) on January 5, 2012 for FSMTA, Inc. and FSMTA Association Services.  I traveled to Charleston South Carolina for the AFMTE Education Alliance, August 18-20, 2011. This group represents schools who are trying to work on protocols for massage therapy instruction. I talked with Dr. Ben Benjamin at this meeting and asked if he would be our 2012 Keynote Convention Speaker.  FSMTA had a massage booth at the Florida Chiropractic Association in Orlando August 25-28, 2011. Also, this year the FCA Liaison arranged for a massage booth at the Jacksonville FCA. This is an additional presence which will help in building bridges between disciplines. 3

 There were many Chapter functions during Massage Therapy Awareness Week October 23-29, 2011. Chapter activities were reported in our magazine and in Chapter Newsletters.  As part of the Massage Therapy Awareness Week there were multiple radio interviews to help with positive public information about massage therapy.  Our Executive Committee Members serve as liaison to Chapter Presidents. EC liaisons were available for questions or concerns and answered and resolved issues with efficiency. In addition, we traveled around the state attending chapter meetings, making membership presentations and guest speaking at massage school events and graduations.  We have Standing Committees for Bylaws: Sydney C. Sheaffer; Educational Standards: Elisa Di Falco; Legislative: Scott Hartsfield. All of these committees play an important part in our organization functions and responsibilities.  Our State Committees formulated individual plans of action. They set committee goals and proceeded to make those goals become reality.  We have added FSMTA Member Benefits. We have expanded our Professional Liability Insurance Program to include Colonic Irrigation and Massage Today’s student membership program.  The FSMTA.org website is still in need of renovation. I have asked but so far we have had no funds to do more than patch problems. We have a social aspect on Facebook but I am not happy with the idea that people can be “friended” or not for reasons other than keeping a chapter website open for its members. We still need a professional website that includes at least a brief description of each chapter, our bylaws, history, Massage Message in an better download style and of course good discussions of any matters pertinent to LMT’s.  Ten FSMTA Chapters held elections in January & February 2012. The officers will serve a 2 year term. A current list of all FSMTA officers can be found in this annual report. You will note that there are still some chapter vacancies. Volunteers for offices can be handled by our current by- laws and policies and procedures.  FSMTA encourages all our members to continue to get to know the legislators in your home districts. FSMTA is well represented in Tallahassee by General Counsel Paul Watson Lambert and lobbyists Janet Mabry and Allison Carvajal. Our Lobby Team continually monitors bills which may affect our profession. Due to the vested interest of Governor Scott in the hospital health care industry, we had an additional element to fight in our effort not to be excluded from PIP. I do not know the outcome of the PIP bill at this writing.  For the last trip of my term, I went to California. The cost to FSMTA was only for incidental fees. I attended the American Massage Conference in San Diego, April 19-22. This conference is open to other alternative medicine groups so that Chiropractors, Acupuncturists and Massage Therapists are having programs, Continuing Education and vendors. We need to meld our interests with other groups so that we are not as easily set aside in the future.  FSMTA fiscal year began April 1, 2011 and ended March 31, 2012. Membership dues revenue is the main source of Association income. FSMTA Association Services Inc. income is derived from the sale of liability insurance. Our association is financially sound. Executive Treasurer, Executive Finance Committee and Executive Director presented a conservative but workable budget for 2011/2012 in an effort to compensate for the economic realities  The approved budget will be presented to the general membership at the Annual Membership Meeting which takes place at 5 o’clock on Thursday June 28 during Convention 2012Each FSMTA Committee and Chapter has prepared a report to help you understand the health of ourorganization. Executive State First Vice President: Marion PadgettACTIVITIES:June 26, 2011 The Convention Committee met for the post-Convention meeting to discuss the outcomeof the event. Afterwards we held our Executive Committee meeting for the 2012 pre-Conventiondiscussions.September 10, 2011 I attended the Convention Committee meeting at the FSMTA home office in WinterPark, Florida to discuss potential presenters, themes, and logos to present to the Board.September 30, 2011 We set sail aboard the Monarch of the Seas leaving out of Port Canaveral, Floridawhere we held the Quarterly Board on Saturday - Sunday October 1-2, 2011. The Quarterly Boardmeeting consisted of discussion and attendance to all scheduled business as well as enjoying fellowshiptogether. At this meeting we assessed and selected the 2012 FSMTA convention speakers, theme,schedules, and chapter sponsorship.November and December 2011 Board members attended to usual FSMTA business by phone andemail. I hope everyone had a joyous and blessed holiday season!January 7-8, 2012 The Winter Quarterly Board meeting was held at the International Palms Resort in theOrlando area.January 22, 2012 The Executive Committee met with the American Massage Council to discuss newmajor insurance coverage’s which will be announced later this year.February 25, 2012 The Financial Committee met in Winter Park, Florida to formulate the budget forapproval for 2012-2013. State Presidential candidates were invited to be present at this meeting toobserve how this planning was implemented.During this Quarter we were able to finance and move into our new property which will house the FSMTAhome office.March 13, 2012 I attended the March meeting of the Sugar Dunes Chapter.March 14, 2012 I attended the March meeting of the Gulf Coast Chapter.April 19-20, 2012 I attended the Florida Board of Massage Meeting at the Doubletree Hotel in Orlando,Florida.I look forward to seeing you all on July 27-31, 2012 at the annual FSMTA Convention which will be heldat the Omni Resort in Orlando, Florida.Marion Padgett, Executive First Vice PresidentExecutive State Second Vice President: Donna Smith It is a privilege and honor to have served the board as your State 2nd Vice President this year. Weas a team, including our full board worked diligently for you, the member. The executive committeelooked for ways to be more efficient. Serving on the executive committee puts obligation on our part tobalance our state budget and present to the board for approval. We have worked hard to make thesenumbers stay within most of our proposed budget in this time of keeping our association strong andfunctioning. We have shown other organizations that we can maintain and hold our current membershipwhen other associations have had a decline in large numbers. Not only have we kept membership, butbroke our 5,000 mark in October. This year has pulled us in many different directions and new doors and opportunities opened. Ourhome office now has a permanent home. This required persistence to follow this through to completion. 5

We could see the benefits and money this will save our association now and long term. I want topersonally thank those who believed we could find the ideal property at an affordable price. We had agreat team oversee this project. We also met with American Massage Council and there is new coveragebeing added to what they have to offer our members. This plan should also help our membership growas facial specialist policies become available. Our board also voted at our fall quarterly meeting tochange some times for events at convention this year. We wanted to make sure the students attendingSuccessful Start had the opportunity to visit our vendor hall along with convention attendees. Theexecutive committee had daily contact with each other through e-mails, thus giving us contact on aregular basis. At this time I want to thank the members for allowing me to be involved in our association as State2nd Vice President. This is an incredible association with people who give selflessly of time and talents.Always remember that you are an important part and a vital instrument in the success of FSMTA. April 2012, I attended the Palm Beach Chapter Meeting. May 2012, I attended by local chapter MeetingI look forward to this convention and seeing all of you again! We have spent much effort in thepreparation for this convention. I hope you are excited about it as I am. I thank you for all the goodresponses to me regarding the Executive Board Meeting Minutes. I work really hard to give the bestsummary possible. I look forward to doing this for the next two years.I would like to thank each and every one of you that donate your time and efforts to this organization! Iknow life is busy and time is valuable. Ascan be seen from the consolidated financial statements by our CPA Joseph P Mitchell,there is a large sum of money required to provide education and information for ourmembership, as well as opportunities to promote and protect our profession of MassageTherapy. Not only do we do that for our members, our actions provide benefits for thenon-members as well.A key figure to look at when reviewing the consolidated financial statements is thechange in unrestricted assets. This figure for a “not-for-profit” organization likeFSMTA will equate to the net income/loss for a “for profit” organization like yours ormy business. Unrestricted Assets for the fiscal year ended March 2012 decreasedby $21,073, composed of $4,777 increase from chapters and $25,849 decrease fromCentral Office. As shown in the Consolidated Statement, compared to the prior year,income decreased by 4.8% and expenses increased by 1.1%. Fiscal year 2012, beinga non-renewal year, this decrease was not totally unexpected. It just shows that theFSMTA Board has some challenges to focus on.  Chapters Central Office ConsolidatedTotal Revenues  153,483. 713,319. 866,802.Management Expenses  ‐13,255. ‐148,157 ‐161,412.Program Services  ‐135,451. ‐591,011 ‐756.463. ‐25,849. Change  4,777. ‐21,073.Chapter’s revenues come from Dues, Newsletters, Meetings, and Events. CentralOffice revenues come from Dues, Convention, Legislative, Merchandise, Newsletter,and Other Income. 7

Management Expenses are the administrative cost of running the organization.Program Services are FSMTA activities and programs available for members andsupport the Massage Therapy industry.This fiscal year closed with FSMTA buying an office condo to house the administrativeoffice (FSMTA Central Office) and stabilize the Occupancy expenses. Although thismaneuver created some short term expenses, the Board believes that the long termbenefits will greatly outweigh the short term cash outflow. The FSMTA employees haveexpressed that they are enjoying the new location.FSMTA & FSMTA Services budgets for the fiscal year end of March 2013 has beenpresented and approved by the Financial Review committee and the FSMTA Board ofDirectors. Both budgets were developed with the idea of growth and a cautious eye onexpenses.Members, the benefit that you can receive from our professional organization canonly be enhanced by your involvements. Many of you have talents that can benefit alllevels of the organization and strengthen the Massage Industry. Our combined voicesstrengthen our presence.It has been an honor and pleasure to serve FSMTA as your State Treasurer this term.And your vote to re-elect me to this office again is appreciated. I will work again tomaintain the high standards of FSMTA in supporting members and the profession ofMassage Therapy. Thank you for your support and efforts of creating a strong FSMTAfor Florida Licensed Massage Therapists._________________________________________________________________Executive Director: Lynn Hupp2011 - 2012 was a great year for FSMTA and Central Office. We produced a successful convention atthe Renaissance Orlando Resort at SeaWorld, we fought a hard fight against PIP legislation, we boughtour very own office and we increased our membership by 1000 thanks to Massage Today and their FreeStudent sponsorship. We continue to revise and refine our liability insurance program based on theneeds of our members and now have what is probably the best liability insurance program in the country.We have worked with our third-party processor to cut costs related to credit card processing andstreamlined the procedure cutting down the time it takes to process membership and insuranceapplications.The Massage Message has improved in content, surpassed all advertising revenue projections, and isbeing delivered to members on time and often early. More members are using electronic means ofcommunication which means we can hold the line on dues – the last dues increase was in 2005. Thewebsite, email blasts and FSMTA Facebook page have helped to keep members informed of FSMTAactivities.FSMTA staff continue to look for more member benefits and we always strive for excellence as we servethe FSMTA members.Your FSMTA staff consists of the following individuals: 8

Our Hospitality Chair provides coffee for our meetings and members bring other 9

Matthews During the last year our chapter began using MailChimp to email our members prior to eachmeeting as well as contact many of the non-member therapists in the area. We have also had a non-member volunteer make about 400 phone calls every month to remind members and area therapistsabout our meetings. As a result, we have more than doubled our monthly meeting attendance and gaineda number of new members. We are thrilled to have a 20%-25% non-member attendance at mostmeetings. Our Christmas party was a particular success last year as we had 20 therapists and 10 guests inattendance, and our wonderful sponsors donated 19 door prizes as well as some wonderful gifts for allwho attended. We were also excited to welcome almost the entire massage therapy class from Lively into ourchapter last year thanks to the Massage Today sponsored student memberships, and we look forward tomeeting new classes in the coming year. The Big Bend Chapter has had a fantastic year of growth, and we look forward to another year ofcontinued growth and greater participation of our members in chapter activities.Submitted by Barbara L. Brevard is continuing to hold monthly chapter meetings alternating between South and North Brevard County. Our South Chapter meetings are being held at Space Coast Health Institute in Melbourne and our North Chapter meetings are being held at the Best Western in Cocoa. The attendance level continues to be very good and growing at both locations. We have had a great line up of CE providers during our chapter meetings and we are booked through October. In March we had a successful CPR class. We will be scheduling another CPR class, a Sports massage class and another Protection Awareness class after convention. Brevard is gearing up for convention and already created our chapter identifiers. We use Social Media to its full potential, Facebook, Twitter, Constant Contact, E-mail. We have quit sending out newsletters and instead we are keeping our members informed on a regular e- mail basis. Our website is www.fsmtabrevard.org which is updated by our webmaster and by our 1st VP Carl Stewart. The codes and entrance to the website are on file with the State. Our Brevard Board and our Committee Chairs are contacted via e-mail through a first name and website name. [email protected] which is forwarded to our normal e-mail address. We are regularly promoting the FSMTA and the benefits of Massage Therapy at local events and within the community. We accommodated 3 Teacher week events and we have 6 massage events scheduled for Nurses week. The Brevard Chapter just did a big massage event at Holmes Regional Hospital in April as well as a Veterans event. Brevard Chapter continues to have a dynamic synergy and an incredible team spirit.We are Bold, We are Bountiful, We are Brevard!Respectfully submitted by: Joanna Godwin, LMT, Chapter President 11

We Celebrated Earth Day and the Chapter donated $30 to the Arbor Day Foundation to plant 30 trees.  April 30 – May 1 – CE Presentation by David Kent, Headaches: Types, Triggers and Treatment. We had a full class of 26 attendees and earned over $3,500 for our chapter.  May – Nancy Kenney Smith presented Intro to Scar Management. A much needed work to give relief to children and adults with restrictive scar tissue. We honored our Volunteers with a pizza party and presented them with lapel pins – “You Make a Difference.” June – Laurie Messina presented Himalayan Salt Stone Massage. Karen Lewis was our lucky winner for a complimentary massage at the néu lotus spa at the Renaissance Orlando SeaWorld Resort from those members registered for Convention. We collected first aid items in a joint effort with all the chapters for a medical trip to Haiti. Convention – Great turnout at Convention. We celebrated a chapter party with a Mexican Fiesta. Noreen Monticeux won a $200 gift certificate from Massage Warehouse in our Grand Prize Drawing. August – Pat Donahue presented Bindgewebsmassage. Excellent class on connective tissue release. Celebrated end of summer with pizza and popsicles. Paula Costantini began collecting clean used table linens, towels, t-shirts to be donated to wildlife shelters – great way to recycle our table linens. Monica Leibacher (her idea!) facilitated our first “Xchange for Change” (named by Paula Costantini) where our members can bring in gently used massage related books, CDs and DVDs to trade, sell or donate to the chapter. This was very successful for our attendees and we plan to have equipment for sale or trade several times a year, also. New Treasurer – Linda LeBlanc was sworn in as Treasurer at our August chapter meeting. October – Matt Howe presented Intro to Execution & Inspiration – Spa. Very well received – lots of ideas for easy spa add-ons. Good attendee interaction. Collected linens for animal rescue. MTAW - Chapter Volunteers celebrated MTAW with a t-shirt, 2 CE class in Seated Massage, lunch from Paneras, then provided Seated Massage to the residents at Harbor House (domestic violence safe house). Of our 25 volunteers, almost half were new student members. Big thank you to the Central Florida School of Massage for hosting our CE class. November – Deanine Piccione presented Pregnancy & Infant Massage. Celebrated Thanksgiving and last meeting of the year with food from Smokey Bones. Collected non-perishable food items for Harbor House. Harbor House – Donated four $25 Wal-Mart Gift cards from Nov. door prize and guest funds. Chapter Elections – Ballots went out on November 15th and voting closed on November 30th. Tom Keegan kicked off our Student Mentoring Program, Katie Haley was present to sign her new book, “A Diamond for India,” and our Community Speaker was Chintana Auland with the Minerva Institute. This non-profit organization is heart-centered learning community that offers diverse programs in self-discovery. Our big raffle winner was Larry Stephens, who won a new massage table provided by Massage Warehouse. Michele Clendenin was the winner of an Early Bird Convention Registration in our Participation Contest.  February – Wanda Bonet-Gascot presented Massage Research Capacity. Excellent information. Terri Bettes with the Health Care Center for the Homeless was our Community Speaker. We 13

collected socks and underwear for the HOPE Project, which is their community outreach program.We have begun using a food truck, Eclectic Kitchen, to provide meals that our members canpurchase, $5-$7 at chapter meetings. March – Don McCann presented Intro to Cranial/Structural Core Distortion Release andCommunity Speaker was Valerie Greene, author and founder of the Bcenter.com - local resourcecenter for stroke victims (check it out!). Our meetings are well attended bymembers each month. We have had a variety of presenters in our chapter with CE’s offered free eachmonth as a member benefit. We also had the transition of some chair positions, with freshnew perspectives and energy being added. For a chapter to be healthy there needs to be active participation by the membership. We have anactive healthy chapter in the First Coast. Our members participated in outside events for MassageAwareness Days giving back to the community through chair massage to staff members at the hospitalwhere we hold our meetings, as well as to families dealing with health crises at our local RonaldMcDonald House. We have also had growth in our Sports Team with new members joining and eventsbeing added for the teams’ involvement and benefit. Our members also enjoyed a festive holiday social where Santa, (Mr. Johnny Killebrew), evenarrived for a surprise visit and lively photo opportunities. Each First Coast chapter meeting has a fun theme with surprises for the members each month.Each month we have had delicious meals custom prepared for our chapter members with food and tabledécor to match the theme. Our Board members have worked diligently to use the percentage of membership dues allocatedto the chapter in the most conservative means possible. This conservative fiscal approach has allowedour chapter to remain on solid financial ground, with funds in reserve. We have established a high standard for our meetings in that we have a great reputation amongpresenters as being one of the liveliest groups, as well as one of the most hospitable groups they presentto. 16

I have personally served the chapter for seven years. Six of those years have been as thechapter President. I feel confident as I now move up to the State President level that the chapter willremain strong and viable under new leadership. We continue toschedule the very best CE presenters in our profession. Within the past year we hosted Dan McGovern,Teresa Matthews, Thomas Liberto, William Muhlstadt, and Cary Bayer. We consider our chapter to bevery “provider friendly” and welcome their products and workshop information for our members to takeadvantage of. We thank all of them for coming from such long distances to help educate our members. Our Annual Christmas Party at Vince Carters in Daytona Beach was a huge success we gaveaway over $2,000 dollars in gifts and prizes to our members which, included a Massage Table, a mini prothumper, bon Vital products, bio freeze, Massage Warehouse gift bags and our very own FSMTA coffeetravel mugs for everyone in attendance. Our Chapter split the cost with members and paid for half of themeal as well. Big thanks went out to our many corporate sponsors who included TD Bank, EdcatEnterprises, and DiscountMugs.com. At our Annual Business meeting this year we showed our members that we had a surplus fiscalyear of over $900 dollars in our Bank Account. Membership had increased by 5% and we are a strongChapter for such a small population center. 17

When we did our inventory for the year we found that our Sports Team Tents are in disrepair andin need of replacement. So we are going to be planning a fund raiser to try and accomplish this goal inthe upcoming year. Heart of Florida Chapter Board meets the first Tuesday of every month to keep things up to datefor the chapter members and discuss new ideals. Our president at the time, Mary Koontz was bearing a baby andit brought on some hard times for her with the chapter to be active during this time but that didn’t stop herfrom doing what she could. The rest of the board had her back and kept the chapter running and building.She was upset to miss the cruise but Leslie Caswell had no problem taking her place. Bruce Gonsethtook the helm while Mary was unable to do much when it got close to giving birth and a few months aftershe had her new baby boy. Our chapter held elections in December and we had a shift in leadership. Mary said that sheneeded a break after having a baby and decided not to run for another term. Bruce Gonseth stepped upand ran for president with no other takers. Larry Miller ran for 1st VP and Donald ran for 2nd VP. Themembers running had no opposes to the positions. Bruce was sworn in office at the state board meetingin January. The other members were sworn in at our regular chapter meeting. This left the chaptertreasurer open but with Larry still helping with this along with Bruce keeping up with the books until wecan find another treasurer to take over. We have moved from the CTAE, Community Technical Adult Education where our pastmemberships chair Greg Sharko teaches Massage to Marion Baptist Association. We thank Greg forhaving us there at the school to have a place to meet. We are happy that Larry Miller was able to find ournew place that they let us to meet with out cost. The Association is much larger and has all the amenitiesto go along with it. We meet on the 3rd Monday of each month at 6:30pm with fellowship and announcements afterour board meeting at 5:00pm. The Sarasota/Manatee Chapter along with Charlotte, DeSoto, Glades and Hardee Countieswere off a roaring start this year. With the help of Massage Today’s magazine offer for bringingStudents into the membership, we were able to sign up 167 new student members in our Chapter.The Sarasota School of Massage Therapy and the Florida College of Natural Health were eager toparticipate with FSMTA in this project. Our Chapter has a strong alliance with both schools. And weare building on that relationship. With that said, I have been visiting both schools and encouraging their students to participate inthis year’s convention, more specifically, the Successful Start program on Thursday. And, hopefullythe entire Convention. I do sense a great deal of enthusiasm from them, but the financial burdenseems to be their major problem. They are encouraging us to produce a “winning Chapter Identifier”so that we can maintain the Trophy for another year. I am pleased to announce that the Sarasota/Manatee Chapter Sport Team will be the recipient ofthe State Sport Team Award, as well as our chairperson, Michele Weissman, being voted the SportsMassage Therapist of the Year. Congratulations, Michele. And to add to the list of people receivingan Award this year, Our Patricia Rogers was voted one of the three people getting the OutstandingState Service award. MyersTime: 6:30 – 9:00 P.M., First Tuesday of the Month with 2 CE hours per meet The Southwest Florida Chapter of FSMTA continued the current term with the officersinstalled in December 2011. With approximately three months in the new position of leadershipfor this chapter, the board was excited to work with one another in creating a level ofprofessionalism in which the board and membership meetings could be directed. Ideas wererecorded for when the board would be able to do sufficient planning. A Long Range Strategic Planning session was held in April 2012 with Mr. Wayne Gofffacilitating the program. Mr. Goff’s instructions of “What Is, What Might Be, What CouldBe, What Should Be, and What Will Be” enable the board members in deciding, analyzing,developing, evaluating and implementing a plan which will enable the Southwest Chapterto become stronger in the FSTMA Vision to promote public awareness of massage therapythrough education and professionalism. The board will continue in strengthening the chapterby planning, promoting and executing doable goals of accomplishment. The president has promoted attendance to the Quarterly Board Meeting, of the boardmembers to express the necessity of the knowledge and experience of how each chapterparticipates in leadership to their members. This will enable the upcoming new presidentand board members to easily transition into their leadership position in lieu of having to learneverything at the beginning of their term. This participate has also created a stronger boardand given us all the greater purpose of meeting monthly. Our education chair, Terry Lowder, has kept our monthly presenter’s agenda booked with a vastrange of modalities. Our members have responded with their approval of the subjectspresented and the variety of professional educators. We fortunately have not experience anydisrupting glitches. We were able the participate in the annual Massage Therapy Awareness Week, a varietyof sporting events, our member’s free Deep Sea Fishing Trip and member’s free AnnualChristmas Dinner. Our monthly chapter meetings, centrally located, are well attended by members. The no-rent costgreatly assists in the budgeting preparation. Teo Nikolov, Second V.P., a FSMTA Sports Instructor is preparing an agenda to trainingour members interested in the FSMTA Sports Massage protocol. The board is seriouslycontemplating the sports arena to see how involved the members wish to participate. Theresa Matthews held a sports team training for our chapter. We had great attendance and areworking towards scheduling successful sporting events as well as chair massage events. Our legislative chair was actively involved in local and state activities, traveling to Tallahassee asnecessary. Many chapter members also participated locally.We currently have 3 FSMTA board members who serve on the advisory committee for the MassageTherapy program at Keiser University in Port St. Lucie.We held a day long class for the Required CEs, free to chapter members and charged $50 for non-members. Our goals for the coming year include retaining membership of our new student members andkeeping them actively involved in the chapter. We are updating our website to a version that will beeasier to maintain and consistently update. Thanks for all the input and opinions received from fellowmembers to assist in these matters. First, several changes were made to our financial accounts and reporting. All accounts weretransferred to Wachovia Bank which was then taken over by Wells Fargo Bank. This transitions wasgreatly facilitated by Lynn Hupp and her staff at Central Office. Such accounts shall be held in FDICCharter banks with deposits not to exceed the insurance limits of FDIC. Auditing and review provisionswere amended to provide the Board discretion when initiating a review or audit. Also, expense re-imbursement forms were reworded to clarify and simplify such reports. Much appreciation to Frank Ansel,State Treasurer for initiating such amendments. Amendments were also added to provide better guidelines to deal with complaints againstmembers and absenteeism by Board members. Notice of Chapter Board meetings was also clarified andupdated. Such additions shall allow the Board effective response options when such issues occur. TheBy-Laws committee continues to be actively involved with refining our organization promoting changeswhich will help facilitate the effective functioning of our documents. Finally, we effectively oversaw our State Elections process. Such an event was quite involved dueto the fact of three candidates running for State President (a first in our history). The process waswonderfully handled by Nominating Chair, Maureen Gilbert and State Elections Chair, Katha King. Fiscal year 2011/2012certainly proved to be challenging with the variety of changes presented to Licensed Massage Therapistsand FSMTA. Below is a snapshot of the items that were addressed during this time period.FacebookDuring the previous fiscal year, a number of communication vehicles were used to share updates aboutlegislative changes. However, we needed a tool to get to the masses and to use the tools that were morecommonly being used. Thirteen of the chapters had some semblance of a Facebook page. With theformality and creation of Facebook pages for each Chapter, the communication will only increase andimprove.Personal Injury Protection The massage profession worked fast, feverishly and unrelenting regarding CS/CS/HB 119 - MotorVehicle Personal Injury Protection Insurance. The Senate companion bill of CS/CS/SB 1860 was equallyemotional and trying. We were unsuccessful in our quest by one vote – keeping in mind that we were upagainst the Governor and his determination for passage of this very bad bill.Human Trafficking HB 7049 - Human Trafficking passed this year. FSMTA has worked diligently with RepresentativeBurgin and other dignitaries to help with this long-overdue issue. This legislation, which amends480.0535, will help both law enforcement and the department. This new law will require personsemployed by a massage establishment (or person performing massage therein) to present validgovernment identification upon the request of an investigator of the department or a law enforcementofficer.HIV Continuing Education HB 4163 - Continuing Education for Athletic Trainers and Massage Therapists was initiated byAthletic Trainers and supported by the Board of Massage Therapy and the FSMTA. AMTA, too, agreedwith the removal of this requirement as a continuing education renewal practice.Law Enforcement – Investigators 29

FSMTA continues to foster relationships with local law enforcements. We currently have contactsin Jacksonville, St. Johns County, Orlando, Polk county and Fort Lauderdale.BOMT Being represented at the Board of Massage Therapy has been a key element to establishingrelationships with the BOMT, students and other key professionals in our profession. FSMTA has beencalled upon by the BOMT in many situations to help with legislative issues, monitors, “456.0635” relatedapplicants, etc.Legislative Conference Call Because the legislative session was going to be different in 2012, we started this year off with aLegislative Conference Call on Tuesday (Jan 10) at 10am. The call was well attended and our Lobbyistsand FSMTA Attorney helped to guide what the landscape would look like during the session.Zeel Networks, Inc. Zeel.com approached the FSMTA leadership about offering their services as a member benefit.After thorough research, it was determined that we would not consider this member benefit at this time.There were a host of issues that could compromise a Licensed Massage Therapist and potentially violatea number of advertising laws.APPLE Tim Cook, CEO, received a formal letter from FSMTA regarding Siri and the \"Happy Endings\"offering. Siri is the intelligent, but automated assistant that speaks back to you (from the iPhone 4s). Ifyou requested of Siri where to obtain a “happy ending”, Siri would refer you to a local Licensed MassageTherapist. Because of petitions and letters, APPLE has removed those associations from the iPhone 4s.Reflexologist Sandra Sigur, Reflexologist, LMT, CYI, SCS, Aromatherapist REALISTIC HOLISTIC continues torequest of FSMTA and BOMT to allow Reflexologist to be removed from underneath Chapter 480. TheBOMT, nor FSMTA, supports this move.Legislative Awareness Days (LAD) LAD was held earlier than normal on February 14 and 15, 2012, due to the earlier legislativesession. Communications were sent to all FSMTA and were highly encouraged to visit their legislators(locally or in Tallahassee, FL). An email was sent on Saturday, Feb 11, 2012 with details and options toconsider. FSMTA has been fortunate to have Senator Jones file a formal Senate Resolution for FSMTA(and AMTA) to formalize these dates via a bill.2012 Legislative Session The 2012 Legislative Session concluded on Friday, March 9. A full report of the 2012 SessionSummary can be found at http://myfloridahouse.gov/ and http://www.flsenate.gov/.The Numbers Data is very important to FSMTA. It is important for us to see the high-level number of growth (orreduction) in our LMTs as well as the establishments. Data is provided by the Department of Health oneach active LMT at the time of the report – as well as establishments. This data is sent to each Chapter 30

President as well as our Central Office. As of February 21, 2012, Massage Establishment 9735,Massage Therapist 31764 and Massage Therapist Apprentice were at 3.Unlicensed Activity and other infractions The landscape is changing with BOMT. Ms. Alsobrook, Deputy General Counsel, ProsecutionServices Unit, advised the Board that Alternative Dispute Resolution (ADR) methods such as Mediation,Notices of Non-Compliance, and Citations have been identified by statute as appropriate methods ofresolving minor violations. Authority to determine which violation may be resolved by ADR has been givento the Boards. The Board of Massage Therapy has rules authorizing use of Citations, Mediation, andNotice of Non-compliance for specific violations. Enforcement is requesting amendments to rules 64B7-30.004, 64B7-30.005 and 64B7-30.006,F.A.C., to allow more violations to be handled through ADR and in turn save the Board money and focusmore resources on more serious allegations. Ms. Karen Ford inquired if Lee Ann Gustafson, Esq., and Ms. Burke-Wammack would draftlanguage using the proposed Alternative Dispute Resolution (ADR) methods and prepare a draft to bediscussed at the next Board meeting July 25-27, 2012. After a lengthy discussion, theconsensus of the board was if a person or place advertises massage then they must have a massagetherapist license or a massage establishment license as it falls under Chapter 480, Florida Statutes. May 2011HB49/SB584 Temporary Permits. After a hard fought battle during the 2011 Legislative Session, this billwas defeated. If the bill had passed, it would have allowed students to work on the Public beforecompleting the required course of study and before passing the required exam. July 2011Educator Summit. During convention 2011, FSMTA hosted the sixth annual Educator Summit. Educatorsand school owners from all over the state attended.Out of State exam candidates. BOMT voted to repeal the Transfer of Credit Rule 64B7-32.004. TheBoard reached a consensus for the Board to review all out-of-state exam application.Legislative Report: The Board voted not to propose legislative amendments to Chapter 480 during the2012 legislative session. August 2011ALL Massage licenses expired August 31, 2011. Many renewed on line and the process was fast andvery efficient. Next renewal period expiration date is August 31, 2013. October 2011Introductions. Many of the DOH/BOMT administrative staff and members of the law enforcement andinvestigative team attended the Tallahassee meeting along with several representatives from theDepartment of Education. They were introduced and applauded, very nice to put faces to names.Recognition: The Board also took a few moments to surprise and honor an outstanding member ofBOMT staff - Paula Mask. Anyone who has ever communicated with Paula on BOMT business orpersonally will agree that she is a delight to know, no matter how many times we pester her ... she isalways so pleasant and helpful. The Rules Workshop on Wednesday was super productive. Rules: Chapter 64B7 FloridaAdministrative Code. Several rules were noticed with the Florida Administrative Weekly. A brief preview... Definitions: several were discussed for clarification- classroom hour, direct supervision, distancelearning; Fees: all fees will be listed in one rule; License Display defined to help law enforcement; ProBono: new forms and rewording to simplify the process; Schools: establishing a pass/fail rate andmaintaining for period of time and the penalties for non-compliance, reducing some documentationrequirements, electronically sending proof of graduation; Disciplinary Guidelines: stiffer fines for fraud. The BOMT is continually reviewing Laws and Rules and making changes as necessary. It is ourresponsibility to keep up to date with changes and work within our scope of practice. Calls seem to be much more complicated in that they are runninginto problems not of the ordinary. With a little research I have been able to answer.Task Force Project on hold:I set up a group for a Task Force to create: “Massage Therapist’s Insurance Billing Practice Guidelines,Rules and Laws.” However I questioned at the board meeting to see if we could (as an association or theBoard of Massage) move forward to set Documentation Standards first as is required especially if one isto do insurance billing. This did not go anywhere at this time so the task force is on hold until we canestablish within our profession the need for this to get up to speed with other health care practitioners.This will be of utmost importance as we move ahead in the health care arena, (if we will continue in thatvein at all).Investigative Concerns: I am still getting reports and questions from investigative agencies including adetective and Captain Byrnes from the FL Dept of Insurance relating to massage therapists and their 35

suspect working relationships with clinics and doctors’ whom the LMT’s hire. Another investigator keepsme posted on all LMT arrests in FL for their involvement in fraudulent activities.Doctors, Clinics & LMT’s.I have been receiving calls nearly every week from Doctors, Doctors offices and Medical Directors askinghow they can work with LMTS and bill for their services. As most of you know, for years on end I havekept vigilant eyes and ears on massage related insurance and other health related issues. The pros andcons of working in physician’s offices, independently by referrals, in “clinic” settings where some massagetherapists are being USED or where they are knowingly involved in fraud and abuse.Workers’ Compensation Annual Educational Conference:John & I attended the 63rd Annual Workers’ Compensation Educational Conference in Orlando at theMarriott World Center. Debbie & Frank Ray (Debbie is my instructor for insurance billing and is fromPlant City, FL) were there for one day to the meetings and visit the exhibit hall. They enjoyed it immenselyand had hurting arms from carrying so many freebies given at the booths. They were sorry they missedthe Lumbar Spinal Fusion Surgery live from the Orlando Regional Hospital. These live surgeries arealways a highlight of the conferences. Maureen and her husband Joel enjoyed the opening ceremoniesand exhibits with us the year before! Check it out!Dates were August 22nd, 23rd and 24th 2011. It was interesting as always. In addition to many breakouts ofa variety of medical and legal subjects, I also attended the Work Comp Division Breakout on Wednesdayfor a variety of sessions. This was my 27th or 28th year to attend this great convention.ELECTRONIC BILLING: The most prominent piece of information here was that Electronic Billing isgoing to be a thing of the near future for all. I will keep all posted as to when it will be mandatory as it nowis in MN and TX.ICD-10 CODES: The other thing is that the ICD-10 CPT Coding is not mandatory until October 2013.ICD-10 Codes are the Diagnostic Codes used by physicians. When they are current I will notify of thosechanges that may pertain to our services. For those not familiar with this, the Diagnostic Code changesare to be more specific in the diagnoses by detailing the most intricate body region of the diagnosed area.EVIDENCE BASED MEDICAL SERVICES: Every year this is a big issue while all are still trying to sortout what it means, how it can be accomplished and so forth, there is still no solid guidelines that we needto be worried about, just be mindful of it and investigate all avenues of this as it pertains to our services.Last year I attended the Chiropractic Breakout on this subject. Bottom line, information I gleaned fromthat, is that each profession has to create their own guidelines as to what is “Evidence Based MassageTherapy” in our case. Who will tackle this?FL PIP FRAUD BILL/ LAW FIASCO:As always I have been keeping on top of issues such as the FL PIP bills, the health care environment andother such situations as they pertain to our profession I have a keen sense and intuitions of what canhappen if we do not take things serious and create rules or make changes ASAP.Relating to Insurance Fraud and LMT’sIn relation to massage therapists and insurance fraud issues, I have worked with attorneys as an expertwitness on a 3 major cases in the 14 months, presented 3 or 4 times to fraud investigators, FBI and 36

undercover agents, insurance adjusters and medical claims defense network. (MCDN). I presented to agroup at Geico Headquarters in Lakeland including the CEO Jeff Atwater from FL Insurance Division, theState Attorney and two assistants.I was fortunate to have been able to see the inside workings of what the real fraud issues are and howmassage therapists for the most part are being exploited. But this was all to no avail with legislativeefforts this year because Governor Scott and the Insurance Industry knew the direction they were goingto take which ultimately led to exclusion for massage therapists’ and acupuncturists’ ability to accept andbill for auto cases in FL.We were the fall guys, the guinea pigs so to speak. But we WILL come back!!Because Robin Smith Westcott had been appointed by Dept of Ins. CEO Jeff Atwater to head the PIPWork Groups last year, which I knew nothing about unfortunately, I asked for an appointment to share theLMT Side of the fraud and abuse in the PIP System. As I was heading to her office I received a call fromSenator Simmons office. He asked his office staff to have me stop by there to explain our side to thembecause he was “Very Interested, but he too was apparently under the thumbs of Gov. Scott and hisagenda to help insurance companies.Renee Scioville, LMT from FSMTA Dade Chapter, came all the way from Miami to be with me.Jonathan Walker at the suggestion of Scott Hartsfield also went with me to the meetings to share ourconcerns. Renee, Jonathan and my husband Jon were all outstanding in their assistance! We werewelcomed with open arms (literally, receiving hugs and pictures from both Robin Westcott and Diane),Senator Simmons Staff member before we left there.I wish I had been able to have had the time and finances to have stayed and arranged to meet everysingle Senator and House of Representative’s office staff to build rapport and camaraderie to let themknow REALLY WHY LMTs are TARGETED! We as a group from FSMTA all did this with the LAD in thepast, and we need to figure how to be doing this again in the future, even if we cannot provide hands onmassage therapy.LEGISLATIVE COMMUNICATIONS:I wrote every massage therapist I have email addresses for (FSMTA members or not) to ask them to doas we have all been faithfully doing, emailing, writing, faxing and calling Legislators. I had mailed a fewpriority letters, some certified and mostly emails along with Fraud, Abuse and OverutilizationPrevention Solution ideas for them to consider. These solutions would not have harmed us in anyway,but would have been able to put us in a better light with those fighting fraud as suggested by FraudInvestigators, etc. However all of this along with all the calls, emails, letters and petitions that werepresented to legislators went on deaf ears and blinded eyes. Only after the PIP Bill was passed did theywrite to rub it in that they got what they wanted! All other responses were canned and basically the samefrom all.FUTURE LEGISLATIVE EFFORTSWe do need to get the list from FSMTA Central Office and thank those legislators (in your districts) for allthey tried to do to help us to remain in the system and vote the others OUT! 37

MASSAGE MESSAGE MAGAZINE  Our state magazine is one of important connections for our members. We have some ofour top educators in our profession taking time out of their busy schedule to submit articles on aregular basis. These articles are informative to therapists and enhance skills and knowledge.We provide this magazine as a member benefit. Although we have no expectation of this beinga profit, our profit margin is at higher rate because of ads sold and accounts receivable that arecollected in a timely manner. This has been possible even with higher postage rates. Weencourage chapters to submit events in their area that are of special interest to be published. Massage Message is a magazine that keeps us connected to other therapists andchapters throughout the state. This is an important part of our association to keep everyoneinformed. Our magazine has come a long way and a thank you to the past chairs who haveadded their input. Enjoy reading and keep the articles coming!! We began connecting withone another to share ideas and suggestions on methods to grow our membership. The FSMTAhas tremendous potential for membership growth across the State. We have licensed massagetherapists that are not familiar with the FSMTA. We also have massage therapy studentsgraduating on an ongoing basis which may not be aware of the benefits of membership. The Executive Board recently voted on and approved a new referral fee program for allmembers. Each member that refers a new member to join will receive a $15 credit with theFSMTA. These credits can be used towards membership renewal or on products purchasedthrough the FSMTA State Store. The Board decided to implement this program permanently, asopposed to a brief membership drive program of the same nature. The committee is researching additional options to propose to the Board for approval togrow our membership. Our strength is in our numbers, and each and every member can helpthe association grow by spreading the word about FSMTA to other LMT’s across the state. 38

I so far havebeen fortunate enough to find sponsorships for both of the executive board meetings. During the January2012 board meeting Erik Dalton sponsored $1,500 plus donated an autographed copy of his book “TheDynamic Body”, as well as a discount on his products.Anna Rodriquez of The Florida Coalition against Human Trafficking was able to present at our January2012 board meeting, and will have a table during our 2012 convention. During the March 2012 Paul Hagen of Vacupractor sponsored $1,500 plus 3 Vacupractors whichwere won in a drawing, all board members were offered a 2 free CE course, our members were offered abig discount on the course and the product. Stephanie Beck presented us a complimentary Webinar on Facebook 101 at the March 2012board meeting; we’ve since then hired her to build all of our 19 chapter pages to create uniformitybetween the chapters within our association. And what a year it hasbeen. At last year’s convention, we broke all daily sales of the previous years and were successful indepleting our long term inventory items. We have started a new line of ladies cut shirts; Men’s Polo’s andreleased the new and extremely popular Messenger Bags.So now we are increasing more of what worked last year and adding items such as; Name Tags, Travelcups and light weight jackets. Also we are introducing fundamentals such as a in booth credit cardprocessors and computer printed receipts in order to speed up the processing time and making it easierfor our members at the Vendor Hall.
