PROPRIETARY INFORMATION All of Darkhorse Tech’s company information is a corporate asset. I understand that misuse or damage of information may be as costly to the Company as would misuse or damage of physical property. I understand that I am responsible for the protection of Darkhorse Tech’s information, as further explained below: 1. Team members may use Darkhorse Tech’s information and third-party proprietary information only for the performance of Company business. 2. Team members may not alter, or in any way change, Darkhorse Tech’s information except in the appropriate performance of job duties. 3. Team members may not divulge Darkhorse Tech or third-party information to anyone whose relationship with the Company does not warrant it. 4. Team members may not use E-mail to transmit Darkhorse Tech’s proprietary or confidential information to any person or party outside the physical site of employment. Team members who have a business need to use E-mail to transmit confidential or proprietary information to any party (including other Darkhorse Tech team members) located outside of their site of employment must first obtain the approval of their supervisor, who will determine whether the use of encryption software or other security measures are necessary or sufficient to ensure that the confidentiality of the transmission is not compromised. 5. Team members are prohibited from using Darkhorse Tech’s name or service marks except in the performance of their job duties, unless prior 1 | PROPRIETARY INFORMATION

PROPRIETARY INFORMATION written approval is obtained from the Company’s President/CEO. 6. Team members may not make representations on behalf of Darkhorse Tech in any public forum. For purposes of this Policy, the term “public forum” includes, for example, but is not limited to, media advertisements, Internet home pages, electronic bulletin boards or chat rooms, or any other media that may be accessed by individuals who are not employees of the Company. Team members choosing to express personal opinions on the Internet should clearly indicate that their opinions do not reflect the opinion of Darkhorse Tech, its officers, or its management. 7. Team members may not attempt to gain access to information or facilities to which they are not specifically authorized. 8. Team members may use the data processing facilities of Darkhorse Tech only in a manner consistent with their job function and for conducting Company business. 9. Team members may not maintain personal information, information for businesses other than Darkhorse Tech’s, or any form of non-Company data on Company computing equipment. • I understand that any user IDs or passwords assigned to me are to be used only by me and are not to be divulged to any other party. • I will comply with all Darkhorse Tech procedures in the assignment and format of passwords. • I am aware that information created, transmitted, or stored on Darkhorse Tech’s information systems, 2 | PROPRIETARY INFORMATION

PROPRIETARY INFORMATION including E-mail messages, are not private and may be accessed by management at any time. • I am aware that all files residing on Darkhorse Tech’s servers or desktop computers are considered Company information, which therefore are subject to auditing and search in the normal course of business.
