I agree that Zest and I both have the right to terminate my employment at any time, with or without notice, and with or without cause. I further understand that transfers, demotions, suspensions, employee discipline, and changes in the terms and conditions of employment may be administered at the sole and absolute discretion of Zest. I understand that I am an at-will employee. I understand that these conditions of my employment may not be modified orally and may only be modified in a writing signed by the Chief Executive Officer of Zest and me. I understand that nothing in the Handbook is intended, nor should be construed, as a limitation of my right and Zest’s right to terminate the employment relationship at any time, with or without notice, and with or without cause, or Zest’s absolute right to transfer, demote, suspend, administer discipline, and change the terms and conditions of employment at its sole discretion. I understand that nothing in the Handbook is intended, nor should be construed, to create an implied or express contract of employment contrary to this express at-will agreement or to Zest’s absolute right to transfer, demote, suspend, administer discipline, and change the terms and conditions of employment at its sole discretion. I understand that Zest reserves the right to depart from and modify the policies stated in the Handbook at its sole discretion, with the exception of my at-will status and Zest’s absolute right to transfer, demote, suspend, administer discipline, and change the terms and conditions of employment.
