GENERAL WORK RULES I was selected for my job with Darkhorse Tech because I possess a level of maturity, responsibility, and commitment that is an essential ingredient of the Company’s continued success. While I work with Darkhorse Tech, I will continue to demonstrate these qualities, and conduct myself in a professional manner at all times. My primary responsibility as team member of Darkhorse Tech is to perform my duties to the best of my ability so that we can all continue to grow and succeed. This responsibility carries with it a number of obligations such as obeying the Company’s rules, cooperating with management and other team members, and remaining loyal to the Company. If my job performance, attitude, or conduct falls short of Darkhorse Tech’s established standards, the Company may take appropriate action ranging from oral or written warnings to termination. As a general rule, I will be given an increasingly severe penalty each time an offense is committed. I understand that some types of misconduct, however, are so intolerable that termination may be imposed for even the first offense. The rules set forth below are not designed for the purpose of interfering with or restricting my rights. The goal of establishing and maintaining these rules is to protect the mutual rights and interests of Darkhorse Tech and all of its team members. I understand that the list below is not intended to be exhaustive. It is merely intended to provide examples of the types of conduct that may result in disciplinary action. Committing any one of the following types of conduct will generally result in an oral warning for the first offense, a written warning for the second offense, a suspension of three days for the third offense, and termination for the fourth offense: 1. GENERAL WORK RULES 2. Unexcused or excessive absenteeism or tardiness. 3. Uncooperative attitude, including unreasonable failure to work in harmony with other team members. 4. Violation of the Company Smoking Policy. Committing any one of the following types of conduct may result in immediate termination for the first offense: a. Theft, participating in a theft, or attempted theft of Darkhorse Tech property or the property of any employee or visitor of the Company. b. Failing or refusing to cooperate with Darkhorse Tech in an investigation of a theft or a suspected theft of another team member’s or the Company’s property, or the investigation of any other work or workplace misconduct. c. Dishonesty; lying; embezzlement; falsifying any Darkhorse Tech record (including employment application), no matter when discovered; falsely reporting any act or transaction or attempting to defraud the Company by any means, including making a false or fraudulent statement regarding absences, medical leave, overtime, workers’ compensation claims; falsifying financial records; falsifying or padding anyone’s time records. d. Damaging, destroying or harming Darkhorse Tech property or the property of another team member or visitor. e. Fighting or assaulting or attempting to assault any member of management, team member or visitor of Darkhorse Tech, or deliberately provoking or inciting another person to engage in an assault or fight. f. Carrying or using firearms, or other dangerous weapons or materials on Darkhorse Tech’s premises (including the parking lot area) or in connection with Darkhorse Tech’s business. g. GENERAL WORK RULES premises, or in connection with Darkhorse Tech’s business. h. Disclosing or misusing confidential information, trade secrets, or proprietary business information about any Company matter to any unauthorized persons or competitors. i. Gross negligence in the performance of work assignments or deliberate concealment of defective work. j. Insubordination, including refusing or failing to obey a reasonable work request or instruction of any member of management, or encouraging another team member to refuse or fail to obey such a request or instruction. k. Violation of Darkhorse Tech’s Equal Employment Opportunity Policy or Policy Against Harassment. l. Violation of Darkhorse Tech’s Drug and Alcohol Policy. m. Failure to immediately report any work-related injury or accident. 3 | GENERAL WORK RULES
