Common Law 99 Lien Definition Common Law Lien Definition: One known to or granted by the common law, as distinguished from one created by the agreement of the parties. It is a right ex- tended to a person to retain that which is in his possession belonging to another, un- til the demand or charge of the person in possession is paid or satisfied. (Whiteside v. The first thing you (Demandant) must do be- fore filing a Common Law Lien is to read the docu- ment carefully in order to have a thorough under- standing of your rights. After you fully understand your rights pertain- ing to the document, then you and whoever jointly owns the property with you must sign the docu- ment in front of a Notary Public. Take the document to your County Clerk’s office and file it. You will be charged a fee, (prob- ably about $20.00). The clerk will stamp your copy, and a “certified” copy will be sent to you in about 30 days. If you wish to have a “certified” copy im- mediately, you may request one from the clerk for an additional nominal fee, (probably about $9.00). Send a copy of the document, certified mail, return receipt requested to the Respondent named on the front page of the lien. (It does not have to be a certified copy; a photo copy will suf- fice).
