Chapter 5: Taking Care of Aging Parents with Durable Power of Attorney Finding an Elder Law Attorney 633 Although the law doesn’t require you to have an elder law attorney prepare your durable power of attorney documents (and preparing one on your own can save some cash in the very short term), lacking the legal knowledge to create a durable power of attorney for property management can cost you thousands, if not more, because of common mistakes or loopholes. A durable power of attorney must be tailored to your specific circumstances to be the most effective document possible. We don’t recommend that you draft your own durable power of attorney, and we hope that you consider carefully the potential problems with do-it-yourself forms and kits. Most lawyers don’t specialize in serving a particular type of person. Criminal lawyers may have a knack for people with similar hobbies — say, knocking over liquor stores — but they don’t focus on a precise segment of the popu- lation as an elder law attorney does. You may be tempted to use your own lawyer to oversee the durable power of attorney, but this decision is usually not the best choice. Consider why:  General-practice attorneys may buy into the myths that go along with old age. They may patronize a perfectly aware senior, talk loudly for no reason, or ignore them altogether. Book VII  Elder law attorneys have connections in the world of senior citizens, Planning from in-home assisted living providers to gerontologists (senior doctors), Your Estate senior-care psychologists, government program information, and more. and Will  General-practice attorneys may not be familiar with all of the subtle aspects of a durable power of attorney, especially in relation to a reverse mortgage. Your general family lawyer will probably be able to refer you to a good elder law attorney, however, so don’t scratch him or her out of your phonebook quite yet. Knowing what to look for Part of what makes finding a good elder law attorney somewhat difficult (besides the fact that you may not have one in your area if you live in a small town) is that so many fields of elder law exist. Different elder law attorneys specialize in all sorts of areas: medical claims, Social Security issues, estate planning, elder abuse, age discrimination, nursing home problems, and elder fraud, just to name a few. When you call around, be sure to explain up front that you’re looking for someone who has experience in creating durable power of attorney authorizations and who is also knowledgeable about reverse mortgages. 46_345467-bk07ch05.indd 633 9/25/08 11:28:08 PM 9/25/08 11:28:08 PM 46_345467-bk07ch05.indd 633

634 Book VII: Planning Your Estate and Will Speaking of that first call, now is a good time to ask some preliminary ques- tions. You may be speaking with a receptionist or assistant, but it’s okay — that person should be able to spout off the answers without missing a beat. Some good first questions to ask include the following:  How long has the attorney practiced elder law?  What associations is he or she a member of?  What should I bring with me when I come in?  What is the fee structure? Does that include the first consultation? In fact, ask anything you want; just remember that the person answering the phone probably isn’t a lawyer, so it’s best to save detailed questions for the attorney. When you’re in and have explained your reason for coming, lay on the more difficult questions. Start with “Have you ever done a durable power of attorney for a reverse mortgage?” Don’t be shy — if you don’t understand something the first time, just keep asking until you do. You’re on the clock, but it’s worth it to get a satisfactory answer. Some sample questions to take with you may be the following:  What are the downsides to getting durable power of attorney in our par- ticular situation?  What provisions do you recommend to the written durable power of attorney?  Judging by our conversation, do you think we have any better alterna- tives to getting durable power of attorney that we haven’t thought of?  After seeing my parent in person, do you feel that a durable power of attorney is appropriate?  How long does it take before the durable power of attorney goes into effect? (Timing may depend on who draws up the paperwork and the office’s turnaround time.)  How often should we revisit the durable power of attorney documents? Because the answers to these questions can vary from family to family, we can’t give you definitive answers here; it’s important to discuss these issues (and any others you can think of) thoroughly with an elder law attorney. In addition, your elder law attorney must possess the same qualities that a good reverse mortgage counselor or originator has: patience, respect for seniors, and superb communication skills. Just as you would with an origina- tor, you and your parent need to feel that you can ask questions, get results within the promised timeframe, and receive personal attention that shows that the attorney cares about you beyond your checkbook. 9/25/08 11:28:08 PM 46_345467-bk07ch05.indd 634 9/25/08 11:28:08 PM 46_345467-bk07ch05.indd 634

Chapter 5: Taking Care of Aging Parents with Durable Power of Attorney 635 Elder law attorneys (as with any other lawyers) usually charge by the hour or part thereof, plus whatever expenses they incur on your behalf (such as making copies or mailing something). Fees vary from office to office but can run as low as $50 an hour at very generous offices with senior finances in mind, to as high as a few hundred dollars an hour. Discuss your financial situ- ation with your attorney right off the bat. If you can’t afford their high fees, many elder law attorneys may very kindly lower their rates or reduce the bill- able hours. When your attorney tells you the rate and gives you an estimate of how much the total cost will be, level with him or her — say how much you can spend and ask nicely if the attorney can help you stay within your budget. Most attorneys will, but many won’t assume you even have a budget unless you say something. You can make the experience of creating a durable power of attorney a posi- tive one by being sure to bring all of the documents, statements, and other items that the elder law attorney requests of you. If your parent has already gotten a reverse mortgage, bring all the loan documents, including the loan agreement, which lays out all of the terms of repayment. You can also ask the reverse mortgage originator you’re working with (or plan to work with) for sample copies to take with you so that the elder law attorney knows all the details of the loan. Book VII Finding a good elder law attorney Planning Your Estate Beyond flipping through pages of “Call for a free estimate” ads that make and Will your legal issues sound like a broken-down car, countless resources available to you can help you find a highly regarded elder law attorney in your area. Remember, you don’t have to go with the first attorney you talk to, and you don’t have to worry about hurting an attorney’s feelings if you choose some- one else. At upward of $250 an hour, attorneys can use their wads of cash to dry their tears. Some great places to start searching include the following:  National Association of Elder Law Attorneys (NAELA): It may come as no surprise that the NAELA Web site is a great place to start when you’re looking for an elder law attorney. Its “Locate an Elder Law Attorney” database has listings of NAELA members all over the country, some with information such as law specialties and links to their own Web sites where you can find out more about each attorney. Visit the site at www.naela.com or call 520-881-4005.  American Bar Association (ABA): The Senior Lawyers Division of the ABA provides a directory of state and city senior lawyer groups in the United States. The ABA Web site also has an option to search for lawyers by specialty. 636 Book VII: Planning Your Estate and Will  Alzheimer’s Association: Not only will you find incredible and up-to- date information about Alzheimer’s tips and recent research on its Web site, but you can also contact your local chapter, which can most likely give you a referral to a competent elder law attorney. Visit www.alz.org or call 800-272-3900.  AARP: AARP is an excellent resource for all facets of aging, and here you can find that AARP really shines. Log on to www.aarp.org/money/ legalissues/ to discover a “Find a Lawyer” link, plus an option to receive 30 minutes of free legal advice from one of AARP’s network attor- neys. If your parent is an AARP member, he or she can receive additional reduced-fee services. While you’re at the site, check out the reverse mortgage links.  Children of Aging Parents (CAPs): This nonprofit organization has resources for many aspects of managing your parent’s affairs. Its chap- ters are in only about 15 states, but this organization may be able to help you contact a similar group in your own area. Call 800-227-7294 for support and suggestions. Using a Living Trust as an Alternative A durable power of attorney isn’t right for everyone. Some people just aren’t cut out to manage other people’s lives; some can barely manage their own. This huge undertaking takes a lot of dedication. Now, everyone loves their par- ents, even if it’s way, way deep down. But if you’re feeling like durable power of attorney is a bit too committal for you, you have other options (we can talk about your commitment issues later). You may have heard about wealthy spoiled kids who have a trust fund wait- ing for them when they turn 18. Granted, this scenario happens more often in the movies than in real life, but trusts can be a useful tool in managing another person’s finances. For our purposes, we focus on the living trust (also called intervivos). A living trust is the only kind that can help you in getting a reverse mortgage for your parent because it’s the only one that guarantees that the trust was created during your parent’s lifetime (hence the name living trust). Generally, a living trust allows one person (the trustee) to handle the property title for another person (the beneficiary). The language of living trusts is confus- ing because, unlike your parent’s will, which names beneficiaries who are usually the heirs, such as you or your other family members, you are the trustee in this instance and your parent is the beneficiary. It’s a financial doppelganger. What’s not confusing is the basic benefit of a living trust: Your parent can be both the trustee and the beneficiary (which means that your parent has control over everything on his or her own) until your parent becomes 9/25/08 11:28:08 PM 46_345467-bk07ch05.indd 636 9/25/08 11:28:08 PM 46_345467-bk07ch05.indd 636

Chapter 5: Taking Care of Aging Parents with Durable Power of Attorney incapacitated; then you or another named trustee can step in and take over. 637 You don’t have to worry about having too much control while your parent is still fully mentally functional. In this way, a living trust is similar to a springing power of attorney, but it has one big advantage: Living trusts are a respected part of the financial world. Whereas people are often suspicious of a springing power of attorney, a living trust almost never causes problems. Living trusts are widely accepted as legal and reputable. A living trust may be set in stone (irrevocable), changeable, or even revoca- ble (in other words, it can be canceled). The format that you and your parent choose depends on your individual situation, but keep in mind that things change. You may decide after a few years that a durable power of attorney is the best path after all, or your parent may decide that your sister is really the one who should be in charge of the house. Talk to a professional about the benefits and potential pitfalls of both options. Setting up a living trust is fairly simple, but it’s not the kind of thing you can do yourself, just as it’s not a good idea to set up a durable power of attorney on your own. Too much legal mumbo jumbo and too many considerations are involved, such as what effects the living trust has on your parent’s other finan- cial areas. The property in a living trust can sometimes (but not always) have an effect on your parent’s taxes and government aid, such as Medicare. You don’t want to go to all the trouble of setting up a living trust and getting a reverse mortgage just to find out that it has negative implications for your parent’s taxes. Book VII The same elder law attorney you scouted out for the durable power of attorney Planning can help create a living trust (see “Finding an Elder Law Attorney,” earlier in this Your Estate chapter). Your regular attorney can help you with this, as long as he or she has and Will some background in living trusts and other aspects of estate planning. Part of the reason a living trust is so easy to do is that you pay someone else to do it — a lot. You have to pay legal fees, processing fees, transfer fees, attorney-needs-a-vacation fees — you get the idea. If you haven’t already, skip back to the section “Finding a good elder law attorney,” earlier in this chapter, and start looking for a good attorney who won’t charge you an arm and a leg. Again, your parent’s financial planning isn’t the time to skimp on costs, but you may have some options for reduced-cost elder law attorneys. One of the downfalls of a living trust is that even when your parent is incapaci- tated and you’re managing the trust, a living trust gives you power only over the property. In most cases, that’s as far as you can go with it. You can get a reverse mortgage on the property, sell it, bulldoze it, paint it purple, whatever you want. But you have no control over the rest of the assets unless the living trust expressly lays them out and transfers them to you. So if you are the trustee but forgot to mention that you will eventually need control over the rest of the estate (bank accounts, other property, family heirlooms, and so on), you’re out of luck.
