Ask the Human Resources Professional by Monica Stewart Wilson How to Avoid a Workplace Retaliation Claim Tips for avoiding retaliation claims, the most common type of claim filed with the EEOC By Monica Stewart Wilson, SHRM-CP Part I of 3 Train Managers/Leaders on Common Pitfalls There are several reasons an employee or applicant could bring a claim against an employer, such as discrimination based on age, disability, national origin, race, religion, and sex. In a recent case, EEOC v. Versant Supply Chain, the defendants violated federal law by promoting and enforcing dress code policies, which interfere with employees’ religious rights by prohibiting employees from wearing any head coverings (except knit caps). This policy didn’t consider those who wear head coverings such as hijabs for religious reasons. The case was settled for $150,000. Where retaliation comes in is when a supervisor takes the EEO complaint personally and may attempt to deter employees from continuing to participate in the complaint process-or even decide to fire them to remove the “problem” entirely. Other retaliatory actions are as follows: ·Work-related threats, warnings, or reprimands. ·Lowered ratings on performance evaluations. ·Transfers to less prestigious or less desirable position or worksites. ·Closer scrutiny of the employee’s work than of other employees’ without a legitimate reason. It is very important for supervisors to recognize and understand how this retaliatory conduct can result in a claim. So, ensure that supervisors are trained on these common pitfalls. MEET MICHAEL DOZIER Michael Dozier, Nonprofit Consultant Michael Dozier is a former nonprofit CEO. He is the Principal Founder & CEO of Carrington, Holland & Leigh, LLC, a nonprofit consulting service that provides comprehensive nonprofit services for community-based, faith-based and other nonprofit organizations. Michael provides hands-on assistance, training, and consultative guidance for nonprofit organizations who are in need of organizational and fund development assistance. Those services include 501(c)3 start up and formation, non-profit infrastructure development, business start-up, grant writing and fund development assistance, board development, strategic planning, business planning, compliance audit, and executive and board coaching for individuals. TAMETRICE E. HODGES Newly Elected Hinds County Chancery Court Judge HONORABLE From Prosperity Neighborhood TAMETRICE E. HODGES to Legal Prosperity “You’re the girl from the ‘hood,” many exclaimed when meeting then Candidate Tametrice E. Hodges for Hinds County Chancery Court Judge. Without hesitation, Candidate Hodges would smile and say, “Yes.” After winning the election, Chancery Court Judge Tametrice E. Hodges still has the same smile as she thinks to herself, “Yes, I’m the girl from the ‘hood.” Growing up in Prosperity, a small neighborhood across from the then boarded up Jackson Mall, now Jackson Medical Mall, Judge Hodges had limited access to what she now enjoys as the norm. Also, Judge Hodges, like many others who lived in her neighborhood, had very few career examples to look to, other than her teachers. “Growing up in Prosperity, I didn’t know lawyers, doctors, or even bankers. I only knew the everyday citizen.” Her familiarity with the everyday citizen shaped Judge Hodges’ outlook and fueled her passion for people. When she became an attorney at Morgan & Morgan, she quickly began championing the rights of injured workers. Overtime, she realized she was championing more than the rights of injured workers. She was championing the livelihood of families. “When a person is injured on the job, she/he cannot work. If a person cannot work, the person cannot feed his/her family, and provide the daily necessities the family needs.” Championing the livelihood of families soon turned into servant work for children and families as a pro bono attorney for children and families in need of an attorney in the family law arena. Family law encompasses cases regarding children, family, property and land. With each case, representing moms and dads in custody and visitation matters, or representing a husband or wife in a divorce matter, then Attorney Hodges realized her true passion—children and families. Though Hodges rarely represented a minor child directly, she was always in a position to advocate for the best interest of the child with regard to adoptions, guardianships, custody and visitation matters. “Under the law, when a child is involved in a family matter, the best interest of the child is the highest consideration. So, although the parties could not agree, I worked hard to get them to focus on their child, and what would be best for their child.” Judge Hodges, then Attorney Hodges, was very successful as a solo practitioner specializing in family law, for over a decade. She received an opportunity to leave her solo practice and become an Assistant District Attorney. This role was hard to give up. “I went from getting parents and guardians to agree on the best interests of their children, to prosecuting persons who victimized children and families.” Her passion for children and families as an Assistant District Attorney intensified. “I know what it’s like to be voiceless and vulnerable. My experience of growing up in a home that caused me to enter into the foster care system and ultimately be raised by my seventh grade reading teacher at age fourteen (14) was a driving force when giving voice to our vulnerable children, while doing everything I could to ease the pain of families who loss a loved one,” says Hodges. Judge Hodges is stepping into her new role as Hinds County Chancery Court Judge. She is succeeding the Honorable Judge Denise Owens, who has served for over thirty years with great compassion and care. Judge Hodges knows she has great shoes to fill, but she is ready to blaze some great trails of her own. “With both my life and legal experiences, I hope to impact youth throughout the city of Jackson and beyond the bench. I am excited to bring to life the many ideas I have to serve our children and families in Hinds County,” exclaims Hodges. Judge Hodges feels destined for this moment in time. Based on her life and legal resume, she is not only destined for this moment in time, but tailor made for the position. “I want women and young girls who come from similarly situated neighborhoods and have similar backgrounds to know that because I made it, so can you. The odds are not against us, but for us. Those same odds can be used to our advantage to offer a perspective no one else can.” I am excited to have the Honorable Tametrice E. The Journey The journey starts with an idea and the confidence to take that dreaded first step. The hardest part of doing anything new is having the courage to begin. As we approach 2023, let's make a conscious effort to take that first step toward whatever it is we have been delaying for whatever reason. We are all guilty of the \"as soon as\" mentality. You know, \"as soon as\" the kids graduate high school or \"as soon as\" I save enough money. Whatever your \"as soon as\" excuse is for not taking that initial leap into the life you want, it is the thing that's keeping you from fulfilling your dream. I have heard people say that there are a lot of great ideas in the graveyard. What that means is there are a lot of people buried with their dreams.
