Monica Stewart Wilson Ask the HR ProfessionalBoss2Boss Magazine Page 3 How to Avoid a Workplace Retaliation Claim By Monica Stewart Wilson, SHRM-CP Part 3 of 3 Establish a Process for Handling Complaints In our last issue, we discussed the importance of knowing how to avoid common pitfalls that could lead to a retaliation claim and training to look for common pitfalls. As an entrepreneur, you may wear many hats, but if you have employees, it is important to recognize and establish a process for handling complaints. Employers should consider assigning a designated management official, or in-house counsel to review proposed employment actions and ensure they are based on legitimate nondiscriminatory and nonretaliatory reasons. Also ask clarifying questions and seek additional information to ensure you fully understand the employee’s concern but being proactive when employees raise concerns about potential EEO violations is key. In summary, consistency is key. Failing to apply policies evenly can lead to perceptions that certain workers are being singled out for filing a complaint or participating in a workplace investigation. Employers should ensure they have a strongly written anti-retaliation policy that is communicated to all staff and you should also clearly inform employees that retaliation is prohibited and that they should report any perceived retaliatory behavior immediately. Your policy should be written in plain language and should include the following: examples of retaliatory actions, proactive steps to avoid actual or perceived retaliation, a reporting mechanism for raising concerns about retaliation and a clear explanation that employees may be disciplined or fired for engaging in retaliatory behavior. “Ask the HR Professional” articles do not necessarily represent the views of the magazine or Monica Wilson. SENATOR HILLMAN T. FRAZIER RE-ELECT HILLMAN FRAZIER SENATE DISTRICT 27 Senator Hillman Terome Frazier represents District 27 in Hinds County. He is chairman of the Senate Interstate and Federal Cooperation Committee and Vice Chairman of the Labor Committee. He is also a member of the Appropriations, Constitution, Elections, Insurance, Investigate State Offices, Joint Legislative Code Compilation, Judiciary Division A, Public Health and Welfare, Rules and Universities and Colleges Committees. He has also served as a member of the Special Committee for the Election Contest of House and Senate Seats. Before beginning his Senate Service in 1993, he was a member of the Mississippi House of Representatives for 13 years. Senator Frazier was born in Jackson, Mississippi. He is a graduate of Jackson State University and George Washington University’s University National Law Center. He successfully completed the “Program for Emerging Political Leaders” at the Darden Graduate School of Business Administration at the University of Virginia in 1999. In 2000 he was nominated and selected to participate in the “Executive Seminar for Southern Legislators” at the College of Arts and Sciences at the University of North Carolina at Chapel Hill. In 2001 he was selected to participate in the “Governing in the Global Age Seminar” at the George Washington University’s Elliott School of International Affairs. He also studied as a Fannie Mae Foundation Fellow at Harvard University’s John F. Kennedy School of Government in 2001. A life-long learner, Senator Frazier graduated Summa Cum Laude from Hinds Community College December 14, 2012 with a degree in “Automobile Collision Repair Technology.” Senator Frazier’s legislative accomplishments are quite extensive. In 1995, he led the Mississippi Legislature in ratifying the Thirteenth Amendment to the United States Constitution which abolished slavery in the United States of America. The State of Mississippi refused to ratify the Amendment in 1865. He also did the research and authored the Compulsory School Attendance and Public Kindergarten Bills, which became the cornerstone of the Education Reform Act of 1982. Senator Frazier authored the bill, which made Dr. Martin Luther King’s birthday an official state holiday in Mississippi. As Chairman of the House Judiciary “A” Subcommittee, he successfully fought for the passage of the Mississippi Crime Victims Compensation Act, which compensates the victim of violent crimes up to $15,000. He also authored and secured passage of the Landlord Tenant Act, which governs housing standards and rental agreements in Mississippi. During the 2006 Legislative Session he fought for the passage of a law that removed breast-feeding from the indecent exposure and the disturbance the peace sections of the Mississippi Code. In 2006 Senator also authored Senate Concurrent Resolution No. 627 which created a Study Committee for the purpose of studying the feasibility of establishing a Civil Rights Museum in the City of Jackson, Mississippi. He co-chaired the committee that made the recommendation to establish the Two Mississippi Museums that opened in December 2017. Senator Frazier has been the recipient of many awards including the “Justice for Animals Award” by the Mississippi Citizens Against Animal Cruelty in March, 2022; the “Lifetime Achievement Award” by the Community Health Center Association of Mississippi on January 29, 2019; the “Lifetime Achievement Award” by the National Black Caucus of State Legislators in December, 2019; the “Breast man of the Year Award” by the North Mississippi Breastfeeding Coalition and the Mississippi Breastfeeding Coalition in 2016; the “2016 Day at the Capitol Appreciation Award” by the State and Capitol Area Chapters of AARP in 2016; the “Global Understanding and Cultural Advocate Award” by the Mississippi World Trade Center in 2014, just to name a few. He and his wife Jean Maria reside in Jackson and have two children, Julian and Gabrielle Jones, daughter-in-law Erica, grandson Kristopher Julian and granddaughter Kawaii Joi and son-in-law Jimmy Jones.

MARCUS WALLACE Candidate for Mayor 2025 Marcus L. Wallace is a former two term Mayor of Edwards, Mississippi, which is in the heart of Hinds County and located in the Central District. Wallace has been successful at garnering local, state, and national notoriety. He is one of the few mayors in the state of Mississippi who has received a Congressional Record by the U.S. House of Representatives. Wallace is not only well- liked and a favorable Democrat in Hinds County, but he is also very well-respected among African Americans with the Central District. In addition, former Mayor Wallace has developed relationships with local and state leaders within community and faith-based arenas. He has earned recognition over the years for being president of one of the fastest growing minority construction firms in the state, M.A.C. & Associates, LLC. He serves on the Mississippi Sports Hall of Fame Board and has been very active in the lives of several young men in schools, churches and communities through his AAU organization, Edwards Bulldogs. Wallace has earned several awards such as Phi Beta Sigma Image Award, Respect Our Black Dollars Businessman of the Year Award, and a host of others. He is a graduate of Southern University A & M, and he is the father of three children, Essence, Dejah and Marcus II. In addition to his vast array of accomplishments, Wallace is known for his passion towards working within the community of Hinds County. Wallace is the most likely primary contender to be reckoned with within the Hinds County Central District, which is the largest and most populated county. His vision to provide “New Energy and a New Era” is a message that will connect with the ever- growing democratic base of young professionals and young adults between the ages of 25 to 45. Wallace has strong community and historic ties of loyalty with voters 55 and older that will guarantee a grass roots voter participation outreach program that is second to none. Failing Forward By Brenda B. Myers The concept of failure is often associated with negativity and disappointment, yet one cannot deny that it is an inevitable aspect of life. However, what if I tell you that failure can lead to success? Yes, failing forward is a concept that revolves around seeing failures as opportunities for growth and learning rather than setbacks. It is about embracing the challenges that come with failing, analyzing the mistakes and shortcomings, and applying the lessons learnt to future goals and tasks. The truth is, every successful person in history has faced failure at some point in their journey, but what sets them apart from the rest is how they viewed and dealt with this failure. They took ownership of their failures and turned them into stepping stones towards success. Failing forward requires us to shift our perspective and see failure not as a roadblock, but as a tool that can help us become better versions of ourselves. It is through failures that we discover what works and what doesn't, and we use this knowledge to improve our strategies and approaches. The path to achieving our goals is not always smooth, and we should embrace this fact. Failing forward allows us to build resilience and perseverance, making us better equipped to overcome future obstacles. In conclusion, failing forward is not a weakness, but a strength. It is an attitude that allows us to grow and learn from our mistakes, and take calculated risks in the pursuit of our objectives. I encourage you all to adopt this mindset and turn your failures into opportunities for success. Remember, it's not about how many times we fall, but how many times we get back up.
