We have a deepteam of first-chair trial lawyers who, together, have tried scores of civil cases toverdict across the country. We win. A law firm built for clients.® Our appellate work is equally effective. In just 22 months, we have argued four times before three federal circuit courts of appeal and twice in state appellate courts. In the Seventh Circuit, we shut down a new theory of liability in asbestos claims. In the second, we successfully argued that a cancer causation opinion was junk science, and the Court of Appeals affirmed a defense verdict for our client. In the Eighth Circuit, we obtained reversal of an order certifying a statewide class involving tens of thousands of individuals who alleged a breach of contract by our client. The trial court in that case was ordered to dismiss the plaintiff’s complaint on remand. Our mass torts group (led by Bob Riley, Ed Casmere, Matt Fischer, and Josh Lee) litigated high-stakes cases across the country. In Missouri, a jury returned a defense verdict for our client after a two-week trial over claims that an alleged exposure to benzene had caused the plaintiff’s cancer. In Wisconsin, we won a federal bench trial for injuries alleged to have resulted from a manufacturer’s use of asbestos decades ago. In the 22 months since our founding, our class actions team (led by Joe Cancila, Greg Curtner, Heidi Dalenberg, Sondra Hemeryck, Jim Gaughan, Nick Kahlon, Jake Kahn, Merili Seale, and Rod Perry) has litigated over three dozen cases, in approximately two dozen different jurisdictions, including six different federal appellate courts. Those cases have involved a broad range of issues, including federal and state antitrust claims, RICO claims, insurance breach of contract, consumer fraud, common law fraud, false advertising, breach of warranty, alleged violations of the Telephone Consumer Protection Act (TCPA), and federal and state securities law claims. We have addressed cutting-edge class action issues, including the application of Rule 23 class certification prerequisites to “issues” classes, how Article III standing requirements apply for members of a certified class in federal court, and how to best protect a class action defendant from oppressive class-wide discovery through scheduling orders and phased proceedings. And we have achieved favorable results for our clients, including the Eighth Circuit’s class certification reversal, dismissal with prejudice of consumer claims against United Airlines challenging its baggage handling practices and ticket cancellation fees, summary judgments in favor of a leading insurance company in cases asserting bad faith claim practices, and dismissals or advantageous settlements of numerous other cases. Our commercial litigation practice (led by Tom Quinn, Jeff Williams, Steve Hankins, Kate Stimeling, Jake Kahn, and Rod Perry) also scored important victories for clients defending their intellectual property in patent actions and upholding their contractual rights in a suit by an aggrieved debt holder. And in a series of actions on the eve of the first World Series championship won by the 4

In the past year, this team (led by Ron Safer, Patricia BrownHolmes, Matt Crowl, Valarie Hays, Dave Resnicoff, Kelly Warner, Ryan Poscablo, and Sandy Musumeci)regularly counseled, defended, and vindicated our clients in what in every instance were quite serious matters.Faced with the prospect of government sanctions in the form of monetary penalties, exclusion from federalprograms, and even incarceration, we brought to bear more than 100 collective years of experience eitherprosecuting or defending public and private companies, corporate executives, and ordinary citizens in similarsituations.Our team represented companies and individuals in a variety of government investigations and prosecutions.Some were witnesses; some were subjects; and some were targets of the investigations. Our cases have involvedallegations of fraud, bribery, racketeering, kickbacks, off-label sales, and a variety of corruption charges. Weoften worked closely with other major law firms representing companies and individuals in those same cases.Over the past year, our internal investigations team has handled some of our most important work. We candescribe a few of our engagements in broad outlines:n Suspecting fraud and other corruption, the FBI raided the home of a CEO of a major long term care company as well as other locations last year. The General Counsel turned to us to manage the immediate crisis, take control of the defense, and conduct a thorough parallel investigation. We found a pattern of abuse by several senior executives, cooperated with authorities, and in the process, contained and stabilized the matter so the Board and management could focus on continuing to provide the highest quality of healthcare. While the criminal case continues, we have filed a civil RICO action, seeking the return of millions of dollars that we believe was looted from our client.n We regularly conduct investigations and assessments in the U.S. and overseas involving allegations of bribery under the Foreign Corrupt Practices Act (FCPA). For instance, in the midst of an investigation by the U.S. Department of Justice for allegedly bribing foreign government officials, a global medical equipment manufacturer retained us to conduct a global and independent assessment of its compliance program and risk under the FCPA. Working non-stop for 60 days in Asia, the Middle East, and Europe, our partners and associates conducted more than 100 face-to-face interviews of our client’s executives and distributors, and 5 rshc-law.com

performed an analysis that the company is relying on in its efforts to reach a favorable resolution with the DOJ. Separately, a Fortune 100 transportation company retained us to investigate potential corruption by its vendor network. And a global shipping company asked us to investigate a distant representative office in which it suspected corrupt activities.n Multiple healthcare companies requested us to conduct efficient, cost-effective, and defensible internal investigations of alleged misconduct by their sales force.n Meanwhile, two major colleges and a nationally prominent university hospital retained us for investigations of hazing, financial misconduct, and abuse allegations.For each of these matters we fielded teams of experienced former prosecutors and criminal defense counsel whoare passionate about defending our clients and achieving the best possible outcomes. At our clients’ direction,we followed the evidence, wherever it led, all over the world.We also represented clients in litigation ancillary to criminal prosecutions. For example, last year, on behalf of ourclient Redflex, we settled a lawsuit with the City of Chicago. Two former company representatives and a City Hallofficial had been convicted on federal corruption charges. Related to the criminal trials, in which we did not play apart, the City sought $360 million in civil damages from Redflex. After months of negotiations, our client settledthe civil action for $20 million, paid out over six years, and was commended by the City for its cooperation in theunderlying investigation.We’ve had ample opportunity to do what we do best: help our clients evaluate, understand, and stop misconductwithin their own organizations, or vigorously and relentlessly mount our clients’ best defense to quite seriouscharges by the government.Two New and Important Practice CapabilitiesOur new Antitrust and Competition Law team is led by our long-time friend and partner, Greg Curtner. Gregfrequently serves as lead counsel in nationwide antitrust disputes and class actions for clients in a wide range ofindustries. Greg is perhaps best known for representing the National Collegiate Athletic Association (NCAA) ina host of challenging matters. He and his team have a broad practice that ranges across federal and state courtsand agencies.Our Business Transactions practice is led by one of the nation’s premier finance and transactions lawyers, JosephMcCoy. Its 13 members offer sound strategic advice for public and private companies on financings, real estatetransactions, and mergers and acquisitions. “All our clients… can rely on RSHC to stand up for them when the heat is on.”n We are pursuing a new trial, based on new evidence, for a former Indiana police officer serving an 80-year sentence for homicide and arson convictions. After a panel of the U.S. Court of Appeals for the Seventh Circuit denied our appeal, we petitioned the U.S. Supreme Court for relief. In a highly unusual statement, three Seventh Circuit judges urged the high court to take this case because of the “unusually strong evidence” of the officer’s innocence.n In April 2016, Ron Safer and a team of RSHC lawyers greeted Eddie Bolden after he was released from prison after serving 22 years for a drug-related murder he did not commit. Safer had worked for six years to win Bolden’s release. Sometimes a photo is all the recognition we’d ever need. Pictured here: Our friend and colleague Eddie Bolden embracing our partner Ron Safer just after Bolden was released from prison.Serving as Special Prosecutorn In July 2016, the presiding judge of Cook County Criminal Court appointed Patricia Brown Holmes as special prosecutor to investigate an alleged cover-up following the police shooting of a 17-year-old in Chicago. After a tape of the incident was released, street protests roiled the city, and authorities filed murder charges against the police officer who shot Laquan McDonald. When Holmes was appointed, she spoke of “the grave responsibility” she had to the public. Thus far, her investigation has led to the indictment of one current and two former police officers on felony obstruction of justice charges for which she has the complete burden of proof at trial. Kelly Warner and Brian Watson, among other RSHC lawyers, are assisting Holmes as the criminal case continues to trial. 13 rshc-law.com
