THE VOICE FOR THE UK’S DISTRICT ENERGY SCHEMESWelcome to another addition of the UK District Energy Journal. I am sure that many of you willbe either heading off or returning from a well earned Summer break by the time that you readthis. Whatever you did we hope that you had a good rest and will return invigorated to attendthe AGM in early September.As you will have seen from the email we have circulated we have raised two questions for youto respond to at the AGM:Session 1 – “What next for district energy”What do you think will be the latest innovation in district energy over the next 5 years – do youhave a product, system, or method of developing schemes or in fact any facet or our sector thatyou think will lead the way or drive innovation or will be extremely important to us over thecoming 5 years? If so, please let us know as we would like to invite the three leading ideas topresent at this year’s AGMSession 2 – “Energising District Energy Schemes to 2030”With the current mixed messages being sent by various bodies regarding the future of gas firedCHP as a technology to deliver carbon savings over the long term as the grid decarbonises, wewould like to discuss this as one of the key issues at this year’s AGM .We would like to invitespeakers to present both on the option of using gas fired CHP, and specifically how they seethe carbon factors evolving and the benefit of CHP over the next 15 years, as well as thosemembers who are involved with technologies or developing schemes which are using thealternative technologies. This includes but is not limited to heat pumps, geothermal, energyfrom waste, biomass and the plethora of other technologies which are being presented by BEISand the GLA as possible future alterative to gas fired CHP as the grid carbon factor reducesover the next decade. We would like particularly hear from members who have been involvedwith or would like to speak about projects where schemes using these alternative energysources have been delivered or are being incorporated and how viability has been achieved ina UK energy market.Talking to a number of members over recent months it is clear that this second question istaxing people the most. As an industry we need to respond to this question because otherwiseif we do not have the answer then the current move towards district energy becomes harder tosupport when we cannot demonstrate viable methods for generating energy for our schemeswhich can compete in the UK energy market, both in terms of cost and carbon content. We allknow how quickly the tide can turn (from seeing what has happened to the PV market) and withdistrict energy still being an emerging energy solution we have to ensure that we can givepotential users the confidence that it is the right choice.I really hope that you decide to come to the AGM and rise to the challenge of either offering tospeak on one of these two key issues or take part in the subsequent debate.Look forward to seeing you there ! ! 2

Innovation LinkOfgem has launched a dedicated service to support businesses looking to offer innovativeproducts and services to the energy sector.As the energy system transforms with new technology, the number of new players in themarket is set to increase dramatically.These people or organisations may not be familiar with energy market rules or where to gofor help.Ofgem’s Innovation Link will provide fast, frank feedback to innovators and help themnavigate the regulatory framework.The service will enable innovators to make more informed choices when developing theirproducts, services and business models. Legal SpotlightCommunal heat - VAT on service charges for metering and billingservices -better together !?This article which focuses on the VAT treatment of additionalrecharges to tenants (for example for metering, billing,maintenance or replacement charges) relating to communal,domestic heat and power supplies.There is a degree of confusion, given that supplies of heat and power for domestic use aregenerally subject to VAT at the reduced rate of 5% rather than the more generallyapplicable rate of 20% for other categories of goods and services.There is little doubt that the supplier of heat and power would usually pay VAT at 20% onbuying-in those services from third parties, so the question becomes are they in turnmaking a single \"composite\" supply of domestic heat and power charged at 5% or multiplesupplies comprising several elements chargeable at different rates?The distinction is heavily fact-dependent. It has been the subject of a considerable amountof Court cases up to European level.To summarise briefly: • Every supply of goods or services is viewed as distinct and independent. • However, a single supply from an economic point of view should not be artificially split. • Therefore it is necessary to focus on the essential features of the transaction. • A \"composite\" supply is no more than a single supply comprising elements which together are to be regarded as constituting the principal supply, albeit that some of them may be regarded as ancillary to it. • The principal element equates to the predominant purpose of the supply. HMRC's view is that for a service to be regarded as an ancillary element of a principal supply, it should not constitute for customers an aim in itself but instead be a means of better enjoying the principal supply. • It is the principal element which governs the rate of tax applicable to that single supply.The fact that separate charges are levied for the individual elements of what, in practice, isa single supply does not result in them being afforded different VAT treatments. Indetermining the overall economic nature of the supply, the relative costs of the elementsmaking it up, whilst not conclusive, is a helpful pointer. It is highly likely that a residentialtenant would regard the supply of heat and power very much as his or her principal aim. Ifthe person supplying the heat and power also charges for metering, billing or equipment,maintenance or replacement, those elements are simply the costs of better enabling thesatisfaction of the tenant's principal aim - supporting that the supply is properly a compositesupply of which the principal element is the supply of heat and/or power. 17

Much the larger part of the price payable for those supplies would relate to the heat andpower.
