เลม ๑๒๗ ตอนท่ี ๔๕ ก หนา ๑ ๒๒ กรกฎาคม ๒๕๕๓ ราชกจิ จานุเบกษา พระราชบัญญัติ การศึกษาแหงชาติ (ฉบับที่ ๓) พ.ศ. ๒๕๕๓ ภมู ิพลอดุลยเดช ป.ร. ใหไ ว ณ วนั ที่ ๑๒ กรกฎาคม พ.ศ. ๒๕๕๓ เปนปท ี่ ๖๕ ในรัชกาลปจ จุบนั พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช มีพระบรมราชโองการโปรดเกลา ฯ ใหป ระกาศวา โดยท่เี ปน การสมควรแกไ ขเพิ่มเตมิ กฎหมายวาดวยการศึกษาแหง ชาติ จึงทรงพระกรุณาโปรดเกลา ฯ ใหตราพระราชบัญญัติข้ึนไวโดยคําแนะนําและยินยอมของ รฐั สภา ดังตอไปน้ี มาตรา ๑ พระราชบัญญัตินี้เรียกวา “พระราชบัญญัติการศึกษาแหงชาติ (ฉบับที่ ๓) พ.ศ. ๒๕๕๓” มาตรา ๒ พระราชบัญญัติน้ีใหใชบังคับต้ังแตวันถัดจากวันประกาศในราชกิจจานุเบกษา เปนตน ไป มาตรา ๓ ใหยกเลิกความในมาตรา ๓๗ แหงพระราชบัญญัติการศึกษาแหงชาติ พ.ศ. ๒๕๔๒ ซึ่งแกไขเพ่ิมเติมโดยพระราชบัญญัติการศึกษาแหงชาติ (ฉบับท่ี ๒) พ.ศ. ๒๕๔๕ และใหใชค วามตอ ไปนแ้ี ทน 96

เลม ๑๒๗ ตอนที่ ๔๕ ก หนา ๒ ๒๒ กรกฎาคม ๒๕๕๓ ราชกจิ จานเุ บกษา “มาตรา ๓๗ การบริหารและการจัดการศึกษาขั้นพื้นฐานใหยึดเขตพื้นที่การศึกษา โดยคํานึงถึงระดับของการศึกษาข้ันพ้ืนฐาน จํานวนสถานศึกษา จํานวนประชากร วัฒนธรรม และความเหมาะสมดานอน่ื ดวย เวน แตการจัดการศึกษาขั้นพ้นื ฐานตามกฎหมายวา ดว ยการอาชวี ศึกษา ใหรัฐมนตรีโดยคําแนะนําของสภาการศึกษา มีอํานาจประกาศในราชกิจจานุเบกษา กาํ หนดเขตพน้ื ท่ีการศึกษาเพือ่ การบรหิ ารและการจัดการศึกษาขั้นพื้นฐาน แบงเปนเขตพื้นท่ีการศึกษา ประถมศึกษาและเขตพนื้ ที่การศึกษามธั ยมศึกษา ในกรณีทส่ี ถานศกึ ษาใดจัดการศึกษาขั้นพ้ืนฐานท้ังระดับประถมศึกษาและระดับมัธยมศึกษา การกาํ หนดใหส ถานศึกษาแหงนนั้ อยูในเขตพ้ืนที่การศึกษาใด ใหย ดึ ระดับการศกึ ษาของสถานศึกษาน้ัน เปน สาํ คัญ ทง้ั นี้ ตามทร่ี ัฐมนตรปี ระกาศกาํ หนดโดยคําแนะนําของคณะกรรมการการศึกษาขน้ั พน้ื ฐาน ในกรณีทเ่ี ขตพน้ื ท่ีการศึกษาไมอ าจบริหารและจดั การไดตามวรรคหนึ่ง กระทรวงอาจจัดใหมี การศึกษาข้ันพนื้ ฐานดังตอไปนี้เพอ่ื เสริมการบริหารและการจัดการของเขตพ้ืนทก่ี ารศึกษากไ็ ด (๑) การจัดการศึกษาข้ันพ้ืนฐานสาํ หรบั บคุ คลทม่ี ีความบกพรอ งทางรางกาย จิตใจ สติปญญา อารมณ สังคม การสอ่ื สารและการเรียนรู หรือมรี างกายพกิ ารหรือทุพพลภาพ (๒) การจัดการศึกษาข้ันพื้นฐานท่ีจัดในรูปแบบการศึกษานอกระบบหรือการศึกษา ตามอธั ยาศัย (๓) การจัดการศกึ ษาข้นั พืน้ ฐานสาํ หรบั บุคคลทม่ี ีความสามารถพเิ ศษ (๔) การจัดการศกึ ษาทางไกล และการจัดการศกึ ษาท่ีใหบริการในหลายเขตพื้นทก่ี ารศึกษา” มาตรา ๔ ใหเ พิ่มความตอไปนเ้ี ปนวรรคหา ของมาตรา ๓๘ แหงพระราชบัญญัติการศึกษาแหงชาติ พ.ศ. ๒๕๔๒ ซึง่ แกไ ขเพิ่มเติมโดยพระราชบญั ญตั ิการศกึ ษาแหง ชาติ (ฉบบั ที่ ๒) พ.ศ. ๒๕๔๕ “ในการดําเนินการตามวรรคหนึ่งในสวนท่ีเก่ียวกับสถานศึกษาเอกชนและองคกรปกครอง สวนทองถิ่นวาจะอยูในอํานาจหนาท่ีของเขตพื้นท่ีการศึกษาใด ใหเปนไปตามที่รัฐมนตรีประกาศ กาํ หนดโดยคาํ แนะนาํ ของคณะกรรมการการศึกษาข้ันพน้ื ฐาน” ผรู บั สนองพระบรมราชโองการ อภิสิทธิ์ เวชชาชีวะ นายกรัฐมนตรี 97
