Majlinda Kelmendi (Judo) World Ranking List position: 1.place (3750 pts) Age:23 (09/05/1991) Majlinda Kelmendi is a Kosovar judoka who competes in the women - 52kg weight division. She is the first Kosovo athlete ever to win a gold medal in the World Championships. Majlinda has won all the possible titles in her category except the Olympic Title. She is the double World Champion, European Champion, World Champion for juniors, Double European Champion for juniors and European Champion U23. Majlinda has won 9 gold medals 2 silver and one bronze medal in the IJF World Tours. She has won also 9 medals from the World Cups/European Open. She competes in the women’s - 57 category. Her best result is the 7th place in the World Championship in Rio de Janeiro in 2013 where she won three fights, one of them with Telma Monteiro, current silver medallist of the World Championship in Russia and multiple medal winner of World and European Championships. Nora has won numerous medals, including two bronze Grand Prix medals, three medals from World Cups/European Open and two medals in European Cups. Her current position in the World Ranking List is 42 place with 298 points. In 2013 her ranking position was amongst the 15 best judoka in the world but after a 9 month absence in judo competitions due to a knee injury she could not keep her position in the Ranking list. We declare Kosovo to be a democratic, secular and multi-ethnic republic, guided by the principles of non-discrimination and equal protection under the law. We shall protect and promote the rights of all communities in Kosovo and create the conditions necessary for their effective partic- ipation in political and decision-making processes. 3. We accept fully the obligations for Kosovo contained in the Ahtisaari Plan, and welcome the framework it proposes to guide Kosovo in the years ahead. We shall implement in full those obli- gations including through priority adoption of the legislation included in its Annex XII, particularly those that protect and promote the rights of communities and their members. 71

We shall adopt as soon as possible a Constitution that enshrines our commitment to respect the human rights and fundamental freedoms of all our citizens, particularly as defined by the Euro- pean Convention on Human Rights. The Constitution shall incorporate all relevant principles of the Ahtisaari Plan and be adopted through a democratic and deliberative process. 5. We welcome the international community’s continued support of our democratic development through international presences established in Kosovo on the basis of UN Security Council res- olution 1244 (1999). We invite and welcome an international civilian presence to supervise our implementation of the Ahtisaari Plan, and a European Union-led rule of law mission. We also invite and welcome the North Atlantic Treaty Organization to retain the leadership role of the international military presence in Kosovo and to implement responsibilities assigned to it under UN Security Council resolution 1244 (1999) and the Ahtisaari Plan, until such time as Kosovo institutions are capable of assuming these responsibilities. We shall cooperate fully with these presences to ensure Kosovo’s future peace, prosperity and stability. 6. For reasons of culture, geography and history, we believe our future lies with the European fam- ily. We therefore declare our intention to take all steps necessary to facilitate full membership in the European Union as soon as feasible and implement the reforms required for European and Euro-Atlantic integration. 7. We express our deep gratitude to the United Nations for the work it has done to help us recover and rebuild from war and build institutions of democracy. We are committed to working con- structively with the United Nations as it continues its work in the period ahead. 8. With independence comes the duty of responsible membership in the international community. We accept fully this duty and shall abide by the principles of the United Nations Charter, the Hel- sinki Final Act, other acts of the Organization on Security and Cooperation in Europe, and the in- ternational legal obligations and principles of international comity that mark the relations among states. Kosovo shall have its international borders as set forth in Annex VIII of the Ahtisaari Plan, and shall fully respect the sovereignty and territorial integrity of all our neighbors. Kosovo shall also refrain from the threat or use of force in any manner inconsistent with the purposes of the United Nations. 9. We hereby undertake the international obligations of Kosovo, including those concluded on our behalf by the United Nations Interim Administration Mission in Kosovo (UNMIK) and treaty and other obligations of the former Socialist Federal Republic of Yugoslavia to which we are bound as a former constituent part, including the Vienna Conventions on diplomatic and consular rela- tions. We shall cooperate fully with the International Criminal Tribunal for the Former Yugoslavia. We intend to seek membership in international organisations, in which Kosovo shall seek to con- tribute to the pursuit of international peace and stability. 10. Kosovo declares its commitment to peace and stability in our region of southeast Europe. Our independence brings to an end the process of Yugoslavia’s violent dissolution. While this process has been a painful one, we shall work tirelessly to contribute to a reconciliation that would allow southeast Europe to move beyond the conflicts of our past and forge new links of regional coop- eration. We shall therefore work together with our neighbors to advance a common European future. 11. The territory of Kosovo is the subject of a dispute between Serbia and the Republic of Kosovo established by the declaration. This was the first case regarding a unilateral declaration of independence to be brought before the court. The court delivered its advisory opinion on 22 July 2010; by a vote of 10 to 4, it declared that “the adop- tion of the declaration of independence of the 17 February 2008 did not violate general international law because international law contains no ‘prohibition on declarations of independence’”:[2] nor did the adoption of the declaration of independence violate UN Security Council Resolution 1244, since this did not describe Kosovo’s final status, nor had the Security Council reserved for itself the decision on final status.[3] There were many reactions to the decision, with most countries which already recognise Kosovo hailing the decision and saying it was “unique” and does not set a precedent; while many countries which do not recognise Kosovo said they would not be doing so as the ruling could set a precedent of endorsing secession in other places. The 2008 Kosovo declaration of independence was adopted on 17 February 2008 in a meeting of the As- sembly of Kosovo.[4] It was the second declaration of independence by Kosovo’s ethnic-Albanian political institutions, the first having been proclaimed on 7 September 1990.[5] 77
APPLICANT KOSOVO OLYMPIC COMMITTEE APPLICATION FILE Serbia decided to seek international validation and support for its stance that the declaration of indepen- dence was illegal at the International Court of Justice. Whether the declaration was in fact an official act of the Provisional Institutions of Self-Government was unclear; in the end, the Court determined it was issued by “representatives of the people of Kosovo” acting outside the normal Provisional Institutions of Self-Government.[6] This was significant, since the Serbian argument was that the Kosovo Provisional Institutions of Self-Government had exceeded the authority given to them by the Constitutional Framework (promulgated by UNMIK). In September 2012, international supervision ended,[7] and Kosovo became responsible for its own governance.[8] Map of the Republic of Kosovo United Nations request On 26 March 2008, the Government of Serbia announced its plan to call on the International Court of Jus- tice to rule on the declaration of Kosovo’s secession. Serbia sought to have the court’s opinion on whether the declaration was in breach of international law. Also, an initiative seeking international support was un- dertaken at the United Nations General Assembly when it gathered again in New York in September 2008.[9] On 15 August 2008, Serbian Foreign Minister Vuk Jeremić officially filed a request at the United Nations seeking opinion of the International Court of Justice.[10] The resolution was worded as follows: The General Assembly, Mindful of the purposes and principles of the United Nations, Bearing in mind its functions and powers under the Charter of the United Nations, Recalling that on 17 February 2008 the Provisional Institutions of Self-Government of Kosovo declared in- dependence from Serbia, Aware that this act has been received with varied reactions by the Members of the United Nations as to its compatibility with the existing international legal order, Decides, in accordance with Article 96 of the Charter of the United Nations to request the International Court of Justice, pursuant to Article 65 of the Statute of the Court to render an advisory opinion on the following question: “Is the unilateral declaration of independence by the Provisional Institutions of Self-Gov- ernment of Kosovo in accordance with international law?”[11] On 30 September 2008, in a trial vote, the Serbian initiative was backed by 120 member states.[12] In the real vote, the United Nations General Assembly adopted this proposal as Resolution 63/3[13] on 8 October 2008 with 77 votes in favour, 6 votes against and 74 abstentions.[14] 78

APPLICATION FILE APPLICANT KOSOVO OLYMPIC COMMITTEE In accordance with the Olympic Charter and the applicable laws and regulations in Kosovo, the General Assembly of the Kosovo Olympic Committee has adopted the following Statutes on …..: STATUTES OF THE KOSOVO OLYMPIC COMMITTEE PREAMBLE The Kosovo Olympic Committee (hereafter the “KOC”), an organization belonging to the Olympic Move- ment, hereby undertakes to respect the provisions of the Olympic Charter and the World Anti-Doping Code and to abide by the decisions of the International Olympic Committee. The KOC undertakes, in accordance with its mission and role at national level, to participate in actions to promote peace and women in sport. The KOC also undertakes to support and encourage the promotion of sport ethics, to fight against doping and to demonstrate a responsible concern for environmental issues. ARTICLE 1: NAME, LEGAL STATUS, JURISDICTION and EMBLEM 1. The name of the association is Kosovo Olympic Committee (hereafter the “KOC”), founded on 27 may 1992 and recognised by the IOC on…. 2. KOC has its seat in Pristina in the Republic of Kosovo. 3. The KOC is the highest sport organisation governing the Olympic Movement in Kosovo. 4. The KOC is a non-governmental and not-for-profit organisation, of unlimited duration, in the form of an association with the status of legal person, which is duly registered at national level and exer- cises its jurisdiction on the territory of the Republic of Kosovo. 5. The KOC may sue or be sued in its own name. 6. The KOC operates in accordance with the Olympic Charter, these Statutes and the applicable laws in Kosovo. 7. The legal representative of the KOC is the President. Any formal correspondence to the KOC shall be addressed to the President and/or Secretary General of the KOC. 8. The assets, incomes and profits of the KOC shall be used exclusively for the purpose and objectives of the KOC and cannot be used to bring direct or indirect profits for any member of the KOC. This provision does not prevent staff members of the KOC from receiving a compensation or a salary as part of their working contract, nor does it prevent a member of the KOC from being reimbursed for justified expenses incurred in the carrying out of their functions. 9. The KOC has its own seal and stamp. 10. The official emblem of the KOC, as approved by the IOC, is as follows: 11. APPLICANT KOSOVO OLYMPIC COMMITTEE APPLICATION FILE ARTICLE 2: MISSION, ROLE, OBJECTIVES and POWERS 1. The mission of the KOC is to develop, promote and protect the Olympic Movement in Kosovo, in ac- cordance with the Olympic Charter. 2. The role of the KOC shall be: a. To promote the fundamental principles and values of Olympism in Kosovo, in particular, in the fields of sport and education, by promoting Olympic educational programmes in all levels of schools, sports and physical education institutions and universities, as well as by encour- aging the creation of institutions dedicated to Olympic education, such as a National Olym- pic Academy, an Olympic Museum and other programmes, including cultural, related to the Olympic Movement. b. To ensure the observance of the Olympic Charter in Kosovo. c. To encourage the development of high performance sport as well as sport for all in Kosovo. d. To help in the training of sports administrators. e. To take action against any form of discrimination and violence in sport. f. To adopt and implement the World Anti-Doping Code, thereby ensuring that the KOC an- ti-doping policies and rules, membership and/or funding requirements and results manage- ment procedures conform with the World Anti-Doping Code and respect all the roles and responsibilities for NOCs that are listed within the World Anti-Doping Code. g. To encourage and support measures relating to the medical care and health of athletes. 3. The KOC has the exclusive authority for the representation of Kosovo at the Olympic Games and at the regional, continental or world multi-sports competitions patronised by the IOC and shall consti- tute, organize and lead its respective delegations at such events and competitions. The KOC shall decide upon the entry of athletes proposed by the respective national federations. Such selection shall be based not only on the sports performance of an athlete but also on his ability to serve as an example to the sporting youth of the country. The KOC must ensure that the entries proposed by the national federations comply in all respects with the provisions of the Olympic Charter. Moreover, the KOC is responsible for the behaviour of the members of its delegations. 4. The KOC is obliged to participate in the Games of the Olympiad by sending athletes. 5. The KOC has the exclusive authority to select and designate the city which may apply to organise Olympic Games or other regional, continental or world multi-sports Games patronised by the IOC in Kosovo. 6. In order to fulfil its mission, the KOC may cooperate with governmental bodies and work to develop and maintain harmonious and fruitful relations with governmental bodies, with mutual understand- ing and respect for the jurisdiction and responsibilities of each entity. However, the KOC shall not associate itself with any activity which would be in contradiction with the Olympic Charter. The KOC may also cooperate with non-governmental bodies. 7. The KOC must preserve its autonomy and resist all pressures of any kind, including but not limited to political, legal, religious or economic pressures which may prevent it from complying with the Olym- pic Charter. 92

The KOC may assist the national sports federations or associations to develop and promote their sport, as well as the athletes in Kosovo, within the framework of the Olympic Charter and the applica- ble rules of the International Sports Federations concerned. 9. To achieve its objectives the KOC shall seek sources of financing in a manner compatible with the Olympic Charter. 10. The KOC may cooperate with other National Olympic Committees. 11. The KOC may establish specific sub-committees or commissions to assist in carrying out its duties and exercising its jurisdiction. 12. The KOC may only use the Olympic symbol, flag, motto and anthem (which are the exclusive prop- erty of the IOC) within the framework of its non-profit-making activities provided such use con- tributes to the development of the Olympic Movement and does not detract from its dignity, and provided that it has obtained the prior approval of the IOC, in accordance with the Olympic Charter. All Olympic properties including but not limited to the Olympic symbol, flag, motto, anthem, iden- tifications (including but not limited to “Olympic Games” and “Games of the Olympiad”), designa- tions, emblems, flame and torches, and all rights to any and all Olympic properties, as well as all rights to the use thereof, belong exclusively to the IOC. The KOC is responsible to the IOC for the observance, in Kosovo, of Rules 7-14 and BLR 7-14 of the Olympic Charter. It shall take steps to pro- hibit any use of any Olympic properties which would be contrary to such Rules or their Bye-laws. It shall also endeavour to obtain, for the benefit of the IOC, protection of the Olympic properties of the IOC. 13. The KOC shall exercise all powers, rights and obligations of an NOC as granted by the Olympic Charter and by the IOC. 93
APPLICANT KOSOVO OLYMPIC COMMITTEE APPLICATION FILE ARTICLE 3: MEMBERSHIP 1. In accordance with the Olympic Charter, the KOC must include as voting members: a. Any IOC member(s) in Kosovo. Such member(s), if any, shall have the right to vote in the general assemblies of the KOC and must be ex officio member(s) of the KOC Executive Board with a right to vote. b. All national federations affiliated to the International Federations governing sports includ- ed in the programme of the Olympic Games. Note: The representatives of these national federations must constitute the voting majority of the General Assembly of the KOC. c. At least two elected athletes’ representatives. These elected representatives must have tak- en part in at least one of the last three editions of the Olympic Games (Note: This require- ment shall apply only after the first participation of the KOC in the Olympic Games). 2. In addition, the KOC may include: a. National federations affiliated to International Federations recognised by the IOC, the sports of which are not included in the programme of the Olympic Games (as voting or non-voting members). b. A limited number of multi-sports groups and other sports-oriented organisations or their representatives, as well as nationals of Kosovo liable to reinforce the effectiveness of the KOC or who have rendered distinguished services to the cause of sport and Olympism (as non-voting members). 3. Qualifications for membership: a. The members and/or the representatives of legal entities members of the KOC shall meet the following conditions: i. Be nationals of Kosovo. ii. Enjoy civil rights and shall not have been convicted of any criminal offense. iii. Be legally constituted and affiliated to the International Federations concerned (for the national federations). iv. Act in accordance with the Olympic Charter, the IOC Code of Ethics, the World An- ti-Doping Code and these Statutes. b. The KOC shall not recognise more than one national federation for each sport governed by an International Federation. c. To be recognised by the KOC and accepted as a member of the KOC, a national federation must exercise a specific, real and on-going sports activity, be affiliated to an International Federation recognised by the IOC and be governed by and comply in all aspects with both the Olympic Charter and the rules of its International Federation. d. Government or other public authorities shall not designate any members of the KOC. e. A member expelled from the IOC may not be a member of the KOC. f. The members of the KOC, except for professional sports administrators, shall not accept any compensation or bonus of any kind in consideration for their services or the perfor- mance of their duties. They may be reimbursed for their travelling, accommodation and other justified expenses incurred in the carrying out of their functions. 4. Application for membership: a. Any application to become a member shall be submitted in written to the KOC Executive Board for consideration and, if the applicant meets the requirements of these Statutes, for submission to the next General Assembly for review and decision. 94

The application file shall meet the requirements established by the KOC according to these Statutes and include all necessary supporting documentation. c. Honorary membership may be granted by the General Assembly (upon proposal by the Ex- ecutive Board) for persons who have given exceptional contribution to the Olympic Move- ment and sport in Kosovo. 5. Rights and duties of the members: a. Voting members shall have the right to vote, to elect, to be elected and to nominate mem- bers for election in the elected governing bodies of the KOC. b. Non-voting members may attend the meetings of the General Assembly with a right to speak only. c. Members have the right to be regularly informed of the activities of the KOC and have the duty to regularly inform the KOC of their own activities. d. Members may benefit from support and assistance of the KOC to develop their activities, if necessary and if requested, and subject to the jurisdiction, possibilities, means and deci- sions of the KOC. e. Members shall actively participate in the work, meetings and activities of the KOC. f. Members must respect and implement the decisions / resolutions made by the KOC gov- erning bodies. g. Members must act in accordance with the Olympic Charter, the IOC Code of Ethics, the Statutes of the KOC and (for legal entities) their own rules and regulations. h. The National Federations shall work closely together with the KOC, in particular for the preparation and selection of the Kosovo athletes in the Olympic Games and at the regional, continental or world multi-sports competitions patronised by the IOC. i. Members shall exercise any other rights and duties in accordance with these Statutes and the Olympic Charter. 6. Cessation of membership: a. A member may cease to be a member in case of: i. Death; ii. Resignation; iii. Loss of capacity; iv. Loss of qualifications for membership; v. Dissolution of the federation / association; vi. Upon expulsion, if the member has breached the Olympic Charter and/or these Statutes. 7. Measures and sanctions: a. When a member has failed to fulfil its duties and tasks, has infringed the Olympic Charter and/or the IOC’s Code of Ethics and/or the KOC Statutes or has not respected nor imple- mented the decisions / resolutions of the competent governing bodies of the KOC, the member may be subject to the following measures and sanctions (depending on the grav- ity of the facts and the level of damage or infringement): i. Warning ii. Suspension iii. Expulsion 95
APPLICANT KOSOVO OLYMPIC COMMITTEE APPLICATION FILE b. Decision to pronounce a warning shall be made by the Executive Board after having given an opportunity to the member concerned to be heard. The Executive Board shall report accordingly at the next meeting of the General Assembly. c. Decision for a suspension or an expulsion of a member shall be made by the General As- sembly and after having given a reasonable opportunity to the member concerned to be heard. Such decision shall be made by a majority of at least two-thirds (2/3) of the votes cast by the voting delegates present at the General Assembly. 8. Register of members: A register of members must be established and kept regularly up-to-date under the responsibility of the Secretary General. This register shall, in particular, include the following information: member’s name and address; date of membership (and copy of the decision / minutes of the General Assembly at which the membership was granted); category of membership; membership status. This register shall be available at any time and shall, in particular, serve as reference to convene the meetings of the KOC. ARTICLE 4: GOVERNING BODIES The governing bodies of the KOC shall be as follows: 1. The General Assembly, which is the supreme decision-making body of the KOC. 2. The Executive Board, which is the executive and management body of the KOC. 96

Those representatives authorised by each federation shall be active members of the executive body of such federation (including, if possible, the Presi- dent of such federation). In accordance with the Olympic Charter, these federations / representatives must constitute the voting majority of the General Assembly. iii. One representative from the national federations affiliated to International Feder- ations governing sports which are not included in the programme of the Olympic Games, which are members of the KOC, with one vote each. Those representatives authorised by each federation shall be active members of the executive body of such federation (including, if possible, the President of such federation). iv. Two athletes’ representatives (if possible, one male and one female) elected by the KOC athletes’ commission established in accordance with the IOC guidelines or by the General Assembly, with one vote each. These elected representatives must have taken part in at least one of the last three editions of the Olympic Games (Note: This requirement shall apply only after the first participation of the KOC in the Olympic Games). v. Other members in accordance with Article 3.2.b. of these Statutes, without voting right. vi. Honorary members of the KOC, without voting right. 2. Powers of the General Assembly: a. The General Assembly is the supreme governing body of the KOC. b. The General Assembly shall have the following powers: i. Adopt the agenda of the meeting and the minutes of the previous meeting. ii. Determine and approve the strategic plan and general policies of the KOC. iii. Hear, examine and approve the annual report of activities of the KOC presented by the KOC Executive Board and hear, examine and approve the objectives and action plan for the following year proposed by the Executive Board. iv. Examine and approve the audited financial statements of the preceding year and examine and approve the annual budget for the following year proposed by the KOC Executive Board. v. Elect the members of the Executive Board. vi. Elect the members of the independent election commission established for the elec- tive General Assembly. vii. Elect the auditor which shall review the KOC financial statements annually. viii. Approve or reject the affiliation of any members to the KOC. ix. Decide upon the suspension or expulsion of any member of the KOC (by decision taken by at least two-thirds (2/3) of the votes cast by the voting delegates present at the General Assembly). x. Define the membership fees, if applicable. xi. Accept any financial or material assistance or donations in accordance with these Statutes. 97

Consider and adopt these Statutes and any further amendment to these Statutes (by decision taken by at least two-thirds (2/3) of the votes cast by the voting delegates present at the General Assembly). xiii. Consider and approve any additional bye-laws or internal regulations proposed by the Executive Board, which are not in contradiction with these Statutes and the Olympic Charter. xiv. Interpret these Statutes (subject to the applicable rules of the Olympic Charter) as the case may be. xv. Decide on the dissolution of the KOC (in the presence of a quorum of at least two- thirds (2/3) of the voting members and by decision taken by at least two-thirds (2/3) of the votes cast by the voting delegates present at the General Assembly). xvi. Exercise any other powers as per these Statutes. xvii. In general, decide on all matters on its agenda and on any matter which is not pro- vided for in these Statutes, as the case may be, and subject to the Olympic Charter. 3. Meetings of the General Assembly: a. The General Assembly must meet in ordinary session at least once a year. The date of the meet- ing shall be decided by the Executive Board. b. The General Assembly shall be convened by notice signed by the President and sent to the mem- bers at least thirty (30) days prior to the date of the meeting, indicating the date, time, place and agenda of the meeting and including all necessary documents. c. The General Assembly can validly act on the items appearing on its agenda. Proposals from the members concerning the agenda must reach the President and/or the Secretary General no later than twenty-one (21) days prior to the date of the meeting. If any modifications have to be done in the agenda, the final agenda shall be communicated to the members no later than fifteen (15) days prior to the date of the meeting. d. An extraordinary meeting of the General Assembly may be convened whenever it is necessary at the request of the President, and/or the Executive Board and/or at least half (50%+1) of the voting members of the General Assembly, following the same procedure and deadlines. e. The meetings of the General Assembly shall be chaired by the President. In the absence or in- capacity of the President, the First Vice-President (or in the absence or incapacity of the First Vice-President, the Second Vice-President, or in the absence or incapacity of both, the Third Vice-President etc.) shall chair the meeting. f. Unless otherwise stated in these Statutes, the quorum required for a General Assembly is at least half (50% +1) of the voting delegates, including a voting majority of the Olympic sports federa- tions delegates. If this quorum cannot be reached the meeting shall be adjourned seven (7) days later. If the quorum is still not reached at this second meeting, the meeting will take place provid- ed that at least one-third (1/3) of the voting members are present, including a voting majority of the Olympic sports federations delegates. g. Unless otherwise stated in these Statutes, decisions shall be taken by the General Assembly by at least half (50% +1) of the votes cast by the voting delegates present. h. In case of tie, the Chairman of the meeting shall have a casting vote. i. Voting shall be conducted by open or secret ballot as decided by the General Assembly, except for election of members or sanctions against members where the vote shall be conducted by secret ballot. j. Voting by proxy is not allowed. k. The voting majority of the General Assembly must always consist of the votes cast by the del- egates of the national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games. l. In addition, when dealing specifically with questions relating to the Olympic Games, only the votes cast by the delegates of the national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games are taken into consideration. m. Elections of the members of the Executive Board must take place every four (4) years, within 6 months following the Summer Olympic Games, during a meeting of the General Assembly which 98
APPLICATION FILE APPLICANT KOSOVO OLYMPIC COMMITTEE must include this point on its agenda. n. Elections shall take place according to the procedure mentioned in these Statutes. o. Copies of the minutes of the meetings at which elections or replacement of members have taken place shall be sent to the IOC. All documents must be certified as true copies by the President and Secretary General of the KOC. p. The Secretary General (or in his/her absence a member of the Executive Board or General As- sembly designated by the Chairman) is responsible for establishing the minutes of the meetings of the General Assembly. The minutes shall be circulated to all members within thirty (30) days following the meeting. 4. Election procedure for the members of the Executive Board: The procedure for elections shall be as follows: a. At the General Assembly preceding the elections, the General Assembly shall elect an indepen- dent election commission which shall be fully responsible for developing, monitoring and con- ducting the election process as a whole (from the receipt of the nominations to the proclama- tion of the final results). This independent election commission shall be composed of three (3) members, including a Chairman, and two (2) substitute members (if necessary). None of these members must be candidate. They must be independent and neutral, have a legal background and have no conflict of interest with the elections. b. Nomination forms shall be sent to all the voting members of the General Assembly no later than thirty (30) days prior to the elections along with the notice of the meeting. c. Nominations may be submitted to the independent election commission by any voting members of the General Assembly no later than fourteen (14) days prior to the elections. d. The independent election commission shall review the nominations received and shall notify the voting members of the General Assembly of the names and brief background of the eligible can- didates no later than ten (10) days prior to the elections. Any potential objection/appeal from any voting member shall be filed to the independent election commission no later than eight (8) days prior to the elections. The independent election commission shall review the objection/appeal and make decision no later than six (6) days prior to the elections and, in this case, shall inform all the voting members accordingly. In case of any doubt as to the eligibility or the non-eligibility of a candidate, the independent election commission shall refer the case to the General Assembly for final decision of the General Assembly before proceeding with the elections. e. Elections shall be conducted position by position and by secret ballot. f. The independent election commission shall prepare a transparent ballot box and all ballot pa- pers to be given to the voting delegates of the General Assembly. g. The independent election commission shall explain the election procedure and answer or clarify any questions before starting the election procedure. h. Once all voting delegates present have been invited to vote by the independent election commis- sion, the independent election commission shall open the ballot box and count the votes publicly. i. If there is one or two candidate(s) for a position, the candidate obtaining 50 % + 1 of the votes validly cast shall be declared elected. j. If there are more than two candidates and none of them obtains at least 50% + 1 of the votes val- idly cast in the first round, there shall be a second round between the two candidates obtaining the highest number of votes validly cast in the first round. In this second round, the candidate obtaining 50 % + 1 of the votes validly cast shall be declared elected. k. The independent election commission shall declare the results of the elections and shall deal with and make decision on any issue/objection which may be raised by any voting delegate be- fore the closing of the General Assembly meeting. l. Both genders shall be represented on the Executive Board. m. As mentioned in the Olympic Charter, the elected representatives of the national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games must constitute the voting majority of the Executive Board. 99
APPLICANT KOSOVO OLYMPIC COMMITTEE APPLICATION FILE ARTICLE 6: EXECUTIVE BOARD 1. Composition of the Executive Board: a. The Executive Board shall consist of the following voting members elected by the General As- sembly: i. President ii. First Vice-President iii. Second Vice-President iv. Third Vice-President v. Fourth Vice-President vi. Not more than 10 members, including at least one athletes’ representative elected by the KOC athletes’ commission or by the General Assembly b. The IOC member(s) in Kosovo, if any, is (are) ex-officio member(s) of the Executive Board with a voting right. c. Out of these 15 elected voting members of the Executive Board, the representatives of the national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games must always constitute the majority of the Executive Board. d. The Secretary General and the Treasurer shall be professional administrators (with a working contract) who shall demonstrate appropriate qualifications and skills to exercise those func- tions properly. They shall be appointed (and terminated/dismissed) by the Executive Board upon proposal of the President. They shall attend the meetings of the Executive Board with right to speak but without right to vote. e. The President and Secretary General shall meet the following conditions: i. He/she shall be a citizen/national of Kosovo. ii. He/she shall hold a University or High School or similar degree. iii. He/she shall have a minimum experience in the Sports Movement and knowl- edge of the Olympic Movement. iv. He/she shall be able to speak at least one of the IOC official languages (English or French). 2. Term of office for the elected members of the Executive Board: The members of the Executive Board shall be elected for a term of office not exceeding 4 years, as per the election procedure established in these Statutes. They may be eligible for re-election (pro- vided, of course, that they still meet the eligibility requirements). 3. Vacancies: a. A member of the Executive Board shall cease to be a member of the Executive Board in case of: i. Death. ii. Resignation. iii. Unjustified absence in three (3) consecutive meetings of the Executive Board. iv. Dismissal or exclusion by decision of the General Assembly by a majority of at least two-thirds (2/3) of the votes cast by the voting delegates present at the General Assembly after having given a reasonable opportunity to the member(s) concerned to be heard by the General Assembly. 100
