WELCOME APACHE WELLS RV RESORT It is a pleasure to have you join our community. The management and staff are committed to providing you with quality service and hope your stay with us will be an enjoyable one; creating many lasting memories and making many new friends. We hope you will enjoy the many events, classes and activities available for your enjoyment. Our activities depend on many volunteers and we thank them for their many hours of community service. The many wonderful guests and staff together; make Apache Wells RV Resort the wonderful commu- nity that it is today ! The following Policies and Guidelines are intended to make living at Apache Wells RV Resort comforta- ble by promoting the safety, well being and quiet enjoyment of each guest. They also set guidelines for the ap- pearance of individual RV’s and Resort homes and the site they occupy, thus helping preserve the value of each guests’ property and the resort. The Resort reserves the right to amend the Policies and Guidelines as the needs of the Resort and guests change. These Policies and Guidelines will be enforced consistently, fairly and equally with reasonable notice to correct violations. Apache Wells RV Resort reserves the right to terminate or refuse renewal in the event there have been infractions of these Policies and Guidelines. This includes home site care, architectural stand- ards and conduct by guests and /or their visitors that interferes with the safety, quiet and enjoyment of the re- sort. All Resort recreational and/or common area facilities, amenities, and activities are subject to change, re- placement, closure (temporary or permanent), modification, renovating, remodeling and/or replacement at any time, without any change or reduction in the rent that residents pay. Resort Management reserves the right to restrict or change the use of any facility as to existence, hours, purposes and conduct, in Managements sole dis- cretion. The rent paid by residents pays for a home site on which the residents recreational vehicle or park model unit may be installed, with the required utility outlets supplied by landlord under applicable law. Such rent does not guarantee use of any facility or attendance at any activities. REGISTRATION /RESERVATIONS Minimum Age Policy: Apache Wells RV Resort is a Resort community for persons age 55 and older. A sec- ond person occupying a site must be a minimum of 40 years of age. Arrival-Registration: All guests must register in Guest Services office. Courtesy Patrol & Resort Rangers will escort you to your site. ANNUAL reservations will be required to furnish a copy of their title and proof of insurance. Check Out Time: 11:00 AM. Please notify Guest Services of your departure in order to make arrangements for any unpaid charges for rent and final electric. Return your post office key to the Post Office and badges to Guest Services. Note: All guests must notify the Post Office to have mail forwarded. Badges: A CURRENT Name Badge must be worn at all times when using the amenities or facilities as a means of identification. Persons who are not wearing a current badge may be asked to leave the facilities. There is a $10.00 charge for replacement Annual badges. Occupancy: All rates are based on a maximum of two (2) persons per site. There is a charge for any additional person and they must be registered with Guest Services. Rents Are Payable In Advance For The Time Reserved: Your site is guaranteed for the period of time you paid for at the time of registration. Annual reservations have first priority. Owners of permanently set Resort Homes must pay the current annual rate each year on or before the anniversary date. Rent Late Charges: If rent is not received within 6 days after the date it is due, a late charge of $5.00 per day from your original due date for each day thereafter that the account remains unpaid will be charged. NSF RETURNED CHECKS FEE - $25.00 Reservations: We will accept reservations for daily, weekly, monthly, seasonal and annual periods. The ap- propriate deposit will hold the reservation. For Monthly reservations the required deposit is $250.00. Daily and weekly reservations must be paid in full at the time the reservation is made. The deposit guarantees you a site but not a particular site number. The rent will begin the first day of the reservation, not the first day of your arrival should it be later. Site Rental Site Priority: Annual r esor t home site r eser vations have fir st pr ior ity of site choice. If ther e is a request to place a resort home/annual reservation on the site you are occupying, you will have the choice of either placing a resort home on the site with an annual reservation or moving to another site. All monthly reservations will be moved for a resort home annual reservation request. Refund Cancellation Policy: Refunds for a month or longer reservation will be issued only if a written can- cellation notification is received 30 days prior to the scheduled time of arrival. A $50.00 processing fee will be assessed on all refunds. Once the cancellation has been made and the RV removed from that site, the site reverts back to the resort. Post Office keys and badges must be returned at this time. There will be no refunds on a previ- ously paid electric bill. Final electric bills where applicable, must be paid. Annual guests who wish to cancel their reservation must give 30 days written notice by completing an “Intent to Vacate” form obtained from Guest Services. No Refunds for Late arrival or early departures for January, February, and March. No Refunds are issued for Daily or Weekly reservation deposits or rents. No refunds are issued on Daily or Weekly reservations. NO EXCEPTIONS. Visitor Policy and Fees: Rent is based on a maximum of two (2) persons per home or RV. Your overnight visitor(s) using any of the facilities including children must be registered in Guest Services upon arrival. They will be issued a name badge which is to be worn at all times while using any of the facilities. A visitor host must accompany all visitors in any of the facilities; regardless of age. Visitors may stay up to 2 weeks per visit. Resi- dents are responsible for the actions and conduct of their visitors. Visitors are allowed only when the owner is residing at the unit. Visitors will be charged the visitor fee of $3.00 per day per person , $15.00 per week plus tax. Annual residents are allowed two (2) visitors total to stay free of charge for a maximum of two weeks each year. All visitors are limited to a total of 2 weeks per visit per year in which they may stay at Apache Wells RV Re- sort. Visitors staying longer than 30 days must have management approval and complete the annual resident re- quirements. and are subject to be charged the posted rental rate. 6

Visitor Policy and Fees Cont’d: Cal-Am Properties patios, happy hours, and certain activities, are for ex- clusive use of it’s residents. Authorized residents are allowed a limited visit by a guest twice per season (a maxi- mum of two (2) visits by the same guest each season across all Cal-Am Resort properties). The same guest may not be sponsored by other residents or other Cal-Am Resort properties, if the guest has already visited two times for the season. The visiting guest may be warned upon the second visit that future events may not be attended, and upon the third visit, the guest may be required to leave. If the guest refuses to leave , police will be called and the guest will be prosecuted for trespassing under ARS 13-1501, 13-1502, 13-1504, or common law. PET POLICIES 1) Pets are allowed in Apache Wells RV Resort. All Pets must be registered with Guest Services, includes current vaccination records, pet agreement and assistive animal documentation. 2. Size and weight limits: Presently none. Number of pets allowed two (2). 3) Pets are to be in the presence and control of the owner or responsible person at all times. Guest agrees to keep the pet (s) inside the RV or Resort home unless on a leash. Pets are not to be left unattended. Outdoor kennels, fencing or other enclosures may be approved by Resort management, and are not permitted to be left on the site when not in use. 4) One PET AREA has been provided in the resort and is for the enjoyment of you and your pet. (See the re- sort map for location). PLEASE walk briskly or drive your pets to the pet area. Please don’t allow your pet to meander onto your neighbors site or on the vacant sites on the way to the pet run. Pets must be supervised in the pet runs and relief areas and you must always pick up after your pet. 5) Pet Droppings: Carry appropriate means for cleaning up the pet’s droppings and pick up immediately. (Doggie bags are provided at the pet runs and relief areas for your convenience) 6.) Pets are not to invade the privacy of any other guest’s site or must not interfere with other guests’ peaceful enjoyment of the resort such as: excessive barking, aggressive behavior etc. Pets are not allowed in or near the common areas of the Resort including the grass areas. 7) The guest agrees to be responsible for the pet (s) and to immediately reimburse the RV Resort and or any other guest or any other persons for any damages caused by the pet (s). In any event the guest expressly agrees to in- demnify and hold harmless the management and owner of this RV community of any and all liability or claims of liability arising in connection with the pet (s) including attorney’s fees. . 8) If pet (s) is/are loose on premises, guest agrees that management may but is not obligated to retrieve and return it to the guest, or cause appropriate officials to impound it. Guest agrees to indemnify management and owner for any damages or expenses it may incur carrying out any of these foregoing options. 9) Guest agrees that if any violation of the Pet Guidelines is observed or another guest makes a valid complaint, the pet (s) owner will receive an official written warning to correct the problem, remove the pet (s) or vacate the Re- sort. If a second violation is noted or a second valid complaint is received, the pet (s) owner will receive notice to vacate for behavior in violation of the Pet Guidelines. 10) Guest certifies that pet (s) vaccinations are current and will be kept current for the duration of stay in the Re- sort. Guest certifies that pet (s) is/are licensed with the proper authorities. 11) The following breeds are NOT permitted: Chow, Rottweiler, Staffordshire Terrier (Pit Bull) or any mix con- taining these breeds. Restr icted br eed Ser vice dogs must supply paper s of authenticity. Therapy dogs do not qualify as a service dog. 12) Guest will be required to sign an agreement of understanding of the resort pet policies and list identification information of their pet (s). 13) Please do not feed stray animals, including cats and birds. Hummingbird feeders are allowed. 7

AMENITIES & SERVICES ACTIVITIES: The Guest Services Office and Activities Committee coordinate hundreds of events during the season. Information on events are available in the monthly Newsletter and posted throughout the Resort for all events and activities. For events and for booking room reservations for private parties, please come to the Guest Services Office. (Bookings and Events are subject to Management and/or Activity Board approval; applicable fees may apply). Activities Available: See our event schedule for a glimpse at everything this season. Volunteers: Volunteers donate their time and effort because they enjoy being a volunteer and making a contri- bution to a community, or helping out their neighbors and friends. A volunteer is not compensated for the work performed. Recognition and being appreciated is compensation enough for true volunteers. All volunteers must be registered with the Activity Office. Captains, supervisors and coordinators will maintain a record of hours contrib- uted by each volunteer. We APPRECIATE our volunteers and recognize them for their support, effort and dedi- cated time to the community in which they live. The community is a better place because of our volunteers! Vol- unteers Give From The Heart. Everyone has a special talent that can be of help, so if you would like to get in- volved, please stop by the Gest Services Office and sign up. COURTESY PATROL: Roving patrols are on duty at various times during the day and night. However, they are not on duty 24 hours a day, 365 days a year. Please use common sense and take precautionary measures to assure your personal safety and protect your belongings by locking your doors, windows, sheds, bicycles, etc. Report suspicious situations FIRST to the police, and THEN to Guest Services. FAXES / COPIES: Faxes/copies may be done at the Guest Services Office. WATER / ICE: Vending machines are located by the Laundry Room. GATES: The Main entrance is open year round. LAUNDRY FACILITIES: The laundry facilities are card operated machines and are open DAILY 6 AM—9 PM during the entire year. Laundry cards are purchased and refilled at the Guest Services Office. MAIL: is centrally located in the Main Complex. This is a mail drop and pickup location only. Certified, registered, priority packages and stamps are not sold at this mail drop and pickup location, see a local Post Office for these services. Mail is picked up and deposited in assigned locked mailboxes ever y day except Sunday & Holidays. The mail office window will be open from 2-4 PM, Monday –Friday, during the fall and win- ter season. Upon checking in/out Guest Ser vices will issue a mailbox key for all RV sites when checking you in for your stay. Upon checking out you must return your mailbox key as part of your check out process. There will be a $30 lock change fee added to your final site and utility billing if the mailbox keys have not been returned to guest ser- vices prior to your departure date. Park home owners are required to check in and out the same as RV sites, howev- er it is only necessary to return mailbox keys at the time of sale or transfer of the unit. The mail room window is manned from 2-4 PM daily Monday – Friday for your convenience. We will receive packages at this location and will notify you by placing a slip in your mailbox for pickup if the parcel is to large for the mailbox. To speed up delivery of packages please be sure to use the correct address and site number, most delivery services will deliver to your site when doing this; Your Name 2656 N. 56th Street, Site #_____ Mesa, AZ 85215-1309 PROPANE: Please contact Guest Services for information on local propane companies servicing the Resort. Note: Fire Ordinance does not allow propane bottles to be filled in the resort.. They will pick up your tank and leave a replacement one. The propane bottles must be on concrete blocks and must be secured with a chain to pre- vent tipping. Residents must comply with all state and local requirements for use of propane on resort property 8

SWIMMMING POOLS & HOT TUBS:  Please read & follow the posted guidelines at each pool & hot tub  Note: AZ law states No one under the age of 16 is allowed in the Hot tubs.  The pools are open daily 24 Hours a day. You must shower pr ior to enter ing the pool and after apply- ing suntan lotions which cause chemical imbalances.  The Pool Temperature: The pool is heated all year to a safe temperature per Maricopa County Health De- partment. The temperature is maintained at 84 +/- 86 degrees but will vary due to outside temperatures.  Children under the age of 18 years of age are allowed to swim with the responsible resident during the hours of 11 AM to 2 PM in East pool unless a resort activity is planned.. Babies in diapers and children not potty trained are not allowed in the pool without proper disposable swim pants, i.e. Huggies Little Swimmers.  Name badges: Your CURRENT name badge must be with you and r eadily available for identification when using the pool.  Swimwear: Appr opr iate swimwear must be wor n at all times. Speedo wear and thongs ar e not allowed. TRASH COLLECTION: Trash pick up days from May- October are on Thursday. The Recycle bin is picked up on Fridays May-October. In our busy season November-April trash will be picked up on Mondays and Thursdays. The Recycle bin will be picked up on Tuesdays and Fridays November-April. The recycle bin is located by the maintenance buildings on Sites 7 and 8. Trash is to be in a tied bag and placed in the trash can at your site. No loose trash. Your trash bin should be placed curbside per map instructions (with the handle facing away from the street) by 6 a.m. Within 24 hours, you MUST pull your trash bin back in from the curb after it is emptied. If you have large items such as furniture, appliances, etc., you will need to make separate arrangements to have it hauled away. The nearest land- fill is Highway 87 and Gilbert Road. The Dumpster next to the Dog Park is for MAINTENANCE USE ONLY. UTILITIES: The Resort furnishes water service to all sites. Trash and sewer charges apply to all occupied RV sites 30 days or more and all annual home sites. Trash: $20.22/MO Sewer: $9.43/MO Note: Utility charges once received can be combined in one check payable to Apache Wells RV Resort. Electric, trash and sewer services for daily and weekly rentals are included in the rent. All monthly and annual guests will be billed monthly for electric usage. The Salt River Project E-23 Residential Rate; including applicable customer charges and taxes, is used to compute electric billing. Rates are subject to change without notice. NOTE: All utility invoices are due upon receipt and are considered delinquent after the 10th of the month. UPGRADES : Resident (s) or commercial service companies are not to make any upgrades or repairs to the elec- tric service without prior Management approval. PLEASE CALL Guest Services for any needed repairs. If you call for an outside electrician or plumber it will be your responsibility to pay for the services. NOTE: Replacement of 50AMP breakers on annual sites is the responsibility of the annual resident. Apache Wells RV Resort strongly recommends that all residents with RVs or park models install a surge protector designed for their type of RV or park model. This recommendation is for the protection of the electrical system in your home or RV. The resort will not be held responsible for any damage to your elec- trical system, regardless of cause. Generator use is not permitted in the resort unless permission is given by resort manager. 9

RESORT GUIDELINES Age/Condition of RV’s and Resort Homes: Management reserves the right to refuse any resort home or RV based on age, condition and length. The vehicle or home must be fully self-contained, well kept, less than 10 years old, and in good condition. There are some exceptions that are at the discretion of management. The only type of RV’s accepted in Apache Wells RV Resort are motor homes, travel trailers, 5th wheels and park models, NO excep- tions. All units must be a minimum of 22 Ft. in length excluding the tongue. Bicycles & Golf Carts are both to observe the same traffic patterns as motorists. Bicycles: It is strongly recom- mended that bicycles have the proper reflectors and that the rider wear helmets. Bicycles must have both the appropri- ate front and rear lighting when riding at night. It is highly recommend that you lock your bicycle with a secure chain and lock for safe keeping. Golf Carts: For safety reasons, children under the age of 16 are not allowed to operate. Only licensed drivers should be driving a golf cart within the resort. The golf cart must have proper lighting for night driving . Driving/Walking Through Sites: Driving through vacant sites is not permitted. Any damage to utilities will be billed to the person responsible. Please do not walk through other guests’ occupied sites. Home Site Maintenance: The home site and patio are to be free of weeds and overgrown shrubs, clutter, un- sightly items, loose items such as boxes, trash containers, overstuffed couches or chairs, appliances, hanging laundry, additional trash containers (other than the one provided by the Resort) and unattached large canopies. RV sites, one EZ Up canopy will be approved by management, a signed approval is required. Please see Guest Services to obtain a “Canopy Document”. Canopy needs to be a 10’ x 10’, Tan/Brown/Beige/ or other neutral earth tone color shade. When you leave your home for an extended period of time, please make arrangements for a caretaker. If it becomes necessary for the resort staff to clean up your site, a charge of $20.00 per man hour (minimum $60.00) will be charged and billed to you. * It has been recommended by Mesa Police Dept. that when you leave for the summer you do not put up ropes or chains across the driveway or aluminum on the windows. Resort Employees of Apache Wells RV Re- sort are prohibited from performing tasks for individual guests except in emergencies and /or specifically authorized by Management. Please see Guest Services for more details. Home & Site Improvements: All site and resort home improvements require Management approval. Please see the Architectural Guidelines section of this booklet. Yard/Patio Sales are not permitted except during Resort wide approved events which are typically held twice a year. Check with Guest Services Office for dates. Parking On The Street: All vehicles must be removed from the street by 10PM. Street parking during the day is permitted for short term only. Parking must not create a hazard or impede emergency vehicles. Registered guests may get a special parking permit from Guest Services to park at the East or West ends of the main complex only based on availability. Overnight Parking at Main Complex is not permitted. Proper identification of vehicles will be required. All others will be towed at owner’s expense. Be A Good Neighbor: To park in another Guests’ site requires written permission from that Guest, and it must be on file with Guest Services. With permission, you may park a car, pickup or van type vehicle. RV’s and trailers are NOT permitted. Please do not drive or walk through your neighbors site that is occupied. NOTE* Driving through vacant sites could damage underground utilities. Guest Parking and Additional Vehicles: The driveway area on each home site is the designated parking area for vehicles. This is the only area to be utilized for vehicle parking. This area is designed to accommodate up to two vehicles. If the guest chooses to construct a room addition or shed in this area, it is that guest’s responsibility to make arrangements for parking of vehicles in accordance with these guidelines or park any additional vehicles off property. Parking at Community buildings parking areas is for guests and visitors only. Overnight parking is not permitted in these areas unless a special overnight parking permit has been obtained from Guest Services. Vehicles in violation of this guideline are subject to towing at the owner’s expense. All vehicles parked or stored in Apache Wells RV Resort must be currently licensed, registered, operable and may not be in unsightly condition. All residents and guests must have a current resident resort vehicle ID sticker, vehicle ID hang tag for the rear view mirror or a dash- board vehicle pass. 10

Parking Towed Vehicles: RV’s towing enclosed cargo trailers may park the trailer on the site only when they fit properly and do not infringe proper vehicle parking. Cargo trailers will not be allowed to park on resort home (park model) sites. No open trailers are allowed with one exception, one trailer of a size and type to haul one ATV type vehicle will be permitted on an RV site if it does not interfere with the proper parking of other registered vehicles on that site. No boats, utility trailers, or open trailers with items stored on them, are to be parked on any site. No Exceptions. Vehicle Loading or Unloading: A temporary parking spot may be assigned if available, but must be au- thorized through Guest Services. Under no circumstances may a vehicle be parked in such a way that will block the street or impair the passage of any emergency vehicles. No vehicle of any type may be parked or stored on a vacant home site. Vehicles in violation of this guideline are subject to towing at the owner’s expense. Quiet Time: Please observe quiet time and keep noise to a minimum between the hours of 10:00 PM and 7:00 AM. Rules Posted: Guests and their Visitors must observe all rules posted by management at facilities in the resort. All posted rules shall be considered a part of these Resort Guidelines. Soliciting: Soliciting is not permitted in the Resort. If you see someone soliciting, please call Guest Services or Courtesy Patrol so that appropriate action may be taken. Trees / Citrus Fruit: You may only harvest citrus fruit from the tree located on your home site or from a vacant home site. DO NOT harvest fruit from any home site, whether Resort Home or RV; without permission from the guest. Businesses: Operating a personal/commercial business within the boundaries of Apache Wells RV Resort RV Resort is prohibited. Weapons / Dangerous Instruments: The use of weapons, including but not limited to BB guns, air guns, sling shots, bow and arrows are NOT permitted in Resort public areas. SELLING, BUYING AND RENTING RESORT HOMES & RV’s 1) Resort Site Evaluations must be completed by Resort Management for any RV or Resort Home that is intended to remain in Apache Wells RV Resort prior to the sale. The evaluation is based on current setback re- quirements. NOTE To “Grandfather” an existing code violation is not possible if it was a violation of the City of Mesa Building Code at the time the improvement was made. The seller must correct any violations prior to the sale or the buyer must agree in writing to make the necessary changes within a limited agreed upon time frame. Refusal to comply with required corrections can result in the sale not being finalized and/or the removal of the home or RV from the resort. 2) Condition of RV or Park Model to be Sold On-Site. For any RV (including but not limited to park models) that a Tenant desires to sell to remain on-site in the Resort, Tenant must advise the Resort at least two (2) weeks before putting the RV up for sale, and must allow Resort Management to inspect the RV to ensure that it meets all Resort Rules and Regulations, including but not limited to any separate Architectural Guidelines. In or- der to preserve and/or upgrade the quality of the Resort, the Resort reserves the right to require the removal from the Resort of any RV that is not compatible with other RVs in the Resort, and/or that is in a rundown condition, and/or that is in disrepair. Any such RV must be removed from the Resort within sixty (60) days of the sale, and in such cases the buyer will not be approved for tenancy in the Resort. Generally speaking, any RV greater than forty (40) years old will likely be determined to be incompatible with other RVs in the Resort, as the Resort is working to preserve and upgrade the quality of the Resort as a whole. 3) Transfer of Ownership: The seller is to notify Guest Services of the sale and must pay applicable transfer fee. Apache Wells RV Resort compliances must be furnished prior to the transfer of ownership. Responsibility for the site and rent remains with the seller until this step is completed. Seller must inform buyer of background check requirement. Please refer to (New Annuals, Line #5). Cal-Am requests first right of refusal. 4) Registration of New Owner: The buyer must contact the Sales Office to complete the Resort registration requirements PRIOR to the sale. If the buyer is to reside at Apache Wells RV Resort, he/she must meet the age requirements and have prior Management approval. There is a $150.00 administration-processing fee for all trans- fer of ownership, payable at the time of the transfer. *See Sales A ssociate for more detailed information 5) New Annuals are subject to a background check; fees apply 6) For Sale Signs One (1) free Cal-Am Standard Sign can be displayed in homes. Signs may be picked up at the Cal-Am Sales Center. All homeowners interested in selling their homes are encouraged to visit our Resort In- formation Center for details on listings. NOTE: Tenants staying 180 days or longer are subject to a background check. Such applicants will be charged a fee to cover the costs of these checks. 11

RENTING YOUR HOME OR RV: Resident may rent their RV or Resort Home under the following conditions: 1) Guest Services office is to be notified of the pending ar r ival of the r enter and may r equir e a copy of any rental agreement between the two parties. A renter staying beyond six (6) months must complete all the annual registration requirements including a background check. Resort management limits the rights to the number of rentals and or sub leases that will be allowed in a calendar year or 12 month period. 2) The renter (s) must conform to the age requirements of the Resort and abide by all Resort Rules and Regula- tions. 3) Tenants may not use websites like AirBNB, VRBO, HomeAway, and the like to sublet their RV/space. The Resort is intended for Tenants who either reside in the Resort full-time or who return seasonally. Subletting using AirBNB, VRBO, HomeAway, and the like constitutes running a business from the Resort in violation of these Rules and Regulations. Residents who use advertisements for VRBO’s will be issued compliance notices, if 3 compliance notices have been issued resort management will be forced to start the eviction process. 4) Arrangements for payment of electric bills must be made between owner and renter. The monthly billing for electric usage will remain in the owner’s name. The owner will be responsible for any unpaid electric bills. 5) An administration-processing fee for each time the home/unit is r ented of $50.00 is payable at the time of registration of the renter. Renter’s mail cannot be handled until proper registration in Guest Services is completed. 6) Homeowners relinquish his/her resort privileges and r esor t Club pr ivileges dur ing the time the home/unit is rented. MOVING YOUR RESORT HOME OUT OF THE RESORT AND CANCELING YOUR ANNUAL RESRVATION Tenant must provide the Park with a request for a Clearance for Removal not less than thirty (30) days prior to move-out (this time is necessary for management to make arrangements to enable the move-out). The seller is responsible for the site maintenance and all rent until the home is removed.  The Resort requires all contractors to be certified and to be registered in Guest Services and must provide a proper certificate of liability insurance prior to removal of any RV and/or park model. All work must be con- ducted during regular business hours 8 AM - 4 PM, Monday through Friday only. Contractors must report to Guest Services before starting any type of tear down. NO EXCEPTIONS!  No refunds for any annual rent. Tenant must pay all rent and other charges through the removal date before the Clearance for Removal will be issued.  When the RV or park model is removed, all necessary and accessory structures such as sheds, awnings, car- ports, fences, Arizona rooms and the like must also be removed unless the Park requests or agrees otherwise in writing.  Homeowner will continue to be charged rent for 30 days from the date of office’s receipt of notice or until lot is vacated; which ever occurs first. Specific information is outlined in Notice Of Intent To Vacate Form - Forms are available in Guest Ser- vices Office.  When a park model home is removed, all concrete and asphalt on the space (including but not limited to con- crete pads and driveways), and all landscaping and landscaping materials, must be removed unless the Park requests or agrees otherwise in writing. When a park model home is removed, the space must be left com- pletely clear, with all holes and depressions filled in with clean fill dirt, so that is restored to a condition as if no home had ever been placed on it, and so that it is ready for the placement of a new home.  The space must be left clean, free of trash, building materials and construction debris. 12

 All holes and depressions must be filled in. The space must be graded and level, and approximately the same level as adjoining lots. If fill dirt is necessary, Tenant is responsible for supplying clean fill dirt.  Resident or contractor must notify Guest Services when the home is ready to be moved off the site. Apache Wells RV Resort Site Inspector must conduct a site evaluation before home is allowed to be removed from the Resort.  The resident nor contractor are authorized to discard any items in resort dumpster. NO EXCEPTIONS!  If after Clearance for Removal 30 days expire, home/shed have been removed and site has not been cleaned up, 72 hours will be given to complete clean up. After 72 hours a $25 charge per man (minimum of $100) will be assessed to homeowner. ARCHITECTURAL STANDARDS Residents are expected to keep their homes and accessory structures up to the Resort Architectural Standards. This includes repairing or replacing damaged skirting, air conditioners, evaporative coolers, trellises, storage enclosures, etc., as needed. Homes, carports, patios and other structures which in the judgment of Management have become obsolete through neglect, basic design or age may require remodeling or removal from the Resort at the time of resale or with at least (90) ninety day notice at any time by Management. APPROVED RV’S, HOMES AND VEHICLES: APACHE WELLS RV RESORT is a zoned RV Resort. We welcome Class A, B and C Motor Homes, Travel Trailers, 5th Wheels and Vacation Homes (Park Models). All units must be a minimum of 22 feet in length and a maximum of 400 sq. feet of livable space including all bays, tip-outs and/or slide-outs. All RVs must be no more than 10 years old and or in good condition. Park models 1980 or older will be allowed to remain in the resort with a year to year inspection and approval by Management each year. Management reserves the right to approve or reject any RV, Home or Vehicle. SITE IMPROVEMENTS: APACHE WELLS RV RESORT has a staff member to evaluate and approve any improvements or new upgrades. All site improvements including new Resort Homes for outside painting, carpeting, awnings, sheds, concrete, landscaping, etc. requires Management approval. Home site improvement request forms are available at the Guest Services office. Your intended home improvement will need to be explained on the form and returned to Guest Services. You will be notified generally within (5) five working days of approval or disapproval. Approval is based on current requirements of Apache Wells RV Resort and the City of Mesa Building code re- quirements and is not subject to prior conditions. Applications will be reviewed by a Apache Wells RV Resort staff member prior to Management approval. Absolutely no work will commence on a Apache Wells RV Resort site without written Management approval and the appropriate Building Permit. Modifications attempted without ap- proval will be subject to removal at the owner’s expense. CONTRACTORS / SERVICE COMPANIES / PERSONS: It is the residents’ responsibility to inform the Guest Services office of the Company name performing services on the residents’ site. Only properly licensed and in- sured vendors/contractors are allowed to work in the Resort. The resort must have a copy of their current proof of insurance for liability and workers compensation. 13

REQUIRED PERMITS APACHE WELLS RV RESORT REQUIRED PERMITS To Place a Resort Home (Park Model) or other permanent unit. Previously owned Resort Homes (Park Models) must be inspected and approved prior to delivery and must have written permission from Resort Management before delivery and setup.  Installing or replacing awnings, skirting and air conditioners  Modifying any electrical or plumbing. (i.e. washer & dryers)  Landscaping, digging or adding concrete.  Structural modification to any home.  Any exterior “Project” involving any contractor and /or delivery from any vendor from outside the Resort.  Paint colors for home,decks and or driveways colors or patterns CITY OF MESA REQUIRED PERMITS: Electric additions or modifications. * A ll utility lines must be buried. Plumbing additions or modifications. Raised Decks if weight-bearing, greater than 22” in height, such as below patio enclosures. NOTE: No improvements that extend into setbacks will be approved, because of the hazard to buried electrical and plumbing lines. AIR CONDITIONERS : A/C units are to be on the ground only at the rear of the home and out of the rear easement. Note* Devices of any type such as: air conditioners, and solar panels are not to be mounted on the roof of the home or other structures. Solar panels are currently not allowed on homes or other structures. Air conditioners on park models (Vacation Homes) are to be connected to the existing duct work. Existing air conditioners currently mounted on the roof or in the window are “grand-fathered” until replacement is needed due to age/malfunction or the home is sold to a new owner. At the time the home is placed “For Sale” they must be removed and placed properly. AWNINGS: A maximum length 40’ length awning, subject to set backs. See page 16; Placement Settings Permanent Homes. RV awnings must be permanently attached to the RV. No free standing awnings are allowed at any site Window Awnings must not infringe upon the access to the side space and are not to protrude less than (7’) seven feet from the ground. Awnings placed over a permanent shed must be 20 gauge, check with local requirements. In the event you have storm damage to your awning it is your responsibility to send a reliable person/company to clean up and repair the awning. Due to liability reasons; Resort staff will not be involved. Do not use an auger to anchor your RV, shed, or awning in the setback area. 14

ARIZONA ROOMS/ PATIO ENCLOSURES: The enclosure may not exceed the length or width of the awning and must not restrict the parking for at least one vehicle. The Arizona rooms set back must be at least (18’) Eighteen feet and required setback from street. It must be of similar exterior material to the permanent home and must conform to the City of Mesa building codes. Drawings for elevation, window and door locations, washer/dryer, types, including descriptions of all materials, must be submitted together with any improvements on the building permit request. Maximum combined square footage is 520 square feet, (Shed 120 square feet; Arizona Room 400 square feet) Bay Windows must be noted on permit applications. Bay windows are considered in the calculations of square footage. Generally located front of the unit, not on the side of unit. Sample worksheets are available at the Guest Services office. Firewalls are required by the City of Mesa where building structures are less than 6’ apart. Electric service to the Arizona room is to be up to code and wired direct or plugged into the pedestal. DECKS: May not hinder or restrict the use of any exit from the unit and must not obstruct parking for at least one vehicle. The setback must be inline with the front edge of the home. FENCES / PRIVACY WALLS: No fencing of any kind is permitted. Those in existence may remain in place until the home sells, repair is needed or Management requests removal. Privacy walls must be of similar material to the exterior of the permanent unit. Fiberglass plastic or lattice is not permitted. Planting borders may be rock or clay colored brick. Those in existence of other colors or types may remain in place until the home sells, they become unsightly or Management requests removal. LANDSCAPING: Palm trees are the responsibility of Apache Wells RV Resort. All other planting on annual sites is the sole respon- sibility of the resident. Location and type of plants must be submitted for approval by Management. (Exception is small flowers). A minimum of three feet (3) of unobstructed passage must be maintained between sites. No large trees or cactus will be allowed in the side easement. Management reserves the right to limit the type of plantings and their heights and location. Management also re- serves the right to remove objectionable plantings and bill the resident/renter at the rate of $30.00 per man hour (minimum $30.00). A thirty day notice will be given prior to Management removing the plant/tree to allow the resident the option of removing them. LANDSCAPING will NOT be allowed in the rear easement, unless it is of a temporary nature, such as patio blocks & flower beds. NO CONCRETE other than the parking area/patios. Pavers ONLY. Plants Restricted : Oleanders, Caster plants, Bougainvillea, Large leaf Cactus, Chollo Cactus, Clinging Vines, Century Plants. Trees Restricted: No other trees than the palm tree furnished by the Resort. Dwarf Trees allowed in boxes only. 15

PLACEMENT/SETTING PERMANENT HOMES : Minimum set backs: Size of the site determines the minimum set back distance, which is determined by management and sales. Bay windows must be noted on permanent placement applications. Bay windows must be noted on permanent placement applications. SATELLITE DISHES: Approval by Apache Wells RV Resort Management is required before placement of the dish. Maximum diameter of the dish will be (18”) eighteen inches in diameter on all park models and mobile RV’S. STORAGE SHEDS: All new placements of permanent sheds must be located under the awning, extended all the way to the ceiling of the awning and covered with similar or like material and color as the home and meet Mesa City codes. Existing homes that have a permanent shed that is not of the same material, will be evaluated at the time of the sale to determine if the shed must be upgraded to meet current architectural standards or removed. New shed installation requires to be all sides closed to the awning roof. A maximum of 1 (one) Rubbermaid storage unit no larger than 52 cubic feet is allowed per site and requires approval by management Shed maximum size is 120 square feet. PERMITS are required by the City of Mesa for all new shed constuction. Firewalls are required by the City of Mesa on the wall of the shed adjacent to any structure closer than 6 feet and in other areas as required. Temporary shed placement r equir es Apache Wells RV Resor t per mit. SKIRTING: Skirting is required on permanent units including 5th wheels . Skirting material must be new and of like material that is on the permanent unit. It is recommended that all skirting be on a 4” wide concrete base. This will deter rotting and termite damage and alkaline attack to the metal runner. SIGNAGE: Prior written permission is required from the Resort management before adding or displaying any signage to your site or the exterior of the recreation vehicle or resort home, including but not limited to banners and/or flags. Ob- scene, offensive, or inappropriate flags will not be approved. Political Signs. Political campaign signs relating to a specific candidate for election to public office or to an existing initiative, refer- endum, or recall process may be displayed in the window of the RV or park model or on the home site. The size of the sign may not exceed six (6) square feet, and the sign may displayed only during an election season beginning sixty (60) days prior to the primary or election, and must be removed within 24 hours after the polls for that primary or election close. No other signs except for “For Sale” or “Open House” signs as set forth in these Rules and Regula- tions and in compliance with any Rules set forth in these Rules and Regulations are permitted on the home site or on the RV. Flag Poles: Prior written permission is required from the Resort management before adding or installing an in ground flag pole DRONES: Drones / RC Planes cannot be flown at any time on or above the resort property by residents / guests / third parties. The resort management reserves the right to use drones for marketing, special events and or activities . 16

UTILITIES: INSTALLATIONS: ELECTRIC: Each site has one (1) 50AMP, 220 volt circuit and one (1) 30 AMP, 110 volt circuit. These are maintained by the Resort. The cost of modifications must be preapproved, is the financial responsibility of the resident. Electric lines on all permanent homes are to be buried and neoprene-covered. ARIZONA ROOM electric service is to be wired direct to the pedestal. Electric service to the storage shed will be done to City Code. Apache Wells RV Resort strongly recommends that all residents with RVs or park models install a surge protector designed for their type of RV or park model. This recommendation is for the protection of the electrical system in your home or RV. The resort will not be held responsible for any damage to your elec- trical system, regardless of cause. Generator use is not permitted in the resort unless permission is given by resort manager WASHERS & DRYERS: Must have Management approval prior to installation. NEW WATER lines on permanent homes are to be 3/4” copper tubing and buried below ground. SEWER lines shall be appr oved har d plastic line and bur ied below gr ound. (Note: Feminine pr oducts ar e prohibited from being flushed down the sewer pipes. Residents may be held responsible for sewer cleaning fees: if appropriate). NONCOMPLIANCE – INDEMNITY & ATTORNEY’S FEES Noncompliance of Resort Guidelines: Apache Wells RV Resort reserves the right to terminate or refuse renewal in the event that there have been rule infractions. This also includes site care infractions and conduct by guests and/or their visitors that interferes with other guests’ quiet and enjoyment of the Resort. Indemnity and Attorney’s Fees: Management is not responsible to guest, his/her visitors, employees or agents for loss, damage, death or injury of any kind by the use of the Resort, or by fire, flood, vandalism or other casualties, except those incidents resulting from the gross negligence or intentional acts of Resort, Resort Manage- ment or Resort owners. Guest (s) hereby agrees to indemnify and waive all claims and demands against the Re- sort, Resort Management or Resort owners, and will hold them harmless for liability for all claims unless arising from negligence and willful acts of Resort Management or Resort owners. Guest further agrees to obtain and keep in full effect at his own cost, the extended insurance coverage for homeowner, fire and other liabilities to protect guest (s) and all others from loss and liability. Proof of this insurance is to be provided to Guest Services annually. All RV sites in Apache Wells RV Resort remain under the control of Management at all times. Revision - August 1, 2020 17

GENERAL ASSUMPTION OF RISK & RELEASE OF LIABILITY Caution: This is a release of legal rights. Read and understand it before accepting these terms by agree- ing to abide by all resort Rules & Regulations, of which this is incorporated. Cal-Am Resorts operates Recreational Vehicle Resorts throughout the State of Arizona. References to Cal-Am Resorts (\"Cal-Am\") include all of the Cal-Am Recreational Vehicle Resorts in the State of Arizona, the individual entities that own them, the entities that manage them, their officers, officials, employees, volunteers, contractors, agents, and assigns. Each Resort offers a wide variety of recreational and other amenities for use by its residents. These include (without limi- tation), therapy spas, hot tubs, swimming pools, exercise facilities, tennis courts, pickle ball courts, and facilities within clubhouses and in other areas of the Resort. These facilities include such things as wood working shops, weight rooms, lapidary shops and the like. Each Resort also offers organized activities. These include entertainment performances, pickleball tennis and other sports tournaments, swimming classes, exercise classes, dance classes, and field trips. Some activities are organized and spon- sored by the Resort; others by voluntary resident associations. Some activities entail payment of an additional fee to par- ticipate. Cal-Am Resorts are “dog friendly”. Additionally some are located in areas where certain varieties of wildlife may be en- countered. I/we, by electing to reside in a Cal-Am Recreational Vehicle Resort, may participate in one, some or all of the activities referred to above, and to use some or all of the facilities and amenities offered by any Cal-Am Resort as described above. In consideration of my participation in activities or use of facilities and amenities, I agree as follows: RISKS INVOLVED: I agr ee to closely inspect all facilities befor e using them. I under stand that some facilities such as therapy spas, hot tubs, swimming pools, exercise rooms, wood working shops, and other facilities represent a risk to health and safety. I understand that some activities such as tennis, swimming, pickleball, jogging, and participation in exercise, dance and swimming classes can be strenuous and can also pose a risk to my health and wellbeing. With respect to such activities I understand that I will participate only in those which I am medically and physically able to. I under- stand that some activities involve risks in traveling to, within, and/or returning from different areas, including, but not lim- ited to, political, legal, social, and economic conditions; different standards of design, safety, and maintenance of build- ings, public places, and conveyances; and local medical and weather conditions. I agree that in deciding to use any facility or participate in any activity, I will make my own investigation, will obtain materials from a variety of sources, and am willing to accept these risks. I understand the risks posed by animals and agree to use care when outside in a Resort espe- cially when encountering dogs or wildlife. HEALTH AND SAFETY: I have been advised to consult with a medical doctor with r egar d to my per sonal medical needs. I state that there are no health-related reasons or problems that preclude or restrict my participation in any activities that I elect to participate in or use any facilities that I choose to use. I have obtained all required and recommended immun- izations, if any. I recognize that Cal-Am is not obligated to attend to any of my medical or medication needs, and in fact may expressly instruct its employees to not attend to such needs, and I assume all risk and responsibility therefore. In case of a medical emergency occurring during my participation in any activities or use of any facility, I understand that I may receive no as- sistance from Cal-Am employees or volunteers, I am responsible for my own medical treatment and emergency care as needed, and agree to pay all expenses relating thereto and release and agree to hold harmless, defend and indemnify Cal- Am from all liability of any nature whatsoever for any actions. ASSUMPTION OF RISK AND RELEASE OF LIABILITY: Knowing the r isks descr ibed above, and in voluntar y consideration of being permitted to participate in the activities and use the facilities and amenities referred to above, I agree to release, indemnify, and defend Cal-Am and its officials, officers, employees, agents, volunteers, sponsors, and contractors from and against any claim which I, the participant, my legal guardian or any other person may have for any losses, damages or injuries arising out of or in connection with my participation or use. I also agree to fully acquaint all guests and invitees I permit to engage in such activities and/or use these facilities, with the foregoing and to defend, indemnify and hold Cal-Am harmless from any claims by any such guest or invitee arising out of such use or activity. I expressly understand that this assumption of risk and release of liability also applies to injury resulting from encounters with dogs, wildlife and other animals in the Resort. SIGNATURE: I indicate that by my r esidence at this Resor t, and/or signatur e on the Resor t r egistr ation car d, that I have read the terms and conditions of participation and use, and agree to abide by them. I have carefully read this Release Form and acknowledge that I understand it. No representation, statements, or inducements, oral or written, apart from the foregoing written statement, have been made. This Release Form shall be governed by the laws of the State of Arizona which shall be the forum for any lawsuits filed under or incident to this Release Form or to the participation in an activity or use of a facility. If any portion of this Release is held invalid, the rest of the document shall continue in full force and effect. 18
