7 November 2017 Property Portfolio Page 13 THE LAW AND GENEROSITY TO FAMILY MEMBERS AND FRIENDSThis article deals with the legal relationships that may have been unwittingly created by a client’s generosity.No doubt clients have at some or other stage allowed their family members or friends to stay on their property without any form ofremuneration. In today’s recessionary times with rising unemployment and the income of the aged and retirees rapidly dwindling, ithas become not uncommon for destitute family members and parents to be offered accommodation by fellow family and children.Clients, by their generosity, may have unwittingly conferred and granted to their friends or family members a personal servitude.A personal servitude is defined as a real right granting the holder thereof in his personal capacity the right to do something onsomeone else’s property. There are various types of personal servitudes in South African law, but the three most common types ofpersonal servitudes are : 1. Usufruct; 2. Use (Usus); and 3. Occupancy (Habitatio).It is important that clients should know the distinction between what constitutes Usufruct, Usus and Habitatio.Usufruct is a real right which provides a usufructuary with the right to use and enjoy another person’s property. The usufructuary hasthe right to collect, consume or alienate the fruits of the property.Use (Usus) grants to the holder of such a right until his death or for a shorter term agreed upon, to use a thing belonging to someoneelse for his own needs or those of his household without damage to the substance of the thing. Use differs from Usufruct in that theholder may only take as many fruits of the thing as meets his daily needs.Habitatio (Occupancy) is the right to reside in someone else’s house. Unlike in the case of Usus, Habitatio carries with it the right togrant a lease or sub-lease to others. Habitatio terminates upon the death of the occupier or upon the expiry of the period thereof if itwas only granted for a specified period.However, no doubt, in practice, most clients will have no written agreement with their friends and/or family members recording theterms of the relationship with them. The problem with this is that oral agreements are extremely difficult to prove and, as the oldsaying goes, possession is nine-tenths of the law – the friend and/or family members are in possession and occupation of theproperty. A simple example will illustrate a potential problem which can occur:Joe Smith has allowed his mother-in-law to stay in a flat let on his property, at no cost to her, for the last couple of years. Nothing hasbeen recorded in writing or formalised pertaining to their arrangement. It was always Joe’s understanding that, when he decides oneday to sell the property, his mother-in-law would have to vacate her granny flat and find alternative accommodation. Joe attempts tosell the property to a third party but then receives a letter of demand from his mother-in-law’s attorney advising that he can only sellthe property subject to the mother-in-law’s real right of usus which entails that she has the right to reside in the granny flat on theproperty until her death! The immediate problem for Joe is twofold. Firstly there is no written agreement in place defining thearrangement with his mother-in-law and secondly his mother-in-law is in possession of the flat let on the property. Joe will have to at-tempt to evict his mother-in-law on the basis that she is in unlawful occupation of the flat let and will have to both prove and disprovethe terms of the arrangement with his mother-in-law. Such an exercise will be both costly and time-consuming.
