Completed Architectural Application to include all signed forms by Owner and Contractor 2. Full sets of plans and/or drawings of the existing floor plan and elevations with and specifications from contractor. (hard copy and PDF file format) 3. INSTRUCTIONS & REGULATIONS Professionally Managed By Prime Qi Management & Consulting. The following information describes and explains the construction and improvement regulations for Unit Owners, Designers and/or Contractors working in Units located at SEASIDE AT FISHER ISLAND CONDOMINIUM ASSOCIATION, INC. These regulations apply to all Unit Owners, Lessees, designers, contractors, sub-contractors and their employees. In the event of an omission the Association’s documents will prevail. The Unit Owner shall be fully responsible to ensure that all parties involved in any work conducted in his/her Unit is provided a copy of these construction and improvement guidelines and that the contractor understands that their workers must strictly comply with these improvement guidelines. NOTE: Due to the nature of the building’s construction, penetration of the floor or ceiling slab is strictly prohibited without the express written consent and prior authorization of the Engineer of Record and/or the Association. Any damages to the building structure proven to be caused by a Unit Owner’s Contractor, will be the responsibility of the HomeOwner to repair or pay for repairs completed by the Association based upon approved procedures by the Structural Engineer of Record. OWNER REQUIREMENTS PRIOR TO STARTING WORK Unit Owners must have closed on their Unit and provided a Closing Statement & Special Warranty Deed to the Association office. Required by the State, County, or Local Governments, any and all permits along with a Notice of Commencement must be properly filed with the local records before work on the Unit Owners construction project may commence.

Managed and Cared For By Thalita Arias Continued Copies of all permits, plans and notices must be supplied to the Association office prior to commencement of work. The Association shall have the right to immediately shutdown the Unit Owner’s construction work for failure of the Unit Owners and/or its contractors to comply with these construction and improvement guidelines, with all costs associated with the shutdown to be borne by the Unit Owner. The Association shall have the authority to designate and/or increase the trash removal/cleanup fee at any time, at its sole discretion, due to the type, size or scope of work of the Unit Owner’s project and the resulting trash removal/cleanup costs. Daily cleanup is required by the Owner’s contractor to ensure that no safety or fire hazards exist in the Unit. Special attention must be placed on any materials such as oily rags and flammable liquids that could spontaneously ignite. No materials, debris, trash or scrap is allowed to be placed or left in Common Areas. The Unit Owner’s contractors shall remove all trash, debris, hazardous and scrap material from the property at the end of each work day. NOTE: THE CONDOMINIUM TRASH CHUTES(S) SHALL NOT BE USED BY THE CONTRACTOR OR ANY HOME OWNER FOR DISCARDING OF CONSTRUCTION DEBRIS (INCLUDING CARPETING, TILE, WOOD, CEMENT, ETC). ADDITIONALLY, DRAINS ARE NOT TO BE USED TO DISCARD ANY MATERIALS EITHER. VIOLATION OF THIS RULE WILL RESULT IN THE HOME OWNER’S CONSTRUCTION PROJECT BEING SHUT DOWN BY THE ASSOCIATION AND FEES ASSOCIATED WITH DISPOSAL OF THE DEBRIS CHARGED TO THE OWNER, AND COST OF RUNNING CAMERAS TO ENSURE DRAINAGE SYSTEM HAS NOT BEEN COMPROMISED.

Application Documents A “ARCHITECTURAL MODIFICATION APPLICATION FORM” or, in the case of hardwood flooring installation, the “NOTICE AND ACCEPTANCE OF STANDARD FOR CONTROL OF SOUND TRANSMISSION AND IMPACT ISOLATION (FLOOR COVERINGS)” & the “SUBMISSION REQUIREMENTS FOR HARDWOOD FLOORING INSTALLATION” must be filled out by the Unit Owner, submitted to the Association and, approved prior to any work commencing. Copies of all drawings, licenses and insurances must be submitted at the time of application. After the Association’s approval and prior to commencement of work the Unit Owner must supply the Association with a copy of the permit and any notices filed with the City/County/State. All submitted paperwork becomes part of the Owner’s Unit file. A check for fees must be turned in along with the application to the management office. Check payable to: Seaside at Fisher Island Condominium Association, Inc. for a total of fee One Hundred ($100) dollars must be submitted along with the ARCHITECTURAL MODIFICATION APPLICATION FORM to the Management Office as a waste disposal/construction impact fee. 2. Approval Procedure Prior to commencing any type of remodeling to a residence, the Unit Owner shall submit a completed Architectural Modification Application Package for review and approval. The Board, in its sole discretion, shall have 30 days after the date of receipt of form on which to approve or reject the Modification.

Managed and Cared For By Thalita Arias Continued The Unit Owner acknowledges and agrees that by filing their Architectural Modification Form with the Association, the Unit Owner has agreed to abide by all the terms and conditions of the Designer’s Guidelines contained herein. The Unit Owner further acknowledges and agrees that the Association’s approval of the Unit Owner’s Applications shall not be deemed in any manner to be an acceptance by the Association of any responsibility with respect to the compliance of the plans and specifications to applicable code or laws or to be an acceptance of responsibility in any other manner with respect to said plans and specifications. The construction plan shall include the following: Plans and specifications for all work to be performed; Anticipated commencement date; Elevator Padding Dates; Parking Plan & Anticipated completion date; If applicable, engineering report confirming review of structural load capacity and x-ray verification of clearance for any slab penetrations. List of all contractors, contractor/subcontractor employees, sub- contractors with supervisory personnel and contact information. Licenses and Certificate (s) of insurance from all Contractors and Subcontractors involved; Building Permit application as required by local governing authorities. 1. Permits Failure to comply with permit requirements may result in fines by the City, County, State and Association, as well as the postponement of work. No workers will be permitted access, make deliveries of materials, or commence work in the unit, without providing the Association with a copy of the permit, as well as displaying the permit on the unit door. Permitting is required when making any improvements involving plumbing, electrical, flooring, waterproofing and structural modifications. Please visit the City of Miami-Dade County's website for permit information.

1. License, Proof of Insurance Professionally Managed By Prime Qi Management & Consulting. All contractors must provide a copy of any State, County or City required licensing and a Current Certificate of Insurance for General Liability of at least $1,000,000 and with SEASIDE AT FISHER ISLAND CONDOMINIUM ASSOCIATION, INC., AND PRIME QI MANAGEMENT AND CONSULTING, LLC listed as an additional named insured in the Certificate Holder Box. Additional Insured and Subrogation of Waiver is required by Seaside at Fisher Island Condominium Association, Inc. for approval. Prior to commencement of the Unit Owner’s construction project, the Unit Owner shall ensure that all of their contractors have in force and have agreed to continuously carry during the period of construction, comprehensive General Liability and Workers Compensation insurance as required by state law. All of the Unit Owner’s contractors shall furnish to the Association written proof of the insurance coverage in the form of insurance certificates in a form satisfactory to the Association. A minimum of 30 days “Notice of Cancellation” to the Association is required and this shall be set forth in the certificate. In the event that any of the Unit Owner’s contractors fail to have, at the time of the commencement of construction and continuously carry during the course of the performance of their work at the Condominium premises, the insurance hereon provided, and should damage, loss, personal injury or death occur, which would have been covered by said insurance, the Unit Owner shall be deemed liable to the Association for any losses or damages which the Association incurs by reason of the failure of the Unit Owner’s contactors to have the required insurance in place.

Professionally Managed By Prime Qi Management & Consulting. CONTRACTORS INSTRUCTIONS & REGULATIONS CERTIFICATE OF INSURANCE NOTES 1. INSURED - The “Insured” named on the certificate should match the name on the W-9 and on the invoices. 2. GENERAL LIABILITY COVERAGE – We require a $1,000,000 minimum for each occurrence. An X must also be marked in the Additional Insured and Subrogation Waived columns. 3. WORKERS’ COMPENSATION COVERAGE – We require Workers Compensation coverage, even if the company is exempt from obtaining Workers’ Compensation coverage by the State. An X must be marked in the Subrogation Waived column for the reasons listed in No. 2 above. 4. DESCRIPTION OF OPERATIONS BOX – This section may be used to copy verbatim information in the policy. The additional-insured and waiver of subrogation status should not be listed in this box. The appropriate columns must be marked with an X. Please be aware that using a certificate or attached form in an attempt to vary policy terms presents legal risks, including violation of insurance regulatory requirements, and should not be engaged in without prior consultation with insurance carriers, policies, and legal counsel. 5. CERTIFICATE HOLDER - Both the Association and Prime Qi Management & Consulting must appear in the Certificate Holder Box and as ADDITIONAL INSURED. One Certificate of Insurance may include both names; however, the address listed must be the Association’s Management Office mailing address of 19200 Fisher Island Drive, Fisher Island, FL 33109. 6. ACORD FORM - The certificate must be on an ACORD 25 (2009/09) Form or a later version.

Continued Managed and Cared For By Thalita Arias As for requests to make an addition, alteration or improvement, the Unit owner shall submit a full and detailed set of plans and specifications to the Association. The details of the plans and specifications must be commensurate with the extent or nature of the work to be performed. In the event that the nature or the extent of the proposed construction warrants the retention of an architect, engineer, or constructor, to review the plans and specifications and/or monitor the construction, the associations shall have the right to engage such professional for it’s own benefit and the costs and expenses of same shall be reimbursed by the unit owner. Construction that results in considerable noise must be accomplished so as to minimize the disruption and discomfort visited upon by others. Examples are jack hammering, drilling, and tile and saw cutting. The contractor must submit to the association an estimate of the length of time to accomplish this type of work. For jack hammering and other activities that will result in excessive noise, the work will be limited to four (4) hours per day from 11:00 A.M. – 3:00 P.M., and the contractor must use multiple tools in order to expedite the work. 7. Construction may occur from 9:00 A.M. – 4:00 P.M.. Monday through Friday. All contractors shall cease work and clean up by 4:00 P.M. each day so that the contractors leave Fisher Island no later than the 4:30 P.M. commercial barge. Contractors are to drop off and pick up materials at the building entrance, and contractors may not park in front of the building. Construction material may not be store in hallways or other common areas. 8. Contractors may not park vehicle in the garage. 9. Each Unit will be assigned TWO parking spaces (only), others will need to park off site.

All construction material and debris must be removed from the premises daily; and, the dumpsters and other trash receptacles my not remain overnight. 11. Trash chutes and contractors may not use association trash receptacles. 12. Contractors may not use the association luggage carts. 13. Elevator pads must be installed during construction. 14. Hard surface flooring may not be installed without an approved sound control system with a minimum s.t.c. rating of 55 and must contact management once the sound proofing has been installed in order to take pictures for the unit file. 15. All units contain smoke detectors, and these should be covered during construction so that they do not go off, but they should be uncovered at the end of each day. 16. Contractors shall not alter, modify or tamper with the fire sprinkler systems. Any work, which will require interference with the fire sprinkler system, must be coordinated through the property manager and appropriate approval obtained. 17. A minimum of a $5,000 deposit is required ($2,000.00 of which are non-refundable) or whatever the Board of Directors determines depending on the project. Both the unit owner and the contractor will be responsible for any damage caused to the common elements, another unit, or otherwise. 18. If extenuating circumstances exist, or if any special requirements arise, please contact the property manager in advance so that the association may review and deal with those requirements on a case by case basis.

Contractors are responsible for protecting the walls, ceilings, doors, floors and other Common Areas from damage. Please use extreme caution in transporting materials and equipment and remember that any damage to the Common Areas will be charged to your company and/or the Unit Owner.

Continued Every Contractor/Vendor providing services to a Unit, i.e., Unit Owner, and/or Association, must comply with all applicable laws, governmental regulations and City ordinances, conduct themselves in an ethical and respectable manner.During this time of such work no noise should surpass the boundaries of the unit.
