Dear Friends of Legal Aid: As we reflect back on 2014, we are reminded of the tremendous challenges facing our community’s most vulnerable members and the awesome responsibility the Legal Aid Society of Palm Beach County faces every day in ensuring their equal access to justice. Legal Aid’s staff, volunteers and board of directors are dedicated to protecting the legal rights of our clients to live in safe and stable environments with ade- quate housing, food, health care and educational opportunities. Through Legal Aid’s 17 projects, victims ofdomestic violence, abused and neglected children, frail and exploited elders, victims of discrimination and disabled indi-viduals all have a voice in our judicial system and a chance to live a brighter, healthier and safer future.We are also reminded that none of us does our job alone. In order to improve the quality of life for disadvantaged indi-viduals in our county, we deeply appreciate the support we receive from the private bar, court administration, the judici-ary, the Palm Beach County Board of County Commissioners, the Clerk and Comptroller of the 15th Judicial Circuit, the Chil-dren’s Services Council of Palm Beach County, The Florida Bar Foundation, the Area Agency on Aging of Palm Beach/Treasure Coast, the United Way of Palm Beach County, the Town of Palm Beach United Way, Allegany Franciscan Minis-tries, the Quantum Foundation, the Community Foundation for Palm Beach and Martin Counties, and a variety of othercharitable organizations, foundations and individual donors.A few of our most significant accomplishments in 2014 included: Through generous funding from Allegany Franciscan Ministries and the Quantum Foundation, Legal Aid’s Medical Legal Partnership Project (MLP) began collaborating with the Caridad Health Center and El Sol/MY Clinic, which pre- dominantly serve low-income migrant populations. As a result MLP now offers services at nine (9) Palm Beach County health clinics as well as through referrals from the 2-1-1 Palm Beach County Health Navigator Program. Legal Aid’s Public Guardianship Project expanded its program to serve indigent incapacitated wards in Martin, St. Lucie and Okeechobee Counties. At the request of the Statewide Public Guardianship Office (SPGO), Legal Aid entered into a contract to serve individuals in these additional counties as part of a SPGO initiative to accomplish public guardianship coverage throughout the state. The Legal Aid Society was the recipient of The Doyle Award for Nonprofit Excellence, established by The Dennis M. and Lois A. Doyle Family Foundation in partnership with Sun Sentinel Charities, which spotlights local nonprofits and the people behind them that make South Florida a great place to live.We are very fortunate to have a board of directors, staff and funders who recognize and appreciate the need for all seg-ments of our community to have meaningful access to our judicial system in order to protect their health, safety and secu-rity. Through the Project’s ser- vices, children in foster care in Palm Beach County have an attorney present to represent their interests in all court hearings and staffing, ensuring their voice is heard on all decisions affecting their lives. Since its in- ception, the Foster Children’s Project has helped over 2,000 clients find permanent homes within 12 months. MEDICAL LEGAL PARTNERSHIP PROJECTIn 2014 Legal Aid’s Medical Legal Partnership Project represented 427 clients in 475 cases by providing assis-tance in securing healthcare benefits, Social Security, food stamps, and unemployment compensation; prepara-tion of advanced directives; assistance in securing legal immigration status or citizenship; ensuring safe andstable housing; and securing accommodations for individuals with disabilities. Project staff provide services atfour Federally Qualified Health Centers, FoundCare Health Center, Genesis Community Health, the CommunityHealth Center of West Palm Beach, Caridad Center and El Sol/MY Clinic, as well as collaborating with 2-1-1Palm Beach County health navigators.

2014 RYAN WHITE LEGAL PROJECTThe Ryan White Legal Project provided legal representation, adviceand education to individuals infected with the HIV virus, primarilyfocusing on access to health care, health insurance, Social Security,Medicare, Medicaid and employment matters. In 2014 Ryan Whiteattorneys secured $262,807 in total lump sum benefit payments anda total of $18,339 in regular monthly payments for Ryan White cli-ents. Approximately 70% of the appeals filed by Legal Aid resulted inan award with back payments to its clients. PUBLIC GUARDIANSHIP PROJECT www.legalaidpbc.orgIn 2014, Legal Aid’s Public Guardianship Project (PGP) expanded its program toserve indigent, incapacitated wards in the three additional counties of Martin, St.Lucie and Okeechobee. The Public Guardianship Program agreed to enter into acontract with the Statewide Public Guardianship Office (SPGO) to serve theseadditional counties as part of SPGO’s initiative to accomplish public guardianshipcoverage in all 67 counties in the State of Florida. Due in part to PGP’s coopera-tion, SPGO was able to achieve this goal, and Florida is now the only state in thecountry, with the exception of Delaware, to have public guardianship coverage inevery county. PROGRAM HIGHLIGHTS EDUCATIONAL ADVOCACY PROJECT Legal Aid’s Educational Advocacy Project (EAP) provided advocacy and legal services to 123 students and their fami- lies in the K-12 public school system, many of whom were children with disabilities who were identified as having unmet special education needs. Through due process hear- ings, mediation and/or demand letters, EAP staff success- fully secured legally-mandated services and enhanced the educational opportunities for these deserving and needy students. IMMIGRANT ADVOCACY PROJECTIn 2014, the Immigrant Advocacy Project assisted 267immigrants in applying for lawful permanent resi-dence, with particular focus on the needs of abused,abandoned and neglected children; victims of domes-tic violence; victims of violent crime; victims of humantrafficking; individuals who were severely disabled;individuals coping with HIV or other serious healthconditions such as cancer and renal failure; the elderly;and individuals who were homeless. LOW INCOME TAXPAYER CLINIC “Thank you to the Legal Aid Society and the Low Income Taxpayer Clinic (LITC) for your invaluable assistance and empathic service while assisting my sister with stopping an IRS garnishment of her Social Security Disabil- ity. When we arrived at Legal Aid for our appointment, both my sister and I were nearly ready to faint with dread and worry. When the LITC staff person came to take us to her office, she immediately set about making us both feel at ease and treated us with respect, empathy and dignity. We were overjoyed [with the eventual outcome], and so relieved that these words seem to fall far short of accurately describing our feelings. Since the IRS garnishment threat was lifted off her shoulders, my sister’s mental attitude and health has drastically improved. I cannot thank you enough for the difference your efforts made in our lives.”

2014 ELDER LAW PROJECT “I have worked my whole life and never needed to ask for help from anyone until now. I am a proud person and it was hard to ask for help. I was real anxious because I had fears of being belittled. But the experience I had was very comforting. I am very satisfied with the whole experience. Thank you very much.”RELATIVE CAREGIVERS PROJECT RELATIVE CAREGIVERS PROJECT The Relative Caregivers Project continued to provide legal advice, consultation and representation to relative caregivers who are caretakers for minor children, ensur- ing family stability while keeping the children out of fos- ter care. THOSE WE HELPCHILD ABUSE AND NEGLECT The Palm Beach County courthouse had become a place where the 12- year old girl had to relive the most terrifying moments of her life. November 22 was different. For the first time, the courthouse was home for a joyous occasion for Sophia. She was legally adopted along with her 5-year old sister, Emily, as part of Palm Beach County’s National Adoption Day celebration. They have parents. They have stability. They have hope.Go back 2 1/2 years earlier: Sophia and Emily are pounding the door of a rural house with a debris-litteredlawn. Their birth father had just dragged their birth mother into the house by her hair. She’s screaming.The screaming stops. Their father eventually lets them into the house and their mother is in a bedroom. Sophiagoes into the bathroom. It’s blood-splattered.Later that evening, the girls’ mother comes out of the bedroom—her face swollen. The girls and their motherwould spend a few more days in the house until a police officer serving a court summons stumbles upon thesituation. Within hours Sophia and Emily are placed in foster care.They also get someone who is going to tirelessly fight for their best interest, making sure they have a voice incourt. They get an attorney through the Legal Aid Society’s Foster Children’s Project. The project, which repre-sents more than 500 Palm Beach County children a year, is one of the funded programs of the Children’s Ser-vices Council of Palm Beach County.“The girls history is heartbreaking,” said Susan Hendricks, the Legal Aid attorney who has been representingthem for the last two years.“These are the cases you lose sleep over because what the kids have experienced is so awful and the kids are insuch bad shape when you meet them,” Hendricks said.The girls’ mother had been the subject of abuse reports herself as a child, getting pregnant when she was just14 years old. The mother had been in and out of psychiatric treatment and battled substance abuse issues. Thefather had run-ins with the law and had been accused of beating the girls’ mother.Just seven months after Emily was born, the two girls were sheltered at a foster home after the Florida Depart-ment of Children and Families tried three times to stabilize the family. The girls were in foster care for 21months until they were reunified with their mother in January 2010. Photos and names of clients are representative to protect privacy

2014Despite a court order barring the father from seeing the girls, he clearly was seeing them, Hendricks said. Thencame that horrific day in March 2011 when the father promised the mother to take her out to dinner for herbirthday and instead took her and the girls to the house in Okeechobee County. Sophia would have to testifythree times about the abuse she had witnessed as Legal Aid sought to protect her and her sister.“It was chilling to hear what happened from her perspective” Hendricks said. “She didn’t know if he was killingher mother. That’s what the little girls feared.”Their mother ultimately failed to show up for the hearing terminating her parental rights. Their father foughtand lost.Hendricks said that when she first met the girls, Sophia was withdrawn and two years behind in school, whileEmily had serious behavioral issues. Both girls were traumatized, but through it all, they had built an incrediblebond.A couple saw the girls’ photos at the Heart Gallery, a collection of photos of children needing homes put up bythe Children's Home Society of Florida at local shopping malls. The girls met the couple and began bondingwith them.“They have made great strides,” Hendricks said.“It made me have hope. Whenever they wouldwalk their dogs, condo board members followedthem in their cars, surveilled them and took photos.Upon learning of this situation from one client, FairHousing Project staff reached out to other aggrievedresidents, resulting in a group of nine clients. LegalAid staff advised them of their fair housing rights,filed discrimination complaints with the U.S. Depart-ment of Housing and Urban Development, anddrafted a lawsuit. Before the lawsuit could even befiled, the condo board requested that the partiesfirst mediate in an effort to resolve the matter. As acondition of doing so, Fair Housing Project staff de-manded and obtained a temporary suspension ofthe communities’ rules and surveillance pending themediation’s outcome. The parties mediated in Sep-tember 2013, and through mediation the parties set-tled for $81,000 for Legal Aid’s clients.

THOSE WE HELPDOMESTIC VIOLENCEFor several years Marcela had been struggling with violent episodes at the handsof her ex-husband during timesharing exchanges for their young child. Marcelahad tried to obtain many restraining orders against her ex-husband, however all ofthe injunctions had been denied by the court. Eventually, the ex-husband was ar-rested for a domestic battery which was not pursued by the State Attorney’s Of-fice, despite the fact that Marcela had video evidence of the assault. At this point, Marcela sought the assis-tance of the Legal Aid Society’s Domestic Violence Project. When her ex-husband showed up for the restrain-ing order hearing with his attorney, he refused to agree to the order, so the case was continued and discoveryproceeded. Legal Aid’s attorney spent hours with Marcela reviewing the complete history of domestic violenceshe had experienced, all the while attempting to negotiate a solution with the ex-husband which would bothprotect Marcela and resolve the other issues she was experiencing regarding time-sharing and the exchangesof their young child. Eventually, after three hearings and numerous negotiations with the ex-husband’s attor-ney, Legal Aid’s Domestic Violence Project attorney secured a restraining order through an agreement thatprotected Marcela from any further contact or abuse and resolved the remaining child custody issues.IMMIGRATION Gisela was illegally brought to the United States at the age of 4. At age 12, the Department of Children and Families (DCF) removed Gisela from the fam- ily with whom she was living because of severe mental, emotional and sexual abuse. When DCF attempted to obtain Medicaid coverage and a Social Secu- rity number for her, they realized that she had no legal status in the United States and was therefore ineligible for any health coverage. To make matters worse, Gisela did not even know her true country of birth. The Juvenile Court appointed Legal Aid’s Immigrant Advocacy Project to solve the child’s immi-gration matters. Immigrant Advocacy Project staff determined that the Gisela was eligible to apply for lawfulpermanent residence through a special procedure designed for juvenile court dependents. First they amendedthe order of dependency to include findings required by the immigration law. Then staff began an exhaustivesearch for the child’s birth certificate, finally locating a copy at the elementary school where Gisela was firstenrolled. The Legal Aid attorney then prepared and submitted the required documents and applications andrepresented Gisela at her immigration interview. She was approved for lawful permanent residence, which willenable her to work and live in the United States permanently. Her new status also rendered her eligible forMedicaid coverage as well as coverage under the Affordable Care Act. Gisela will now be able to attend a col-lege or university in the United States and to qualify for in-state tuition. She can live and work in the UnitedStates permanently, and after five years, she will be eligible to apply for United States citizenship.

2014GUARDIAN ADVOCACY Mrs. Lowell is a 62-year old mother of a severely disabled adult child. Randall is unable to perform any of his daily tasks – eating, washing, bathing, dressing – without assistance. He is in a wheelchair and has the capacity of a very young child. In August of 2014, Ms. Lowell was referred to the Legal Aid Society’s Medi- cal Legal Partnership Project (MLP) by staff at a local health clinic, where she re- ceives primary care. She was notified that the Agency for Persons with Disabilities (APD) intended to further reduce Randall’s benefits to an unsustainable level (there had been a prior reduction to Randall’s benefits that had already greatly reduced the quality of Randall’s life). The new, proposed reduction would prevent Randall from receiving lifesaving therapy and assistance.After investigating the facts of Randall’s case, the MLP attorney appealed the APD’s decision. As representa-tive on the case, the MLP attorney learned that it was a statewide change in the way APD calculates its budgetand that legal services organizations were collectively challenging these changes in federal court. The MLP at-torney was then approached by a large number of other clients to represent them in their administrative hear-ings. The MLP attorney was able to stay proceedings at the administrative level until the federal judge deter-mined that APD’s changes were illegal and unconstitutional. The court ordered APD to make significantchanges to the way it calculated its clients’ budgets. As a result, Randall was able to retain his benefits.During this administrative appeal on Randall’s behalf, Mrs. Lowell lost her long-time employment as a house-keeper. Her previous employer, recognizing that Mrs. Lowell was in a precarious financial situation, had beenpaying an attorney to handle her guardianship for her son. Without her employer’s assistance, Mrs. Lowell re-alized that there was no way she would be able to afford to pay an attorney to file her 2014 guardianship pa-perwork. Mrs. Lowell discussed this situation with the MLP attorney. Unfortunately, Florida law requires anattorney of record in all guardianship cases. After consulting with her colleagues, the MLP attorney deter-mined that the best course of action would be to convert the guardianship into a guardian advocacy position.Mrs. Lowell would be able to retain all of her legal rights and responsibilities without having to file annual pa-perwork with the assistance – and expense – of an attorney. The MLP attorney successfully petitioned thecourt for a conversion naming Mrs. Lowell as the guardian advocate for her son, Randall. PRO BONO PARTICIPATION Pro Bono Impact in 2014In Palm Beach County, the Legal Aid Society of Palm Beach County is thedesignated agency for administering Florida's Pro Bono Plan. That plan, 528outlined in Rule 4-6.1, Rules Regulating the Florida Bar, describes lawyers' Number of Attorneysprofessional responsibility for pro bono service. The professional respon- Providing Pro Bonosibility may be discharged by: (1) annually providing at least 20 hours of Servicespro bono legal service to the poor; or (2) making an annual contributionof at least $350 to a legal aid organization. Each year, the Legal Aid Soci- 1,070ety requests participation from the county's attorneys and forwards a Number of Attorneysparticipation form to be completed.
