faWfaWoonnrriiddtthhaaLJJllLllUU..IIBBSS WWEETTRRIIiittCCTThhEEYYLLaaIIffnnooBBddrrEEJRRJUaaUTTllSllSYY..TTIWWICaaCnniiEttEddhh fofJJoLLrUUrII DEAR FRIENDS AND SUPPORTERS: 2010was a year in which Legal Aid, with the assistance of the private bar, established a number of Pro Bono initiatives in order to continue to meet the increased demand for our services, which began in 2008 as a result of the country’s severe financial crisis. The large influx of families facing mortgage foreclosure required innovative approaches to providing legal assistance to this client group. Thankfully forty (40) Florida Power & Light (FPL) attorneys came forward to partner with Legal Aid and establish the FPL Mortgage Foreclosure Project to provide advice, counseling and education to these families. Additionally, twenty (20) attorneys at Office Depot collaborated with our Pro Bono Department and initiated a Foreclosure Mediation Project to help individuals through the maze of the Residential Mortgage Foreclosure Mediation Program. In response to the growing number of Palm Beach County youth aging out of the foster care system and in need of advocacy to ensure their successful transition to adulthood, the law firm of Greenberg Traurig partnered with Legal Aid’s Juvenile Advocacy Project to create the Independent Living Project. The Greenberg lawyers serve as attorneys ad litem for these young people to protect their rights to benefits to which they are entitled under the law. 2010 also saw the establishment of the Legal Advocacy for Minor Mothers Project (LAMMP), funded by the Florida Bar Foundation and Greenberg Traurig. This program provides legal representation for parenting and pregnant girls involved in the delinquency and dependency court systems. In addition to responding to the immediate needs of Palm Beach County’s disadvantaged community, we also responded to the earthquake crisis in Haiti. With emergency funding from the Florida Bar Foundation, we hired a Creole-speaking paralegal to assist Haitian nationals to apply for Temporary Protected Status (TPS). We also pursued Special Immigrant Status for Haitian children brought to the United States after their parents died in the earthquake. On a much lighter note, we are happy to report that we were able to increase the amount raised by our 10th Annual Cup of Justice Golf Classic, held on October 11, 2010 (Columbus Day), by 100%. All these funds are earmarked for Legal Aid’s Educational Advocacy Project. We could not have achieved any of the above goals without the unwavering support of Legal Aid’s board of directors, staff, funders and the private bar in Palm Beach County. While the demand for our services exceeds ourcapacity, especially during these difficult times, we strive to meet the current legal needs of low income individualsin Palm Beach County. In addition to providing direct legal services to individuals and families, Legal Aid staff oftenadvocate for systemic change on matters that emerge from our cases.The Legal Aid Society fulfills its mission by responding proactively to emerging needs. The following issues werepriorities in 2010:• Guaranteeing access to education, housing, health care, nutrition, and public benefits.• Ensuring that youth with disabilities and those in the criminal justice system have equal access to quality public education.• Advocating for safe, stable, appropriate and permanent placements for children in the foster care system.• Protecting elderly residents from abuse, neglect, exploitation and ensuring that they have a permanent home.• Securing the safety of victims of domestic violence.• Counseling clients faced with foreclosure, evictions and homelessness and preventing housing discrimination.• Assuring appropriate treatment and/or placement for youngsters with emotional, developmental or physical disabilities. 3

DCF and GAL toldthe judge that Florida would face fines if it did not hold up itsend of the compact. They also argued that New York coulddecline to accept Robert if Florida violates ICPC.JAP offered evidence that it was in Robert’s bestinterest to remain in New York pending the ICPCprocess. The Court granted the Motion to Extendthe Visit for up to 30 days from the start of the visit.The JAP attorney then filed a Motion for Modification ofPlacement for Robert to permanently live with his auntand uncle. DCF and GAL filed an Emergency Motion forOrder Returning the Child to Florida arguing that Robert’scontinued placement violated the ICPC. While it mayhave been technically correct that ICPC was violated byallowing Robert to stay without an official acceptancefrom the State of New York, the JAP attorney argued itwas more important that Robert desired to live with hisfamily who could provide a loving, stable, permanenthome for him and this placement was in his best interest.The judge ruled in favor of DCF and GAL expressingregret that she felt compelled to order his return toFlorida. The judge then stayed her order pending appeal.The JAP attorney filed a Writ of Certiorari to theFourth District Court of Appeal appealing the juvenilecourt’s order. In a stunning ruling with far-reachingimplications, the 4th DCA ruled that, “Although thereis technical non-compliance with the compact, theparamount concern is the best interest of the child.”The 4th DCA further stated, in a sharp rebuke to DCF,that, “DCF has taken on overly legalistic positionthat cannot be reconciled with the facts in thiscase. Courts and agencies charged with protectingthe welfare of children should be concerned foremost withthe best interest of the child.” Finally, the 4th DCA wrotevery poignantly of Robert, noting, “The record in this casedoes not fully reveal the extent of the hardships (Robert)has faced, but he has expressed a determination toovercome these obstacles and a brighter future is at hand.”

She hadalso started divorce proceedings, but allowed them to bedismissed after she reconciled yet again with her husband.The prior cases had involved serious injuries includingbroken bones and her husband had actually been arrestedfor each of the incidences. Kari was not working at thetime. Her husband made a good living and for that andvarious other reasons she decided to reconcile with him.In late 2010 Kari called the Domestic Violence Project forrepresentation in a new injunction case. Once again, shehad suffered serious injuries during a recent attack by herhusband, however, this time the incident was witnessed byher young children. Once again her husband was arrested. 6

The Elder Law Projecthas been able to be helpful through legal representationfor foreclosure cases and through explanation oftimetables and procedures so that clients can have abetter understanding of the events that are transpiring.The Project was also able to develop two newbrochures for distribution to our elder clients to(1) explain the basic requirements for qualificationfor Social Security Disability and SupplementalSecurity Income including what to do if they aredenied benefits and an explanation of Medicareand Medicaid (2) to explain the importance ofplanning for future medical needs through AdvancedDirectives, Powers of Attorney and Living Wills.Martha Jones, an 85 year old woman, came to the as pro bono counsel for Ms. Jones and contacted a Elder Law Project (ELP) with a mortgage foreclosure local news reporter to discuss Ms. Jones’ situation. Clyde’s application under the HRIFA program had been denied in 2003 because he tested positive for HIV. Fortunately, the “HIV bar” to lawful status was removed from the immigration law in early 2010. Staff assembled the voluminous documents necessary to establish eligibility for the program, which included hundreds of pages of documentation establishing his continuous residence in the United States from 1992 through 2010, and moved the court to reconsider his HRIFA application based upon the change in law. The judge granted the motion to reconsider and then granted Clyde’s HRIFA application, and he became a lawful permanent resident of the United States in one day. Now Clyde is able to remain in the United States where he can access the medications necessary to sustain his health. 9

Beginning in January 2010, the Project started a clinic one evening per month where FP&L attorneys meet with clients who have been served with foreclosure papers at the Legal Aid Society offices from 5 to 8pm. Since the Project’s inception 215 families facing foreclosure have been provided with legal counseling. 10
