The location of the food truck shall not obstruct pedestrian pathways, the park driveway or create a safety hazard. □ Crawford Cove Park will remain open to all residents of Crawford Crossing. □ Food truck hours are limited to sunrise to sunset and may not remain overnight. □ All litter, trash and materials associated with the food truck is the responsibility of the requesting homeowner. □ Homeowners are responsible for all costs associated with any damage or clean up necessary at the park following the event. □ Location standards do not apply to food trucks which operate as a part of a Crawford Crossing sponsored event. Release and Indemnification. By signing this agreement, Homeowner hereby releases, and agrees to defend, indemnify, and hold harmless the Association and its members, directors, officers, managers, and agents, from any costs, claims, damages, or liability, including without limitation liability for negligence, strict liability, or punitive damages, including without limitation claims for personal injury or death, arising out of or associated with this event and food truck operations. In no event shall the Association be liable for any damages or injury pertaining to the operation of the Food Truck and associated event. CRAWFORD CROSSING HOA COMMITTEE STRUCTURE & APPLICATION
Crawford Crossing HOA Committee Roles & Responsibilities The Crawford Crossing HOA Board recognizes the value of adding homeowner involvement in the establishment, development and operations of the Crawford Crossing HOA. The engagement of homeowner volunteers will be accomplished through the creation or continuation of standing committees. Committees will consist of: • ARC – Architectural Review Committee • Lake Committee • Property & Development Committee • Event & Hospitality Committee Each committee will be comprised of five (5) members, one of which will be an HOA Board member. These standing committees provide support to the Board by reporting back on relevant issues and the status of their committee work. For this reason, committee chairs are often board members. Committee members will serve for one year but may serve multiple years with Board approval. Committee work is expected to take 2-4 hours per month; however, this may fluctuate pending actions the committee is working on. The Board has the authority to fill committee vacancies, as well as remove members from the committee. Committees have no expressed or implied power or authority. Committee members are not expected to provide manual labor for any project or event; however, they may recruit volunteers to help with specific projects. Roles and Responsibilities of the Committee Chairpersons • Provide leadership and ensure the Board’s goals for the committee are successful. • Schedule and attend committee meetings; follow up with absent members. • Create and send out meeting agenda. • Prepare background material(s) for other committee members. • Prepare meeting documents, such as minutes, reports and/or project plans. • Send meeting minutes to the Board and provide committee work updates one week prior to HOA board meetings, if applicable. • Oversee the development and implementation of work or action plans. • Serve as chair for one year; may serve longer with board approval. • Observe and follow CC HOA Bylaws and CC&Rs. Note: Committee members may assist the Chair by assuming some of these responsibilities. CCHOA Committee Structure REV 7-27-22 Page 1
Roles and Responsibilities of Committee Members • Attend scheduled meetings. • Commit time to work with other committee members in fulfilling committee goals. • Contribute to fulfillment of committee work or action plans. • Assist in preparation of minutes, reports and/or project plans to include research as necessary. • Serve on the committee for one year. • Observe and follow CC HOA Bylaws and CC&Rs. Note: Committees may choose to assign responsibilities differently than listed above. Purpose of Committees ARC – Reviews the design and landscape plans of all new homes and any changes or additions to the landscaping or exterior of any existing homes. They shall assist the Board in its oversight responsibilities related to the ARC requirements as outlined in the Bylaws, CC&Rs and other governing documents; including emailing ARC approval and denials to the Board for review and comment 24 hours prior to notifying the homeowner. Committee members will monitor landscape and homes in the HOA and bring compliance issues to the attention of the Board. Lake Committee – Reviews dock installation and Private Use Area (PUA) modification applications and makes recommendations to the Board. Create Private Use Area Permits as instructed by the Board. Assists the Board in its oversight responsibilities related to the lake requirements as outlined in the Crawford Crossing Lake and Park CC&Rs, Bylaws, CC&Rs and other governing documents. Committee members will monitor the lake area, docks, private use areas adjacent to the lake and peninsulas in Crawford Crossing and bring compliance issues to the attention of the Board. Property and Development Committee – Assists the board in identifying the current and future needs for both developed and undeveloped common and private use areas in Crawford Crossing.* Makes recommendations to the board from homeowners that relate to the use of HOA property. May assist the Board in the planning and development of Capital Improvement projects, including, but not be limited to, creating project projections, obtaining contractors and developing budget proposals. The Committee will monitor the Common Use and Private Use areas of the HOA and bring compliance issues to the attention of the Board. *Note: This does not include the HOA maintenance contract, which is a board responsibility, or the PUA areas adjacent to the Lake, which fall under the Lake Committee. Events and Hospitality Committee – Plans, sponsors and notifies the community of HOA events and activities throughout the year. Examples of these include, but are not limited to, neighborhood Meet and Greets, National Night Out, and lake/holiday activities. Elicits ideas for new activities from the HOA and brings to the Board as appropriate. Provides new homeowners with a welcome letter and personal visit when possible. Suggestions for Successful Committees 1. Stay in contact with your committee members: • Maintain contact list of all committee members. • Provide list to all committee members and the Board Secretary. 2. Manage the logistics: • For in-person meetings, be sure the agenda, location and directions, contact information, discussion materials are sent with adequate advance time. • Follow the committee chair’s direction on how to manage documents. 3. Support the committee chair to lead the committee effectively: • If you take meeting minutes or notes, ask the chair what level of detail is desired. • Develop a year-long calendar for meetings or work timelines. • Collaborate and communicate to ensure all committee members are equally informed. 4. The HOA Board member serving on the committee, Board President or Secretary will: • Ask the committee chair if there are materials the Committee would like to include in the board packet or have available to distribute at the meeting. • Be available to the committee chair the week before the meeting to discuss what will be presented at the HOA Board Meeting if they are being asked to present information. • Be available to assist in problem solving concerns with other committee members or regarding committee responsibilities or actions. CRAWFORD CROSSING HOA P RIVATE USE AREA MODIFICATION
Crawford Crossing HOA Lakefront Private Use Area Application Process Required for ALL modifications to the Private Use Area (PUA) (or Common area for certain properties) adjacent to the lake, including dock installations. 1. Homeowners wishing to modify the PUA adjacent to their lakefront property are required to submit a complete Private Use Area application, with supporting documents, to the Lake Committee via the Board email. Applications can be found at www.crawfordcrossinghoa.com. The Board email is [email protected] A complete application packet includes: a. Private Use Application b. Detailed Site Plan (include all dimensions and measurements) c. Dock plan, if applicable d. Insurance. Insurance to include the Crawford Crossing HOA and The City of Turner (if PUA includes a dock) as additional insured. 2. Application packets are reviewed by the Lake Committee to ensure modifications meet the PUA Guidelines. The Lake Committee will work with homeowners to get additional information, as needed, and make final recommendations to the Board. The Lake Committee Chair must submit the recommendation, along with the complete application, to the Board at least one week prior to a Board meeting. The entire approval process may take up to 45 days. 3. The Board will vote on applications at their monthly HOA Board meetings. If approved, the Lake Committee will prepare a PUA Permit and instruct the homeowner on the recording process. Final approval will be given once the Lake Committee receives a copy of the recorded permit. 4. It is the homeowner’s responsibility to pay recording fees and record the PUA Permit with the Marion County Clerk’s Office. Once recorded, the homeowner must return the permit to the Lake Committee for verification of recording and record keeping. 5. All documents are submitted to Century 21 NorthStar for retention. I (we) further acknowledge that I (we) have carefully read, understand and agree to comply at all times with all the requirements of the CC&R’s and Lake Packet Guidelines. I (we) further agree that the development of the Private Use Area shall conform to all development plans submitted and approved by the Board and that any and all changes to the approved plans must be submitted to and approved by the Board before any altered plans are implemented. I (we) further understand that no work may commence without written permission from the Board. All requirements of any law, ordinance or regulation of the State, County or City and any other government entities shall be complied with as far as the construction process is concerned. The Board reserves the right to hold an on-sight inspection of the proposed area to be modified. Once plans have been approved, inspections may be made at any time to ensure compliance. By signing this agreement, specific permission is hereby given to the Board to enter the property at reasonable times to make said inspections. Failure on the part of the contractor and/or owner to strictly adhere to the CC&R’s, Lake Packet Guidelines, and the plans approved by the Board, will force the Association to take all steps necessary to remedy such noncompliance. If the undersigned are notified that they are not in compliance with this agreement, they agree to stop construction, to pay fees as required by the Board to review revised plans, and to pay the costs of the Association in enforcing compliance, whether or not any legal action is taken.
