U•COMP Board of Trustees Meeting Friday, March 6, 2020 U•COMP Operations Update Submitted by: Harry Krot, Director of Marketing and Member Services Marketing  Program advertisements and articles were placed in the PML Municipal Reporter, the League Link and the PAHRA Monitor as well as the GFOA Newsletter.  Staff ordered conference giveaways that have the new U•COMP Brand. Operations  Reviewed impact of recent UC decision: Robert E. IHLEIN, Petitioner v. UNEMPLOYMENT COMPENSATION BOARD OF REVIEW Summary: A few weeks ago, a municipal manager from one of our U•COMP member municipalities reached out to us about a recent unemployment court case that made the local papers here in the Harrisburg area. The manager asked about the impact of the case as it relates to the Trust paying manager claims going forward. The Ilhein decision dealt with a municipal manager who filed for unemployment compensation but was denied by the judge stating in her opinion that, major non-tenured policymaking or advisory positions are not eligible, referring to the municipal manager in this case. Staff obtained a copy of the decision and reviewed it with our legal counsel. Staff also conferred with Equifax as to their thoughts on the matter. Our attorney stated that the case was unreported and as such does not create precedent. Furthermore, two previous UC referee decisions from 2003 and 2006 provide additional basis for the Trust to continue to pay unemployment compensation to municipal managers.

U•COMP Trustees Meeting March 15, 2019 ~Page 2~ The U•COMP Trust has always paid unemployment claims for municipal managers. Based upon on our legal counsel’s review, we have determined that the recent Ilhein case does not impact the Trust’s current policy of paying UC claims for municipal managers. The Trust will continue with its current policy.
