They told him that placing retentions into a guaranteed trust account would protect sub-contractors’ cash from upstream insolvency and urged the Minister to consider outlawing extended payment terms, such as the 126-day model used by Carillion. They also explained to Mr Clark the role of other mechanisms like project bank accounts and public contracts payment models, which can be used to protect SMEs and the thousands of people they employ. Our snap poll of members also revealed that: • Micro businesses (less than 10 employees) are owed on average £98,000 by Carillion, but one is owed over £250,000; • Small firms (10-49 employees) are owed £141,000 on average, but one is owed £800,000; • Medium-sized businesses (50 – 249 employees) are owed on average £236,000 – but one is owed almost £1.4m; • The very largest businesses (250 employees +) working for Carillion are owed on average £15.6m. According to its latest set of accounts, Carillion was holding over £800m in overdue payments owed to sub-contractors, but the company’s liquidators PwC said they will not honour payments for work completed before January 15. This will be classified as ‘unsecured debt’ and is, therefore, unlikely to be recovered – it is this kind of blatant payment abuse that the Aldous Bill seeks to avoid in future. “There are frantic attempts going on behind the scenes to rescue Carillion’s projects and switch them to other contractors,” said BESA President Tim Hopkinson. “However, unless retention money is protected, there is a danger that the problem will simply be moved to another place and the same thing could happen all over again,” he said. Mr Hopkinson urged all BESA members to write to their local MPs urging them to support the Bill and help it get through the vote on April 27th. TRAINING BESA apprenticeship service gathers pace BESA has been accredited to provide apprenticeship training for the building services sector across the uK and also to be an independent ‘end point assessor’ in England. These are key achievements for the Association as it steps up the delivery of the New Standard apprenticeships and is the culmination of two years’ hard work. It means it is now able to provide members with a complete apprenticeship training service from initial recruitment through to final certification – and then ongoing competence assessment throughout a candidate’s working life. Piper Training Ltd (trading as BESA Training) is now an officially registered training organisation able to operate across England, Scotland, Wales and soon Northern Ireland. Last year, it was also appointed as a Registered End Point Assessment Organisation (RoEPAO), which allows it to assess new training standards in England. The use of end point assessment marks the start of a new era in apprenticeship training with candidates given a final test to ensure they have developed the necessary knowledge, skills and behaviours to equip them for the ‘real world’ of work in the building engineering profession. The assessment involves a series of interviews, practical assessment and supporting questions where students are examined – independently of their training provider – and this should give employers greater peace of mind that they are receiving apprentices with fully rounded competence ready for productive work. SUPPORTING YOUR BUSINESS Don’t let your data processing catch you out GDPR is coming and there is no way of escaping it! In the last issue of your BESA we shared with you a checklist of the top 10 steps you needed to take in order to prepare your business for the enforcement of GDPR on 25 May 2018. As part of the compliance process, BESA has been considering how it handles its data processing. We have been tasked with asking ourselves a series of important questions to help map out our data processing and we thought it would be useful to share some examples with you to help you get started.
