COVERAGE All the LGUs affected by the Supreme Court Decision datedDecember 18, 2018 (G.R. No. 171947-48). The Project covers the 178 LGUswithin the Manila Bay Area located in Regions III, IV-A, and NCR.REGION CITIES MUNICIPALITIES III 13 81 14 53 IV-A 16 1 NCR 43 135 TotalKEY LEGAL PROVISIONS Order of His Excellency President Benigno S. Aquino III to clear thewaterways and adjoining tributaries to the Manila Bay. Supreme Court Decision dated December 18, 2008 (G.R. No. 171947-48),and its corresponding Resolution dated February 15, 2011, directing the 13agencies, including this Department to spearhead the clean - up, rehabilitationand preservation of the Manila Bay. PROCEDURES The concerned DILG Office (Central/Regional/Provincial) shall providetechnical assistance in partnership with HUDCC and NHA on the formulation ofLSP and RAP of the LGUs through series of training activities and seminars forthe workshop and writeshop of the said plans. The DILG shall monitor the status of these plans up to the adoption of theLGUs. 44

ROLES AND RESPONSIBILITIESDILG Central Office (BLGS) shall:  Formulate policies to provide guidelines in the implementation of the MBCRPP-ISF Component;  Steer/facilitate training programs to capacitate personnel both from DILG and LGUs who provide technical assistance in addressing ISF concerns in the field of LSP and RAP;  Prepare plans and budget necessary for project fund allocation;  Coordinate with HUDCC and other NGAs and NGOs concerned in addressing ISF issues and problems on housing;  Monitor the progress of project implementation to ensure that the objectives are realized and the targets are met; and  Update the Secretary, through the Undersecretary for Local Government, on the progress of the project implementation. DILG Regional and Field Offices shall:  Facilitate training programs to enhance the knowledge and skills of the members of the LHB in the development of LSP and RAP;  Facilitate writeshops for the actual drafting of the plans by the LGUs;  Coordinate with HUDCC, other NGAs and CSOs concerned in addressing ISF issues and problems;  Conduct convergence meetings with stakeholders to synergize efforts to clean-up the Manila Bay area and its tributaries; and  Monitor the progress of the project and submit update to the Secretary, through the Undersecretary for Local Government. 45

Local Government Unit shall:  Develop LSP, through the LHB, in coordination with the Housing and Urban Development Coordinating Council (HUDCC) and DILG;  Maintain and update databank on the profiles of their inhabitants, especially the ISFs;  Coordinate with NGAs, CSOs and other agencies that provide assistance in addressing ISF concerns; and  Advocate laws and related policies in addressing ISF concerns through activities conducted in the locality, such as during Barangay Assembly Days, among others. FINANCIAL ARRANGEMENTS The funds intended for the preparation of LSPs, and RAPs shall bereleased, downloaded or transferred to the concerned DILG Regional Office,based on their approved Operations Plan and Budget/Work and Financial Plan.The PMO will facilitate the downloading/transferring/releasing of funds throughthe Financial Management Service. Within 30 days after the utilization of saidfunds for the preparation of the Plans, the DILG Regional Office, through theirrespective DILG Provincial Offices, are required to submit to the PMO, theirrespective disbursement/liquidation report, to ensure that the funds areappropriately utilized and accounted for. A copy of the said report will also beprovided to the DILG FMS. SUBMISSION The LGUs are expected to submit a report of the status of their LSP andRAP to DILG Regional Program Management Teams for the consolidation and itshall be submitted to MBCRPP-PMO. Subsequently, the LGU shall conduct thenecessary steps in proposing for the approval and adoption of the draft plan bytheir local sanggunians for funding and implementation purposes. 46

This KPI is anchored on the tenets of Republic Act No. 9275otherwise known as the Philippine Clean Water Act of 2004which requires that a Water Quality Management Area be established and a Governing Board for the same beoperational. The Board shall then release the guidelines for the LGUs to use as basis in creating Water Quality Compliance Plans (Section 20).



The last LGU KPI is the number of Information, Education andCommunication Campaigns. Each regional office is asked to organize at leastthree (3) showcase clean-up drives within their region every quarter. Theseclean-up drives are separate from the regular clean-ups that the LGUs are toconduct themselves. Whenever the Regional Office organizes such activities, it isexpected that they would also conduct at the same time small seminars within thelocality to promote environmental awareness amongst its inhabitants. The LGU KPI also hasreportorial requirements, asidefrom the number of clean-upsconducted; LGUs are also tosubmit data on the amount ofwaste collected per clean-up andthe total area of waterwayscovered by the clean-up activity. RATIONALE Help in the actual cleaning of waterways and the Manila Bay; and Promote environmental awareness to entail behavioral change and solicit the participation of the citizens in cleaning and maintaining their surroundings. KEY LEGAL PROVISIONS Supreme Court Decision dated December 18, 2008 (G.R. No. 171947-48), and its corresponding Resolution dated February 15, 2011, directing the 13 agencies, including this Department to spearhead the clean-up, rehabilitation and preservation of the Manila Bay. ROLES AND RESPONSIBILITIESDILG Regional Office shall:  Organize clean-ups with simultaneous Environmental Management seminars to barangay officials and host communities;  Monitor LGU clean-ups;  Conduct dialogues with LCEs for the advancement of the program and its concerns; and  Consolidate the LGU data report for the said LGU KPI for submission to the Central Office. DILG Central Office (BLGS) shall:  Devise the report format to be used for the LGU KPI;  Consolidate the LGU KPI Reports of the Regional Offices;  Verify the data submitted;  Submit the LGU KPI Report to the Supreme Court; and  Prepare the DILG LGU KPI Presentation intended for the Supreme Court MBAC meetings. SUBMISSIONSThe DILG Regional Offices shall submit to the Central Office (MBCRPP-PMO)20 days after the end of each quarter, a consolidated regional report of the LGUKPIs. For LGU KPI VI, they are to submit the number of clean-ups conducted,the amount of waste collected, and the area covered by the clean-up. Such datawill be reflected on the Supreme Court Report of the Department. 50





Submission of Quarterly LGU Key Performance Indicator Reports to theSupreme Court– Manila Bay Advisory Committee (SC-MBAC) All key performance indicators are to be inventoried by the LGUs during themonitoring quarter. By the end of the quarter, the LGUs must submit their reports totheir respective City/Municipal DILG Offices using the DILG Manila Bayanihan DataCapture Forms (refer to Annex VII and VIII). The City/Municipal DILG Office shallthen forward the same to their respective Provincial/Cluster DILG Offices forconsolidation. The Provincial/Cluster DILG Office with its established Inter-agencyManila Bay Monitoring and Validation Team shall conduct random validation ofLGU submissions as needed. The deadline of the submission of the Provincial/ClusterDILG Offices to the Regional Offices is on the 10th day of the reporting month (orthe month after the monitoring quarter). Once the LGU reports have been submitted to the ROs, the Regional FocalPersons and Program Officers must prepare a Regional Consolidated Quarterly LGUKPI Report. This report must be submitted to the Central Office before, but not laterthan the 20th day of the reporting month. Upon receipt of the Regional Reports, the Central Manila Bay Team shallprepare the Overall Department Consolidated Quarterly LGU KPI Report. Thisreport shall be submitted to the SC-MBAC and the Manila Bay Coordinating Office,in electronic copy, ideally on or before the 25th day of the reporting month, whethersigned or unsigned. If unsigned, electronic copies of the signed documents shall beforwarded as soon as the Secretary or his representative has affixed his/her signatureon the report. An electronic copy of the Overall Department Consolidated Quarterly KPIReport must also be transmitted to the Office of the Solicitor General, DILGPlanning Service, DILG IAS, DILG COA, and DILG ROs III, IV-A and NCR.Manila Bay LGUs (KPI Reports) Supreme CourtDILG Provincial/Cluster Office Manila Bay Coordinating Office (DENR) DILG Region III DILG OSG DILG Region IV-A Central Office PS DILG NCR 53

Downloading and Sub-allotment of Funds to Regional Offices Every semester, or whenever practicable in accordance with the Central/Regional Operations Plan and Budget, the PMO, through the FinancialManagement Service, shall facilitate the releasing, downloading and transferringof funds in favor of Regional Offices III, IV-A and NCR. Said funds will includeprovisions for Subsidy to LGUs, operational expenses for the Manila Bay RegionalPMT such as supplies and materials, payment for contract of services, trainings,seminars and workshops, and other cost necessary in the implementation of theproject.Sub-allotment DILG Regions III, IV-A and NCRSubmission of Reports on the Utilization of Funds To ensure that the funds downloaded are appropriately disbursed andutilized, the DILG Regional Offices are required to submit to the PMO, withinfive (5) days after the end of every quarter, their respective a) Flash Report; b)Report of Disbursement; and c) Accomplishment Report (based on the OPB/WFP). It is to be noted that no funds shall be released in the succeeding quartersunless these reports are submitted by the concerned Regional Offices. Providedfurther that before the subsequent release of additional funds, the Regional Officemust upon request for the release of their funds have already disbursed at least90% of the funds previously released to them. Additional reports may be requiredto be submitted upon instructions and directives from the higher officials of theDepartment, or upon requests from NGOs, and other national governmentagencies such as Commission on Audit, Congress and Senate.Fund Utilization DILG Regions III, Report IV-A and NCR54





Intra and Inter-Agency Meetings The Manila Bay PMO and its Regional counterparts are to regularlyconduct Coordination and Consultative Meetings to properly monitor andcoordinate the activities of the program. Said meetings are intended to harmonizethe efforts not only of the different concerned offices of the Department but alsothe activities and efforts of the other mandamus, cooperating agencies, and theLGUs.DILG Manila Bay Regional and Central Semestral Exit Conference Before or at the end of each semester, the Regional Offices together withthe members of the Regional Inter-agency Monitoring and Evaluation Team areto conduct an exit conference with its covered LGUs as participants to assess theoverall performance of the LGUs and to communicate to them the results of theircollective efforts in response to the mandamus. The activity will also serve as avenue for the LGUs and the NGAs to discuss and/or resolve issues and otherconcerns on the implementation of the program. After the conduct of the Regional Exit Conferences, the Central Officeshall organize a national level conference. The conference shall have similarobjectives but the participants will be the Central Offices of the concerned NGAsand the Regional Offices of the DILG. The Central level conference will focus onthe policy side and the resolution of issues and concerns raised during theregional exit conferences.Yearly Planning and Budgeting Workshop Before the end of each calendar year, the Central PMO shall organize aplanning and budgeting workshop. The workshop shall be an avenue to producethe working drafts of the central and regional Operations Plan and Budget for thesucceeding calendar year. 57
