Crewing Manual Assign seagoing staff from available resources to a vessel bearing in mind an individual’s suitability to a particular vessel as well as always ensuring that said seafarer is adequately qualified and experienced for that particular type of vessel which he will be employed. Ensure that seafarers assigned to any vessel meet the certification requirements of the STCW 1995 Convention, as amended, authenticity of various licenses like GMDSS, Certificate of Competency & Seaman’s Book and the vessel’s flag state administration etc. Concentration on Training of seafarers to ensure that continuous upgrading of professional knowledge and interpersonal skills achieved as per principal requirement. Explore all possibilities for cost effective travel arrangements for joining and repatriating of our seafarers. Priorities are given to implement training schemes for Cadets or Trainees, who after training will be able to supplement the Company’s requirements for sea staff. To maintain records of seafarers and copies of their certification in the ShipMate database. Absolute fool proof administration in all matters relating to a seafarer’s employment, remittances, his and his family welfare (in case of any emergency). Review ship’s monthly wage statement ensuring that any deviations from the norm are followed up immediately with the ship’s command with the copy to SeaTeam Singapore. Maintain close communication with head office and principal to ensure that their requirements regarding quality of staff are being met in all aspects. Liaising with local and international seafaring unions. Review salary and employment terms and conditions as may be requiredControlled Revision: 01 Jan 2015CRM Part A - CRW Doc 003 Approval: WBFSEATEAM MANAGEMENT-CREWING ADMINISTRATION Page: 4 of 13

Crewing Manual3.3 Organizational Structure SeaTeam Management (India) Pvt Ltd and SeaTeam Management (Phils) Inc., are privately held affiliate of SeaTeam Management Pte Ltd (Singapore) established for the exclusive crewing office for the company. The organizational structure reflects the operational obligation and condition for the company with lines of authority and responsibility. The senior management of SeaTeam consists of:  CEO  Crewing Manager  Accounts Manager This group oversee the overall management of the Crewing offices with respect to crewing strategy, crew planning, policies, and quality. The CEO SeaTeam Management (India) Pvt. Ltd concurrently serves as the Senior Manager Crewing for SeaTeam Management Pte Ltd, Singapore. SeaTeam Management (India) Pvt Ltd and SeaTeam Management (Phils) Inc. serves as the primary drivers of crewing services and responsible to follow and incorporate applicable sections of the HSQE Management System as an organizational unit of SeaTeam Management Pte. Ltd., Singapore.3.4 Crew Emergencies3.4.1 Illness, Injury or DeathInitial notification of any Major Casualty will be normally received bythe responsible Technical Superintendent or DPA who will then informthe CEO of the relevant SeaTeam Crewing office. Crewing Manual  Crewing Manager o Contact details are listed in SOPEP Appendix BDepending on the severity of the accident / injury, a decision is made,whether to maintain a watch at the office. The following procedure isfollowed:-  In case of Illness or Injury to a seafarer whilst on board : o Family of seafarer is informed o The seafarer is repatriated to homeport. o On arrival at home port depending on the severity of the injury or illness the company doctor arranges hospitalization. o The seafarer is kept under the company doctor’s observation until he declares the seafarer medically fit to join vessel as per governing CBA. o Seafarers NOK (Next of Kin) must be informed about the permanent disability of a seafarer within 48 hours, of such disability being declared by the medical practitioner.  In case of Injury to office staff whilst in the office premises : o The company doctor is immediately called upon and hospitalization arranged depending on the severity of the injury. o On doctor’s declaring staff medically fit, the staff member resumes work.  In case of death (natural or accidental) of a seafarer whilst on board the following procedure is followed : o Family of seafarer is informedControlled Revision: 01 Jan 2015CRM Part A - CRW Doc 003 Approval: WBFSEATEAM MANAGEMENT-CREWING ADMINISTRATION Page: 6 of 13

Crewing Manual o Seafarers: NOK (Next of Kin) must be informed about the death of a seafarer within 48 hours.  In the case of an accidental death, an enquiry would be required to be conducted followed by post-mortem, as such, the following documents should be available : o Death Certificate* o Post-mortem Report* o Inquiry report. o Police Report. o Embalming Certificate* o A letter from the Police Authorities at the port the body is being landed, certifying that they will have no objection for shipping the body to the seaman’s hometown in India. o A “To Whom It May Concern” letter from the Relevant/ Consulate/Embassy, stating that it is in order to transport the body to seafarers home country. o Extracts of the official Log Book Entries, duly signed by the Master* o Statement of witnesses. o Crew members Passport. o National / Flag state CDCs. o Inventory of Personal Effects from the Master*Please note that all the items should be in original with the exception ofthe Log Book entry, which will be an extract and therefore will besigned by the Master. Items marked with an * will require to beendorsed by the Consulate/Embassy.All the above documents plus the Personal Effects should accompanythe body of the deceased. A copy of the list of PersonalEffects signed by the Master should be inside the baggage and one listshould be with the above mentioned documents. A copy of all theabove documents, including the list of Personal Effects should becovered under a separate cover to the SeaTeam Crewing offices.Please note that all valuables, including cash, jewellery, cameras, musicsystem, etc. should not be sent with the personal effects, as there is alikelihood of the same being stolen. It is recommended that thesaid items be sent by hand of some officer off-signing from the vesseland the officer may be instructed to handover same to the office foronward transmission to the next of kin.3.5 Local Purchasing / Agency NominationThe services purchased related to fleet personnel are:  Medical examination  Uniform / PPE  Air tickets  Agency Nomination  Visas  Union fees3.5.1 Medical ExaminationOn confirmation of selection of an officer or crew member, Seafarer’sMedical are conducted as per Flag state / ILO requirements. Oncompletion of medicals, bills from the company’s medical doctor isreceived and cleared by the Field Office In-charge. On completion ofmedicals and X-ray a detailed report is sent to the office, and a copy ofthe report is retained by the Company Doctor. Crewing Manual3.5.2 Uniform / PPEOn completion of medicals, the selected officer or crew member will beissued with uniform and PPE by the company. The crewing office shallensure efficient stock and charge to respective vessel on issue.3.5.3 Air TicketsThe travel arrangements are done by the SeaTeam Crewing office, aftergetting quotes from different travel agents. At the discretion of theCEO, travel agent may be appointed. Appointment of travel agent to beyearly and once approved, no comparative quote is required. 2 travelagents should be used accordingly as reference for benchmarking.3.5.4 Agency NominationCompetitive quotes will be requested from Port agents and costeffective Crew changes will be affected.3.5.5 VisasThe crew office shall pay or reimburse crew when visas are required.3.5.6 Union FeesThe crewing office will be responsible for making relevant payments inrelation to vessel Union Agreements. This will include deductions fromcrew if stipulated in the agreement.3.5.7 Statutory ContributionsWhere required the crewing office shall make local statutory payments(Provident Funds, SSS, PhilHealth etc). Such payments will be deductedfrom crew if stipulated in agreement.3.6 Vendor EvaluationThe CEO will be responsible for evaluation of suppliers. The 'VendorEvaluation Form' will be used for the same. Crewing Manual requirements of the sample given in terms of quality, has a self corrective process, good after sales service and is cost effective.  Good - Product/service criteria where the subcontractor is given a chance to meet the product/service criteria as defined in Excellence.  Poor - Product/service criteria is where the subcontractor’s quality and service deteriorate over a period of time.3.7 Maintenance of Personnel RecordsOnce accepted into employment, the Crewing Manager and/or CrewingExecutive will keep comprehensive individual service histories of allofficers and crew. These files will record all transactions andcorrespondences with individual marine personnel. Files shall besupported or maintained by the crewing database.3.7.1 ShipMate DatabaseData to be checked and confirmed in the ShipMate Database for thosenewly employed:  PERSONAL- Grade.  STATUS - Date of Availability  EXPERIENCE. To cover at least the last 5 years – Name & Type of Vessel, Dwt, Grt, Engine Type, Engine Model, KW, BHP, UMS, TEU’s (as applicable). Check details of vessels on www.equasis.org. Details to check – Dwt, Grt, Model, Engine Type, Ship Manager Details (for ref check), Vessel Flag, Inspection & Manning (for Deficiencies during sail period of sea-farer).  REFERENCE CHECK – Company Name, Contacted Person’s Name & Designation, Quotes of the contacted person & contact details  TRAVEL DOCUMENTS – All Document Details to be put in with Validity, for e.g. CDC, Passport, US Visa.  COURSES – Mandatory STCW Courses & Value Added Courses (if done any)Controlled Revision: 01 Jan 2015CRM Part A - CRW Doc 003 Approval: WBFSEATEAM MANAGEMENT-CREWING ADMINISTRATION Page: 10 of 13

Crewing Manual4.0 Crew Qualification & Recruitment  Purpose o To specify qualification requirements for crews  Application o Singapore Office o Crewing Offices o Fully Managed Vessels  Responsibility o SeaTeam Management (India) Pvt Ltd o SeaTeam Management (Phils) Inc. o Masters o Individual Crew 4.1 Standards of Training Certification and Watch-Keeping 1995 The STCW convention of 1995 provides basic requirements and standards of qualification necessary for each position on board. Full details are available in the MLC Section of this Manual. 4.2 General Recruitment Practices Crew may be directly recruited by the company or by approved manning agents. Coordination of all recruitment activities is the responsibility of the Crewing Manager. Crewing Manual • Unless extenuating circumstances prevent a personal interview, senior officers will be interviewed by the Crewing Manager prior to being employed for the first time4.3 Verification of Qualifications and ExperienceThe validity of all required certificates, endorsements and experience ofnew applicants is to be checked before employment is considered. • MPM Matrix 001 SeaTeam Officers Minimum Requirements is to be used as a cross reference by the Crewing Manager and staff of Crewing office. o Seaman’s documents must also be checked, both national and international, and personal papers, i.e. validity of passports, visas and vaccination certificates. o Documents will be verified with national authorities through computer databases where available or by postal request. o Upon joining, the Master shall satisfy himself that each crew member has the relevant certificates and endorsement for the position to be held, SeaTeam Form No. CREW 039 should be used for this purpose. He shall ascertain that each crew member is only assigned to jobs and tasks that are in line with his position, qualification and experience, and that the crew members are able to understand key instructions. o The Master shall also check all required travel documents, visa and vaccination certificates are valid for the vessels trading pattern. o The Master shall notify SeaTeam if he finds personnel not conforming to the above. • For senior officers, previous experience and employment is to be checked by having new applicants complete SeaTeam Form No. CREW 039 where the previous employer’s reference is required.Controlled Revision: 01 Sep 2015CRM Part A - CRW Doc No. 004CREW QUALIFICATION & RECRUITMENT Approval: WBF Page: 2 of 14

Crewing Manual o Crewing agents may use equivalent documentation or procedures4.4 Medical Examination for SeafarersAn applicant's medical history is of extreme importance in determiningmedical fitness for sea service. In addition to the medical backgroundinformation required to be listed on SeaTeam Form No. CREW 039Personnel Form, each applicant's medical history shall be checked andsubstantiated during a pre-employment physical examination at anapproved medical clinic. The pre-employment physical examination willinclude increased testing in accordance with age and life-style.Full details of the Pre Employment Medical examination is listed in MLCsection of this Manual.4.5 Interview ProcessInterviews for those being employed on ships with multi-national crewswill be conducted in English for to assess a candidate's suitability forthe vessel intended. Crewing Manual o Comments and assessments made by the interviewer(s) shall be noted and record in shipmate or crew personal files.4.6 Guidelines for Hiring Sea Staff • It is the responsibility of the Crewing Manager to interview, process and hire sea staff • It is the responsibility of the Crewing Manager to ensure all candidates are fully qualified, certified, and medically fit prior to employment • The Crewing Manager and/or Crewing Executive shall ensure that all engaged shipboard personnel if not yet holding valid documents as required by flag state, owner/principal and/or IMO STCW '95 convention are properly applied for, and certificate of application forwarded to all parties concerned • For vessels under full management, hiring of all new Masters, Chief Mate, Chief Engineers, 2nd Engineering Officers and Electricians shall be confirmed by the Fleet Manager in Singapore. • Candidates must be thoroughly checked with previous employers, extensively interviewed to establish level of qualifications and reasons for joining the company • All certificates and endorsement held must be verified for authenticity • For senior positions, Crewing office shall short-list preferably 3 candidates, stating order of preference. Documents (i.e. Bio- data and copies of Seaman's Books on their last 3 contracts) are to be faxed to the company for final selection and approval o The Crewing Manager is to verify with the Fleet Group prior confirmation of selected candidates o For ratings and junior officers, selection and approval may be carried out by the Crewing Manager • Crewing Manager are required to advise the company the names of lined-up crew in ample timeControlled Revision: 01 Sep 2015CRM Part A - CRW Doc No. 004CREW QUALIFICATION & RECRUITMENT Approval: WBF Page: 4 of 14

Crewing Manual • All ex-crew and officers recommended for re-employment are automatically approved for sign-on any of the vessels without further approval from the company as long as subject personnel is duly qualified for the type of vessel and trade • Officers and crew shall as far as possible and practicable rotate among a group of vessels, taking into consideration the owner and type of vessels • If manning agents intend to re-hire any officer or rating who has been reported adversely from previous ship(s), the Crewing Manager shall be notified for discussion and approval prior to re- engagement • All officers and crew due to sign on must have documents (especially licenses, passports, seaman books either National or flag state) valid for the full duration of the contract. • All the applicants (except top 4 and Electrical Officers) to undergo relevant Crew Evaluation Test (CES) test as part of recruitment process. The minimum requirement is 50 percent score.4.7 Minimum Experience Criteria for Promotion and SelectionIt should be noted that experience criteria may vary depending on therequirements of the ship owner, charterer, and/or flag of registry of thevessel: • Deck Department o Master – at least 60 months total actual sea service as a Deck Officer before promotion to Master, including 24 months previous experience as Chief Officer, at least 12 months of which must have been served on the type of vessel where vacancy is available. Minimum entrance requirement as above + 6 months experience as Second Officer. o Third Officer – at least 12 months actual sea experience, including at least 6 months on a similar type of vessel. Minimum entrance requirement as above + 6 months experience as Third Officer. o Bosun – at least 60 months actual sea experience as a Deck Rating with at least 24 months previous experience as Able Bodied Seaman, including at least 12 months on the type of vessel where vacancy is available. o Pumpman – at least 48 months actual sea experience as a Deck or Engine Rating with 24 months previous experience as Able Bodied Seaman or Motorman,including at least 12 months on the type of vessel where vacancy is available. o Able Bodied Seaman (AB) – at least 24 months actual sea experience as a Deck Rating, including at least 6 months on the type of vessel where vacancy is available. o Ordinary Seaman (OS) – at least 6 months actual sea experience on the type of vessel where vacancy is available. o Cadet – Graduate from a Government accredited nautical academy/ institution.• Engine Department o Chief Engineer – at least 60 months total actual sea service as a Marine Engineer before promotion to Chief Engineer, including 24 months previous experience as 2nd Engineer, atControlled Revision: 01 Sep 2015CRM Part A - CRW Doc No. 004CREW QUALIFICATION & RECRUITMENT Approval: WBF Page: 6 of 14

Minimum entrance requirement as above + 2 years experience as Chief Engineer.o Second Engineer – at least 30 months total actual sea service as a Marine Engineer before promotion to 2nd Engineer, including 15 months previous experience as 3rd Engineer, at least 12 months of which must have been served on the type of vessel where vacancy is available. Minimum entrance requirement as above + 1.5 years experience as Second Engineer.o Third Engineer – at least 12 months total actual sea service as 4th Engineer, including at least 6 months on the type of vessel where vacancy is available. Minimum entrance requirement as above + 6 months experience as Third Engineer.o Fourth Engineer – at least 12 months actual sea experience, including at least 6 months where vacancy is available. Minimum entrance requirement as above + 6 months experience as Fourth Engineer.o Fifth Engineer - at least 4 years shore based training at a Government accredited maritime academy/institution.o Electrician – at least 12 months actual sea experience as Electrician or proven history as an Electrician in the marine/offshore environment. Crewing Manual o Motorman – at least 24 months actual sea experience as an Engine Rating, including at least 6 months on the type of vessel where vacancy is available. o Wiper – at least 6 months actual sea experience. o Cadet – Graduate from a Government accredited nautical institution. • Catering Department o Chief Cook – at least 42 months actual sea experience as a Catering Rating with 24 months previous experience as 2nd Cook or proven record of experience and proficiency as a cook or chef in a marine/offshore environment. o Second Cook - at least 18 months previous experience as Messman or proven record of experience and proficiency as a cook or chef in a marine/offshore environment or a reputable hotel/restaurant. o Steward/Messman – preferred record of experience as a waiter, steward or messman or work of a comparable nature, preferably in the marine/offshore environment.4.7.1 Verification of Compliance with OCIMF VIQ MatrixThe crewing manager is responsible to monitor compliance with theOCIMF VIQ Officers Experience Matrix and ensure staff employed meetsminimum expectations. • Ship Mate crewing software “drop-down” feature for Officers Experience will be used for this purpose • If experience requirements cannot be met, documented alternate controls are to be established (e.g. extended hand-over, marine superintendent attendance at first discharge, enhanced induction and briefing, etc.)4.7.2 Probationary Period for Newly Hired Senior OfficersControlled Revision: 01 Sep 2015CRM Part A - CRW Doc No. 004CREW QUALIFICATION & RECRUITMENT Approval: WBF Page: 8 of 14

Crewing ManualAll newly hired senior officers, including the Master and Chief Engineer,will be considered to be on probation for the first three (3) months oftheir first contract. • Fleet technical is responsible to appraise new officers using the company standard form on completion of their probationary period • Employment will be considered confirmed if performance appraisal results in their re-hire.4.8 Development and Promotion of Chief Officers and SecondEngineersWhile the Master/Chief Engineer is to ensure the Chief Officer andSecond Engineers are given ample opportunity to develop skills, suchas ship handling, as necessary to assist professional development andpromotion, the company will, once required experience is obtained andwith, the joint recommendation of the Fleet Manager and CrewingManager, schedule high performing individuals for attendance of aCommand / Leadership Assessment Program. • Successful completion of a recognized command/leadership assessment program is one of the factors considered in promotion to Master or Chief Engineer. • Candidates will attend a 3 week rotation through Singapore office prior promotion to Master or Chief Engineer. Rotation will provide time for interaction with different departments in Office as well as on the job training to develop higher career path and allow evaluation & review of candidates. • Returning Senior Staff will be periodically routed through Singapore Office to support operational commitments while ensuring practical considerations are accounted for.4.9 Returning CrewIn general off-signing staff should be given an indication of their nextappointment. The Master should then follow up with a written statement to the Crewing Manager clearly stating the reason for signing off the crew member In case of accident or injury, a written Statement by the Master, a Logbook entry, an Incident Investigation Report SeaTeam Form No. HSQE 005, statement from a witness (s) and other documentation such as relevant technical printouts or other recordings are required. If a doctor is involved, a Doctor's Report must follow In both of the above situations, it is very important that if the doctor’s visit was to a foreign doctor, his report should be in the English language Note: Some CBA's have clauses dependant on the injury being \"work related\" From experience please note that the full reporting procedure should be followed even if the cause seems to have \"not been work related\", i.e. self-inflicted or occurred outside work hours Repatriation of crew members is undertaken only on Doctor’s written recommendation. Crewing Manual9.2 Fatigue Management The most powerful means of relieving fatigue is to get proper sleep and to rest when appropriate. There are however a number of steps that can be taken to prevent fatigue. Steps such as the following are important in the prevention of fatigue on board ship, and are within the Master’s ability to influence and/or implement:  Ensuring compliance with maritime regulations (minimum hours of rest and/or maximum hours of work)  Using rested personnel to cover for those traveling long hours to join the ship and whom are expected to go on watch as soon as they arrive on board (e.g. allowing proper time to overcome fatigue and become familiarized with the ship)  Maintaining open communications with senior management by informing supervisors when fatigue is impairing their performance  Improving shipboard conditions to ensure that when there is an opportunity to sleep, crew members can take advantage of it without interruptions, e.g. by scheduling drills and routine maintenance functions in a manner that minimizes the disturbance of rest/sleep periods  Assigning work by mixing up tasks to break monotony and to combine work requiring high physical or mental demand with low-demand tasks (job rotation)  Scheduling potentially hazardous tasks for daytime hours  Taking time to personally verify that watch-keeping personnel are getting adequate rest  Ensuring that shipboard conditions, within the crew’s ability to influence, are maintained in a good state (e.g. maintaining the heating, ventilation and air-conditioning on schedule, light bulbs are replaced, sources of unusual noise are taken care of at the first opportunity)Controlled Revision: 01 Jan 2015CRM Part A - CRW Doc No. 009REST AND WORK PERIODS Approval: WBF Page: 2 of 5

Crewing Manual  Re-appraising traditional work patterns and areas of responsibility on board to establish the most efficient utilization of resources (such as sharing the long cargo operations between all the deck officers instead of the traditional pattern and utilizing rested personnel to cover for those who have travelled long hours to join the ship and who may be expected to go on watch as soon as they arrive)  Promoting supportive relationships on board (good morale) and dealing with interpersonal conflict between seafarers  Establishing shipboard practices for dealing with fatigue incidents and learning from them (e.g. as part of the safety meetings)  Increasing awareness of the long term health care of appropriate lifestyle behavior (e.g. exercise, relaxation, nutrition, smoking and alcohol consumption)9.3 Best Practice Implementation To support operations and yet maintain a safe shipboard working environment, the company requires risk assessments to be undertaken at those times when the crew experiences a situation where they are not getting adequate rest. To assist Master to assess the risks associated with fatigue, the company is providing each vessel with Digital Fatigue Calculators. These evaluate the degree of risk based on hours of sleep and allow the user to determine how long before fatigue reaches an unacceptable level based on a score. These scores were established by the University of South Australia after extensive studies of fatigue and fatigue prevention in Australia for the transport industry. Three Fatigue Calculators are provided to each vessel, together with this Directive, for permanent stationing on the bridge, in the Cargo Control Room or Ships Office, and in the Engine Control Room. In cases where a crew member is required to work outside scheduled working hours the fatigue calculator can be used to assess individual fatigue. At no time should a SeaTeam employee continue to work beyond the threshold when fatigue risk becomes extreme, as determinedControlled Revision: 01 Jan 2015CRM Part A - CRW Doc No. 009REST AND WORK PERIODS Approval: WBF Page: 3 of 5

Crewing Manual by a score of 13+ on the Fatigue Calculator. If the crew is required to work with an elevated risk as indicated by a score of 6 - 12 on the Fatigue Calculator, appropriate risk control measures should be introduced. These include; o Reviewing symptoms of fatigue o Ensuring symptom monitoring is incorporated into crew resource management strategies o Provision of support napping o Replacement of position with other employees who are rested Required Training / Staff Induction A CBT module has been provided to each vessel together with the Fatigue Calculators and senior officers should use this to familiarize themselves with the use of the fatigue calculator. Non-Conformances with Working & Resting Hours To assist vessels in complying with statutory requirements and company guidelines, it should be noted that: o Non-Conformances in Working & Resting Hours should be documented in company format in ShipNet o Non-Conformances may not include more than 25% of crew at any one time o Non-Conformances may not continue longer than the exceptions specified in the flag issued DMLC Part I o The DPA Should be immediately notified of any situation where this policy cannot be complied withControlled Revision: 01 Jan 2015CRM Part A - CRW Doc No. 009REST AND WORK PERIODS Approval: WBF Page: 4 of 5

Crewing Manual10.0 Dismissal  Purpose o To define dismissal procedures  Application o Singapore Office o Crewing Offices o All Vessels  Responsibility o SeaTeam Management (India) Pvt Ltd o SeaTeam Management (Phils) Inc. o Masters 10.1 Disciplinary Actions Upon engagement, the seafarer can only be repatriated for valid reasons, as provided in any applicable CBA Table of Offences and Maximum Penalties and, or the general principles of Maritime Law, which may. In cases of misconduct, the three elementary steps for all personnel evaluations must be adhered to:  Verbal corrective, duly noted and entered in the Logbook  Written warning, supported by a SeaTeam Evaluation Report, and signed by the Master and the person, SeaTeam Form No. CREW 002 and SeaTeam Form No. CREW 003  Dismissal, according to the procedures in the CBA and the Guidelines for the Grievance Procedure o Board Hearing dismissal, recorded on the appropriate form, SeaTeam Form No. CREW 005Controlled Revision: 01 Jan 2015CRM Part A - CRW Doc No. 010DISMISSAL Approval: WBF Page: 1 of 6

Crewing Manualo Immediate dismissal, in the case of gross misbehaviour, SeaTeam Form No. CREW 006 to be filled in, signed and submitted without delayo If it is deemed necessary to terminate the contract of employment, the seafarer is to be duly informed. He will be entitled to termination pay and repatriation as prescribed in the CBAo For all dismissals, a hearing is to be summoned before a committee, consisting of the master as a chairperson and two other members appointed by the master. If possible, one of the other members should be chosen from the officer or crew group to which the seafarer has belongedo The chairperson is to question the seafarer and any witness who might be able to provide information in the case. The remaining members of the committee and the seafarer himself may ask questions of the witnesses through the chairperson, or directly, as the chairperson decides. The submitted statements from the seafarer and the witnesses are to be documented on SeaTeam Form No. CREW 005o The statements are to be read out to those who have submitted them. If the chairperson makes a decision in the matter, he is to state the grounds for his decision and the decision is to be entered on SeaTeam Form No. CREW 005o The members of the committee, by their signature, certify the accuracy of the entered statements. The seafarer is entitled to a copy of the completed SeaTeam Form No. CREW 005. A notice of the hearing should be entered into the ship's logbook with the findingso The master is to decide as soon as possible after the conclusion of the hearing, if the seafarer should be dismissed or given notice of termination, or if the case should rest without further steps for the time beingo If the master decides to dismiss the seafarer immediately, the seafarer is to be informed of the decision. Crewing Manual be included on SeaTeam Form No. CREW 005 and should be recorded in the ship's logbook o A seafarer who has been dismissed should be given the information in writing. SeaTeam Form No. CREW 006 should be used. He will have no entitlement to termination pay or repatriation as per CBA o If the master decides to give the seafarer notice of termination, the seafarer is to be duly informed and receive the entitlement indicated in the CBA o In special cases, a committee may be appointed by the Company or the Company's representative and the hearing can take place ashore if it is considered necessary to best investigate the basis for dismissal10.2 Guidelines on Proof for Dismissal for CauseThe following are means of proof to sustain or deny a claim on pre-termination cases: Log Book Extracts o Non-presentation of a Log Book Extract in a pre-termination case by the owners will sustain the Seaman's claim. The Log Book Extract is highly relevant and material to show cause of discharge and should be authenticated true copy or notarised Master's Report o The weight of the Master's Report has been emphasised in various cases. The Master's Report however must contain statements that he has conducted his own investigation, has given the Seaman the opportunity to be heard and after these proceedings he has found just and legal cause to terminate the Seaman.
