THE ROLE OF AN AGENT
THE ROLE OF AN AGENT9.2 •NFL Pre-draft training support•On-field and off-field skills development•Assistance with expenses related to use ofa training facility, housing, etc.•Showcasing your skills through arranged workoutswith NFL teams•Marketing and promoting you to NFL teamdecision-makers•Soliciting feedback from teams and trackingwhere you will be drafted or have otheropportunities•Player contract negotiations•As a rookie•Negotiate best terms availablewithin the rookie pool system•Quick payment of bonusamounts•Skill or injury guarantees•Roster bonuses•Bonus default language•Offset language•Personal appearances•As a veteran•Explain available market•Negotiate best terms available•Total guaranteed money•Average per year•Roster bonuses•3-year contract value•Total contract•Bonus default language•Managing your career on a daily basis•Travel/housing support•General services•Travel arrangements•Apartment location•Furniture rental/purchase•Bill paying and household budgeting•Cell phones, cable, computers•Insurance guidance•Assist in addressing liability, life anddisability insurance needs•Legal services or referral to outside attorneys•Wills and estate planningROLE OF A FOOTBALL AGENTProfessional-level student-athletes and their families are typically approached by many individuals offering different services. So, it is important to understand that, in the NFL world, an “agent” is a contract advisor who has been certified by the NFL Players Association (NFLPA). Only an NFLPA-certified contract advisor (or the athlete himself) can negotiate a contract on behalf of an NFL player. The NFL agent’s role is to do everything they can to assist you in obtaining employment with an NFL team and then to negotiate a player contract on your behalf of that player with the team.WHAT DO FOOTBALL AGENTS DO?In short, an agent negotiates on your behalf with football employers to obtain you a job and contract. NFLPA-certified contract advisors will explain the full range of services they will provide to you as an agent. The following list summarizes many of the services NFL agents provide their player-clients:
9.3THE ROLE OF AN AGENT•Real estate•Intellectual property•Family law•Criminal issues•Marketing in a variety of areas•Car deals•Shoe deals•Trading cards•Promotional appearances•Endorsements•Football camps•Charitable endeavors•Music and television deals•Financial assistance•Cash management•Loans for autos or homes•Lines of credit•Tax and accounting services•Tax planning•Federal, state, and local tax filings•Withholdings and estimated payments•Real estate guidance•Supervise home and real estate acquisition•Obtain appraisals•Assist with financing
THE ROLE OF AN AGENTFREQUENTLY ASKED QUESTIONS WHO REGULATES AGENTS?The National Football League Players Association (NFLPA) is the certified union for NFL players. It regulates and certifies who is a legitimate NFLPA-certified agent. State laws and university policies also apply to agents, requiring registration and prohibiting conduct that jeopardizes a student-athlete’s eligibility. The NFLPA is in Washington, DC, and can be reached at (800) 372-2000 to answer questions about agents. Your compliance department is always available to provide information on agents and other advisors.WHAT IS THE DIFFERENCE BETWEEN AN AGENT AND A FINANCIAL ADVISOR?An agent discusses your employment with football teams and negotiates your contract. A financial advisor may give you advice on how to manage, save, and invest the money you earn through your employment. Most agents do not serve as financial advisors to their players. Most agents will offer to assist you in researching, interviewing, and selecting a financial advisor. All fees and arrangements between a financial advisor and client are negotiated separately from NFL agent fees.ARE YOU REQUIRED TO HAVE AN AGENT TO PLAY IN THE NFL?No, there is no requirement that a player must have an agent. It must be noted that only the player or an NFLPA-certified contract advisor is permitted to negotiate a contract with an NFL team; it cannot be done by a parent or any other non-certified advisor. The complexities of pre-draft training, contract negotiations, and career counseling make it almost standard for NFL players to have agents who are dedicated full-time to the representation of athletes.WHAT SHOULD I LOOK FOR IN AN AGENT?You should look for someone who will do everything to maximize your value as a football player and handle your business competently, honestly, and professionally. Different people value different things in an agent. Most try to determine and assess an agent’s education, experience, knowledge, commitment, communication, honesty, integrity, relationships, and successes.9.4
