Textbooks and supplementary textbooks published by the Diaspora Publishing Centre must be fitted with the logo of the institution and the holographic stamp of the certification on the part of the Ministry of Education, Sports and Youth. The Diaspora Publishing Centre provides the holographic stamp from the Minis- try of Education, Sports and Youth towards payment. 4. Textbook and supplementary textbooks awards for teaching in the Albanian Diaspora are placed on their respective covers, in accordance with Schedule 1 attached this decision. 5. The financial impacts arising from the implementation of this decision must be borne by the budget approved for the Diaspora Publishing Centre. 100

Government Policy For Diaspora REGULATION FOR THE FUNCTIONING OF THE DIASPORA COORDINATION COUNCIL The Diaspora Coordination Council (DCC) was established pursuant to Law No. 16, dated 05.04.2018, “On the Diaspora” The Regulation on Internal Functioning is approved by the Diaspora Coordination Council, pursuant to Article 18 (2/b) of this Law, “... approves rules of procedure for the accomplishment of its activ- ity and rules for the decision-making procedure. Article 1 Scope of the Regulation The scope of this regulation is to define the rules on the: a. Internal functioning of the Albanian Diaspora Coordination Council; b. Rights and obligations of the Members of the Diaspora Coordination Coun- cil in satisfying the respective competences, in compliance with the legal framework of the Republic of Albania; c. The modalities of managing decisions-making and documents from and to the Albanian Diaspora Coordination Council; d. Legal and technical instruments for the proper development of the adminis- trative and technical activity of the Council. Article 2 Legal Basis 1. The internal regulation of the Albanian Diaspora Coordination Council shall be implemented in compliance with the legislation of the Republic of Albania. As such, it was drafted pursuant to Law No. 16, dated 05.04.2018, “On Diaspora”. 2. The regulation on the functioning of the Diaspora DCM No. 320, dated 15.05.2019, Council”. Coordination Council is in full cohesion with “On the status of mem- bers of the Diaspora Coordination Council of Article 3 Functioning 1. The Albanian Diaspora Coordination Council shall be composed of 15 mem- bers. Their election shall be carried out pursuant to DCM with No. 340, dated 06.06.2018, “On the determination of the detailed rules on the conditions and mo- 107
Government Policy For Diaspora dalities for the election of representatives in the Diaspora Coordination Council”. 2. The official activities of the Diaspora Coordination Council are attended by the Prime Minister, the Minister responsible for the Diaspora, the Minister respon- sible for the Foreign Affairs, the Minister responsible for the Internal Affairs, the Minister responsible for Finance and Economy, the Minister for Education, the Minister for Culture, and representatives from the Academy of Sciences, the Na- tional Chamber of Commerce and Industry, the Albanian Radio and Television, the National Agency of the Diaspora, the Diaspora Cultural Centers, representa- tives of the ministry responsible for Diaspora in the government of Kosovo, and at the Diaspora Coordination Council discretion, diaspora organizations. 3. The President of the Republic, at his request and, in coordination with the Prime Minister and the Minister responsible for the Diaspora, shall preside the special meetings of the Diaspora Coordination Council. Article 4 Competences 1. The Diaspora Coordination Council shall have the following competences: a. identify the problems of the Diaspora and proposes to the Minister respon- sible for the Diaspora concrete actions for their solution; b. request information on the coordination between the Minister responsible for Diaspora in Albania and the ministry responsible for Diaspora in Kosovo, on actions taken regarding problems identified by the DCC; c. determine the guidelines for drafting/amending the strategy on Diaspora; d. approve the procedural rules for the enactment of its activities and deci- sion-making; e. contribute to the establishment of cooperative relations between the par- ties; f. assist and coordinate the activity of associations in the Diaspora; g. undertake initiatives in the service of the nation and democracy. 2. The financial implications for the work of the Diaspora Coordination Council are borne by the National Diaspora Agency. Article 5 Headquarters The main office of the Diaspora Coordination Council shall be at the National Dias- pora Agency in Tirana. 108
Government Policy For Diaspora Article 6 Organizational Structure 1. The organizational structure of the Diaspora Coordination Council is approved by this Regulation of the Albanian Diaspora Coordination Council. 2. The organizational structure of the Albanian Diaspora Coordination Council consists of the chair, deputy chair and secretary, who are elected by the members of this Council. 3. The selection of the organizational structure is done via ballots, according to a points system. Each member shall cast its vote for three other members, giving each of them three, two and one point. The member who collects the most points shall be the chairman, the second, the vice-chairman and the third, the secretary. 4. The election of the chairman, vice-chairman and secretary is done by secret bal- lot. Article 7 Office Term 1. The representatives of the Diaspora Coordination Council are elected for a 4-year office term, with the right to re-election, but no more than once. 2. A member of the Diaspora Coordination Council is dismissed before the expira- tion of a 4-year mandate, in following cases: a) resignation, upon individual request; b) exercise of activities causing a conflict of interest; c) other. 3. A member of the Diaspora Coordination Council is discharged before the expira- tion of a 4-year mandate, in following cases: a) negligence; b) fails to satisfy the functions provided by Law No. 16/2018, “On Diaspora”, and by DCM No. 320, dated 15.05.2109, “On electing the members of the Di- aspora Coordination Council”. c) is absent, without justification, in meetings more than 2 times consecutively; d) becomes incapable of performing the functions charged due to any physical or mental disease for a period longer than 6 months; e) in the course of execution of the functions, acts against the interests of the Diaspora Coordination Council. 109
Government Policy For Diaspora Article 8 Chair, Deputy Chair and Secretary 1. The Chairman of the Diaspora Coordination Council represents the Diaspora Co- ordination Council in relations with third parties and issues statements on his behalf. It is the spokesperson of the collective decision-making of the Council, in accordance with the provisions of this regulation. a) The Chairman of the Diaspora Coordination Council has the following com- petences, but without being limited to them: b) Chairs the meetings of the Diaspora Coordination Council, conveying and guaranteeing the implementation of principles, values, legality and ethics; c) Ensures order during the meetings of the Diaspora Coordination Council and guarantees that all members of the Council have their say; d) Coordinates the organization of official meetings of the Diaspora Coordina- tion Council, in cooperation with the Secretary and the National Diaspora Agency; e) Coordinates the attainment of objectives and obligations of the members of the Diaspora Coordination Council, only in view of implementation of the latter’s decisions; f) Supervises, in tandem with the Deputy Chair, the activity of the National Diaspora Agency, to monitor the tasks and decisions of the Diaspora Coor- dination Council. g) Together with the Deputy Chair, shall inform the members of the Diaspora Coordination Council whenever acting as such in relations with third par- ties with the rights of representation on various issues. Article 9 Meetings of the Diaspora Coordination Council 1. The meetings of the Diaspora Coordination Council shall take place, as a rule, on December 18th of each year, on the National Diaspora Day. 2. The Diaspora Coordination Council may meet at the request of not less than one- third of its members or, at the request of the Minister responsible for the Diaspo- ra, with a pre-determined program. 3. In cooperation with the Minister responsible for the Diaspora, the Chair of the Council shall decide on the place of the next meeting. 4. The meetings of the Diaspora Coordination Council shall be chaired by the Chair of the Diaspora Coordination Council, except when the President of the Republic of Albania, at his request and, in coordination with the Prime Minister and the 110
Government Policy For Diaspora Minister responsible for the Diaspora, chairs the special meetings of the Dias- pora Coordination Council, pursuant to Article 19 (2) (3) of Law No. 16, dated 05.04.2018, “On Diaspora”. 5. Upon announcing the organization of the meeting of the Diaspora Coordination Council, the technical secretariat (National Diaspora Agency) shall make avail- able, to each member, the materials according to the issues included in the agen- da. 6. In cases of extraordinary meetings of the Diaspora Coordination Council, the no- tification of each member shall be made not less than 15 ( fifteen) working days prior to the meeting, except for emergencies and whenever the special meeting of the Diaspora Coordinating Council is accepted by not less than two thirds of its members. 7. The National Diaspora Agency, as the technical secretariat of the Diaspora Coor- dination Council, based on the projects and issues submitted for consideration, shall prepare the agenda of the meetings. The agenda and materials shall be sent to the members of the Diaspora Coordination Council not less than 30 (thirty) days prior to the date set for the meeting. 8. In case of extraordinary meetings, based on the projects and issues submitted for consideration, the technical secretariat shall prepare the agenda which is sent to the members of the Diaspora Coordination Council not less than 15 ( fifteen) calendar days prior to the date set for the meeting. 9. Meetings of the Diaspora Coordination Council shall be considered convened when attended by two thirds of its members. The Diaspora Coordination Council shall adopt decisions by two-thirds of the votes of all its members. Voting to Di- aspora Decision Coordination Council decisions is open. 10. The minutes of the Diaspora Coordination Council meetings shall be kept by the National Diaspora Agency and verified by the secretary and chair of the Diaspora Coordination Council. 11. The National Diaspora Agency shall prepare, within 5 ( five) working days, the minutes of the meetings and shall send them to all members of the Council by e-mail. Article 10 Electronic Communication 1. The official webpage of the Diaspora Coordination Council is: http://keshilli. koordinues.diaspora.gov.al/. This website is managed by the National Diaspora Agency and maintained by the National Information Society Agency. 111

The Diaspora Coordination Council has an official profile on social media, such as: facebook, instagram, twitter and linkedin, which are managed by the National Diaspora Agency. 3. Each member of the Diaspora Coordination Council shall have its official address provided by the domain-i @diaspora.gov.al, namely name.surname@diaspora. gov.al. 4. Pursuant to DCM with No. 320, dated 15.05.2019, “On the status of the members of the Diaspora Coordination Council”, the National Diaspora Agency shall ad- dress the National Agency for the Information Society (NAIS) with an official let- ter for the opening of official e-mails for the members of the Diaspora Coordina- tion Council. The names of the representatives in the Diaspora Committee and those of the representatives of each ministry, shall be made public, along with their contact details. 5. Official e-mails shall be used by members of the Diaspora Coordination Council only during the exercise of their duties. 6. The closing of the official e-mails is done according to the provisions of Article 6 of this regulation, through an official letter the National Diaspora Agency sends to NAIS at the moment of the end of the office term. Article 11 Cooperation with state institutions 1. Members of the Diaspora Coordination Council have the right to attend the meetings of the State Diaspora Committee, by prior notification through the Na- tional Diaspora Agency. The National Diaspora Agency shall notify the members of the Diaspora Coordination Council, at least 15 ( fifteen) days before the date of the meeting of the State Diaspora Committee. 2. The members of the Diaspora Coordination Council, interested in attending the meetings of the State Diaspora Committee, shall receive by the technical secre- tariat, not less than 6 (six) days before the meeting, all materials according to the agenda. 3. The members of the Diaspora Coordination Council may attend the hearings of the Albanian Parliamentary Commissions on issues related to the interests of the Albanian Diaspora, observing the procedures set out in the Rules of Procedure of the Albanian Assembly on attending its commissions’ hearings. The National Diaspora Agency shall notify the members of the Diaspora Coordination Council at least 15 ( fifteen) days prior to the date of the hearing. 112
Government Policy For Diaspora Article 12 Division of Duties 1. The members of the Diaspora Coordination Council share among themselves the tasks on following up the issues and approve their progress in addressing the issues. The follow-up of the issues and the respective solution proposals by the state institutions, are developed in cooperation with the National Diaspora Agency. 2. Each of the members of the Diaspora Coordination Council shall organizes, as needed, meetings with Albanian associations in the Diaspora and with the community there. The meetings shall take place in the premises of the Albanian Embassies in the host countries or in other suitable premises. Members should inform the Diaspora Coordination Council and the National Diaspora Agency about the meetings held and their outcomes. 3. Each of the Council’s members shall maintains contacts with the Albanian com- munities. Article 13 Working Groups 1. The Council may, as appropriate, set up working groups to deal with technical matters of an economic, statutory, cultural, scientific and sports’ nature. The number of members and the modalities of organization and operation of the working groups is determined by a decision of the Diaspora Coordination Coun- cil, pursuant to Article 21 (3) of Law No. 16, dated 05.04.2018, “On Diaspora”. 2. The Council may decide to establish commissions or committees for the prepara- tion and selection of projects and ideas of special and strategic interest. Article 14 Information and administrative proposals 1. Members of the Diaspora Coordination Council shall be entitled to request infor- mation by sending written and electronic requests from the state institutions of the Republic of Albania, on issues related to the interests of the Albanian Diaspo- ra communities. Such exchange of information can also be carried out with the mediation of the National Diaspora Agency. 2. The members of the Diaspora Coordination Council shall be entitled, through the National Diaspora Agency, to propose state institutions with administrative acts related to the interests of the Albanian communities in the Diaspora. 113

The Diaspora Coordination Council shall decide on the organization of the Al- banian Diaspora Assembly and on the way of cooperation with the responsible state structures. 2. The official website of the Diaspora Assembly shall be managed by the Diaspora Coordination Council, based on their own judgement. Technical aspects shall be covered by the National Diaspora Agency in coordination with NAIS. Article 16 Approval and amendment of the Regulation 1. The regulation of the Diaspora Coordination Council shall be approved by not less than two thirds of the members of the Diaspora Coordination Council. 2. Amendment of this Regulation may initiate upon request of one third of the members or upon request of its Chairman. 114

The series “Bilingual Classics” and “Bilingual Dictionary for Children”, published by the Diaspora Publishing Centre, must be fitted with the logo of the institution. 4. The prices of the series “Bilingual Classics” and “Bilingual Dictionary for Chil- dren” are printed on the respective covers, as per the list no. 1, as attached to the herein Decision and which constitutes an integral part thereof. 5. The financial effects for the implementation of this Decision, in the amount of ALL 2,800,000 (two million eight hundred thousand) shall be borne by the budget adopted for the Diaspora Publishing Centre for 2020. 115

The appointment of coordinating officers for Albanian diaspora affairs nearby Consular posts of the Republic of Albania as follows: - 1 (one) coordination officer for the diaspora on education and justice affairs and investment promotion at the Embassy of the Republic of Albania in the Republic of Italy; - 1 (one) coordination officer for the diaspora on education and justice affairs and investment promotion at the Embassy of the Republic of Albania in Greece; - 1 (one) coordination officer for the diaspora on education and justice affairs and to encourage investment in the Consulate General of the Republic of Albania in Milan, Italy; - 1 (one) coordination officer for the diaspora on education and justice affairs and to encourage investment in the Consulate General of the Republic of Albania in Thessaloniki, Greece. 2. Government Policy For Diaspora 2.1 Job description, main duties and method of communication defined in the agree- ment concluded between the Ministry for Europe and Foreign Affairs and the proposing institution. The agreement should contain: a) job position and rank of appointment; b) job description; c) term of employment; d) the rights and obligations of the employee. 3. Coordination officers for Albanian diaspora affairs are appointed by the minister responsible for foreign affairs after the co-proposal of the minister in charge of the field to be covered by the officer and minister responsible for Diaspora. Dias- pora coordination officers can also be appointed from outside the Foreign Ser- vice, who possess knowledge and prominent expertise in the field of education, justice and investment promotion. 4. The financial effects for the implementation of this decision will be covered by the budget of the ministry responsible for foreign affairs. 5. The Ministry of Europe and Foreign Affairs, the State Minister for Diaspora and other line ministries, case by case coordination officers, referring to areas of pro- vided in point 1, for the implementation of this decision. In view of supporting the teaching of Albanian language and culture in the Dias- pora, the Diaspora Publishing Centre shall provide and distribute, for the eligible categories provide in list 1 herewith attached, free textbooks and supplementary textbooks for the school year 2020-2021. 2. The categories benefiting free textbooks and supplementary textbooks published and provided by the Diaspora Publishing Centre, according to the provisions of the DCM no. 443, dated 26.6.2019, “On the organization of the process of teaching and selection of teachers in the Diaspora”, are the students and the teachers. 3. Textbooks published and provided by the Diaspora Publishing Centre, shall be equipped by the publishing house with the logo and the stamp with the corre- sponding hologram. 4. The price of each textbook and supplementary textbook for teaching in the Alba- nian Diaspora shall be placed on their respective covers, in accordance with List 1 attached to this decision. 5. All financial implications arising from the implementation of this decision shall be borne by the budget allocated to the Diaspora Publishing Centre. 122

Government Policy For Diaspora ORDER No. 103, dated 07.08.2020 ON THE ESTABLISHMENT OF AN AD-HOC COMMISSION FOR THE EVALUATION OF THE RESULTS OF STUDENTS WHO STUDY ABROAD AND FOREIGN CITIZENS OF ALBANIAN ORIGIN, WHO RECEIVE SCHOLARSHIPS FROM THE REPUBLIC OF ALBANIA Pursuant to Article 102 (3) of the Constitution and point 7 of Decision No. 504, dated 24.6.2020 of the Council of Ministers “On the establishment of a State Database of students studying abroad and foreign citizens of Albanian origin, who receive schol- arships from the Republic of Albania”. HEREBY ORDER: 1. The establishment of an Ad-hoc Commission for the evaluation of the results of students who study abroad and foreign citizens of Albanian origin, who receive scholarships from the Republic of Albania (hereinafter referred to as Commis- sion). 2. The Commission shall chair by the State Minister for Diaspora and shall have the following composition: a. Deputy Minister of Education, Sports and Youth; b. Deputy Minister for Europe and Foreign Affairs; c. General Secretary of the Ministry of Education, Sports and Youth; d. General Secretary of Minister for Europe and Foreign Affairs; e. Director of the National Diaspora Agency; f. Director of the General Directorate of Policy and Development of Education, Sports and Youth in the Ministry of Education, Sports and Youth; g. Director of the Directorate General for Political and Strategic Affairs at the Ministry for Europe and Foreign Affairs; h. Director of the Directorate of Consular Affairs in the Ministry for Europe and Foreign Affairs. 3. For the evaluation of the results of students who study abroad and foreign citi- zens of Albanian origin, who receive scholarships from the Republic of Albania, the Commission is based on information for students, citizens of the Republic of Albania who study abroad and for students, foreign nationals of Albanian or- 127

The Commission shall draft an annual report for the State Diaspora Committee and the Subcommittee on Diaspora and Migration in the Albanian Assembly. 5. The Commission shall meet at least 3 (three) times a year or exceptionally at the request of its Chairman. 6. The institutions mentioned in point 2 herein shall appoint their representatives in this Commission within 7 (seven) days from its entry into force. 7. The Coordinator Group is chaired by the State Minister for Diaspora. 3. Experts from other structures, such as non-profit organizations, international bodies, universities and personalities may also be invited to meetings of the Co- ordinator’s Group. 8. The heads of the institutions mentioned in point 3 of this order shall be assigned to appoint their representatives within 5 ( five) days from its entry into force. 9. Establishment of the interinstitutional working group for implementation of measure 64 of the National Diaspora Action Plan approved by the Council of Min- isters Decision No. 259 of 9 May 2018. 2. The structure of INSTAT’s annual report on the Albanian Diaspora is to be real- ized in cooperation with the National Diaspora Agency. 138

Government Policy For Diaspora ORDER No. 53, dated 09.04.2020 ON THE ESTABLISHMENT OF THE INTER-INSTITUTIONAL WORKING GROUP FOR THE REVIEW OF THE NATIONAL DIASPORA STRATEGY AND ACTION PLAN Pursuant to Article 102 (3) of the Constitution and Article 12 (1) of the Law no. 9000, dated 30.01.2003, “On the organization and functioning of the Council of Ministers” and Decision no. 259, dated 9.5.2018 of the Council of Ministers, “On the approval of the National Diaspora Strategy and Action Plan 2018-2024”, upon proposal of the State Minister for Diaspora, HEREBY ORDER: 1. Establishment of the inter-institutional working group for the review of the Na- tional Diaspora Strategy and its Action Plan, adopted by Decision no. 259, dated 09.05.2018 of the Council of Ministers. 2. The proposals of the inter-institutional working group for the revision of the Na- tional Diaspora Strategy and its Action Plan to be submitted for approval to the Council of Ministers within June 2020. 5. The heads of the institutions mentioned in point 2 herein are charged, that within 5 ( five) days from its entry into force, to appoint their representatives in the in- ter-institutional working group 6. The State Minister for Diaspora, the Ministry for Europe and Foreign Affairs, the Ministry of Finance and Economy, the Ministry of Education, Sports and Youth, the Ministry of Culture, the Ministry of Interior, the Ministry of Justice, the Minis- try of Health and Social Protection, the Ministry of Agriculture and Rural Devel- opment, the State Minister for the protection of Entrepreneurship, INSTAT, the Academy of Sciences and the National Diaspora Agency are responsible for the implementation of this order. Government Policy For Diaspora DECISION No. 585 dated 22.07.2020 ON THE APPROVAL OF NATIONAL DIASPORA STRATEGY AND ACTION PLAN 2021-2025 Pursuant to Article 100 of the Constitution, upon the proposal of the State Minister for Diaspora, the Council of Ministers DECIDED: 1. The approval of National Diaspora Strategy and Action Plan 2021-2025, in ac- cordance with the text attached herein, which shall constitute an integral part thereof. 2. Decision No. 259, dated 09.05.2018 of the Council of Ministers “On the approval of the National Diaspora Strategy and Action Plan 2018-2024” is repealed. 3. All line ministries and central institutions, to which the Strategy and the Action Plan are assigned as specific duties, are in charge of implementing this decision. This decision shall enter into force upon publication in the Official Gazette and shall be effective from January 1, 2021 and up to then, Decision no. 259, dated 09.05.2018 of the Council of Ministers “On the approval of National Diaspora Strategy and Action Plan 2018-2024” shall be implemented. Government Policy For Diaspora LAW No. 115/2017 ON THE ESTABLISHMENT OF THE NATIONAL AGENCY OF DIASPORA Pursuant to articles 78, 81, and 83, point 1, of the Albanian Constitution and based on the Council of Ministers’ proposal, THE PARLIAMENT OF ALBANIA, DECIDED: CHAPTER I GENERAL PROVISIONS Article 1 Object This law defines the mission, content and functioning of the National Agency of Dias- pora, as well as well as other issues related to its activity. Article 2 Mission The mission of the National Agency of Diaspora is to develop and strengthen the insti- tutional cooperation with Diaspora through: a) The improvement of diaspora community members’ position, as well as pro- tection of their interest and rights at the respective countries where they live; b) Offers assistance in preserving the language and in protecting the national cultural heritage; c) The encouragement of economic cooperation between the country of origin and diaspora; d) Cooperation for prosperity, peace, wellbeing, culture and social solidarity of the whole nation. Article 3 Definitions Under the framework of this law, the following terminologies have these meanings: “National Agency of Diaspora”, hereinafter called “The Agency”, is the responsible governmental body responsible for matters related to diaspora. 147
Government Policy For Diaspora “Diaspora” includes: - Early Albanian communities in the world; - Any individual born in Albania that resides outside of its political borders; - Any individual born outside of Albanian political borders but is of Albanian or- igin. - “Responsible minister”, is the Minister whom under this Government covers all the activity related to diaspora. - “Country of origin”, is the Republic of Albania. Article 4 Principles of activity The Agency is organized and operates based on the principles of legality, constitution- ality, cooperation and inclusiveness. CHAPTER II AGENCY’S ORGANISATION AND OPERATION Article 5 Agency’s organization 1. The Agency is an independent legal public entity, seated in Tirana, under the framework of the respective law on the organization and functioning of the pub- lic administration. 2. The Agency’s activity will be under the supervision of the responsible Minister for Diaspora. 3. The supervising bodies of the Agency are the Steering Council and the Executive Director. 4. The structure and the organizational competencies of this Agency are pursuant to Council of Minister’s Decision under the proposal of the responsible Minister for diaspora. 5. The organizational structure of the Agency shall be approved by a decree of the Prime Minister. 6. The employment relations for the Executive Director and the Agency’s employees are regulated pursuant to Civil Employee’s Legislation. As per the administrative employees, employment relations are regulated pursuant to the Labor Code pro- visions. 148
