Government Policy For Diaspora Article 9 Confidentiality The Parties undertake, through appropriate procedures, not to disclose; confidential data, news and information obtained as a result of and in connection with the activi- ties covered by the agreement. Article 10 Personal Data Processing The Parties are mutually committed to the processing and storage of data and infor- mation, such as paper and electronic data, related to the performance of activities related to this Agreement and to the Operational Agreements and Convention under the Article 4, in accordance with the measures and obligations imposed by the EU Directives on the General Data Protection Regulation, Legislation dated 30.6.2003, no. 196, “Code regarding the protection of personal data” and ss.mm. ii. Article 11 Dispute Resolution Any dispute arising from the interpretation or application of this agreement, shall be resolved by negotiation and mutual understanding between the parties. Article 12 Signing of Agreement This Act, consisting of 7 (seven) sheets has been drafted in two copies and shall be signed at the event specified, in accordance with Presidential Decree no. 131, dated 26.04.1986, in accordance with the respective legislation of the party which will re- quire registration. Government Policy For Diaspora COOPERATION AGREEMENT BETWEEN THE ALBANIAN FUND FOR DIASPORA DEVELOPMENT OF THE REPUBLIC OF ALBANIA AND UNIVERSITY FOR BUSINESS AND TECHNOLOGY, KOSOVO Albanian Fund for Diaspora Development (AFDD) and Higher Education Institution - University for Business and Technology (UBT) in Kosovo, hereinafter referred to as the “Parties” With the wish to collaborate in the field of research, teaching, technological development and innovation, and having in consideration that: UBT is an institution founded on several core values such as promotion of teaching, research and innovation, promotion of international values, and best quality stan- dards and practices, creation of a dynamic environment that fosters growth at the individual and professional level; The Albanian Fund for Diaspora Development will have the mission of ensuring and distributing financial resources in the framework of encouraging socio-economic and cultural development, based on the national strategy for Diaspora, through promot- ing, encouraging and directing philanthropic trends and investments in support of development of the Diaspora in the Republic of Albania and abroad; Given the interest of both bodies in creating the means to promote concrete coop- eration in scientific and educational research between institutions, based on the op- portunity to conduct research and training activities, as well as in promoting any sci- entific cooperation which is useful to better achieve the relevant institutional goals, also by involving other public and private entities, national and international, for the purposes of innovation and exploitation of results; The parties agree on the following: Article 1 Scope 1. UBT and AFDD shall agree to establish and implement projects, programmes and activities in various fields in accordance with their mission; 2. UBT shall assist AFDD in providing professional expertise in order to achieve a successful scale in institutional and development capacity building, especially in ideas, projects, pilot projects, specific programmes, which are important seg- ments of the engagement in this memorandum; 250

Government Policy For Diaspora Article 2 General principles The provisions of this Agreement shall be interpreted in accordance with the princi- ple of institutional and academic cooperation; 1. In order to better achieve their institutional goals, the parties recognize their common interest in maintaining and developing forms of cooperation in re- search, teaching, technological development and innovation, in teaching and training activities, and in the provision of services to support research activities. 2. The parties aim to identify new models and strategies to strengthen connectivity with the territory, including the social and cultural aspect, experimenting with new forms of communication and sharing high-tech knowledge and experience within the local community. 3. The Parties undertake to assess the feasibility of the forms of student mobility, teaching and research staff, and university orientation activities; 4. Any proposal for joint activities must be approved in advance by both institu- tions. Upon acceptance of the proposal, both institutions designate the persons responsible for implementing the activity. Article 3 Object 1. The Parties shall jointly commit, in accordance with their respective legislations and within their powers, to cooperate with a view to: a) Identify priorities for drafting and developing teaching, orientation, re- search and development projects, identified also through careful analysis of the demand expressed by the various components of the social, economic and industrial aspects, and in cooperation with other universities and re- search institutions; b) Achieve student, teaching and research mobility; c) Plan joint training courses or ensure recognition of educational activities in accordance with the regulations in force in both countries; d) Design, implement and make available international doctoral courses; e) Utilize research results, technological mobility and innovation, favouring interactions with the industrial and territorial system; f) Carry out educational activities, research and to share the results of research activities by professors. 2. Such actions shall be undertaken by favouring appropriate cooperation and syn- 251

Government Policy For Diaspora ergies with National Bodies and Agencies, with the industrial system and with any other body that shows an interest in participating. 3. The cooperation between the Parties shall be governed by the provisions set out: a) in this Agreement; b) in the individual Engagement Deeds as follows; c) in all the applicable provisions. Article 4 Cooperation for research, development and innovation activities 1. The Parties shall promote mutual cooperation in research, development and in- novation. During the validity period of this Agreement, the parties may agree on specific research topics. 2. These forms of cooperation can be achieved by determining the operational acts provided below, identifying the scientific structures of each body involved in the project. Each Act shall be adopted by the Parties pursuant to their respective do- mestic legislation. 3. Collaboration activities in carrying out specific project partnerships may include the following: a) determination of mid-term programmes in research and performing re- search, development and innovation projects, for joint participation in Eu- ropean Framework Programs, in addition to drafting proposals at national and international level; b) cooperation in the development and promotion of activities of common in- terest through international networks in which the parties participate; c) study and experimentation of innovative services to leverage search results, technology mobility and innovation start-up financing; d) promotion, establishment, enhancement and development of new business activities and new products that support the dynamism of innovation in the territories involved and experimentation with an innovative model; e) encouragement of activities for the dissemination of scientific and techno- logical culture in the territory; f) exchange of expertise between respective institutions; Article 5 Cooperation in the field of education, culture and advanced training 1. In the context of cooperation in didactic and training activities, the parties de- clare their availability to carry out joint activities as follows, including but not limited to: 252

Government Policy For Diaspora a) Informing, assisting and supporting potential candidates to study at UBT; b) supporting the writing of theses and projects for obtaining the bachelor, master, doctorate degree, and internships; c) organizing educational visits and student internships; d) organizing conferences, debates, seminars, round tables and other activities of common interest; e) organizing joint academic activities; f) cooperation in the development and promotion of cultural activities of com- mon interest in national and international networks to which the parties are affiliated; g) organizing events in synergy with other bodies; h) favouring practical work activities regulated by a specific agreement defined under current legislation; i) UBT shall provide scholarships for all excellent students from the Diaspora which will be assigned by a special decision, in order to contribute to the quality education of youth; j) Support of young people in building professional competencies, in employ- ment, entrepreneurship and other innovative, cultural and artistic activities. The same applies to other community groups with a particular interest in the development of society, specifically women, etc.; k) Supporting AFDD in capacity building and performance in line with current requirements, best practices of European and international standards, pro- viding training, consulting, certification, research, analysis and in general feasibility studies; l) Organizing events of common interest; m) Joint preparation and participation in development projects in the local, re- gional, European and international context, cross-border projects, and oth- er projects of interest to Diaspora development; n) Support with expertise in preparing the necessary documents and reports; o) Implementation of Standards and Technical Rules, etc. Article 6 Joint Steering Committee 1. For the coordination of the cooperative activities referred to in this Agreement, the Parties agree to establish a Joint Steering Committee consisting of two repre- sentatives for each Party. The Committee appoints its Chairman; in the event of an equitable vote, the oldest member who has obtained the majority of the votes shall be appointed Chairman. 253

Government Policy For Diaspora 2. The Committee also meets, by means of telematics, with one of the Parties and draws up a regulation on its functioning. 3. The Committee remains in office for the duration of the Agreement and is reap- pointed in the event of a renewal of the Agreement. 4. Committee members are not remunerated for their membership. Any expenses for the members’ mission will be covered by the respective membership entity. 5. The Committee has the following tasks: a. coordinates collaborative activities; b. plans interventions on a three-year basis; c. monitors joint initiatives carried out in cooperation and draws up regular reports on their progress with the competent bodies of the Parties; d. identifies individuals who will attend these activities, trainings, etc. Article 7 Operational Acts The Parties agree on the implementation of research projects, training activities, study orientation, professional and career orientation, initiatives aimed at enhancing the results of scientific research and any other activities of common interest, through the definition of operational acts, identification of the scientific study structures of each Party involved in a joint project or initiative. Each Act shall be adopted by the Parties pursuant to their respective domestic legislation. Article 8 Confidentiality and Intellectual property 1. The Parties shall be obliged to preserve the secrecy and confidentiality of the in- formation, data and know-how to be disclosed during the validity and/or imple- mentation of this Agreement, except for the information, data, news and deci- sions for which the law constitutes an administrative or judicial order, therefore imposing an obligation to disclose and/or obtain the consent of the Party from which such data originate. 2. Any intellectual property rights owned by a Party shall remain its full ownership and its use permitted by the other Parties under this Agreement shall not imply the recognition of any license or right in respect of this right, except where the transfer of this license or right is expressly provided for in the operational acts. 3. Any intellectual property rights owned by one Party may be used by the other Party for the activities mentioned herein only through expressed written consent 254

Government Policy For Diaspora of the Party owning these rights and in accordance with the rules stipulated by the party in question and/or by the Parties to the engagement deeds. Article 9 Personal data The parties allow the processing of their personal data in accordance with current leg- islation on protection of personal data; the same data may be included in databases, computer files, and telematic systems solely intended for the purposes stipulated in this Agreement. Article 10 Forms of collaboration The Parties have agreed that this Agreement shall not exclude the possibility of other forms of cooperation with entities which are not parties to this Agreement. Article 11 Duration 1. This Agreement shall enter into force upon its signing by the authorized repre- sentatives of the two Institutions. 2. This agreement is valid for an indefinite period. 3. The Parties may unilaterally and at any time terminate this Agreement for legiti- mate reasons. In order to terminate the Agreement, the parties shall make a writ- ten request that they wish to terminate the collaboration, six months in advance. 4. In case of cancellation or non-extension of the agreement, the started activities should be completed. Article 12 Disputes 1. Any disputes that may arise regarding the interpretation and implementation of this Agreement shall be settled by mutual agreement by consultation and negoti- ation between the competent representatives of the parties. 2. The Albanian Fund for Diaspora Development and UBT are not liable for any dis- putes that may arise with any third parties. 255

Government Policy For Diaspora AGREEMENT BETWEEN ALBANIAN FUND FOR THE DEVELOPMENT OF DIASPORA AND “ALB-SHKENCA” INSTITUTE ON COOPERATION IN THE AREA OF OF RESEARCH AND DEVELOPMENT WITH THE ALBANIAN SCIENTIFIC DIASPORA The Albanian Fund for Diaspora Development (AFDD) and the Albanian Institute of Researchers (IASh), based on the willingness and desire to achieve sustainable so- cio- economic development of Albania and Albanian-speaking lands, hereby agree to cooperate in accordance this agreement. The AFDD represents a legal public entity under the dependency of the State Minister of Diaspora, and IASh represents a non-profit, non-governmental scientific structure that brings together researchers of all disciplines from the Diaspora and from all over the Albanian areas in the Balkans, with head offices in Tirana, Pristina and Skopje. The AFDD and the IASh, hereinafter referred to as the “Parties”, based on the will- ingness and desire to cooperate in the area of scientific research, organization of sci- entific conferences, publications and studies for the benefit of the common interest, hereby agree as follows: Article 1 Object 1. The Parties shall jointly commit, in accordance with the applicable legislation, to cooperate with a view to: a) Issue of joint publications in the field of Diaspora for study and educational purposes; b) Organize conferences or trainings on research-related issues in collabora- tion with the Diaspora; c) Implement of publications schedule that help deepen the knowledge of the Albanian Diaspora. Publish scientific contributions and papers in thematic conferences; d) Undertake other initiatives in the field of diaspora deemed necessary by the Parties, in accordance with the scope of this Agreement. Article 2 General principles 1. The Parties to this Agreement are governed by the principle of equality and mu- tual benefit in accordance with the applicable legislation. 257

The Parties shall act in compliance with the common interest in maintaining and developing forms of cooperation to promote, publish and conduct scientific and cultural research in cooperation with the Diaspora. Article 3 Cooperation for scientific works and activities 1. The Parties shall promote mutual cooperation in the field of publications, scien- tific research and cultural heritage. 2. Collaborative research activities include, but are not limited to: a) cooperation in the development and promotion of activities of common in- terest through international networks in which the parties participate; b) Organization of conferences or trainings on issues related to the Diaspora and beyond; c) Publication or publishing studies on the history of the Albanian Diaspora and cultural heritage; d) Promotion and publication of studies or publications in e-book format; e) Promoting activities in countries where parties to the agreement have head offices of their activity; f) Organizing activities in cooperation with other parties; Article 4 Confidentiality and Intellectual property 1. The Parties shall be obliged to preserve the confidentiality of the information, data and know-how to be disclosed during the validity and/or implementation of this Agreement, in compliance with their mutual understanding. 2. The intellectual property rights of a Party shall remain in full ownership of that Party unless otherwise agreed by the Parties therein. 3. Intellectual property rights owned by one Party may be used by the other Party for the activities mentioned herein only through expressed written consent of the Party owning these rights and in accordance with the rules provided for by the party in question. Article 5 Personal Data Processing The Parties shall agree to data processing in accordance with the agreement herein and with the legislation in power on the protection of personal data. Article 6 Forms of collaboration The Parties have agreed that this Agreement shall not exclude the possibility of other forms of cooperation with entities which are not parties to this Agreement, if coop- eration with third parties shall be in accordance with the purpose of this Agreement. Article 7 Responsibility The parties are not liable for any disputes that may arise with any third parties. Article 8 Term, Renewal and Waiver 1. This agreement shall enter into force immediately upon its signature by the Par- ties. 2. This Agreement has a duration of 3 years from the date of its entry into force and may be renewed for the same period based on a written agreement between the parties. 3. The Parties may make eventual changes or waive from this Agreement by giving written notice to the other Party six months in advance. The waiver of the parties from this Agreement shall not have any effects on the relations that have begun to exist during the period of this Agreement. Article 9 Communication between the parties 1. The Parties engage to maintain continuous communication between them and to exchange any information necessary for the performance of their duties. Com- munication shall be conducted in paper form or electronically. In each case of submitting a request, the parties shall engage to respond within 10 calendar days. 2. The Parties shall always undertake availability for communication and collabo- ration with one another with a view to coordinating the actions to be carried out on a case-by-case basis. 259

Government Policy For Diaspora Article 10 Amendments The Parties shall make amendments to this Agreement based on mutual written con- sent. Article 11 Dispute Resolution Any disputes that may arise regarding the interpretation and implementation of this Agreement shall be settled by mutual agreement between the parties. Article 12 Language of the Agreement This Agreement is drafted in Albanian language in two copies for each Party. Government Policy For Diaspora TREATY Between STATE MINISTER FOR DIASPORA OF REPUBLIC OF ALBANIA And DIPLOMATIC RESEARCH & POLICY FOUNDATION (DRPF), UNITED NATIONS, EDUCATIONAL, SCIENTIFIC AND CULTURAL ORGANIZATION (UNESCO) REGARDING THEIR PARTICIPATION IN THE EDUCATIONAL RESEARCH & DEVELOPMENT, ADVOCACY, TRAINING AND DEGREE GRANTING FRAMEWORK WITH UNIVERSITY MANDATE. Premise Having regard of the willingness of the parties striving towards the expansion and strengthening of the relations between the parties in observance of the values of qual- itative education, promotion of educational research and development, promotion of Albanian language and Albanian cultural heritage and solidarity; Being aware of their mutual interests of cooperation and mutual support; With the aim of supporting the cross-regional and international cooperation, in the ambit of the European integration process having in attention the expertize of UNE- SCO and the field of responsibility of State Minister for Diaspora in conformity with Decision No. 510, dated 13.09.2017 “On the definition of the scope of activity of state Minister of Diaspora”; Willing to contribute towards the social and economic development in the respective territories; In full compliance with the legislation of Republic of Albania as well as international obligations and those arising from international treaties and international law; The State Minister for Diaspora Mr. Pandeli Majko and Mr. Jaagz Bajaj, DRPF and UN- ESCO expert special in charge for Albania (here in after “the parties”) agree as follows: Article 1 Diplomatic Research & Policy Foundation (DRPF) The Parties are participating in Collaborative Education and Research Framework with University Mandate which has International legal personality and such capaci- ties as may be necessary to exercise its functions and fulfill its objectives. Government of Republic of Albania represented by its Ministry “Ministry of Diaspora” is hereby the Participating Country of This Treaty. 261

Government Policy For Diaspora In order to achieve the goals as defined above The Ministry of Republic of Albania, a member of the Collaborative Education and Research Framework with University Mandate, receives the mandate to develop the Education Framework of Research and development. Article 2 Objective The Parties, within the scope of their respective powers, according to the procedures laid out in the legislation of the respective parties, and in compliance with interna- tional and community obligations, bilateral relations and educational, will organise social and cultural activities, as well as coordinated actions for the implementation of partnership and exchange projects, within the framework of UNESCO policies and programmes. Article 3 Sectors of cooperation Parties commit to developing cooperation in the following sectors: a) Culture and Education • Establishing of cooperation between universities and principal cultural in- stitutions of both parties and creating a joint program for this purpose. • Providing of specialized training, courses, development of curriculum, oper- ation of regular classes on distance learning mode, certification modules to nominees of participating parties and general public including awarding of proper diploma, degree and post graduate titles including doctoral degree based on international standards. • Monitoring and assessment of Quality Education and research under vari- ous UNESCO Policies on Education • Crating sustainable Development program in Education in Albanian lan- guage assisting Albanian communities in way to protect and promote an unique language as Albanian is and to transmit it at the second and third generation of Albanians abroad. • Formulation and dissemination of educational polices for inclusive growth of participating governments. • Providing a specialized training and certification modules to nominees of participating parties and general public including awarding of proper diplo- ma, degree and post graduate titles. 262

Government Policy For Diaspora • To collaborate with the Universities, NGOs, foundation of participating Countries with similar objective by way of co-operation in Education. • Collaborating and assisting the establishment of Albanian Cultural Centers in conformity with legal provisions. d) Social and Health assistance • Encouraging and supporting the exchange of technology in the health sec- tor; • Promotion of cooperation and cooperation between the research and health sectors; • Orientation of cooperation and cooperation initiatives towards a common system logic and organization or participation in the annual activities orga- nized by the parties; e) Safety and quality off food products • Promotion of cooperation and cooperation in the fields of quality control in the food chain, with special emphasis on agriculture and livestock; • Promotion of cooperation and cooperation between service centers and re- search institutions in this field; • Encouragement of the exchange of information between the operators in the sector; Article 4 Modes of cooperation The parties commit to maintain direct contacts and to engage in exchange of rep- resentative and public officials, at least once per year, in order to contribute to the implementation of this Treaty, as well as jointly designed projects. The parties undertake to promote partnership relations between local institutions and other organizations, companies and interested persons, in the following forms: • Exchange of information and experiences in the common interest of • the contracting parties; • Meetings, seminars, study visits and workshops on issues of common • interest for the parties; • Participation in joint projects financed by European funds; • Promotion of activities in the international relations and in the ambit of Europe- an Union institutions. 263

Government Policy For Diaspora Article 5 Collaborative Education and Research Framework with University Mandate’s oper- ations are regulated by its statutes which are available in its designated secretariat office and posted online officially at website of organization. Article 6 Resources This Treaty will be rendered available through funding of projects to be implemented, and with reference to the UNESCO and international funds, or to the economic re- sources of institutions concerned. The Participating Parties shall not be required to provide financial support to Collab- orative Education and Research Framework with University Mandate beyond volun- tary contributions, nor shall they be responsible, individually or collectively, for any debts, liabilities or obligations of the Organization. Article 7 Final provisions This Treaty can be changed or added to by mutual agreement of the Parties, the Col- laborative Education and Research Framework with University Mandate’s Depository acting as depository of all revisions. This multilateral and open Treaty takes effect on the date of signing and continues for each Party until it declares its intent to terminate its participation by providing to the Collaborative Education and Research Framework with University Mandate’s Depository a written notification no less than six months prior to the termination of its participation. Should this Treaty be terminated for any reason in accordance with the procedures outlined above, the Parties can continue with any activity initiated before the termi- nation of this Memorandum. Article 8 Language The Parties agree to use English as a working language, in written and verbal commu- nications. 264

Government Policy For Diaspora Article 9 Membership Any State or intergovernmental organization may at any time notify the designated depository of its request to participate in the organization. If the request is approved by passing of resolution, participation will become effective immediately after the date of deposit of the proper instrument. The request may be sent via electronic email also. Article 10 Disputes Any dispute regarding the translation and implementation of this memorandum of understanding must be settled amicably between the parties. Article 11 Entry into force This memorandum of understanding will enter into force on the date of its signature. Tiranë me 08/10/2019 MR. Government Policy For Diaspora MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL DIASPORA AGENCY AND THE ALBANIAN PHYSICIANS ORDER PREAMBLE The National Diaspora Agency and the Albanian Physicians Order, hereinafter re- ferred to as the Parties:  Acknowledging the importance of improving the position of members of Diaspo- ra and the protection of their rights and interests through international bilateral or multilateral agreements;  Wishing at promoting the strengthening and development of cooperation be- tween the Parties herein, in the interest of the Albanian Diaspora.  Promoting the networking of Albanian professionals in the field of medicine in the Diaspora;  Aiming at organizing scientific activities on the exchange of experiences and achievements in the field of health in the Albanian Diaspora;  Affirming the will and determination to cooperate and contribute to the im- plementation of this Memorandum to fulfil the commitments under Law No. 115/2017, “On the establishment of the National Diaspora Agency” and Law No. 123/2014, “On the Order of Physicians in the Republic of Albania”. The Parties herein agree to enter into this Memorandum of Understanding, hereinaf- ter referred to as the Memorandum. Article 1 Object The goal of this Memorandum is to promote cooperation between the Parties for the registration and establishment of links with Albanian professionals in the field of medicine in the Diaspora. It aims at promoting joint activities and bring the contri- bution of the physicians who profess their activity in the Diaspora to the homeland. Article 2 Scope of the Agreement The Parties undertake, in accordance with their competencies and areas of activity, to cooperate in: 266

Government Policy For Diaspora a. Establishing communication between Albanian professionals in the field of medicine in the Diaspora; b. Organizing joint activities between Albanian physicians in Albania and those in the Diaspora; c. Establishing working groups for application with joint projects in calls for project-proposals launched by different donors. Article 3 Competences of the Parties Cooperation under this Memorandum shall be enacted as follows: The National Diaspora Agency, in accordance with its scope of activity, but without being limited to it, commits to: a. Create and update the database on Albanian doctors professing their activ- ity abroad; b. Promote policies of cooperation and interaction with Albanians practicing medicine outside Albania; c. Provide support for the mapping and networking of Albanian professionals in the field of medicine in the Diaspora. The Albanian Physicians Order, in accordance with its scope of activity, but without being limited to it, commits to: a. Evidence Albanian physicians who have studied abroad and returned to Al- bania; b. Organize conferences or scientific activities in implementation of this Mem- orandum; c. Government Policy For Diaspora MEMORANDUM OF UNDERSTANDING BETWEEN ACADEMY OF ALBANOLOGICAL STUDIES AND THE CENTER FOR THE STUDY AND PUBLICATIONS ON ARBËRESH PREAMBUL The Academy of Sciences and the Centre for the Study and Publications on Arbëresh, hereinafter referred to as the Parties: Acknowledging the importance of enhancing the quality of the scientific research in the areas of Arbëresh community’s history, geography, literature and culture; Aiming at highlighting the contribution of the Arbëresh community in preserving the Albanian language, culture, traditions and cultural heritage; Wishing to promote scientific research studies and publications and increase their quality, including academics and researchers in this field of research; Aiming at coordination the activities, studies and standardization of the scientific re- search on joint evaluations; The Parties herein agree to enter into this Memorandum of Understanding, hereinaf- ter referred to as the Memorandum. Article 1 Object The scope of this Memorandum is to promote cooperation between the two institu- tions for the exchange of expertise, joint studies and scientific research on the history and culture of the Arbëreshë community. They shall coordinate their activity by pay- ing special importance to research, evaluation, preservation and promotion of the material and spiritual heritage of Arbëresh culture, as one of the most expressive his- torical evidence of Albanian identity. Article 2 Scope of the Agreement The Parties shall cooperate with each-other on: a. Carrying out joint studies on Arbëresh community’s history, literature and culture; b. Organising activities and attend common scientific conferences inside and outside Albania; c. Establishing working groups for application with joint projects in calls for project-proposals launched by different donors; 287

Government Policy For Diaspora Article 3 Competences of the Parties Pursuant to this Memorandum, cooperation shall be enacted as follows: The Centre for the Study and Publications on Arbëresh shall: a. Provide financing for the specialised studies on the Arbëresh history and culture; b. Publish the aforementioned studies; c. Organize scientific activities, workshops and conferences with the focus on the Arbëreshë community; The Academy of Albanological Studies shall: a. Cooperate with the Cultural Anthropology Institute, as part of the Academy of Albanological Studies and, the Centre for the Study and Publications on Arbëresh in the field of ethnology, folklore and art of the Arbëresh; b. Cooperate with the Institute of Linguistics and Literature, as part of the Academy of Albanological Studies and, the Centre for the Study and Publi- cations on Arbëresh, in the study of the Arbëresh dialect/language, as well as making available to the latter the written and audio library of Albanian dialectology for study purposes, in compliance with legislation and regula- tions for their use; c. Cooperate with the Institute of History, as part of the Academy of Albanolog- ical Studies and, the Centre for the Study and Publications on Arbëresh, for the provision of archival funds for study purposes, in accordance with the legislation and regulations in place for their use. d. Cooperate with the Centre of Albanian Encyclopaedia, as part of the Acade- my of Albanological Studies and, the Centre for the Study and Publications on Arbëresh, in order to compile and publish the Arbëresh encyclopaedia; e. Provide expertise for conducting studies and publications on Arbëresh by CSPA, to ensure the quality of scientific research and on-going support to young researchers in this field; f. Collaborate to CSPAs studies for publications in scientific journals, which the Academy of Albanological Studies and its constituent institutes publish periodically. 288

Government Policy For Diaspora Article 4 Implementation of the Memorandum 1. The Parties undertake to jointly assess the implementation of the Memorandum through the drafting and submission of a written periodic report, at the end of each calendar year. 2. The report shall contain, in addition to the data on the progress of the training activities developed during the calendar year, concrete recommendations for ad- dressing the identified issues. Article 5 Communication between the parties 1. The Parties commit to maintain continuous communication between them and to exchange any information necessary for the performance of their duties. Com- munication shall be conducted in paper form or electronically. Upon each re- quest submission, the Parties shall engage to respond within 10 calendar days. 2. The Parties shall undertake availability at all times for communication and col- laboration with one another, with a view to coordinating the actions to be carried out on a case-by-case basis. 3. Upon signing of this memorandum, the Centre for the Study and Publications on Arbëresh is entitled to communicate directly with each institute/centre of the Academy of Albanological Studies for concrete cooperation, but in any case the rector of the Academy of Albanological Studies shall be informed in the quality of the head of this institution and acting as representative with third parties. Article 6 Financial Costs Any financial cost arising from the implementation of this Memorandum is subject to the legislation in force and shall comply with the budget expenditure limits of the Parties, or the CSPA supports through donations or granted funds through viable projects. Article 7 Term and Amendments This Memorandum is entered into for an indefinite period of time. It may only be amended by written agreement between the Parties. 289

Government Policy For Diaspora Article 8 Dispute resolution Any disputes that may arise regarding the interpretation and implementation of this Agreement shall be settled by mutual agreement between the parties. Article 9 Entry into Force The Memorandum shall enter into force on the day of its signature and shall be pub- lished on the official websites of the Parties. It is prepared and signed in 4 ( four) orig- inal copies, two of which are deposited with the Centre for the Study and Publications on Arbëresh and two with the Academy of Albanological Studies. Government Policy For Diaspora MEMORANDUM OF UNDERSTANDING ON THE COORDINATION OF THE WORK FOR THE ESTABLISHMENT OF THE ADMINISTRATIVE STRUCTURE FOR DIASPORA AND MIGRATION IN LOCAL GOVERNMENT BETWEEN THE MINISTRY OF INTERIORS THE MINISTRY FOR EUROPE AND FOREIGN AFFAIRS THE STATE MINISTER FOR DIASPORA AND ASSOCIATION FOR LOCAL AUTONOMY PREAMBLE The Ministry of Interior, Ministry for Europe and Foreign Affairs, State Minister for Di- aspora, Albanian Association of Municipalities and Association on Local Autonomy, hereinafter referred to as the Parties: Acknowledging cooperation with the Albanian communities in the Diaspora as pivot- al in building connecting bridges with the homeland, as well as raising awareness in view of exchange and preservation of the national values; Aiming at promoting the influence that the Diaspora has on the economic, political and cultural development of the country of origin; Wishing to develop cooperation and interaction policies with all Albanians in the host countries where they reside; Aiming at establishing administrative structures for Diaspora and migration in local government in order to provide the highest quality service in each one of them; Aiming at strengthening relations with members of communities in the Diaspora who have their place of birth or origin in the territory covered by each local government unit; By confirming the willingness and determination to collaborate and contribute to the realization of this Memorandum, in view of satisfying the commitments arising with- in the framework of Law No. 38/2019, “On some addenda and amendments to Law No. 139/2015, “On Local Government”; The Parties herein agree to enter into this Memorandum of Understanding, hereinaf- ter referred to as the Memorandum. Article 1 Object 1. The purpose of this Memorandum is the commitment to create an administrative structure at the municipalities, for the diaspora and migration, according to the 291

Government Policy For Diaspora provisions of Law No. 38/2019, “On some addenda and amendments to Law No. 139/2015, “On Local Government”. 2. The organization of the administrative structures for Diaspora and migration in the local government units, shall be done according to the estimations on the number of their inhabitants. These structures for Diaspora and migration shall be opened in each municipality at the level of: - Directorate - for municipalities with more than 50,000 inhabitants - Sector - for municipalities from 20,000 to 50,000 inhabitants - Office - for municipalities with up to 20,000 inhabitants 3. The number of employees in these structures shall be determined by decisions adopted by the Municipal Councils. The professional criteria of the employees who shall be hired in the structures for Diaspora and migration in the local gov- ernment units, shall be determined by the Department of Public Administration. Article 2 Scope of Cooperation The Parties shall cooperate with each-other for the establishment and training of the administrative structure for the Diaspora and migration in the local government units, in accordance with the provisions of Article 29/1 of Law No. 38/2019, “On some addenda and amendments to Law No. 139/2015 “On Local Government”. Article 3 Competences of the Parties Cooperation under this Memorandum shall be enacted as follows: 1. The Ministry of Interior and the relevant migration structures within this insti- tution shall; 2. Inform the administrative structures on Diaspora and migration in the local government units, on the state policy on migration and the respective programs which will be implemented at the local level; 3. Provide information on the participation of the representatives of the adminis- trative structures for Diaspora and migration in the municipalities in the consul- tative meetings and activities on migration issues; 4. Cooperate with the administrative structures for Diaspora and migration in the municipalities on the review of activities related to migration issues and the pro- vision of services to migrants; 5. Inform the representative of the administrative structures for Diaspora and mi- 292

Government Policy For Diaspora gration in the municipality on donor assistance, calls for project-proposals, in- cluding local programs on illegal migration prevention, benefiting local self-gov- ernment units; 6. Cooperate and hold consultations with the administrative structures for Diaspo- ra and migration in the municipalities, in view of designing and implementing special programs for young people and their families, in order to reduce irregular migration. 7. Provide support to the administrative structures for Diaspora and migration in the municipalities, with information on the applicable Albanian legislation re- garding the status of citizens who want to emigrate or return, as well as for for- eigners residing in the territory of the Republic of Albania. The Ministry for Europe and Foreign Affairs and the relevant structures within this institution shall: 1. Coordinate with the diplomatic corps for the exchange of information with the administrative structures on Diaspora in the local government units, on the Al- banian communities to which the local government units have expressed their interest; 2. Provide assistance in coordinating activities for the Albanian communities origi- nating from the territories of local government units, in the host countries; 3. Coordinate work with the Ministry of Interior and the State Minister for Diaspo- ra, for the provision of information and assistance on issues related to Diaspora and migration. The State Minister for Diaspora, through the National Diaspora Agency, shall: 1. Ensure the participation of representatives of the administrative structures for Diaspora and municipal migration in forums or consulting structures related to diaspora and related issues; 2. Coordinate the partnerships between local government institutions and dias- pora organizations/communities for the purpose of sustainable local economic development, education of young people and promotion of local historical and cultural values; 3. Inform the representative of the administrative structures for Diaspora and mi- gration in the municipality on donor assistance, calls for project-proposals, in- cluding programs benefiting local self-government units; 4. Provide encouragement and assistance for the necessary information, for inter- ested parties from the Albanian communities in the Diaspora, on the Albanian legislation in the field of investments. 5. Coordinate with the Agency for the Support of Local Self-Government, to train 293

Government Policy For Diaspora the staff of the administrative structure for Diaspora and migration in each mu- nicipality; 6. Provide assistance to municipalities in setting annual activities and priorities and/or issues addressing Diaspora and migration issues. The Association on Local Autonomy shall: 1. Adopt decisions and make operational the administrative structure for Diaspora and migration in each municipality by 2020. 2. Organise joint trainings of human resources of the administrative structure for Diaspora and migration in each municipality, for the implementation of the state policy on Diaspora and migration. 3. Prepare the annual calendar of activities for the Diaspora and migration in each municipality and install electronic platforms in each local government unit which shall serve as information on the activities and issues concerning Diaspo- ra and migration. Article 4 Competences of the administrative structure for Diaspora and migration The competences and duties of the administrative structure for Diaspora and migra- tion in the municipality are as follows: 1. Encouraging the organization of activities, at the national and international lev- el, in view of maintaining continuous communications in strengthening relation- ships with the Albanian community abroad. 2. Informing stakeholders from the Diaspora and migration on the Albanian legis- lation in the field of investments in the respective municipalities. 3. Providing assistance and information on issues related to acquiring the Albanian citizenship; 4. Coordinating the work with the administrative structures in the municipalities to increase the absorption capacities of European Union projects’, to the benefit of the Diaspora community and migrants; 5. Coordinating the work with the Ministry of Interior, the Ministry for Foreign Af- fairs and the Ministry of Diaspora, for the provision and facilitation to informa- tion access regarding the issues related to Diaspora and migration; 6. Develop electronic platforms and disseminate information on Diaspora and mi- gration issues, in cooperation with the relevant digital communication structure in the municipality, which administers and publishes the information on the offi- cial website of the municipality. 294

Government Policy For Diaspora Article 5 Monitoring The Ministry of Interior, the Minister in charge of Diaspora and the National Diaspo- ra Agency shall, periodically, monitor the execution of obligations by municipalities, regarding the establishment of the administrative structures for Diaspora and migra- tion and, the performance in the implementation of their functions. Article 6 Communication between the parties 1. The Parties undertake to establish a Technical Secretary composed of represen- tatives from the Parties. 2. The competences of the Technical Secretariat consist in the implementation of communication and coordination of actions to be taken on a case-by-case basis for the implementation of this Memorandum. 3. The Parties engage to maintain continuous communication between them and to exchange any information necessary for the performance of their duties. Com- munication shall be conducted in paper form or electronically. Upon each re- quest submission, the Parties shall engage to respond within 10 calendar days. Government Policy For Diaspora AGREEMENT BETWEEN THE MINISTRY FOR EUROPE AND FOREIGN AFFAIRS AND THE STATE MINISTER FOR DIASPORA “On the appointment of the Coordination Officers for Albanian Diaspora affairs in the Albanian consulates in Italy and Greece”. The Ministry for Europe and Foreign Affairs, represented by the Minister, Mr. Gent Cakaj and State Minister for Diaspora, represented by the Minister, Mr. Pandeli Majko, pursuant to DCM No. 780, dated 06.11.2019 of the Council of Ministers “On the ap- pointment of Coordination Officers for the Albanian Diaspora affairs in the Albanian consulates in Italy and Greece” agree on the signing of the agreement as follows: Article 1 Object This agreement aims at formalizing the rules on the work of coordination Officers for Albanian diaspora issues, regarding education, justice and investment promotion at the Embassy of the Republic of Albania in the Republic of Italy, Consulate General of the Republic of Albania in Milan, Italy, at the Embassy of the Republic of Albania in Greece, at the Consulate General of the Republic of Albania in Thessaloniki, Greece. Article 2 Legal Basis Pursuant to Article 31 (2) of Law no. 23/2015, “On the foreign service of the Republic of Albania” and paragraph 2.1 of DCM no. 780, dated 06.11.2019, “On the appointment of the coordinating officers for Albanian Diaspora affairs in the Albanian consulates in Italy and Greece”. Decision of the Council of Ministers no., 345, dated 29.04.2020, “On the procedures on the ap- pointment and financial treatment of the employees appointed by other institutions to the diplomatic missions of the RoA”, agree as follows: Article 3 Rank of Appointment Diaspora Coordination Officers shall be entitled to the rank of First Secretary. 297

Government Policy For Diaspora Article 4 Competencies of the Ministry for Europe and Foreign Affairs 1. Accredits Coordination Officers in embassies and consulates in Italy and Greece, pursuant to Decision no. 780, dated 06.11.2019, “On the appointment of the coor- dinating officers for Albanian Diaspora affairs in the Albanian consulates in Italy and Greece”. 2. Creating all facilities for the operation of funds for SMD Coordination Officers, through embassies and consulates, in Italy and Greece. 3. Approval of competitive procedures to be carried out by embassies and consul- ates in Italy and Greece and for the expenses of the Coordination Officers under their dependency. 4. Undertaking action in accordance with the Vienna Convention on Diplomatic Relations (and the law on foreign affairs of the Republic of Albania for the enti- tlement of every right as by the employees of the diplomatic missions of the Re- public of Albania in foreign states, as well as obligations arising from this status to the four Coordination Officers of the SMD. 5. Allocation of the monthly wage to the personal accounts of each Coordination Officer representing the Ministry of State for Diaspora, and all allowances per- taining to the position, in accordance with the legislation in force. 6. Contract the rental services for accommodation to each representative and for office facility, over the competition procedures and obtaining approval from the MFA. 7. Entering into contracts for the costs of compulsory health insurance, as well as all costs related to the operation of the office of SMD Coordination Officers, in- cluding office furnishing. 8. Expenditures defined in paragraphs 5, 6 and 7 herein, for the year 2020 will be borne by the budget of the National Diaspora Agency in implementation of the DCM No. 445 “On an addition to DCM No.780, dated 06.11.2019, “On the appoint- ment of the Coordination Officers for Albanian Diaspora affairs in the Albanian consulates in Italy and Greece” dated 03.06.2020. 9. Overseeing the procedures for managing the allocated funds, according to the provisions under the law herein, and making transparent the monthly expendi- tures to the Ministry of State and Diaspora, according to the specific items of expenditures as defined. 298
